Summary
Ms. Claire O'Petit draws the attention of the Minister of State, Minister of the Interior, to the necessary adaptation of article R. 431-9 of the Highway Code which provides in particular that "when the roadway is bordered on each side by a cycle path, users of this path must take the one open to the right of the road, in the direction of traffic.(...) The fact, for any driver, of contravening the provisions of this article or those taken for its application is punishable by the fine provided for contraventions of the second class”. It turns out, in fact, that despite a significant increase in cycle paths, many cyclists persist in using the lane reserved for land motor vehicles (MTV). The dangerousness of these behaviors is increased due to the fact that the vigilance of VTM drivers, alerted to the existence of these tracks bicycles, decreases. Also, in order to support the provision of cycle paths and its obligation for cycle drivers to use them, it asks for its position on the advisability of modifying article R. 431-9 of the highway code in order to introduce a fourth class fine.
