Summary

Mr. Patrick Hetzel draws the attention of the Minister of Action and Public Accounts to the failure to recover criminal fines. The Senate Finance Committee has just released a report in which it is indicated that more than half of the amount of these fines is not recovered. It is specified that, excluding criminal charges, the criminal courts handed down, in 2017, 209,000 firm fines. The overall amount of these fines (excluding fixed fines, speed cameras and civil fines) represented 385 million euros in 2016. The Senate Finance Committee estimates that, "at the end of 2017, the recovery rate of criminal fines imposed in 2016 was estimated at 48%", or 168 million euros. What is at issue is the archaism of a system based on software from the 1970s. Transmissions between jurisdictions and departmental directorates public finances (more than 500,000 conviction statements) are still done by paper, and the Public Treasury must re-enter everything manually. The result is that the average time between the judgment and the administration taking charge is five months, or even fourteen months in Seine-Saint-Denis, or even two years in Guyana. Worse, “the recovery application (AMD), designed in the 1970s, does not allow processing of million in fines that it must pay (including criminal fines).” While the replacement of Bercy's software has been in progress for several years, this project has been frozen. Also, he would like to know if a global recovery reform is planned in the short term.
