Mr. Olivier Fayssat draws the attention of the Minister of National Education to the situation of schools which, without being integrated into a priority education network, present social and academic characteristics comparable to those of establishments classified REP or REP+. Priority education classification is based in particular on a network logic around a local college. This organization can lead to leaving certain schools outside the system even though their social indicators are red. This is particularly the case of the Calanques de Sormiou public school, located in the Cayolle district of Marseille. Its social position index has been around 80 over several years, a level comparable to that observed in priority education establishments and significantly lower than the departmental median. However, its attachment to the Royal College of Spain, which does not fall under priority education, does not allow it to benefit from the same resources as establishments with comparable social characteristics. This situation is all the more worrying as the school indicators reveal significant difficulties: upon entry into first grade, a significant proportion of students are identified as being “in need” or “fragile”, while the numbers per class remain high despite the additional resources occasionally granted. The increase in the life expectancy of disabled people constitutes major progress, but it reveals needs to which the current medico-social offer does not sufficiently meet. Many disabled adults continue to live at home with their parents, who provide daily support while they are themselves. aging, ill or losing autonomy. These families are frequently faced with particularly long waiting lists to obtain a place in a nursing home, a medical foster home or a specialized reception home. However, not all EHPADs have dedicated units or staff sufficiently trained in these different profiles. Entry into an EHPAD should therefore not become, by default, the only solution offered from the age of sixty due to the lack of places in the disability sector. Mr. Olivier Fayssat draws the attention of the Minister of the Interior to the growing threats that criminal organizations pose to mayors and local elected officials engaged in the fight against drug trafficking. The situation recently experienced by the mayor of Alès, Mr. Christophe Rivenq, constitutes a particularly worrying illustration of this. After the discovery of tags at his home and two 9 millimeter caliber cartridges in his mailbox letters, accompanied by threats attributed to the DZ Mafia or one of its emanations, the elected official was placed under police protection, equipped with an alert button then exfiltrated from his home. Without prejudging the conclusions of the judicial investigation or the identity of their authors, these facts testify to a change of scale in the methods of intimidation used by criminal networks against representatives of the Republic. These Threats seem directly linked to the action taken by the municipality against the establishment of drug trafficking. Mr. Olivier Fayssat draws the attention of the Keeper of the Seals, Minister of Justice, to the conditions of access of mayors to information relating to persons registered in the Automated Judicial File of Perpetrators of Sexual or Violent Offenses (FIJAIS). Responsible for municipal police in application of article L. 2212-1 of the general code of local authorities, mayors are primarily responsible for public security on the municipal territory. However, when a person registered with FIJAIS settles in their municipality, they are not informed, even though this information is known to the prefect, the public prosecutor and the security forces. This situation creates a clear contradiction between the responsibilities entrusted to them and the means at their disposal to prevent risks. The first proposals presented by the Government display widely shared objectives, particularly in terms of improving the quality and safety of care, reduction of territorial inequalities and strengthening of prevention. Olivier Fayssat attire l'attention de M. le garde des sceaux, ministre de la justice, sur les conséquences des décisions de l'Agence nationale de la sécurité des systèmes d'information (ANSSI) relatives à l'utilisation de certains outils d'investigation numérique par les experts judiciaires en informatique. Plusieurs experts judiciaires alertent sur les difficultés rencontrées depuis 2022 pour acquérir et utiliser des logiciels indispensables à l'exploitation des téléphones saisis dans le cadre des procédures pénales, ces outils étant soumis à une autorisation préalable de l'ANSSI qui leur serait refusée. Ils estiment que cette situation est susceptible de limiter l'exercice des missions qui leur sont confiées en application des articles 230-1 et 706-102-1 du code de procédure pénale, lesquels les habilitent à réaliser, sous le contrôle de l'autorité judiciaire, des opérations techniques d'accès, d'extraction et d'analyse des données numériques. Selon ces professionnels, cette organisation conduit à transférer ces opérations vers des services spécialisés déjà fortement sollicités, allongeant de plusieurs mois les délais d'exploitation des téléphones et retardant d'autant certaines enquêtes judiciaires, notamment lorsqu'elles portent sur des violences sexuelles commises sur des mineurs. Dans un contexte où le législateur entend favoriser un traitement plus rapide de ces procédures, il lui demande comment le Gouvernement entend concilier les exigences de sécurité mises en œuvre par l'ANSSI avec les prérogatives reconnues aux experts judiciaires par le code de procédure pénale. Il souhaite également savoir si une évolution du cadre réglementaire ou une clarification des textes est envisagée afin de permettre aux experts judiciaires de disposer des moyens techniques nécessaires à l'accomplissement de leurs missions, tout en maintenant les garanties indispensables en matière de sécurité nationale.

