Summary
The area where the fishing walls of Montreuil are located is of undeniable heritage interest which should be taken into account in any development project. The mixed immobilization project mentioned (EIF project) is compatible with the local urban planning plan (PLU) of Montreuil. It must create a floor area greater than one hectare, as well as a parking area of more than 50 units, and therefore falls under sections 39 and 41 of the table annexed to article R. 122-2 of the environmental code, which provides, beyond certain thresholds, for a case-by-case examination in order to assess the need to have an environmental assessment carried out. This case-by-case procedure took place and, considering the history of polluting activities on the site, the persistent presence of pollutants in the soil and in the water table, the sensitive nature of the planned uses (housing, spaces gardening, etc.), the insertion of the project perimeter in a sector of ecological interest in an urban environment, and the potential landscape and environmental impacts, the regional and interdepartmental directorate for the environment and energy of Île-de-France (DRIEE-IF) deemed it necessary, by a decision dated October 5, 2018, to request the completion of an environmental assessment of this project. This will notably have to assess the impact environmental and landscape aspects of the project, specify its impacts on rainwater flows, assess the nuisances during the construction phase, assess the compatibility of the state of the site with the planned uses, and specify the methods for taking into account the heritage character of the site. This assessment will be subject to the opinion of the environmental authority (regional environmental authority mission (MRAe) Île-de-France), relating to the quality of the impact study and the consideration of environmental issues by the project. The public consultation, which will be carried out prior to any administrative decision, will allow all stakeholders concerned to express themselves on the project, on the basis of a file including the impact study and the opinion of the environmental authority. Finally, the procedure for examining the building permit, by the municipality of Montreuil, will have to take into consideration the impact study, the opinion of the environmental authority and the conclusions of the public consultation. The decision taken must be justified with regard to the impacts of the project, and if necessary prescribe measures intended to avoid, reduce or compensate for the significant impacts of the project.
