Summary
Mr. Xavier Breton draws the attention of the Minister to the Minister of Territorial Cohesion and Relations with Local Authorities, responsible for cities and housing, to the individualization of heating costs in collective buildings. Article 26 of Law No. 2015-992 of August 17, 2015 relating to the energy transition for green growth sets the obligation to install measuring devices per dwelling in order to determine the quantity of heat consumed. By December 31, 2019 (depending on their energy category), all buildings with collective heating must be equipped with thermal energy meters or electronic distributors installed on the radiators, with the exception of buildings for which it is technically impossible to measure the heat consumed by each room and those for which the device would represent an excessive cost. An implementing decree published in September 2019 worries individuals. In fact, the expenses used to define "the excessive cost in relation to the expected energy savings" exclude the insulation of the pipes, the sludge removal, the balancing of the installation as well as the installation of variable flow pumps which is nevertheless decisive for hoping for a reduction in consumption. With such criteria, the obligation will affect more buildings without this bringing them the slightest added value. This choice is all the more questionable since the draft decree and order were disavowed by the High Council for Construction and Energy Efficiency (CSCEE). The decree also ratifies the use of the dispatcher. However, this device is criticized by the co-owners who contest its technical reliability. According to the design office Enertech specializes in the energy performance of buildings, distributors can cause errors that can either overestimate consumption by 80% or underestimate it by 30%. Also, he asks him to please indicate whether measures are envisaged to facilitate the application of this obligation and to make it financially more bearable for individuals.
