Ms. Julie Laernoes questions the Minister of Territorial Planning and Decentralization on the methods of taking into account intermunicipal compensation in the calculation of the differential allocation at the end of the mandate. As the next municipal elections approach, many local elected officials will be required, at the end of their mandate, to initiate a process of professional reintegration. Law No. 2002-276 of February 27, 2002 relating to local democracy has established the Allocation Fund for elected officials at the end of their mandate (FAEFM), the management of which is entrusted to the Caisse des Dépôts et Consignations. This system aims to support the professional retraining of elected officials by limiting the loss of income at the end of their mandate. It is funded by local authorities, in proportion to the compensation paid to their elected officials. However, many elected officials locals simultaneously exercise responsibilities within their municipality and within a public intermunicipal cooperation establishment (EPCI), receiving in this respect distinct compensation, the accumulation of which constitutes their total monthly compensation. However, the current terms of implementation of the FAEFM appear insufficiently clear regarding the taking into account of these different compensations. This situation raises a particular concern for elected officials from small municipalities, whose municipal allowances are often modest and whose personal financial balance is partly based on their intermunicipal compensation. Mme Julie Laernoes appelle l'attention de M. le garde des sceaux, ministre de la justice, sur la réforme envisagée dans le cadre des états généraux de l'insertion et de la probation (EGIP), prévoyant le transfert, dès 2026, des enquêtes sociales rapides (ESR) vers les services pénitentiaires d'insertion et de probation (SPIP). Le secteur associatif socio-judiciaire, acteur central, historique et reconnu du système judiciaire français n'a pas été consulté dans le cadre du rapport d'inspection ayant servi de fondement à cette réforme. Non seulement les associations du secteur seraient mises en grand danger par une telle réforme, dont les ESR peuvent représenter jusqu'à 80 % de l'activité et des budgets, mais de surcroît ce sont des centaines d'emplois qualifiés qui seraient menacés. En effet, les associations socio-judiciaires reposent sur un équilibre financier fragile et assurent, au-delà des ESR, d'autres missions telles que les stages de responsabilisation, les contrôles judiciaires socio-éducatifs ou encore les enquêtes de personnalité. L'ensemble de ces activités pourrait être fragilisé si la mission des ESR était transférée aux SPIP. Ce projet apparaît d'autant plus incompréhensible que les conseillers pénitentiaires d'insertion et de probation (CPIP) ne disposent déjà pas, à ce jour, des moyens suffisants pour assurer un suivi et un contrôle pleinement efficients des personnes condamnées qu'ils prennent en charge. Les économies annoncées de cette réforme sont dérisoires, mais surtout trompeuses, ne prenant pas en compte les coûts indirects et cachés (perte de réactivité, surcharge des SPIP, disparition d'innovations développées localement par les associations). La réforme aura, par ailleurs, des impacts négatifs sur les magistrats (perdant un partenaire ancré territorialement), pour les justiciables (avec une réduction des accompagnements possibles, un risque accru de récidive et de surpopulation carcérale) et plus largement sur la démocratie. Aussi, elle lui demande s'il compte réaliser une évaluation indépendante des impacts d'une telle réforme, avant une éventuelle mise en œuvre, et s'il est prévu d'organiser une concertation avec les associations et magistrats.