As the law stands, the highway code limits its scope of application only to roads open to public traffic. However, this procedure, governed by the articles R. 325-47 to R. 325-52, requires in particular a formal notice from the owner of the vehicle within eight days, making its application particularly slow and unsuitable for emergency situations, in particular when a vehicle blocks an access route for firefighters or ambulances. This decree was taken to try to correct the negative effects of the taxation of the retirement pension increase for parents of three children and more. In fact, this taxation had the effect of removing from the Health Insurance Fund for the Electric and Gas Industries (CAMIEG), for the complementary portion alone, a few hundred spouses of agents in the electricity and gas industries as of December 31, 2014 and several thousand as of December 31, 2015. Based solely on the resources received in 2013, this decree does not meet the objective set to maintain the right to the CAMIEG supplementary scheme for parents of three or more children. M. Olivier Fayssat attire l'attention de M. le ministre de l'intérieur sur la pérennité et le soutien apportés aux clubs de tir en France et en particulier à celui de La Ciotat, situé dans le département des Bouches-du-Rhône. Le Club de tir ciotaden, fondé en 1968 et regroupant aujourd'hui environ 1 200 membres, se voit contraint de quitter son site historique situé dans le périmètre du Parc national des Calanques. En effet, le club est signataire d'une convention de mise à disposition de 1968 à aujourd'hui, en échange de l'entretien du terrain. Cette convention a été brutalement remplacée par un loyer de 100 000 euros par an. Le tir sportif est une activité populaire, les adhérents paient 150 euros par an, ne permettant pas au club de couvrir ce loyer. Ce stand de tir assure des fonctions essentielles, tant pour les tireurs sportifs que pour les forces de sécurité. La police nationale ainsi que certains agents pénitentiaires y effectuent régulièrement leurs entraînements obligatoires au tir, contribuant ainsi à leur formation et à leur qualification, essentielles à la sécurité publique. Depuis la création du Parc national des Calanques en 2012, le club a entrepris de multiples efforts pour réduire son impact environnemental, notamment en couvrant certains de ses stands et en fermant les installations de ball-trap. En outre, de par sa situation géographique, aucun problème de voisinage n'est à déplorer. Malgré ces mesures et l'absence de concertation avec les autorités du Parc, la situation s'est dégradée, exacerbée par la demande d'un loyer prohibitif, rendant la situation financièrement insoutenable pour cette structure associative. Les difficultés de cohabitation que rencontre ce club de tir ne constituent pas un cas isolé. Elles soulèvent de nombreuses questions de sécurité et de continuité dans la formation des forces de l'ordre. De plus, elles interrogent quant aux conséquences de la fermeture des stands de tir pour la pratique du tir sportif, une discipline dans laquelle la France a déjà brillé sur la scène internationale, notamment lors des jeux Olympiques. Enfin, les clubs de tir sont aussi utilisés par les chasseurs pour s'entraîner, essayer et régler leurs armes. 1 200 000 chasseurs et 250 000 tireurs sportifs voudraient connaître le sort que leur réserve le Gouvernement. Il souhaiterait connaître sa position quant à la préservation de ces installations, notamment celles de La Ciotat, et quelles mesures pourraient être envisagées par l'État pour favoriser la continuité des activités de ces infrastructures, nécessaires à la sécurité des Français, dans un cadre respectueux de l'environnement.

La calanque de Sormiou est située en zone police nationale, dans le 9ème arrondissement de Marseille. C'est donc à la police nationale et à la police municipale d'assurer les mesures directes de sécurité sur et autour de ce site, en lien avec les agents assermentés du Parc national des Calanques (PNC), également compétents pour contribuer à sa protection. En ce qui concerne la gendarmerie nationale, il peut être relevé que les agents du PNC bénéficient du soutien opérationnel du détachement du groupe de cavalerie de la Garde républicaine de Marseille, qui effectue des patrouilles régulières et qui peut être renforcé, dans le cadre de la coopération européenne, par des cavaliers étrangers. Aussi, le commandement pour l'environnement et la santé (CESAN) est en contact avec le PNC, dont les agents assermentés sont rattachés à l'office Français de la Biodiversité (OFB). L'action de la gendarmerie s'opère notamment sur le volet de la formation. Une première session de formation, dispensée par l'office central de lutte contre les atteintes à l'environnement et à la santé publique (OCLAESP), a permis à une vingtaine de leurs agents d'acquérir des compétences en matière de police judiciaire, notamment sur l'audition des personnes mises en cause. En complément, des échanges ont été engagés avec la responsable de la mission « Police de l'Environnement » au sein du PNC, afin de renforcer ces actions de formation. L'objectif à terme, est de permettre aux agents d'exercer pleinement leurs prérogatives en matière de police judiciaire. Des formations complémentaires pourraient aussi être envisagées à destination des éco-volontaires (environ 10 personnes) et des éco-gardes (environ 20 saisonniers). Par ailleurs, la mise en place de sessions spécifiques de formation aux infractions environnementales, réalisées conjointement avec les agents du parc, au profit des fonctionnaires de la police nationale et des agents de la police municipale seraient également envisageables. Enfin, dans le cadre de ses missions d'appui, le CESAN est en mesure d'élaborer des fiches méthodologiques, adaptées aux atteintes constatées et à la réglementation particulière applicable sur ce site classé. the whole of ces initiatives pourrait être formalisé dans une convention entre le CESAN et le PNC.
