The Interministerial Road Safety Committee convened on January 9, 2018 by the Prime Minister demonstrates the Government's desire to save more lives on our roads and to continue the proactive and innovative policy already initiated in terms of road safety. The Government cannot ignore those who were killed on metropolitan and overseas roads, just as it cannot ignore the 76,840 injured in 2017, including more than 29,000 hospitalized, some of whom will have lifelong after-effects. It is to reduce these dramatic figures that he has taken the necessary measures. During the interministerial committee in January 2018, 18 measures were decided, including measure no. 5, the aim of which is to reduce the maximum authorized speed outside urban areas. In January 2017, the Ministry of Health implemented a plan to combat Lyme disease and other tick-transmitted pathogens. The objectives of this plan are to strengthen prevention, and to improve and standardize patient care by updating recommendations and organizing specialized consultations for patients suffering from diseases transmitted by ticks. The High Authority of Santé has already published recommendations for good clinical practice allowing all doctors to manage the different forms of the disease in a harmonized manner across the national territory. The General Directorate of Health is working, in conjunction with regional health agencies, to set up specialized centers for patient care. The diagnosis of Lyme disease is primarily based on clinical criteria, with biological results providing additional arguments: current treatment recommendations take this fact into account and are likely to be updated according to evolving knowledge. Registration on the list of long-term illnesses (ALD) is a prerogative of the national health insurance fund, which remains particularly attentive to the situation of people sick. Mrs. Yolaine de Courson draws the attention of the Minister of the Armed Forces to the concerns and questions expressed by the Departmental Union of Fighters' Associations (UDAC) of Côte-d'Or. In the initial finance law passed in 2016, an increase in the value of the military disability pension index point (PMI) was planned but was canceled during 2017 by the freezing of civil service remuneration. This increase was not reconsidered in the 2018 finance bill. The fighter's pension does not follow the same developments and was increased by two PMI points, or 10% higher than the PMI. Ces armes ne peuvent être portées par un policier municipal lorsqu'il est seul en service. Ces dispositions ne s'appliquent pas à l'utilisation d'autres dispositifs notamment les armes létales. Or dans les plus petites communes qui ne disposent que de deux policiers municipaux comme c'est le cas de la ville de Montbard, en Côte-d'Or, ces dispositions limitent grandement l'usage de ces dispositifs pourtant plus adaptés. Dans ce cadre, elle lui demande s'il est envisageable de revoir les conditions requises au port des PIE dans les villes de petite taille, sous réserve bien entendu, de former les agents de police concernés.

Mrs Yolaine de Courson questions the Secretary of State, to the Minister of the Economy and Finance, on the harmonization at European level of traceability measures for the metals trade. Since August 1, 2011, cash payment for retail purchases of ferrous and non-ferrous metals has been prohibited in France, regardless of the transaction amount, in order to combat metal theft and its international networks. A measure that does not exist in neighboring countries, it causes an increase in illegal exports. This phenomenon is encountered in all Member States of the European Union. The harmonization of this legislation at Community level would also be beneficial for other countries because it would, among other things, provide security for businesses and employees who no longer handle cash, combat theft of metals - a phenomenon common to all countries in the European area -, the fight against parallel recycling sectors which free themselves from environmental obligations to revalorize raw materials and to increase the fight against tax fraud since only account to account payment allows financial traceability. The MP shares the Minister's ambition to act strongly in favor of a rapid energy transition in the face of the climate emergency. This measure plays a major role in this and strongly encourages private investment in this area. It is also a significant source of income and an opportunity for diversification for farmers, who are the first to suffer the impacts of climate change. The arrangements for establishing an identity card application have been simplified and dematerialized in order to make it easier for citizens to apply for. In certain rural areas, it is sometimes necessary to travel several dozen kilometers to benefit from this service. Municipal staff sometimes have to go through a hundred kilometers to obtain this device, collect the fingerprints of the citizen concerned then return the device to the prefecture. Côte-d'Or, a department of 8,763 km² for 704 municipalities, only benefits from one mobile device. Ms. Yolaine de Courson alerts the Minister of Higher Education, Research and Innovation to the financial consequences of the technical old age shift (GVT) on the budget of French universities and in particular that of the University of Burgundy. In 2018, a compensation system made it possible to partially cover the increase in personnel costs linked to promotion and seniority. Mrs. Yolaine de Courson questions the Minister of Solidarity and Health about the increase in the price of tobacco. The continued increases in tobacco prices planned between 2018 and 2020 meet the public health objective of combating tobacco, the leading cause of preventable mortality. Alongside this objective of enabling people to prepare and find the means to quit smoking, this increase in the price of tobacco is accompanied by an awareness policy to support smokers who wish to stop and reduce consumption among young people and help the most vulnerable. However, for several years there has been a constant increase in the purchase of tobacco via social networks, postal packages or even across borders which know no borders, through real organized trafficking. Thus, in Côte d'Or, it becomes more interesting to make a trip to Luxembourg than to buy in the Côte d'Or. Beyond the problem of trafficking - estimated at 35% of sales and nearly 