In Loire-Atlantique, the reduction of 300,000 euros in state aid seriously compromises the ability of the Loire-Atlantique food bank to continue its mission to combat food insecurity. Indeed, in Loire-Atlantique, hundreds of retirees from the City of Nantes who have had a contract for several decades have been told that these contracts would be terminated by their insurer. Certainly, this practice is legal and complies with article L. 113-12 of the insurance code, but these contracts, most of which are at least thirty years old, (still active because they are renewed by tacit agreement) do not specify that the contributions are non-returnable. After having received these sums for decades, the insurance terminates the contracts when the policyholders approach the age of 80, a particularly questionable period, because the policyholders arrive at a point in life where this subject can gain importance. The timing of this termination is all the more sensitive as the organizations which offer this type of contract often limit the age of people who can take out insurance to a range between 80 and 85 years old. Policyholders who are victims of these unilateral terminations can no longer take out new insurance. Representatives of very small, small and medium-sized enterprises cannot, with some exceptions, exercise this right, since by definition, they employ few employees. It is therefore the representatives of large companies who decide on behalf of smaller ones, including to implement specific provisions for companies with fewer than 50 employees. VSEs are at a disadvantage even though they represent 96% of businesses in France! This rule is not acceptable, as it hinders the exercise of social dialogue balanced and necessary for the production of social standards adapted to small craft businesses and their employees, particularly in the construction sector. The hearings relating to the “Flash mission on the representativeness of employers' organizations”, which took place in the summer of 2023 at the request of representatives of small businesses, also raise this situation of breakdown of equality. The confederation of crafts and small construction companies (CAPEB) and the union of local companies (U2P), which essentially represent VSEs and SMEs, have thus formulated a certain number of proposals in order to establish greater equity between representatives of large and small companies. Les agents publics de l'État peuvent bénéficier d'une rupture conventionnelle en application de l'article 72 de la loi n° 2019-828 du 6 août 2019 de transformation de la fonction publique, qui prévoit : « Le fonctionnaire mentionné à l'article 2 de la loi n° 84-16 du 11 janvier 1984 qui, dans les six années suivant la rupture conventionnelle, est recruté en tant qu'agent public pour occuper un emploi au sein de la fonction publique de l'État est tenu de rembourser à l'État, au plus tard dans les deux ans qui suivent le recrutement, les sommes perçues au titre de l'indemnité de rupture conventionnelle ». Les modalités de ce dispositif ont par ailleurs été précisées par deux décrets en date du 31 décembre 2019 et un arrêté en date du 6 février 2020. L'article 8 du décret n° 2019-1593 du 31 décembre 2019 relatif à la procédure de rupture conventionnelle dans la fonction publique précise que « préalablement à leur recrutement, les candidats retenus pour occuper, en qualité d'agent public, un emploi au sein de l'une des personnes de droit public mentionnées à l'article 1er du présent décret adressent à l'autorité de recrutement une attestation sur l'honneur qu'ils n'ont pas bénéficié, durant les six années précédant le recrutement, d'une indemnité spécifique de rupture conventionnelle soumise à l'obligation de remboursement prévue, selon le cas, au septième, huitième ou neuvième alinéa du I de l'article 72 de la loi du 6 août 2019 susvisée ». Il en résulte ainsi qu'un ancien agent public qui viendrait à occuper un emploi comme titulaire ou contractuel dans les six années suivant sa rupture conventionnelle est tenu à une obligation de remboursement des sommes perçues au titre de cette rupture. Cependant, la question de savoir si un vacataire est un « agent public » qui occupe un « emploi » ne semble pas tranchée par les textes en vigueur, dans la mesure où le statut de vacataire n'est pas défini ; les contours du statut ont été définis ponctuellement par la jurisprudence. En effet, une vacation est une activité accessoire et non un emploi principal, d'une part ; un vacataire n'est ni fonctionnaire, ni contractuel, d'autre part. Il est considéré comme un « agent civil » de l'État, au sens d'une jurisprudence récente du Conseil d'État (CE, 7 février 2020, Commune de Nanterre, n° 420567). Le décret du 31 décembre 2019 précité précise que cette obligation s'impose au « candidat », ce que n'est pas un vacataire. Elle souhaite ainsi avoir des éclaircissements sur l'interprétation des textes législatifs et réglementaires concernant l'obligation de remboursement de l'indemnité spécifique de rupture conventionnelle pour un ancien agent public qui effectue des vacations après une rupture conventionnelle, dans les six ans qui suivent cette dernière.

