This bill requires the Department of State to notify Congress when an entity receiving U.S.-provided funds enters into an agreement with the Taliban (the group controlling the government of Afghanistan). The State Department shall submit a report to Congress on the total amount and types of payments provided by such entities to the Taliban. The State Department shall also submit a report that includes a copy of each agreement between such entities and the Taliban between August 31, 2021, and the date of enactment.

Fourth Amendment Is Not For Sale Act This bill expands prohibited disclosures of stored electronic communications under the Stored Communications Act. The Stored Communications Act generally prohibits certain technology providers—remote computing service (RCS) providers and electronic communication service (ECS) providers—from disclosing the contents of stored electronic communications to anyone, including the government; and records or information pertaining to a customer or subscriber to a government entity. This bill extends the general prohibitions on disclosure to an additional type of technology provider: intermediary service providers. Intermediary service providers (commonly referred to as data brokers) are companies that deliver, store, or process communications for RCS and ECS providers. The bill also limits the authority of law enforcement agencies and intelligence agencies to access certain customer and subscriber records or illegitimately obtained information. With respect to such records, the bill prohibits law enforcement agencies and intelligence agencies from obtaining the records or information from a third party in exchange for anything of value (e.g., purchasing them); prohibits other government agencies from sharing the records or information with law enforcement agencies and intelligence agencies; and prohibits the use of such records or information in any trial, hearing, or proceeding. Additionally, the bill requires the government to obtain a court order before aquiring certain customer and subscriber records or any illegitimately obtained information from a third party.

Upper Colorado and San Juan River Basins Endangered Fish Recovery Programs Reauthorization Act of 2024

Upper Colorado and San Juan River Basins Endangered Fish Recovery Programs Reauthorization Act of 2023 This bill reauthorizes through FY2031 and revises the U.S. Fish and Wildlife Service's Upper Colorado River and San Juan River Basin recovery implementation programs to restore populations of certain endangered and threatened fish. The goal of the Upper Colorado River Endangered Fish Recovery Program is to recover the humpback chub (Gila Cypha) , bonytail (Gila elegans) , Colorado pikeminnow (Ptychocheilus lucius) , and razorback sucker (Xyrauchen texanus) . The states of Colorado, Utah, and Wyoming are partners in the program. The goal of the San Juan River Basin Recovery Implementation Program is to recover the Colorado pikeminnow ( Ptychocheilus lucius ) and razorback sucker ( Xyrauchen texanus ). The states of Colorado and New Mexico are partners in the program. The bill expands the programs to include the recovery of threatened fish stock. Thus, the bill requires the Upper Colorado River program to continue efforts to restore populations of the humpback chub, which was reclassified from an endangered species to a threatened species in 2001.

Canadian Snowbird Visa Act

Canadian Snowbird Visa Act This bill authorizes the Department of Homeland Security to admit into the United States qualifying Canadian citizens as long-term nonimmigrant visitors. A qualifying Canadian citizen is an individual who (1) is at least 50 years old, (2) maintains a Canadian residence, (3) owns a U.S. residence or has rented a U.S. accommodation for the duration of the individual's stay, (4) is not inadmissible or deportable, (5) will not engage in employment or labor for hire in the United States other than for a non-U.S.-based person or entity by whom the Canadian citizen was employed in Canada or for whom the Canadian citizen performed services in Canada, and (6) will not seek certain forms of assistance or benefits. A qualified individual may be admitted for up to 240 days during any single 365-day period. The spouse of such an individual may be admitted under the same terms, except that the spouse is not required to separately satisfy the requirement for owning or renting a residence in the United States. An individual admitted into the United States under this bill shall have nonresident alien tax status.

