Summary
S sheets are issued by the intelligence services for distribution within the wanted persons file and to the Schengen information system for state security purposes. They constitute a monitoring tool and aid in administrative investigation, without any coercive nature. They allow services to collect, in complete discretion, data on an individual (surroundings, movement, means of transport) when crossing a border or checking on national territory or in one of the Schengen States. To the extent that S sheets are issued as part of an administrative investigation, they in no way constitute an assessment or an indication of the dangerousness of an individual, nor a fortiori of their supposed involvement in a criminal offense. It is therefore not possible to communicate them to elected officials as the secrecy, a guarantee of the effectiveness of intelligence work, directly conditions the usefulness of S files. Likewise, the transmission of such information would directly harm the confidentiality of ongoing intelligence investigations. Finally, the compromise of this confidentiality, in addition to the personal responsibility that it would place on the authors of any uncontrolled disseminations, would be likely to hamper the outcome of the intelligence investigations and therefore, ultimately their chances of being taken into account by the judicial authority. However, it should be emphasized that the Government has not remained inactive in the face of the need to promote better complementarity between the local policies of territorial authorities and the action undertaken by the State in this area. Indeed, following the interministerial committee for delinquency prevention and radicalization (CIPDR) on February 23, 2018 in Lille, the Prime Minister presented the 60 measures provided for by the national plan for the prevention of radicalization. Among the main areas of work presented by the Government in this plan are the objective of "completing the detection/prevention network" as well as that of "involving local authorities in the care" of people presenting signs of radicalization, and support for their family. For the implementation of the first objective, local authorities are thus invited to appoint "referents", elected officials and/or coordinators of the local security and delinquency prevention council/intercommunal security and delinquency prevention council in order to strengthen and secure the exchange of information with the monitoring units for the prevention of delinquency. radicalization and support for families (CPRAF) and improve systems for detecting, reporting and caring for radicalized people. The Government is also planning the development of a national training framework for elected officials "intended to be implemented at the territorial level with a view to intensifying training actions for territorial agents" in particular in connection with the national center of the function territorial public and the national council for the training of local elected officials. In accordance with the announcements of the President of the Republic in May 2018, Christophe CASTANER, Minister of the Interior, signed a circular on November 13, 2018 strengthening exchanges between prefects and mayors in matters of radicalization. Responding to a long-standing expectation expressed by mayors, this circular provides that the prefects will inform the mayors who request it on the general state of the threat in the territory of their municipality. It also provides for the designation, within State services, of local contacts to enable mayors to report, in real time, a situation of suspected radicalization, and guarantees mayors systematic feedback on the reports they make. Finally, it authorizes the prefect, in certain situations, to transmit personally to the mayor of confidential nominative information, for example to draw his attention to the profile of a municipal employee presenting a risk of radicalization, or to the risks associated with the subsidizing of an association or a business. To guarantee the confidentiality of exchanges as well as that of the work of the police, gendarmerie and intelligence services, a charter will be signed between the prefect, mayor and public prosecutor. For the implementation of the second objective, the plan plans to rely on the district sub-prefects and the prefect's delegates to develop cooperation actions between local authorities and State services in conjunction with the CPRAF and local social operators (family allowance fund, local missions, etc.). Also provided for in this framework, the strengthening of the action of departmental councils in monitoring the children of families returning from areas of terrorist group operations in connection with the CPRAF at the local level and the SG-CIPDR at the national level, as well as the generalization of radicalization prevention plans in city contracts.
