Mr. Stéphane Baudu draws the attention of the Minister of the Economy, Finance and Recovery to the effectiveness of the measures envisaged to deal with the deterioration of the economic and social situation in the territories. Indeed, to face the economic consequences of the health crisis, companies are increasing restructuring projects in order to reduce their production costs and their fixed charges. These Restructurings are often announced with digital preservation of employment at the company level, either through operations of grouping of locations with capture of functions with higher added value, or through projects of total or partial transfer of activities. In both cases, the industrial sites located in what is now commonly called “peripheral France” are the more impacted, threatened with closure or dismantling to the detriment of the living areas they supply and the local authorities which had often supported them financially for many years. These projects will inevitably result in local job losses and leaks of skills and know-how. Medium-sized and rural towns were already suffering from a lack of economic attractiveness before the health crisis, they will not be able to cope with the simultaneous closure of businesses already established. The economic and social repercussions will be particularly painful and lasting for these territories. The crisis is here, undeniably, and we cannot avoid all of its effects. However, support systems, whether national or local, cannot support certain opportunistic maneuvers, sometimes envisaged before the crisis, going against the efforts made by the State and communities to maintain the dynamism and density of the French industrial network. Therefore, he would like to know the measures that the State plans to implement to fight against the worsening of the territorial divide which is coming and more particularly what are the provisions provided for by the new ARME system, put in place since the law No. 2020-734 of June 17, 2020 relating to various provisions linked to the health crisis, other urgent measures as well as the withdrawal of the United Kingdom from the European Union in terms of compensation and whether it is planned, in this sense, to condition government aid on the conservation of industrial sites and jobs in the territories.

Many of them face significant production costs and struggle to make a living from their work. However, this know-how is also an intangible asset which contributes to the dynamism and influence of the country. Therefore, he would like to know if the Government intends to work to better take into account the specificities of artistic crafts and what tools the State uses or intends to make available to these companies in order to support their competitiveness, and in particular if tax adaptations could be considered, such as an exemption or a reduced rate of VAT.

M. Stéphane Baudu attire l'attention de M. le ministre de l'action et des comptes publics sur les inquiétudes suscitées par la quasi-disparition de la mission relative aux « droits indirects » de la Direction générale des douanes et des droits indirects (DGDDI). Préconisée par le Comité Action Publique 2022 et appliquée dans le projet de loi de finances pour 2020, elle concerne onze des quatorze taxes nationales dont l'administration des douanes avait la charge puisqu'elles seront désormais progressivement transférées à la Direction générale des finances publiques (DGFIP). S'il est certain que le fractionnement actuel du recouvrement mérite un effort de rationalisation et de simplification, l'unification entre la déclaration et le recouvrement opérée par le Gouvernement soulève plusieurs craintes. D'une part, elle brise le lien cohérent qui existait entre recouvrement et contrôle. D'autre part, ce choix pourrait menacer la qualité des dispositifs. En effet, l'administration fiscale possède une capacité unique à contrôler sur tout point du territoire et dispose d'une expertise particulière sur les enjeux liés au commerce communautaire et international. Fort du meilleur taux d'intervention de l'OCDE avec 0,39 euro de coût administratif pour 100 euros recouvrés, son efficacité est avérée. Par conséquent, le transfert de ces taxes, dont la valeur est de 35 milliards d'euros, pourrait gêner leur perception et ainsi diminuer ces recettes. Dès lors, quelles sont les garanties offertes par le Gouvernement pour diminuer ce risque et comment entend-il répondre aux craintes des fonctionnaires de la DGDDI ? Enfin, plus largement, quel avenir pour leurs missions et leurs emplois ? Par ailleurs, le Comité Action Publique 2022 insistait également sur la dimension numérique de la rénovation de ce système, en conséquence il lui demande quelles sont les mesures proposées.

Le principe de fonctionnement des fonds de formation est redistributif, le fonds d'assurance formation des chefs d'entreprise artisanale (FAFCEA) étant financé par les contributions des artisans. La loi n° 2016-1088 du 8 août 2016 relative au travail, à la modernisation du dialogue social et à la sécurisation des parcours professionnels a procédé à une refonte du recouvrement de la contribution à la formation professionnelle des artisans non micros entrepreneurs, qui est réalisé depuis 2018 par les URSSAF et non plus par la direction générale des finances publiques (DGFIP). De plus, les chefs d'entreprise artisanale ayant le statut de salarié et relevant du régime général doivent nécessairement, depuis le changement de collecteur, déclarer cette contribution sur la déclaration sociale nominative (DSN) pour que celle-ci puisse être collectée. La diminution du montant de la contribution à la formation depuis 2018 provient d'une diminution du nombre de cotisants recensés lors du transfert de la collecte. Elle s'explique aussi, et essentiellement, par le fait que de nombreux artisans salariés, assujettis à la contribution à la formation professionnelle à la fois en tant que travailleur indépendant (cotisation versée au FAFCEA) et en tant que salarié (cotisation versée à leur opérateur de compétences), ont refusé de déclarer la première sur la DSN et ainsi de s'en acquitter, contestant leur double assujettissement. Le Gouvernement a pris des mesures adaptées, dès connaissance des difficultés dans la collecte rencontrée en 2018, pour éviter toute rupture dans le financement des formations des chefs d'entreprise artisanale, notamment via des prêts de l'ACOSS à hauteur des engagements financiers déjà pris par le FAFCEA sur cet exercice. Le FAFCEA a également été associé à la recherche de solutions. Pour 2019, le Gouvernement reste mobilisé et a pris des mesures afin que le FAFCEA puisse continuer à financer la formation des artisans. Le montant collecté pour 2019 a été reversé au FAFCEA le 18 mars 2019. Il a été décidé en outre de geler, pour l'année 2019, le remboursement de l'avance de 11,7 M€ accordée en 2018 par l'ACOSS au FAFCEA. Par ailleurs, un abondement complémentaire et exceptionnel du FAFCEA est envisagé à court terme, dont les modalités pratiques sont en cours de définition. the whole of ces mesures va permettre d'assurer la continuité de la prise en charge de la formation continue des chefs d'entreprise artisanale, en complément de la nécessaire révision du budget du FAFCEA en adéquation avec le nombre de cotisants.