27% of the country's total consumption - there is a real public health question linked to the harmfulness of the product which primarily affects minors. Although actions are being taken to combat smuggling and limit cross-border purchases, this should be done fight against illicit trade on a European scale with the adoption of common measures on traceability and the limitation of cross-border trade. The community of communes of the Tille and Ignon valleys plans to acquire a tarmac surface of 2,100 m² adjoining the Is-sur-Tille - Marcilly sur Tille station and including the SNCF is the owner in order to establish a multimodal transport platform there. This would involve renovating the roadway, creating parking spaces for cars, buses and bicycles, installing a carpooling area, charging stations for electric vehicles and an electric bicycle rental site. Located 25 km from the Dijon metropolis, the Is-Marcilly railway station has numerous services suitable for journeys home-work in an area with demographic growth. Ms. Yolaine de Courson alerts the Minister of Territorial Cohesion and Relations with Local Authorities on the law of August 3, 2018 relating to the implementation of the transfer of water and sanitation powers to communities of municipalities, published in the Official Journal of August 5, 2018. Under certain restricted conditions, municipalities which are part of a community of municipalities will be able to postpone the date of the transfer of water and sanitation skills, or only one of them, on January 1, 2026 (instead of January 1, 2020, as provided for in the NOTRe law). To do this, they must be members of a community of municipalities which (as of August 5, 2018) does not exercise, on an optional or optional basis, water or sanitation skills. This possibility of objecting is also open to municipalities that are members of a community of municipalities which exercises, in an optional manner, the missions relating to the non-collective public sanitation service (defined in III of article L. 2224-8 of the CGCT). In the event of application of these provisions, the full transfer of sanitation competence will not take place on January 1, 2020 and the intermunicipal transfer of missions relating to collective sanitation will be postponed until January 1, 2026. However, with regard to the circular of August 28, 2018, the municipalities members of a community of municipalities exercising only the competence of water production would be refused the right to object to the full postponement of "water" competence to January 1, 2026. While the law targets "competences relating to water or sanitation", this ministerial circular specifies in fact that the right to object is "exclusively reserved for municipalities which are members of communities of municipalities not exercising [ ] the competence in question, including partially, with the notable exception of the non-collective public sanitation service”. Mrs Yolaine de Courson questions the Minister of State, Minister of the Interior, on the provisions relating to the reception of Travelers. Ms. Yolaine de Courson draws the attention of the Minister of Action and Public Accounts to the increase, since 2013, in the turnover of the French leather industry (+40%) which has led to a very significant increase in the reduction of its assigned tax, paid to the State, which will represent in 2018 more than 3 million euros, or 20% of the amount collected. This causes a considerable deprivation of resources which will not allow to finance the collective actions of the Industrial Technical Center (CTI) and the Professional Economic Development Committee (CTC) of the sector for the benefit of SMEs and VSEs: training, research and development, export, etc. This confiscatory cap makes the French leather sector an exception in the landscape of sectors benefiting from an assigned tax since it is the only one to remit such a percentage of its collection. SO that an increase in the ceiling of the assigned tax has been requested by professionals in the sector for several years, in line with the increase in turnover of the French leather industry and its international development, the MP would like the Government to specify its plans for the assigned taxes, both in terms of the ceiling and the rate of the tax. Indeed, although it fully subscribes to the objective necessary to reduce public spending, it appears counterproductive from an economic point of view that the objective of a reduction of 10 million euros in the resources of the Industrial Technical Centers (CTI) by 2019 and of 30 million euros by the end of the five-year term, involves the homothetic reduction of the ceilings for all the sectors concerned, without taking into account the specificities of each and the impact on these. On the other hand, the desire to lower the tax rate for the French leather industry so that the amount collected does not exceed the ceiling denies it any hope of a gradual increase in its resources. Concerning the French leather sector, a reduction in the ceiling of 6.5% would represent a shortfall by the end of the five-year term of almost 2.5 million euros compared to the existing level, a level already very insufficient compared to its development projects. This reduction would put an immediate halt to the collective projects that CTC is currently carrying out and which could be developed at an industrial level if the ceiling were gradually raised, as has been requested since 2013. Very concretely, this would involve, for example, the industrial development of a unique tool in the world for marking skins to ensure traceability, the creation of a hand exoskeleton to improve working conditions or training actions intended to preserve know-how. Finally, CTC is about to finalize its performance contract with the DGE for the period 2019-2022, based, at a minimum, on sustainable resources. A brutal cut in its budget would render this approach obsolete, as would the signing of this commitment with the State. Also, while the Government is taking proactive measures in favor of SMEs and VSEs, she questions the reasons which push the Government to want to slow down the dynamics of successful SMEs and VSEs in the French leather sector by depriving CTC of the resources necessary to carry out collective actions in their favor and requests the establishment of a moratorium on this project in particular so that all the stakeholders concerned can discuss.

