Summary

Mr. Christophe Arend draws the attention of the Minister of Solidarity and Health to the financial situation of local elected officials receiving a disability pension or a disabled adult allowance (AAH). The calculations for receiving the disability pension or AAH take into account all of the resources of a local elected official, including their elected office allowance. This compensation can be combined with these different benefits within the limit of the last average annual salary received before their allocation. Beyond this threshold, this may result in the reduction, or even elimination, of the AAH and a claim for reimbursement of overpayment. Thus, this means that if a citizen is elected to the municipal council, he is in the same situation as if he returned to employment and then loses the payment of his disability pension. The local elected person with a disability would be forced to choose only one of the two sources of income. Today, faced with a task requiring ever more expertise and availability, citizens no longer have the desire to get involved in municipal life by running for the position of mayor, deputy mayor or delegated councilor. Thus, the additional penalization of people with disabilities further discourages citizens who wished to get involved in the political life. In a previous request (question no. 10717 published in the Official Journal on July 17, 2018), the Government responded that it was “reflecting on the disability policy, in particular in order to examine potential levers for improving the incentive system for resuming or continuing a professional activity for all insured persons”. He asks him if the Government has reached a new conclusion following its reflections and whether it intends to exclude, at least in part, the elected office allowance from the calculation of the resources conditioning these benefits.
