The Act on Amendments to the Law on Environmental Fees and Amendments to Other Laws Related to It

The change reorganizes the flow of money received from environmental fees. From now on, the part determined by the state budget of the corresponding year from the money received in the state budget from environmental fees will be allocated to the Ministry of Environment. Currently, environmental fees are paid to the state budget and from there to the Keskkonnainvestmentite Keskus (KIK) foundation to a specified extent. In the explanatory letter, it is stated that the amount of financing in the environmental field is planned to maintain at least the current volume. Only the principles of strategic funding planning, the organization of the use of funds and the movement of funds between budget lines are changed. Therefore, the change will not have a negative impact on the parties. The change is necessary because stipulating the amount of funding with the fee rates that have been valid since 2009 is now unjustified and rather restrictive. The amount of funding cannot be flexibly planned in advance for larger-scale projects nor raise it if necessary. According to the amendment, the amounts earmarked for environmental protection would no longer depend on the receipt of environmental fees or fee rates, but the use of this money would be shaped on the basis of the priorities set during the state budget strategy, the need for environmental protection and a long-term strategic view. Also, the amendment of the law would end the situation where the Ministry of the Environment and the institutions of its administrative area also request funds from KIK to finance the costs of its core activities, such as monitoring. In the future, basic activities will be financed directly from the budget of the Ministry of the Environment. In this way, the transparency of the funding of the administrative area increases and the workload decreases. The bill increases the part of the environmental fees received by the local government units, which concerns the oil shale mining right, oil shale thermal treatment, and oil shale fly ash and hearth ash disposal fee. It is also supplemented § 56(1) of the Environmental Fees Act, in such a way that the Ministry of the Environment allocates an amount annually for the implementation of the environmental program, the amount of which corresponds at least to the amount of money received in the state budget from fees for the right of special use of water in the previous year. The change has been made so that the Center for Environmental Investments will retain certain funding with which to finance environmental projects. The bill also amends the Atmospheric Air Protection Act, Administrative Cooperation Act and Environmental Monitoring Act.

The Law on Amendments to the Land Cadastre Act, the Subsoil Act and the Spatial Data Act

In order for the Land Board to be able to hand over the relevant tasks related to the field of information and communication technology (ICT) to the Information Technology Center of the Ministry of the Environment (KEMIT), it is necessary to change the legal acts that assign the Land Board the tasks related to keeping information systems and registers. According to the draft law, the Information Technology Center of the Ministry of the Environment is designated as the authorized processor of the cadastre. The main purpose of the bill is to raise The efficiency of ICT management and development and the security of information systems within the Ministry of the Environment's governance area. 90 percent of the content services of the Land Administration rely on information technology. The explanatory letter states that the division of responsibility is very important in keeping the state's main registers. In order that the operation and development of nationally important information systems is guaranteed and that there is no legal ambiguity in the division of tasks and responsibilities of the Land Board and between KEMIT, it is necessary to specify as precisely as possible the competence of both institutions in maintaining information systems. Consolidating ICT services under one authority of the administrative area, whose task is to develop and manage the information systems of the institutions of the entire administrative area of ​​the ministry, helps to reduce duplication and the resulting inefficiency in the provision of services.

Act on amending the Radiation Act

The European Union directive will be adopted into Estonian law, according to which the Ministry of the Environment must organize radiation and nuclear safety mutual assessments at least every six years. In the case of Estonia, the directive applies to the Paldiski former nuclear facility, and thus the subject of the peer review must be chosen considering the given facility. The first peer review will be organized in 2017. In practice, this means that a working group consisting of Estonian experts conducts a self-assessment, which is then sent to other EU member states for assessment. According to the currently valid law, an international audit must also be conducted every ten years. The amendment to the law stipulates that the audit must be carried out without delay even if an emergency radiation situation has arisen at the Paldiski site. In Estonia, there have been no emergency radiation situations, and the Paldiski nuclear facility has had nuclear fuel for years removed back.

Kliimapoliitika põhialused aastani 2050 paneb paika Eesti kliimapoliitika pikaajalised sihid ja suuna selle poole liikumisel. Fookuses on kasvuhoonegaaside heite vähendamine ja kliimamuutuste leevendamine energeetika, transpordi, tööstuse, põllumajanduse ja metsanduse valdkondades. Eesti pikaajaline eesmärk on minna üle vähese süsinikuheitega majandusele, mis tähendab järk-järgult eesmärgipärast majanduse- ja energiasüsteemi ümberkujundamist ressursitõhusamaks, tootlikumaks ja keskkonnahoidlikumaks. Aastaks 2050 on sihiks Eestis kasvuhoonegaaside heidet vähendada ligi 80 protsenti võrreldes 1990. aasta tasemega. Mõjude hindamine näitas, et see eesmärk on täidetav ja toob endaga kaasa tõenäoliselt positiivse mõju majandusele ja energiajulgeolekule.

Valitsusele tehakse ettepanek lahendada olukord, kus kaasomandi majandamisest tulenevate kulutuste mittekandmine osade korteriomandi omanike või valdajate poolt põhjustab olukorra, kus oma kohustusi nõuetekohaselt täitnud isikute soojavarustatus ei ole talvisel perioodil tagatud. See põhjustab oma arved tasunud korteriomanike seisukorra halvenemise.