Mrs. Yolaine de Courson draws the attention of the Minister of Solidarity and Health to the cost of renting a mortuary room following the death of an individual organ donor. Everyone is a potential organ donor. If you do not want your body to have samples taken after your death, you can register on the national register of refusals. Many individuals nevertheless choose to donate their organs after their death. However, although every minute counts when the procurement procedure is carried out, the time the organ is harvested and the time it is transplanted varies depending on the organ: 3 to 4 hours maximum for a heart, and 24 to 36 hours for a kidney. In addition to the collection procedures, there is the time it takes to rehabilitate the donor's body. Several days may therefore pass before the body is returned to the family, and it is not kept informed in real time of the progress of the procedures. As a result, the donor's family is forced to reserve a funeral home for a longer than average period, not knowing when the body will be returned to them. In France, room entry fees vary from 50 to 150 euros and the preservation of the body in this place (on average three days) can be around 300 euros. Mme Yolaine de Courson alerte M. le ministre de l'agriculture et de l'alimentation sur la situation des producteurs céréaliers en agriculture biologique dont les parcelles avoisinent des parcelles en agriculture conventionnelle et sur la problématique de la dérive des traitements phytosanitaires. Le nombre de conversions en agriculture biologique ne cesse d'augmenter ces dernières années dans le pays et Mme la députée s'en félicite. Elle souhaiterait cependant alerter M. le ministre sur les difficultés que rencontrent certains agriculteurs en conversion bio ou qui sont déjà certifiés lorsque leurs terres avoisinent celles d'exploitants en agriculture conventionnelle. En effet, lors de leur conversion ces exploitations sont soumises à des contrôles de certification visant à s'assurer de l'absence au-delà d'un certain seuil, dans la terre et sur les plantes, de composés chimiques issus des phases de traitement. Il est fréquent dans ces situations que la certification de ces exploitations soit repoussée ou que les exploitations déjà certifiées soient déclassées suite à la découverte de pesticides provenant d'exploitations voisines. C'est le cas notamment de composés volatils qui peuvent se retrouver sur des cultures comme le sarrasin qui ne dispose pas d'enveloppe sur sa graine et est donc plus facilement exposé à ces contaminations. Comme M. le ministre le sait, les agriculteurs qui convertissent leur exploitation en bio consentent à remettre en cause leur rentabilité durant les quelques années nécessaires à cette conversion, des aides financières sont d'ailleurs en place pour ces raisons et sont conditionnées à la certification de leur exploitation. Twelve protected geographical indications exist today, such as that of “Burgundy stone”, a unique product extracted and transformed in its district and whose appellation was approved on June 12, 2018. This label is real security for the consumer, the assurance of quality product, manufactured in good conditions in France and the promise of protection of the added value of French companies in the face of multiple attempts at copying or misleading names. Mrs. Yolaine de Courson draws the attention of the Minister of the Armed Forces to the project to revise the very low altitude network (RTBA). The MP welcomes the outcome of the consultation work initiated in 2018 with the Ministry of Ecological Transition and which allowed a first revision of this zoning in order to facilitate the installation of wind turbines throughout France. She regrets, however, that this revision is now questioned and wishes to bring to the attention of the Minister the harmful consequences that these changes could cause. Global warming and all the environmental consequences that result from it are the major challenge facing humanity for centuries to come. France intends to play its role and this is a strong expectation of citizens, as proven by the success of the climate convention for the climate. Mrs. Yolaine de Courson draws the attention of the Minister of Action and Public Accounts to the amount of value added tax (VAT) in the field of funeral directors. The external service of funeral directors (the transport of bodies, the