Summary
Mr. Thomas Portes questions the Minister of the Interior on, on the one hand, the absence of dissolution of the small far-right group called “Brigade française patriote” and, on the other hand, the potential failures of the police services revealed following the racist murder of Mr. Djamel Bendjaballah. Le August 31, 2024, in Cappelle-la-Grande, Mr. Djamel Bendjaballah, a 43-year-old specialized educator, was murdered by a far-right activist, who deliberately hit him several times with his vehicle, in front of his 10-year-old daughter. This crime takes place in a context of prolonged racist harassment, documented by several complaints filed between 2022 and 2024, which remained unanswered despite the seriousness of the facts denounced. The attacker notably sent racist messages to the victim and uttered repeated insults, without any protective measures being implemented. The perpetrator, close to major figures in the neo-Nazi movement, held an arsenal of 22 weapons, 20 of which were found at his home, attesting to an act fueled by a structured and assumed racist ideology. He is also presented as linked to the small group “Brigade française patriote”, a structured organization, partly composed of former soldiers, which organizes paramilitary training, notably in shooting and broadcast explicit calls for racist violence on social networks. This group, whose members are preparing for a so-called “civil war” which they consider inevitable, would be established throughout the territory through a hierarchical organization and would have several hundred members. Investigations also brought to light facts of physical attacks and harassment targeting people due to of their origin. These elements clearly characterize incitement to hatred and violence as well as concrete preparation for violent actions likely to seriously disturb public order, within the meaning of article L. 212-1 of the internal security code. However, almost two years after the events, no administrative dissolution procedure has been initiated against this small group. Furthermore, a recent survey published by the media Blast, entitled Racist murder of Djamel Bendjaballah: the suspect's disturbing links with the police, highlights particularly worrying elements concerning the main suspect. It reveals in particular the existence of calls made from the Lille police station around 9 p.m., immediately after the crime, the nature and recipients of which raise questions, as well as testimonies, notably that of the accused's ex-partner, reporting relationships and interactions with people operating in circles linked to law enforcement. These elements raise major questions about possible failures in the processing of reports targeting the person concerned, whose dangerousness was nevertheless documented, as well as about the conditions in which he was able to act with complete impunity until the passage to the act. In this context, the MP asks the Minister, on the one hand, why no dissolution procedure has been initiated to date against the “French Patriotic Brigade” even though the conditions provided for in Article L. 212-1 of the Internal Security Code appear to be met and whether he intends to proceed without delay with the dissolution of this organization. He also asks him if investigations administrative investigations have been initiated in order to establish possible responsibilities within the police services in the handling of complaints against the perpetrator, if the nature, origin and circumstances of the calls made from the Lille police station immediately after the crime have been the subject of specific investigations, if links between law enforcement agents and the main suspect have been identified and, if where applicable, what disciplinary or legal action has been taken.
