The Act on Amendments to the Electronic Communications Act and the Information Society Service Act

Eelnõu eesmärk tagada senisest tõhusam kriminaalmenetluse ja rahvusvahelise koostöö toimimine. Ühtlasi viiakse Eesti õigus kooskõlla Euroopa Liidu õigusega. Eelnõuga nähakse ette elektroonilise side teenuste ja infoühiskonna teenuse osutajate, kes asuvad väljaspool Euroopa Liitu, kuid osutavad teenuseid Euroopa Liidus, samuti teenuseosutajate, kes asuvad ühes Euroopa Liidu liikmesriigis, kuid osutavad teenuseid teises liikmesriigis, kohustus määrata või nimetada ettevõte või seaduslik esindaja, tagamaks kriminaalmenetluse eesmärgil otsuste ja määruste vastuvõtmine ja täitmine. Eelnõuga sätestatud kohustuste täitmisel on Tarbijakaitse ja Tehnilise Järelevalve Amet (TTJA) keskasutus, kellele edastatakse teave ettevõtete ja esindajate nimetamise kohta ning kes teeb koostööd teiste liikmesriikide keskasutuste ja Euroopa Komisjoniga. Muudatus mõjutab eelkõige direktiivi kohaldamisalasse kuuluvaid teenuseosutajaid, õiguskaitseasutusi ja TTJA-d. Eelnõu mõjutab õiguskaitseasutuste töökorraldust, võimaldab adresseerida kriminaalmenetluse raames otsused ja määrused nimetatud ettevõtetele ja esindajatele ning viib Eesti õiguse kooskõlla Euroopa Liidu õigusega. Eelnõu ei too kaasa täiendavat halduskoormust elanikele ega enamikule ettevõtjatest. Üksnes teenusepakkujatele, kes on hõlmatud direktiivi kohaldamisalas ning asuvad väljaspool Euroopa Liitu, kuid osutavad teenuseid Euroopa Liidus, samuti Eestis asuvatele teenuseosutajatele, kes pakuvad teenuseid teises Euroopa Liidu liikmesriigis, võib esindaja või ettevõtte nimetamisega kaasneda täiendav, vähese ulatusega ja ühekordne kohustus.

Liquor and Other Laws Amendment (Reduction of Red Tape) Act

The bill consolidates changes to the law in several areas in order to reduce the administrative burden on entrepreneurs, simplify procedures and make the work of the state more efficient. A total of 8 laws will be amended to reduce bureaucracy. The changes will reduce reporting obligations, eliminate outdated requirements and simplify the communication of entrepreneurs with the state. Changes to the Alcohol Act increase the flexibility of e-commerce and encourage new technological solutions commissioning. The Electronic Communications Act harmonizes the validity periods of radio and frequency licenses and reduces reporting requirements. The Explosives Act simplifies the procedure for transporting explosives within the country by replacing the permit obligation with the notification obligation. The amendments to the Consumer Protection Act will enhance the work of the Consumer Disputes Commission. In the Precious Metal Products Act, the registration of a name tag is changed to a one-time activity, and in the Tourism Act submission of documents to travel companies is simplified.

Act to amend the Postal Act, the Competition Act and the State Duties Act

The bill will significantly reduce the administrative burden: the universal postal service provider will be released from the unreasonably burdensome obligation to submit cost reimbursement requests, and other operators will no longer have to apply for an operating license, but will be able to operate on the basis of an economic activity notification. As a result of the changes, the cost efficiency and stability of the universal postal service will be improved, the reporting and authorization procedure and postal services will be simplified become more flexible and accessible to users.

An Act to amend the Aviation Act and consequently to amend other laws

Accounting Act Amendment Act

An Act to amend the Customs Act

The draft resolves the bottlenecks that appeared in practice in the implementation of the Customs Act. The fine rates for legal entities, which have been unchanged in the Customs Act since 2001, will be increased. The fine rates will be brought into line with the rates stipulated in the Penal Code. Fines imposed for violations of customs legislation must be proportionate, dissuasive and effective. In order for the discretion of the Tax and Customs Board to be international higher when responding to violations by companies engaged in trade, for example, today's fine rate of 3,200 euros will be increased to 100,000 euros. The turnover and profits of international trade and fuel business are high, and the state's loss in tax avoidance is also high. Fines must reflect the scale of the offense and allow for the forfeiture of the benefits derived from it. The Tax and Customs Board carries out state supervision over the implementation of customs regulations and carries out pre-trial investigation of crimes. In practice, researchers have had to use special tools in their work, the use of which is not provided for by the Customs Act. In order to make the work of the investigation department more efficient, the list of special tools of the Tax and Customs Board will be supplemented, and binding tools, a means of forcibly stopping the vehicle and a technical barrier will be added to the list. In addition, the right to wear the uniform of the Tax and Customs Board is also granted to the Director General of the Tax and Customs Board and for employees of the Internal Defense Academy. According to today's regulation, the form can be worn by students of the Financial College of the Internal Defense Academy, but not by employees.

Spordiseaduse muutmise ja sellega seonduvalt teiste seaduste muutmise seadus

Eelnõuga korrastatakse senist stipendiumide maksmise korraldust, sest praktikas makstakse maksuvabasid stipendiume ka sportlastele, kellega ollakse töösuhtes. Sellisel juhul ei maksta riiklikke makse ning sportlasel puuduvad ka sotsiaalsed garantiid. Sporditegevusega seotud stipendiumi maksmisele seatakse aastane piirmäär, mis on 12-kordne töötasu alammäär. Stipendiumile piirmäära sätestamine toob kaasa sportlastega töölepingu või muu võlaõigusliku lepingu sõlmimise. Täiesti uue toetusliigina võetakse kasutusele sportlasetoetus. Teise teemana täiendatakse karistusseadustiku dopingukuritegude sätet, mille järgi loetakse dopingukuriteoks aine või meetodi määramist, kasutamisele kallutamist, samuti abistamist ja ainete toimetamist üle riigipiiri või tootmist, valmistamist, turustamist, vahendamist või edasiandmist. Kehtiva korra järgi on karistatav vaid dopingu kasutamisele kallutamine kui kasutatakse ravimit. Eelnõuga luuakse spordivõistlustega manipuleerimise vastu võitlemiseks kontaktpunkt, mis koolitab ja teavitab asjaomaseid organisatsioone spordivõistlustega manipuleerimise vastase võitluse osas. Neid ülesandeid hakkab ellu viima Eesti Antidopingu ja Spordieetika SA. Muudatusega lisatakse Eesti spordiregistri koosseisu sporditulemuste alamandmekogu, kuhu kogutakse Eesti ja rahvusvahelistel tiitlivõistlustel saavutatud sporditulemused. Andmebaas on oluline tööriist avaliku raha jagamisel ning spordipoliitiliste otsuste tegemisel. Harrastusspordi ega liikumisharrastuse võistluste tulemusi andmebaasi ei koguta.

Enam kui kolm kümnendit tagasi loodud konventsioon on praeguseks aegunud ja ei paku enam jalgpalliga seotud vägivallale piisavat lahendust. Konventsiooni järgimine võib mõnel juhul isegi suurendada turvalisuse ja julgeolekuga seotud riske jalgpallivõistlustel, näiteks märulipolitsei ebaproportsionaalne kasutamine. 2016. aastal koostati Euroopa Nõukogus uuem, kaasajastatud konventsioon, mis keskendub lisaks vägivalla ohjamisele ka turvalisusele ja heale teenindusele võistlustel. Selleks, et Eesti saaks liituda uuema konventsiooniga, on vaja denonsseerida varasem leping.