Mme Julie Laernoes interroge M. le ministre délégué auprès du ministre de la transition écologique et de la cohésion des territoires, chargé du logement, sur le seuil de 120 jours au-delà duquel ne peut être proposé à la location un meublé de tourisme déclaré comme résidence principale, soit comme un logement occupé au moins huit mois par an, au sens de l'article 2 de la loi n° 89-462 du 6 juillet 1989 tendant à améliorer les rapports locatifs. Ces 120 jours correspondent effectivement aux quatre mois où l'occupant d'une résidence principale n'est pas tenu d'y demeurer. Le respect d'un tel seuil constitue un enjeu pour les élus locaux, soucieux de préserver le parc de logements occupés à l'année. L'expérimentation par la direction générale des entreprises (DGE) d'une interface de programmation d'application (API) centralisant les déclarations des plateformes représente à ce titre un progrès indéniable. Néanmoins, une confusion regrettable semble s'être installée, tant dans l'expérimentation de la direction générale des entreprises que dans le guide sur la régulation des meublés de la direction de l'habitat, de l'urbanisme et des paysages (DHUP). En effet, les 120 jours sont interprétés comme 120 nuitées. Or, quand bien même l'unité de vente des séjours commercialisés par le biais des plateformes est la nuit, il n'en reste pas moins que le nombre de nuits vendues à l'année ne correspond pas nécessairement au nombre de jours où le logement est loué. Puisque, dans les faits, les meublés de tourisme loués une nuit accueillent leur clientèle dans l'après-midi jusqu'à la fin de matinée du lendemain, il semble difficile de ne pas considérer qu'un tel séjour empêche l'habitation à titre de résidence principale non pas pendant un jour, mais pendant deux jours. Elle souhaiterait donc savoir si le Gouvernement entend demander à l'administration de rectifier en conséquence ses productions.

Mme Julie Laernoes interroge M. le ministre de l'éducation nationale et de la jeunesse sur le statut des accompagnants d'élèves en situation de handicap (AESH). Pour cette année 2022, ce sont plus de 400 000 enfants en situation de handicap qui ont fait leur rentrée scolaire en milieu ordinaire. L'article 19 de la loi n° 2005-102 du 11 février 2005 pour l'égalité des droits et des chances dispose que « dans ses domaines de compétence, l'État met en place les moyens financiers et humains nécessaires à la scolarisation en milieu ordinaire des enfants, adolescents ou adultes handicapés ». Dix-sept années sont passées depuis l'adoption de cette loi et malgré l'annonce du recrutement de 4 000 AESH supplémentaires pour 2022, de nombreuses familles n'ont pas pu bénéficier de cette aide humaine dès septembre 2022 et n'ont donc pas pu commencer sereinement cette rentrée. En cause, les difficultés de recrutement liées à la précarité de ces emplois. Alors que 70 % des AESH exercent ce métier depuis plus de trois ans, seulement 23 % ont pu décrocher un contrat à durée indéterminée (CDI). Cette précarité contractuelle s'ajoute à une précarité financière avec un salaire moyen de 840 euros par mois, soit un niveau de rémunération en dessous du seuil de pauvreté. Afin de rendre effective le droit à la scolarisation en milieu ordinaire des personnes en situation de handicap, elle souhaite savoir si le Gouvernement envisage une intégration des 125 000 AESH dans la fonction publique.

Mme Julie Laernoes interroge M. le garde des sceaux, ministre de la justice, sur l'exécution du mandat d'arrêt européen (MAE) émis à l'encontre de Vincenzo Vecchi par la justice italienne. Lors des manifestations du contre-sommet du G8 à Gênes en 2001, la police avait procédé à d'importantes opérations de répression. Du côté des manifestants, on décompte 350 arrestations, 600 blessés et un mort, tué par un projectile de police. Suite à ces évènements, 10 militants, les « 10 de Gênes », avaient été condamnés à de lourdes peines, allant jusqu'à quinze ans d'emprisonnement. Vincenzo Vecchi a lui été condamné à une peine de douze ans et demi. La justice italienne s'était basée sur une loi datant du code Rocco de 1930, issu du gouvernement Mussolini, qui condamne les « saccages et pillages » et dont l'unique but est de museler toute expression et manifestation politiques. Pour échapper à cette peine disproportionnée et fasciste, Vecchi s'était réfugié en France, où il vit toujours avec sa famille et participe activement à la vie municipale de sa commune. Seize ans plus tard, le chef de la police italienne admettait que certains manifestants avaient été victimes d'« actes de torture ». Malgré ces éléments et le refus d'application du MAE par deux cours d'appel, la Cour de justice de l'Union européenne, sur saisine de la Cour de cassation, a statué que la France ne pouvait s'opposer à l'exécution de ce MAE. Elle lui demande s'il compte agir pour que l'État français ait un droit de regard sur les MAE afin de s'assurer du respect de la Charte des droits fondamentaux de l'Union européenne et de la non-application de lois fascistes dans l'arsenal juridique européen.

