Question 30477 — air transport

France · National Assembly

Question 27499 — elections and referendums

France · National Assembly

Question 27500 — elections and referendums

France · National Assembly

Mr. Sébastien Huyghe draws the attention of the Minister of the Interior to the revision of the electoral lists. Article L. 19 of the electoral code provides that the electoral lists control commission “may, by a majority of its members, no later than the twenty-first day before each election, revise the decisions provided for in II of article L. 18 or proceed with the registration or removal of a voter omitted or unduly registered. When she removes a voter, his decision is subject to a contradictory procedure. As provided in III of article L. 19 of the electoral code, these commissions met between the twenty-fourth and twenty-first day preceding the first round of the municipal elections of March 2020. However, doubt arose about the final nature of the removal decisions taken during these meetings, since a second meeting aimed at controlling the elements provided by deregistered voters could not be organized within the time limit. Article L. 19 in fact suggests that the commission is no longer competent in the three weeks preceding the election. Furthermore, it was noted that certain municipal services delayed in communicating the commission's decision to the voters concerned, making a second meeting within the deadline de facto impossible. distributed. He therefore asks whether the cancellation decisions taken during the meeting provided for in III of Article L. 19 of the electoral code can only be contested within the framework of a contentious appeal examined under the conditions provided for in the last two paragraphs of I of Article L. 20 of the same code, since a second meeting of the control commission is not organized before the twenty-first day preceding the election. He him also asks whether each member of the control commission is able to contest the absence of a summons aimed at examining the elements provided by the voters.

Question 28820 — additional insurance

France · National Assembly

Question 24069 — local taxes

France · National Assembly

Mr. Sébastien Huyghe draws the attention of the Minister of Action and Public Accounts to the taxation of housing granted by absolute necessity of service (LCNAS) as part of the reform of the housing tax. The Government has expressed the wish to maintain the housing tax for second homes. However, certain categories of civil servants, such as gendarmes and police officers, have LCNAS in order to make them available in their activity. This official accommodation is essential for the proper performance of their missions. Many of these civil servants also have a home in which their families usually reside. They are alarmed that the LCNAS can be considered as a second home by the tax administration, therefore subject to housing tax even though these accommodations can be considered as work tools. He therefore asks whether the Government intends to exclude LCNAS from the scope of second homes and therefore from being subject to housing tax.

Question 21563 — elderly people

France · National Assembly

Mr. Sébastien Huyghe draws the attention of the Minister of Solidarity and Health to the resources allocated to the management of accommodation establishments for dependent elderly people (EHPAD). The workload of EHPAD staff is in fact increased by an ever-increasing need for care. It also involves more difficulties in personnel management, since the number and duration of sick leave is increasing. In the absence of replacements and in a constrained budgetary context, the quality of service for the elderly can be seriously affected. He asks him if the Government intends to provide financial solutions to the difficulties encountered by many EHPADs. He also asks if the Government intends to intervene to support EHPADs in the face of long-term absences.

Question 24136 — sports

France · National Assembly

Question 21629 — tourism and leisure

Mr. Sébastien Huyghe draws the attention of the Minister of the Economy and Finance to financial transactions between campsite operators and private owners of mobile homes. When a mobile home is sold by a private owner to a private buyer, it is common for the operator of the campsite where this mobile home is installed to impose the payment of commissions. These can take the form of a percentage of the amount of the transaction or an entry fee. It also happens that the campsite purchases the mobile home, before immediately reselling it at a much higher price. These practices are the subject of numerous complaints from mobile home owners, to whom they appear to be abuses with no real legal basis. Faced with the financial consequences affecting mobile home owners, he asks if the Government intends to take steps to rebalance relations between campsite operators and mobile home owners.

Question 27599 — treaties and conventions

France · National Assembly

Mr. Sébastien Huyghe draws the attention of the Keeper of the Seals, Minister of Justice, to the situation of children of Franco-Japanese couples following divorce proceedings. Recent cases of children taken from the custody of their French father or mother and entrusted to the sole custody of their Japanese parent following a Japanese court decision have highlighted the distress of French citizens deprived of any contact with their child. Japanese justice de facto organizes the severance of ties between dual national children and their French father or mother, by granting exclusive custody to the Japanese parent, while making the granting of a residence permit conditional on parental authority. Consequently, those French people who find themselves affected by such a situation can no longer reside in Japan as soon as the divorce is finalized. Despite this situation, which leads to the definitive removal of these children until they reach the age of majority, which is 20 years in Japan, the French courts seem to give priority to the return to Japan as soon as a Japanese court decision has been transmitted, based on the best interests of the child. He therefore asks him if the Government intends to ensure that such ruptures of links can no longer occur. He also asks him to tell him the position of the Government on this situation.

Question 21495 — professional training and apprenticeship

France · National Assembly

Mr. Sébastien Huyghe draws the attention of the Minister of Labor to the financing of apprentice training centers (CFA). Apprenticeship is a major issue for young people's access to the job market. Law No. 2018-771 of September 5, 2018 for the freedom to choose one's professional future provides in particular for involving the branches and social partners in the financing of apprenticeship in France. The latter will be responsible for setting the levels of support for learning contracts by skills operators. However, a distinction is now made between CFA under regional agreement and newly created CFA outside agreement. This distinction creates a distortion of competition between these two categories of CFA. Indeed, CFAs under agreement having concluded apprenticeship contracts before December 31, 2019, will be financed in 2020 from the based on “prefectural costs” alone. CFAs outside the agreement will be financed on the basis of the support levels defined by the branches. He asks him if the Government intends to align the method of financing CFAs under agreement with that of CFAs outside of agreements. He also asks him if he intends to provide funding on the basis of the support levels defined by the branches from 2020 for all CFAs, regardless of the date of conclusion of the contracts.

