Summary
Ms. Fatiha Keloua Hachi draws the attention of the Minister of Public Action, Civil Service and Simplification to access to the territorial loyalty bonus for civil servants. Since 2020, a territorial loyalty bonus in the State civil service has been introduced for agents within the Seine-Saint-Denis department who have served for five consecutive years. Decree No. 2023-1016 of November 2, 2023, entered into force on January 1, 2024, specifies that agents placed on long-term leave retain the seniority acquired to benefit from the loyalty bonus. Leave of this type may be requested by civil servants who are unable to carry out their duties and suffer from one of the following five illnesses: cancer, serious and acquired immunodeficiency, mental illness, tuberculosis and poliomyelitis. By elsewhere, as specified in Article 29 of Decree No. 86-442 of March 14, 1986, amended by Decree No. 97-815, the civil servant must have “exhausted, for whatever reason, the fully paid period of long-term sick leave” to be “placed on long-term leave”. Thus, access to long-term sick leave is very limited and the transition, initially, to long-term sick leave for one year is automatic. Gold It appears that agents on long sick leave, for their part, are not among the agents who, by derogation, retain seniority within the framework of access to the territorial loyalty bonus. Thus, certain agents are unfairly hampered in accessing this bonus, due to their state of health. She therefore asks him how he intends to respond to this problem.