Mme Julie Laernoes interroge Mme la ministre de la transition énergétique sur le projet d'enfouissement des déchets radioactifs dits de haute activité (HA) et de moyenne activité à vie longue (MA-VL) sur le site Cigéo de Bure (Meuse). Il s'agit là des déchets radioactifs les plus dangereux : ils ne représentent que 3,2 % de l'ensemble des déchets, mais concentrent à eux seuls 99,9 % de la radioactivité totale. Malgré une déclaration d'utilité publique le 7 juillet 2022 et son classement parmi les « Opérations d'intérêt national », ce projet de galeries de 270 kilomètres à 500 mètres de profondeur soulève toujours de véritables inquiétudes et doutes quant à sa faisabilité technique et sa sûreté. Stabilité de la roche, risques d'incendies et d'inondation, dangers pour la nappe phréatique, les incertitudes sont trop nombreuses pour continuer cette fuite en avant. Les échecs et incidents de projets similaires d'enfouissement en profondeur tels que le WIPP aux États-Unis d'Amérique, ASSE II en Allemagne ou encore StocaMine en Alsace doivent l'alerter et l'amener à chercher d'autres pistes. Pourtant, le plan national de gestion des matières et des déchets radioactifs (PNGMDR) pour 2022-2026 ne prévoit pas d'autres solutions que l'enfouissement profond pour les déchets HA et MA-VL. Elle lui demande pourquoi les solutions de stockages subsurfaçique des déchets nucléaires à faible profondeur n'est pas étudié, piste pourtant prévue par la loi n° 2006-739 du 28 juin 2006 relative à la gestion durable des matières et déchets radioactifs.

Mme Julie Laernoes alerte M. le ministre délégué auprès du ministre de la transition écologique et de la cohésion des territoires, chargé des transports, sur le respect du couvre-feu actuellement en vigueur de minuit à six heures du matin à l'aéroport Nantes-Atlantique et sur les sanctions financières qui doivent en découler. Depuis son entrée en vigueur en avril 2022, 191 infractions au couvre-feu ont été constatées à la date du 12 septembre 2022. La Direction générale de l'aviation Civile (DGAC) et l'Autorité de contrôle des nuisances aéroportuaires (ACNUSA) gèrent les procédures d'instruction mais celles-ci ont une durée moyenne de deux ans. Après quoi, la compagnie aérienne a ensuite la possibilité de faire un recours auprès de la juridiction administrative. Ces délais sont trop importants pour dissuader le plus rapidement possible les compagnies aériennes d'enfreindre le couvre-feu. Elle lui demande de créer une instance de dialogue réunissant les élus locaux, les associations, les services de l'État et les compagnies aériennes afin de trouver des solutions immédiates et de mettre fin à ces infractions.

Mme Julie Laernoes interroge M. le ministre délégué auprès du ministre de la transition écologique et de la cohésion des territoires, chargé des transports, sur le renouvellement de la concession de l'aéroport Nantes-Atlantique. Couvre-feu non respecté, absence de justification sur les effets de l'extension de la piste, modèle économique principalement basé sur le développement du low-cost , manque d'écoute des parties prenantes, craintes sur les données de santé publique : l'État s'était pourtant engagé à un dialogue constructif sur le réaménagement de Nantes-Atlantique. Le nouveau contrat de concession, annoncé pour l'été 2022, est aujourd'hui repoussé au début de l'année 2023. Cependant, le cahier des charges n'a toujours pas été partagé. Il est donc impossible de vérifier l'adéquation du nouveau contrat avec les réalités territoriales mais aussi avec les engagements de l'État en matière de climat et de trajectoire bas carbone. Octroyer un nouveau contrat de concession sans réelle prise en compte des différents enjeux nationaux et territoriaux aurait des conséquences délétères. Elle lui demande un moratoire sur le processus d'attribution de la future concession actuellement en cours afin d'aboutir à un projet conforme aux engagements de l'État en matière de climat, de protection de la santé publique et de respect de la voix portée par les communes, les habitants et les associations mobilisés sur le territoire.