PREVAIL Act

Promoting and Respecting Economically Vital American Innovation Leadership Act or the PREVAIL Act This bill addresses various issues relating to the U.S. Patent and Trademark Office (PTO), including by imposing additional requirements on administrative patent validity challenges (proceedings to review and potentially cancel issued patents) at the PTO. The bill modifies provisions relating to inter partes reviews (IPRs) and other administrative patent validity proceedings, including by prohibiting an administrative patent judge who participated in deciding whether to institute an IPR (i.e., whether to allow the IPR to proceed based on the initial petition) from also participating in deciding the final outcome of the same IPR; prohibiting a person (individual or entity) from petitioning for an IPR against a patent unless the person has been sued for or charged with infringing that patent, whereas currently any person may petition for an IPR; prohibiting a person who has challenged a patent's validity in an IPR from raising the same challenges against the patent in other proceedings (e.g., district court) if the IPR has been instituted; and raising the burden that the petitioner in an IPR must meet to invalidate a previously-issued patent claim. This bill also makes institutions of higher education (IHEs) and nonprofit entities that hold patents on behalf of IHEs eligible for reduced patent-related fees, including filing fees. (Currently, employees of IHEs are eligible for reduced fees but not the IHEs themselves.) The bill also makes fees collected by the PTO available for the PTO's use without further appropriations from Congress, whereas currently some of the collected fees are subject to appropriations.

Conservation Reserve Enhancement Program Improvement Act of 2023

Conservation Reserve Enhancement Program Improvement Act of 2023 This bill revises the Conservation Reserve Enhancement Program (CREP), which is a component of the Farm Service Agency's (FSA's) Conservation Reserve Program (CRP). CREP is a public-private partnership program which allows states, tribal governments, and nonprofit and private entities to partner with FSA to implement CRP practices. CRP is a land conservation program that provides an annual rental payment to farmers in exchange for removing environmentally sensitive land from agricultural production and planting species that will improve environmental health and quality.  The bill specifies that dryland agricultural uses and grazing are included as appropriate practices under CREP. The bill also allows a land owner or operator to elect to determine the annual payment amount allocated for each year of a CREP agreement, instead of a fixed payment per year for the contract period. For drought and water conservation agreements that include the permanent retirement of water rights, annual payment rates must be equal to the irrigated acre payment rates determined by the Department of Agriculture (USDA). In the case of an agreement that permits dryland agricultural uses, the annual payment rates must be equal to the difference between the irrigated acre payment rates and the dryland acre payment rates determined by USDA. The payment formula is retroactive for certain existing drought and water conservation agreements.  Further, the bill exempts CREP payments from the $50,000 annual payment limitation under CRP.     

National AI Commission Act

National AI Commission Act This bill establishes a National Artificial Intelligence (AI) Commission in the legislative branch. The purpose of the commission is to support the role of the United States in mitigating the risks of AI through appropriate regulation while also supporting U.S. innovation and opportunities with respect to AI. The commission must be bipartisan, with an equal number of members appointed by the Democratic and Republican parties. Members must have a background in (1) computer science or other technical experience in AI, (2) civil society, (3) industry and workforce, or (4) government. The commission must review the federal government's current approach to AI oversight and regulation and recommend a comprehensive, binding regulatory framework in its final report.

REPO for Ukrainians Act

Rebuilding Economic Prosperity and Opportunity for Ukrainians Act or the REPO for Ukrainians Act This bill requires or authorizes various actions related to the confiscation and disposition of Russian sovereign assets (which include funds and other property of Russia's central bank, direct investment fund, or ministry of finance). Under the bill, the President must require U.S. financial institutions to notify the Department of the Treasury of any Russian sovereign assets located at such institutions. The President may confiscate any such assets subject to U.S. jurisdiction. Confiscated funds and the proceeds of liquidated property must be deposited into the Ukraine Support Fund established by the bill. The Ukraine Support Fund shall be used by the Department of State to compensate Ukraine for damages caused by the Russian invasion. The Ukraine Support Fund may also support an international body or mechanism for (1) reconstruction and rebuilding efforts in Ukraine, (2) humanitarian assistance to the Ukrainian people, or (3) other purposes which support the recovery of Ukraine and the welfare of the Ukrainian people. The bill also directs the President to seek to establish, with foreign partners, an international mechanism to provide compensation to Ukraine using the Ukraine Support Fund and Russian sovereign assets confiscated by foreign partners. Additionally, the bill sets policy on related topics, such as specifying that the United States should lead an international sanctions regime to freeze Russian sovereign assets in conjunction with allies and partners.

To amend the Internal Revenue Code of 1986 to require certain contract terms in contracts relating to wind turbines on land not owned by the taxpayer as a requirement in order to claim the credit relating to electricity produced from certain renewable resources.