organization of funerals, the supply of coffins and urns) is defined in article L. 2223-19 of the general code of local authorities as being a “public service mission ". Funeral services are therefore of public utility and each citizen will need them during their life. Only two services required during funerals benefit from a special VAT rate of 10%: ornamental horticulture and floriculture products which have not undergone any transformation and body transport operations, before and after burial, carried out by approved service providers using vehicles specially designed for this purpose. All other services and goods in this area are subject to VAT at the standard rate of 20%, according to article 278 of the general tax code. The obligation to place the body of the deceased in a coffin is also provided for in article R. 2213-26 of the general code of local authorities (except in the cases provided for in article R. 2213-26). However, the cost of a coffin alone is between 500 euros (for a cardboard coffin intended for cremation) and 8,000 euros excluding tax. No reduced VAT rate is provided to allow families with limited means to offer a decent burial to their loved ones without putting themselves in a delicate financial situation. Mme Yolaine de Courson attire l'attention de M. le ministre d'État, ministre de l'intérieur, sur les conditions de travail de la brigade de gendarmerie de Montbard. Les locaux de la gendarmerie livrés en février 2012 présentent de nombreux défauts de conception et de gestion contraignant le travail des gendarmes présents sur site. Chaufferie régulièrement en panne, huisseries non sécurisées contre les défenestrations ou d'éventuels tirs extérieurs, espaces verts entretenus par les gendarmes eux même faute de prise en charge extérieure, tous ces éléments ne facilitent pas les conditions de travail optimales que méritent les gendarmes. Cela n'encourage pas non plus l'installation et la pérennisation du personnel encadrant nécessaire auprès d'une équipe parfois très jeune, notamment en PSIG. Aussi, elle souhaiterait connaître les dispositions qui pourraient être prises afin que les gendarmes de la brigade de Montbard puissent se concentrer sur leur tâche première, en sécurité, et avec un encadrement suffisant et stable.

Mme Yolaine de Courson attire l'attention de M. le secrétaire d'État, auprès du Premier ministre, chargé du numérique, sur de récurrentes anomalies auxquelles certaines communes du territoire français sont confrontées en termes de couverture de réseaux téléphonique et numérique. Des dysfonctionnements réguliers sont constatés dans plusieurs communes rurales et des lieux-dits qui y sont rattachés. En Côte-d'Or, la commune de Vaux-Saules est particulièrement emblématique de ces anomalies observées. Malgré de nombreux signalements auprès de l'opérateur historique, aucune amélioration notable n'a été apportée. Le mécontentement des usagers apparaît dès lors comme légitime. Alors qu'une mission d'information sur la couverture numérique du territoire a été mise en place à l'Assemblée nationale, elle lui demande quelles sont les mesures prévues pour permettre l'amélioration de la couverture du réseau téléphonique des territoires isolés.

Mme Yolaine de Courson alerte M. le ministre d'État, ministre de la transition écologique et solidaire, sur le projet de création d'un circuit de course auto-moto sur les communes de Villy-en-Auxois et de Villeberny situés en voisinage du château de Salmaise et du village classé de Flavigny-sur-Ozerain en Côte d'Or. Ce projet, dont la réalisation est prévue en pleine zone Natura 2000 et en bordure de l'ancienne voie romaine Sombernon-Alésia, produirait de nombreuses nuisances irréversibles telles que la pollution des eaux, des nuisances sonores audibles à plus de 5 km, la destruction de la faune, la détérioration de la voie romaine, une pollution chimique, des risques pour la santé des habitants... Alors que les expériences passées dans des situations comparables dans d'autres régions démontrent qu'il est extrêmement difficile de faire démanteler des infrastructures et ce, même lorsqu'un tribunal administratif l'ordonne, elle lui demande quelles actions le ministère et les autorités préfectorales peuvent entreprendre afin de s'assurer que le promoteur ne passe pas outre les autorisations préfectorales et ne commence les travaux de terrassement et de bétonisation.
