Mme Claire Pitollat souhaite attirer l'attention de M. le ministre d'État, ministre de la transition écologique et solidaire, quant aux respects des dispositions des directives européennes des 15 décembre 2004 (n° 2004/107/CE) et 21 mai 2008 (n° 2008/50/CE) relatives à la qualité de l'air. Ces directives enjoignent les États membres de l'Union européenne à prendre les mesures nécessaires en droit interne d'une part pour assurer l'évaluation et la surveillance de la pollution de l'air, et d'autre part, pour préserver la qualité de l'air ambiant, et l'améliorer au besoin. La France est régulièrement avertie, et récemment mise en demeure, par la Commission européenne, de prendre les mesures indispensables au respect des seuils de pollution dépassés dans 14 régions françaises. Le Conseil d'État avait également enjoint l'État à prendre de telles mesures au plus tard au 31 mars 2018. Le réseau de mesures et de surveillances opéré par les associations agréées de surveillance de la qualité de l'air (AASQA) répond de manière très satisfaisante aux objectifs fixés par les directives en la matière. Les mesures nécessaires prises dans le cadre de la feuille de route nationale et celles des 14 régions dont la pollution dépasse les seuils légaux, semblent davantage reposer sur une logique de volontariat et d'incitation, que sur des mécanismes de contrôle et de sanction, à même de garantir une progression concrète de l'amélioration de la qualité de l'air ambiant. Aussi, elle souhaiterait connaître ses intentions quant aux moyens et indicateurs permettant de garantir une progression concrète de l'amélioration de la qualité de l'air, en conformité avec les objectifs fixés par les directives européennes.

Ms. Claire Pitollat draws the attention of the Minister of Solidarity and Health to strengthening the presence of health professionals in schools. Students in difficulty often come from families in precarious situations. This precariousness is also frequently accompanied by poor access to care. This is explained for financial reasons, but also for reasons of isolation and absence information. The school, as an essential social infrastructure, must be able to constitute a first level of referral for the children in its care, to direct them towards the appropriate health professionals. School medicine has been in sharp decline for many years, with a chronic deficit of school doctors, and overwhelmed and destitute paramedical and medico-social staff. However, school medicine is, not only the basis of fundamental educational actions for prevention in children's health, but also, it can supplement the family sphere finding itself unable to ensure medical monitoring of their children. The MP supports the prevention policy promoted by the Minister. She would like to know the Government's intentions regarding health infrastructure within establishments schools.

Ms. Claire Pitollat draws the attention of the Minister of State, Minister of the Interior, to the sustainability of the financing of the National Sea Rescue Society (SNSM). The SNSM is a 1901 law association recognized as being of public utility, made up of volunteer rescuers. With a high level of expertise recognized by all, it occupies a central place in the organization of sea rescue, for which it carries out almost two thirds of the interventions. rescue carried out by nautical means. Faced with the costs generated by technical requirements, the SNSM is facing financial difficulties calling into question the sustainability of its existence, and thereby the public service mission that it ensures. Its sources of financing suffer from long-term uncertainty. Public funding, provided by the State and local authorities, is structurally insufficient. In view of these parameters and, taking into account the financial situation of the SNSM, it wishes to know the Government's intentions regarding the measures it intends to take to guarantee the sustainability of the SNSM and the service provided.

Ms. Claire Pitollat draws the attention of the Minister of Solidarity and Health to the consistency of pricing for the activity of health establishments, with the objective stated by the national health transformation strategy, of increasing the rate of outpatient medicine to 55% on substitutable hospital stays by 2022. The ambulatory shift, in surgery as in medicine, allows for an improvement in quality of care and patient comfort, while mobilizing fewer resources for care. The outpatient shift in surgery has seen a significant effort in recent years (from 43.3% in 2010 to 54.1% in 2016), thanks to an incentive pricing policy consisting in particular of overbilling for outpatient surgery stays, compared to the costs actually incurred. Ambulatory medicine remains far below objectives affected by surgery. The regulations struggle to precisely define, and therefore distinguish, medical procedures performed in hospital, preventing them from being updated in the outpatient setting. In addition, outpatient medicine does not have the incentive rates that are applied to outpatient surgery. This results in prices that struggle to cover the real costs incurred. Also, faced with this observation, and in order to allow health establishments to resolutely commit to ambulatory medicine, in favor of the quality of care, for the benefit of more efficient health spending, and in line with the challenges of the national strategy initiated, it asks what policies it intends to implement.