Question 20812 — housing: aid and loans

France · National Assembly

Mr. Sébastien Huyghe draws the attention of the Minister of Territorial Cohesion and Relations with Local Authorities to the conditions for granting personalized housing assistance for people over 65 years of age. This aid is paid based on a calculation carried out by the services of the family allowance fund, taking into account the categorical net income, intended for the most modest people. However, continued according to the decrees of January 30, 1997, the reduction for "people over 65" is no longer taken into account in this calculation for non-disabled people born on or after January 1, 1931. This provision appears today to be outdated and unfavorable to elderly people with modest incomes, whose housing constraints are increased. Certain people are thus notified of the withdrawal of the allowance or the refusal of benefit, which would be granted to them if this reduction were taken into consideration. He asks him if the Government intends to revise the conditions for granting APL for these people in order to ensure financial support for low-income retirees in terms of housing. Also, he asks if other aid exists, or if the Government is considering introducing new ones, to support these people in accessing housing.

Question 20779 — French people abroad

France · National Assembly

Mr. Sébastien Huyghe draws the attention of the Minister of the Interior to electronic voting by French people abroad. During the 2017 legislative elections, electronic voting was canceled due to threats of cyberattacks and the imperfections of the platform. However, French people living abroad are not always close to a polling station, thereby excluding them in practice from the right to vote or requiring them to have to travel a long way. (sometimes up to several hundred kilometers). The electronic voting procedure also only concerns legislative and consular elections. Before the Assembly of French People Abroad in October 2017, the President of the Republic declared himself in favor of the return of electronic voting for the consular elections of 2020 and the legislative elections of 2022. He therefore asked whether internet voting will be restored in the framework of the next electoral deadlines and under what conditions. He also asks whether security guarantees will be strengthened to ensure the smooth running of the voting process.

Question 214 — diseases

France · National Assembly

Mr. Sébastien Huyghe draws the attention of the Minister of Solidarity and Health to the management of the treatment of people suffering from Arnold-Chiari syndrome type 1, a rare and orphan disease. Arnold-Chiari syndrome is a congenital malformation of the cerebellum. It is very painful and incapacitating, causing unbearable headaches, neck, shoulder and back pain, constant fatigue, and breathing difficulties. It can even cause problems with motor skills and sensitivity of the upper and lower limbs, leading to total paralysis. There are two types of neurosurgical operation to treat this disease, only one of which is recognized in France. This is craniectomy, a so-called “decompression” method. It turns out that it is a heavy, invasive procedure, requiring hospitalization. prolonged and with limited effectiveness. The second method, called sectioning of the filum terminal (SFT), is practiced in Spain and other European countries. It is considered more effective and non-invasive. According to many testimonies, the results of this type of operation are spectacular. It would make it possible to definitively stop the disease. Its cost is around 17,000 euros, the primary health insurance funds refuse to cover this intervention. In addition, the Gironde Social Security Court recently rendered a decision for the benefit of people suffering from the said syndrome wishing to undergo SFT treatment and requested that the surgical intervention and related hospital costs be covered under the same conditions as if the care had been received in France. He therefore asks him if the Government intends to generalize the treatment responsible for this treatment abroad and authorize the practice of this intervention in French medical centers.

Mr. Sébastien Huyghe draws the attention of the Minister of Action and Public Accounts to the operation of the Insurance Fund for Crafts Business Leaders (FAFCEA). The FAFCEA announced that it would no longer be able to support continuing training courses as of March 15, 2019. In fact, Law No. 2016-1088 of August 8, 2016 relating to work, the modernization of social dialogue and the security of career paths professionals having transferred from the Public Treasury to the URSSAF, the mission of collecting the funds intended to finance these training courses, the collection was seriously affected. The State compensated for the difference observed at the end of 2018, but no corrective measures were taken to return to a sufficient level of collection. Mr. Sébastien Huyghe draws the attention of the Minister of National Education and Youth to the creation of inclusive localized support centers (PIAL). To date, children with a disability benefit from adaptations, adjustments and compensation essential to their schooling. This organization is ensured by the departmental house for disabled people (MDPH), which is authoritative and makes arbitrations. necessary. The bill for a school of trust provides for the transfer of this organization to the PIALs, linked directly to the Ministry of National Education. In fact, it will now be the educational teams who will be in charge of determining the child's needs. The families concerned are alarmed at the consequences on the schooling of their children, particularly in view of the absence of suitable training for the teams. educational. Another source of concern is the proposed access to medical records. Mr. Sébastien Huyghe draws the attention of the Minister of Labor, Employment and Integration, to the approval of the employment protection plan (PSE) within the Cargill company in Haubourdin, which took place on August 17, 2020. By approving this PSE, Direccte authorized the elimination of 170 jobs and the modification of 16 employment contracts, likely to lead to the dismissal of 186 employees. However, the latest restructuring plan established by the management of Cargill d'Haubourdin only foresees 129 layoffs. The gap between these figures arouses particular emotion among employees, even though the social climate remains tense within the company, following the announcement of this restructuring. In this context, an approval approved by the State services allowing the company to carry out up to 57 additional layoffs to that provided for the company does not help to calm the situation, notably sowing doubt among employees about Cargill's real intentions. He therefore asks if the Government is in a position to rectify this approval so that the company can make a maximum of 129 redundancies, and not 186.