Mme Julie Laernoes interroge M. le ministre de la santé et de la prévention sur la loi n° 2022-53 du 24 janvier 2022 visant à la création d'une plateforme de référencement et de prise en charge des malades chroniques de la covid-19. Neuf mois après l'adoption de cette loi et alors que l'Organisation mondiale de la santé (OMS) estime que plus de 17 millions d'européens auraient été touchés par des formes de covid long, aucun dispositif en France ne permet de centraliser et d'orienter les patients vers des dispositifs de soins appropriés. Les personnes touchées par des formes longues de covid-19 se sentent bien souvent délaissées et ne bénéficient que très rarement des traitements adaptés à leurs symptômes. Elle lui demande quand est-ce que le décret d'application pour cette loi n° 2022-53 du 24 janvier 2022 visant à la création d'une plateforme de référencement et de prise en charge des malades chroniques de la covid-19 sera publié, rendant ainsi ses dispositions effectives.

Mme Julie Laernoes interroge M. le ministre des solidarités, de l'autonomie et des personnes handicapées sur la mise en œuvre de la revalorisation salariale pour les professionnels de la filière socio-éducative. Le 18 février 2022, à l'issue de la conférence des métiers de l'accompagnement social et médico-social, le Premier ministre annonçait une revalorisation salariale de 183 euros nets par mois pour tous les professionnels de la filière socio-éducative, dont deux tiers seront financés par l'État et un tiers par les départements. Près de deux mois plus tard, le 8 avril 2022, le Gouvernement présentait aux partenaires sociaux la liste des professionnels concernés par celle-ci. Le Gouvernement précisait qu'elle était applicable de manière rétroactive à partir du 1er avril 2022 et devait être mise en œuvre au plus tard au 1er juin 2022. Malheureusement, plus de six mois après son annonce, cette revalorisation n'est toujours pas effective dans de nombreux départements. Elle lui demande ainsi quelles sont les modalités de financement de cette revalorisation et quelles sont les mesures prises pour accélérer et s'assurer de sa mise en œuvre effective sur l'ensemble du territoire français.

Mme Julie Laernoes interroge M. le ministre de la santé et de la prévention sur l'encadrement des risques de santé publique qui concernent les personnes exposées au trafic aérien. Mardi 28 juin 2022, Air Pays de la Loire et la direction générale de l'aviation civile (DGAC) présentaient les données des campagnes de mesure de particules fines et ultrafines dans les zones impactées par l'aéroport Nantes-Atlantique. Les conclusions sont sans appel : l'impact de l'avion sur la qualité de l'air est certain. Même si ces mesures ont été réalisées pendant les périodes de confinement et donc à un moment de ralentissement important du trafic aérien, les pics atteignent parfois 58 500 P/cm3. Cela signifie que l'avion a un réel impact négatif sur la santé des riverains et des travailleurs des plateformes aéroportuaires. Plusieurs études, notamment de Santé publique France, ont démontré la contribution directe de ces particules au développement de maladies chroniques et neurologiques. Cette situation soulève donc de véritables inquiétudes et génère un stress supplémentaire pour une population déjà exposée aux nuisances sonores. Malheureusement, aucun cadre légal n'existe pour les particules ultrafines et celui posé pour les particules fines demande à être approfondi. Elle lui demande donc s'il compte prolonger les campagnes de mesures aux abords de l'aéroport Nantes-Atlantique et constituer un comité scientifique dont le but serait de formuler des préconisations sur les données de santé publique, notamment en matière de plafonnement du trafic aérien.