Ms. Claire Pitollat draws the attention of the Minister of Solidarity and Health to the system of activity authorizations issued by regional health agencies to health establishments. Pursuant to Article L. 6122-1 of the Public Health Code, must be subject to authorization from regional health agencies; the creation of any health establishment, the creation, conversion and regrouping of health activities care, the installation of heavy equipment, changes to the location of an existing establishment and the renewal of authorizations. Despite authorizations issued for periods of five years, and despite the regulatory texts providing for the possibility of new authorizations in the event of structural changes in activity, practice reveals great difficulties for healthcare establishments to obtain new authorizations in an existing establishment. Furthermore, having regard to article L. 6122-3, which states that no authorization can be issued prior to work or installation of heavy equipment, establishments find themselves waiting for long periods of time to issue an authorization, even though they have made significant investments in medical equipment without being able to use them and thus amortize them. Faced with these difficulties significantly slowing down the transformation of health establishments into a vital care offer for the populations, it asks what diagnosis is established on the authorization regime, and what solutions it intends to put forward in order, on the one hand, to have in each department a report demonstrating the evolution of medical activities and the authorizations which result from them, and on the other hand, with regard to the diagnosis carried out, to further streamline the activity authorization regime of these establishments.

Ms. Claire Colomb-Pitollat draws the attention of the Minister of Health and Prevention to an upgrading of careers in category B for hospital ambulance drivers. Indeed, hospital paramedics were at the forefront during the health crisis. Building on their commitment, the parliamentary majority and the Government have, since the last five-year term, put in place various measures to better recognize their profession. THE Ségur bonuses, the persistence of the new index bonus (NBI) and the recent recognition of the status of “caregiver” are part of this. However, the hospital ambulance profession today sees its scope of know-how increasing. The increase in the number of tasks assigned to them during health care with nurses or during primary para-medical interventions illustrates the extension of their fields of competence. She therefore asks what measures the Government intends to implement to better recognize and support this profession.

Ms. Claire Colomb-Pitollat draws the attention of the Minister of Ecological Transition and Territorial Cohesion to the launch of the creation of a structuring carpooling line in the Bouches-du-Rhône department, as part of the green fund mobilization system “developing carpooling in its territory”. Indeed, as stated by section number 4 of the said system, the prior organization of animation meetings and training of targeted motorists must be thought out and considered: during these meetings, the terms of the financial incentive for the practice of carpooling from which targeted motorists will benefit on a daily basis can thus be presented, like the carpooling allowance supplemented by the State for example. However, in the absence of a decree in the Council of State taken after consulting the CNIL, the regional authority mobility organizer who would like to put the carpooling line into service in the Bouches-du-Rhône department is currently unable to provide the targeted public with their personal invitation cards to the said animation and training meetings. She therefore wanted to know if the Government has already initiated the procedure of referring the matter to the CNIL for an opinion on the necessary draft decree.

La directive 2022/542, adoptée en avril 2022, vise à modifier certaines conditions d'application de taux réduit sur les œuvres d'art. L'esprit de cette nouvelle directive est d'harmoniser les taux qui s'appliquent sur the whole of la chaîne, quitte à faire cesser des régimes dérogatoires lorsque cette suppression est favorable au consommateur final. La directive prévoit notamment de supprimer certains régimes dérogatoires dont celui de la marge et de la marge forfaitaire pour le calcul de montant de TVA due par le contribuable. Ce régime de la marge et de la marge forfaitaire qu'utilisent les galeries et les antiquaires dans certains cas se trouvera conditionné à l'application d'un taux normal en amont des opérations imposables à la TVA. Le régime de la marge ne pourra être utilisé par les galeries et les antiquaires que lorsque les opérations d'acquisition et de vente précédentes auront toutes été taxées au taux plein de TVA, ce qui renchérirait le prix d'acquisition des œuvres. La directive 2022/542 sur l'application des taux réduits de taxe sur la valeur ajoutée (TVA) doit être transposée en droit français d'ici le 1er janvier 2025. Ses conséquences sur le marché de l'art en France seront fonction de la solution retenue pour la transposer. Sans attendre cette échéance, le ministère de la culture et le ministère de l'économie, des finances et de la souveraineté industrielle et numérique ont réuni the whole ofs professionnels concernés. La première réunion a eu lieu le 24 mars dernier. Il est prévu plusieurs réunions au cours des mois d'avril et mai pour évaluer l'impact d'évolutions conformes au droit communautaire mais qui n'entravent pas le dynamisme du marché de l'art en France. L'objectif est de présenter une solution au government bill de finances pour l'année 2024.

