Summary
In October 2015, the European Commission sent a formal notice to the French authorities regarding hydroelectric concessions. As part of discussions with the European Commission, the Government is defending a balanced application of the energy transition law, which has consolidated the concessions regime and guarantees compliance with the public service challenges of French hydroelectricity, thanks to several tools: the grouping of concessions in the same valley, the extension of certain concessions in compliance with national and European law, the obligation to take over concession employees under the same conditions and the possibility of setting up mixed economy companies (SEM) during the renewal of concessions when local authorities are interested. The Government also highlights the social, economic and major ecological problems linked to hydroelectricity, and in particular to water management. The principle of putting expired concessions into competition arises from European and national law. The Government is preparing for this while defending certain essential principles. Pending their renewal, concessions which have expired (so-called “sliding deadline” concessions) continue to pay the taxation provided for by the regulation and by their concession contract, a significant part of which goes to the communities, in particular the royalty proportional to production and energy reserves. Concerning the latter, the conditions for their calculation and payment were clarified by the ministerial decree of February 23, 2016 relating to energy reserves. However, these conditions are not intended to lead to a reduction in compensation. corresponding. Finally, the Government is in favor of the establishment of an additional fee on concessions with rolling deadlines. The examination of the finance bill will be an opportunity for a discussion on the subject.