E-identimise ja e-tehingute usaldusteenuste seadus

Eelnõuga luuakse riigisisene regulatsioon e-identimise ja e-tehingute usaldusteenuste ELi määruse (eIDAS määrus) rakendamiseks. Euroopa Liit soovib suurendada usaldust elektrooniliste tehingute vastu siseturul, luues ühise aluse turvalisele elektroonilisele suhtlusele kodaniku, ettevõtja ja ametiasutuse vahel. ELi määrus reguleerib e-identimise piiriülest kasutust ning ühtsete reeglite alustel selliste usaldusteenuste osutamist siseturul nagu e-allkiri, ajatempel, veebisaidi autentimine jm. Määrus aitab kaasa digitaalse ühtse turu edendamisele ja lihtsustab internetipõhiste piiriüleste teenuste kasutamist. E-identimise koostöö järgi peavad liikmesriikide asutused digitaalallkirju vastastikku tunnustama hakkama 2016. aastal ja elektroonilist identiteeti 2018. aastal. Liikmesriigid võivad teiste liikmesriikide elektroonilist identiteeti vastastikku tunnustada ka juba varem. Eelnõu on Eestis kavandatud jõustuma samaaegselt eIDAS määruse jõustumisajaga Euroopa Liidus, mis on tänavu 1. juulil.

Kaugkütteseaduse ja korteriomandi- ja korteriühistuseaduse muutmise seadus

Eesti Keskerakonna fraktsiooni 27. jaanuaril algatatud kaugkütteseaduse ja korteriomandi- ja korteriühistuseaduse muutmise seaduse eelnõu (176 SE). Eelnõuga muudetakse kaugkütteseaduse sätet, mis reguleerib soojusettevõtte õigust katkestada eluruumi kütmiseks vajaliku soojusvarustuse katkestamist ajavahemikus 1. oktoobrist kuni 30. aprillini. Eelnõuga lisatakse lõikesse lause, mis kohaselt ei tohi soojusettevõtja soojusvarustuse katkestamisega halvendada korteriomandite seisukorda. Eelnõu tagab, et soojusvarustuse katkestamisega ei seata ohtu nende korteriomanike omand, kes on oma arved maksnud õigeaegselt ning soojusettevõtja ees kõik kohustused täitnud. Seletuskirjas märgitakse, et kaasomandi majandamisest tulenevate kulutuste mittekandmine osade korteriomandi omanike või valdajate poolt on paljud korterelamute elanikud pandud olukorda, kus oma kohustusi nõuetekohaselt täitnud isikud on langenud ebaproportsionaalselt ebasoodsasse olukorda isikute tõttu, kes oma kohustusi ei suuda või ei soovi täita.

Energiamajanduse korralduse seadus

Valitsuse 11. jaanuaril algatatud energiamajanduse korralduse seaduse eelnõuga (162 SE) võetakse üle EL-i vastav direktiiv, mille eesmärgiks on säästa 20 protsenti Euroopa Liidu primaarenergia, ehk maavarade ja kütuste tarbimisest, aastaks 2020 ja tagada energiatõhususe edasine suurendamine pärast 2020. aastat. Eelnõuga rakendatakse vaid meetmeid, mida direktiiv tingimata nõuab. Direktiivi ülevõtmise tähtaeg oli 5. juuni 2014 ning hilinemise tõttu on Euroopa Komisjon algatanud Eesti suhtes rikkumismenetluse. Eelnõu näeb ette avaliku sektori energiatõhususe arendamise, milleks kohustatakse keskvalitsust rekonstrueerima igal aastal vähemalt 3 protsenti hoonete pinnast energiatõhususe miinimumnõuete tasemele ning hankima energiatõhusaid hooneid, tooteid ja teenuseid. Keskvalitsuse hulka kuuluvad eelnõu kohaselt Vabariigi Presidendi kantselei, Riigikogu Kantselei, Riigikohus, Riigikontroll, Õiguskantsleri Kantselei, Riigiprokuratuur ning valitsusasutused. Eelnõu näeb ette üldise energiatõhususkohustuse, mille täitmiseks maksustab riik kütuseid ja elektrit aktsiisiga, toetab korterelamute ja tänavavalgustuse rekonstrueerimist jne. Suurettevõtjatele, ehk ettevõtjatele, kellel on rohkem kui 250 töötajat ja kelle aastakäive ületab 50 miljonit eurot või aastabilansi kogumaht ületab 43 miljonit eurot, kehtestatakse nõue viia regulaarselt läbi energiaauditeid. Esimene energiaaudit tuleb teha kuus kuud pärast seaduse jõustumist ning edaspidi iga nelja aasta järel. Eelnõu kehtestab ka auditite miinimumnõuded ja energiaaudiitori pädevuse nõuded. Suurettevõtjaid on Eestis ligikaudu 250. Eelnõu kohustab energiatarbimise juhtimiseks energiaettevõtjaid mõõtma lõpptarbijate energiakasutust ja pakkuma tasuta ligipääsu lõpptarbijate tarbimisandmetele nii reaalajas kui ka tagantjärgi.

Act amending the Railway Act and the Public Transport Act

The bill takes over the directives of the European Union, which regulate the creation of the railway region above the EU and the certification of locomotive drivers. The changes make the rail market more transparent and enhance cooperation in order to facilitate international rail transport, stimulate reliable and sustainable financing, and increase the competence of the Competition Authority in Estonia. The changes primarily concern railway undertakings, which must, if necessary, changes in its business structure to separate the operation of the service facility from other activities. In the network announcement, the railway infrastructure operator must provide more detailed information about the conditions for using the infrastructure. In order to ensure the sustainability of the railway infrastructure, the state is obliged to ensure that the infrastructure company is also able to develop the infrastructure in accordance with the agreements concluded with the state, which means that, if necessary, the state must to contribute financially to the infrastructure company. The bill clarifies the requirements for periodic interim checks of locomotive drivers, according to which language skills must also be checked if the language specified by the railway infrastructure company for use on the railway is not the driver's native language. Language skills are important so that the driver and the dispatcher can understand each other, otherwise dangerous situations may arise due to misunderstandings. Draft specifies the code of conduct of the Technical Supervision Board (TJA) if the locomotive driver does not meet the established requirements.