Ms. Claire Colomb-Pitollat draws the attention of the Minister of National Education and Youth to article 144 of the law of February 21, 2022 relating to differentiation, decentralization, deconcentration and carrying various measures to simplify local public action. This article provides for the submission by the Government to Parliament of a report retracing the prospects for the transfer of school medicine to the departments, its cost, the envisaged methods of recruitment and management of personnel as well as the expected improvements in the functioning of the various actions carried out within the framework of school medicine. Although this law was promulgated a year ago, the lack of submission of this report worries many health nurse advisors. Indeed, many contest the effectiveness of such a transfer which would increase territorial disparities relating to the care of students and would weaken the link between health personnel and the entire educational community. Likewise, some believe that this transfer goes against the policies carried out, which have continually reinforced and reaffirmed the importance of the responsibility of the Minister of National Education in terms of health promotion and thereby, the support and participation of the entire educational community. In order to address the concerns expressed by some of its fellow citizens, it therefore asks for the progress of the report provided for in article 144 of the law of February 21, 2022 as well as its submission to Parliament as soon as possible.

Ms. Claire Colomb-Pitollat draws the attention of the Minister of National Education and Youth to the massive use of papers in examination rooms. Indeed, the subjects of the end-of-school-year examinations are often supplemented by numerous additional documents aimed at providing supplementary and complementary information to the examination subject. In certain tests, the use of paper is such that the exam subjects now resemble real corpora composed of diagrams, texts and a multitude of photos printed in color, on one side and packaged in plastic sleeves. This massive use of plastic may then seem abusive, especially since these documents will only be used once; on the other hand, that there are credible alternatives such as projecting documents on a screen, reducing the format or font size as well as the use of recycled paper sheets. For many students sensitive to the climate cause, this form of exam, which is expensive in terms of energy and raw materials, may seem totally inappropriate today. A search for compromise between educational organization and the fight against waste may seem necessary. She therefore asks him what measures he intends to take. taken to reduce the massive use of papers in examination rooms as well as, more generally, in all classrooms.

Mme Claire Pitollat attire l'attention de M. le ministre de l'éducation nationale et de la jeunesse sur les manques de données publiques quant à la pollution de l'air à proximité des crèches et des écoles, situées dans l'agglomération marseillaise. En effet, d'après une analyse cartographique menée par Greenpeace France à l'échelle de Marseille et de ses communes périphériques, publiée en mars 2019, plus de la moitié des écoles et crèches se situent à moins de 200 mètres d'une zone où la pollution de l'air au dioxyde d'azote dépasse le niveau légal. Asthme, toux, troubles du développement mental, détérioration de la fonction pulmonaire, risques de maladies cardio-vasculaires à long-terme : l'exposition quotidienne des enfants à la pollution de l'air a des conséquences dramatiques. À Marseille, 22% des écoles et crèches sont à moins de 50 mètres d'une concentration illégale de dioxyde d'azote, et 58% à moins de 200 mètres. Ce constat est alarmant. Comme le soulignait l'Organisation mondiale de la santé (OMS), dans une étude en octobre 2018 : « La pollution de l'air a des impacts dévastateurs sur la santé des enfants ». Elle peut être la cause de retards de croissance pulmonaire et même d'une diminution du développement du cerveau ; d'autres études soulignent un lien possible avec les troubles de la concentration et l'autisme. Elle serait responsable de la mort de 600 000 enfants de moins de 15 ans chaque année, selon l'OMS. Aussi, elle lui demande si son ministère dispose de données sur la qualité de l'air à proximité et dans les établissements scolaires. Elle souhaiterait savoir quelles mesures de prévention son ministère peut mettre en place et notamment si une entité ayant pour mission de coordonner les actions relatives à l'état des bâtiments et à la prévention des risques contre la pollution de l'air peut être mise en place.
