Summary
Educational assistants (EAs) are essential to the proper functioning of establishments. They provide essential support to the educational team for the supervision and monitoring of students, as well as for educational assistance in priority education establishments. AEDs are not subject to the general civil service statute. These are the specific provisions of the 4th paragraph of article L. 916-1 of the code of education which provide for their recruitment through contracts of a maximum duration of three years, renewable within the limit of a total engagement period of six years. This system also aims to facilitate the pursuit of higher education, in accordance with the 5th paragraph of the aforementioned article which sets a principle of priority recruitment for scholarship students and which provides, in accordance with the 2nd paragraph of article 3 of the decree No. 2003-484 of June 6, 2003 amended setting their conditions of recruitment and employment, that education assistants, assigned to support functions for teaching staff for educational support and support, are recruited as a priority among students intending to pursue teaching careers. By virtue of these objectives, AEDs are not intended to be recruited on permanent contracts, the definition of which of the regime would, moreover, fall within the competence of the legislator. The fact remains that the Ministry of National Education is attentive to the fact that they can benefit from real professional prospects. The competitive examination remains the normal route of access to teaching staff as well as to the entire State civil service, in accordance with the provisions of Law No. 84-16 of January 11, 1984 which constitutes Title II of the general status of civil servants. The practice and knowledge of school life of AED holders of a license, or parents of three children, can in particular facilitate their access to the internal competition for principal education advisor, the eligibility test of which is based on the recognition of acquired professional experience. The oral admission test is based on the analysis of educational and school life problems in secondary schools. AEDs can also take the various teaching career competitions, particularly internal competitions. They can also take external teaching competitions, which are not constrained by either an age limit or a minimum length of service. Finally, at the end of their contract, education assistants can request validation of the experience acquired in the conditions defined by article L. 6412-1 of the labor code. To go further, current discussions on the development of pre-recruitment systems will primarily concern educational assistants.