Stop Pills That Kill Act This bill increases criminal penalties for offenses relating to the manufacture of fentanyl or counterfeit substances. It also establishes requirements for federal agencies to address the use of counterfeit substances. Specifically, the bill applies an increased criminal penalty for possessing, manufacturing, or distributing certain equipment or materials that are used to illegally manufacture fentanyl, an analogue of fentanyl, or a counterfeit substance (the increased penalty is currently limited to offenses involving methamphetamine). The Drug Enforcement Administration must establish and implement a plan to address counterfeit fentanyl or methamphetamine substances through law enforcement action and education and prevention efforts. In addition, the Department of Justice must annually report on the collection of counterfeit fentanyl or methamphetamine substances by law enforcement and on related prosecutions.

Fight and Combat Rampant Iranian Missile Exports Act or the Fight CRIME Act This bill imposes sanctions pertaining to Iran's missile program. The President must impose visa- and property-blocking sanctions on foreign persons (i.e., foreign individuals, entities, and states) that are knowingly involved with Iran or Iran-aligned entities in certain missile-related activities, such as (1) acquiring, possessing, developing, transporting, transferring, or deploying missiles or related items and technology that are covered by the Missile Technology Control Regime (MTCR), or (2) developing missile or drone technologies. (The MTCR is an informal political understanding among states that seek to limit missile proliferation.) The President must also impose sanctions on (1) certain adult family members of those who are subject to the sanctions discussed above, and (2) foreign persons who knowingly provide significant support to or engage in a significant transaction with those subject to the sanctions discussed above. The bill also requires the Department of State to report to Congress on various topics, including (1) a diplomatic strategy to renew international restrictions on certain missile-related activities set forth in Annex B of U.N. Security Council Resolution 2231, which concerns restrictions on arms transfers to and from Iran; (2) the identities of foreign persons engaging in restricted activity under Annex B; and (3) an analysis of the foreign and domestic supply chains that facilitate Iran's missile or drone programs.

Calling for the immediate release of Evan Gershkovich, a United States citizen and journalist, who was wrongfully detained by the Government of the Russian Federation in March 2023.

Prevent All Soring Tactics Act of 2023 or the PAST Act of 2023 This bill addresses the practice of soring horses. The soring of horses includes various actions taken on horses' limbs to produce higher gaits that may cause pain, distress, inflammation, or lameness. Specifically, the bill expands soring regulation and enforcement at horse shows, exhibitions, sales, and auctions, including by establishing a new system for inspecting horses for soring. In addition, the bill increases penalties for violations.

No Oil Producing and Exporting Cartels Act of 2023 or NOPEC This bill prohibits a foreign state from engaging in collective action impacting the market, supply, price, or distribution of oil, natural gas, or any other petroleum product in the U.S. Specifically, a foreign state is prohibited from collective action that limits the production or distribution of such product, collective action to set or maintain the price of such product, or any other action that restrains trade of such product. Specified defenses such as sovereign immunity (i.e., a foreign state's immunity from the jurisdiction of U.S. courts) and the act of state doctrine (i.e., the prohibition of a court invalidating an official act of a foreign sovereign performed within its own territory) shall not apply to a foreign state's violation of this bill.

CONVEY Act

Clifton Opportunities Now for Vibrant Economic Yields Act or the CONVEY Act This bill directs the Bureau of Land Management (BLM) to convey to Mesa County, Colorado, a parcel of land in Clifton for fair market value. The BLM must pay all costs associated with the conveyance and the county must pay any surveying costs. The proceeds from the conveyance shall be deposited into the Federal Land Disposal Account and available for expenditure.

Failed Bank Executives Clawback Act This bill requires the Federal Deposit Insurance Corporation (FDIC) to claw back compensation paid to certain responsible parties when an insured depository institution or financial company is placed into FDIC receivership.  Specifically, all or part of the compensation paid the previous five years to an institution-affiliated party substantially responsible for the condition of the institution must be paid to FDIC to prevent unjust enrichment and to assure that the party bears losses consistent with their responsibility. Compensation includes salary, bonuses, awards, and profits from buying or selling securities. Finally, the bill establishes that an insured depository institution's holding company is liable to the FDIC for payments to insured depositors, the FDIC's receiver costs, and interest when the institution is under FDIC receivership.
