   Article L. 123-1 du code général de la fonction publique (CGFP) a posé le principe selon lequel un agent public ne peut exercer une activité privée lucrative de quelque nature que ce soit. Ce principe vaut pour the whole ofs agents publics, indépendamment de leur appartenance aux cadres d'emplois de la police municipale. Plusieurs règles tempèrent néanmoins cette interdiction, permettant à un agent, et notamment à un policier municipal, de cumuler des activités: certains cumuls peuvent s'exercer sans autorisation préalable (art. L. 123-2 et L. 123-3 CGFP), d'autres sont soumis à une simple déclaration (art. L. 123-4 à L. 123-6 CGFP) et certains à une autorisation (art. L. 123-7 et L. 123-8 CGFP). Indépendamment de ces règles de cumuls d'activité, un agent public peut exercer son activité à temps partiel. Si certains temps partiels sont de droit (art. L. 612-3 CGFP), d'autres sont octroyés sur autorisation, sous réserve des nécessités de service (art. L. 612-1 CGP). Les policiers municipaux s'inscrivent, au même titre que les autres agents publics, dans ce cadre juridique et peuvent solliciter un temps partiel de droit ou sur autorisation. Il résulte de la lecture combinée de ces textes, qu'un policier municipal occupant un emploi à temps complet peut, à sa demande, exercer ses fonctions à temps partiel afin de cumuler une activité privée lucrative, dans le cadre des dérogations légalement prévues. L'autorisation d'assurer un service à temps partiel est accordée pour une période comprise entre six mois et un an, renouvelable, pour la même durée, par tacite reconduction dans la limite de trois ans. A l'issue de cette période de trois ans, le renouvellement de l'autorisation de travail à temps partiel doit faire l'objet d'une demande et d'une décision expresses (article 18 du décret n° 2004-777 du 29 juillet 2004 relating to mise en œuvre du temps partiel dans la fonction publique territoriale). Cette autorisation peut dans ces conditions être renouvelée. Elle n'est donc pas limitée à quatre ans.
