This joint resolution nullifies the final rule issued by the Department of Labor titled Employee or Independent Contractor Classification Under the Fair Labor Standards Act and published on January 10, 2024. The final rule addresses how to determine whether a worker is properly classified as an employee or an independent contractor for purposes of requirements of the Fair Labor Standards Act (FLSA) that address issues such as minimum wage and overtime compensation. The rights and protections provided by the FLSA apply only to employees.

Protecting Americans' Data from Foreign Adversaries Act of 2024 This bill makes it unlawful for a data broker to sell, license, rent, trade, transfer, release, disclose, or otherwise make available specified sensitive data of individuals who reside in the United States to North Korea, China, Russia, or Iran or an entity controlled by such a country (e.g., headquartered in or owned by a person in the country). Sensitive data includes government-issued identifiers (e.g., Social Security numbers), financial account numbers, biometric information, genetic information, precise geolocation information, and private communications (e.g., texts or emails). A data broker generally includes an entity that sells or otherwise provides data of individuals that the entity did not collect directly from the individuals. A data broker does not include an entity that transmits an individual's data or communications at the request or direction of the individual or an entity that makes news or information available to the general public. The bill provides for enforcement by the Federal Trade Commission.

Protecting Native Americans’ Credit Act of 2024 This bill excludes specified medical debt incurred by Native Americans from credit reports. The bill applies to medical debt related to treatment authorized by an Indian Health Service facility and performed at a non-Indian Health Service facility and medical debt wrongfully charged by the Department of Health and Human Services. This type of debt must be excluded from a credit report if the medical debt was incurred as a result of services received in the last year or if the debt has been fully paid or settled. The bill also establishes a dispute process for such debt.

FIFA World Cup 2026 Commemorative Coin Act This bill directs the Department of the Treasury to mint coins in commemoration of the FIFA World Cup 2026 to be held in the United States, Mexico, and Canada. All surcharges received by Treasury from the sale of the coins shall be promptly paid by Treasury to FWC2026 US, Inc. (the U.S.-incorporated FIFA subsidiary operating the FIFA Men's World Cup 2026) for the purpose of aiding soccer programs and activities in the United States.

DeOndra Dixon INCLUDE Project Act of 2024 This bill provides statutory authority for a National Institutes of Health (NIH) research program on Down syndrome. (Down syndrome is a genetic condition in which a person is born with an extra copy of chromosome 21, which can affect mental and physical development.) Specifically, the bill provides statutory authority for the NIH's Investigation of Co-occurring Conditions Across the Lifespan to Understand Down Syndrome Project (known as the INCLUDE Project). The project was initially established in 2018 to investigate the co-occurring conditions that affect those with Down syndrome (e.g., Alzheimer's disease) and their quality-of-life needs, particularly through (1) targeted research on chromosome 21, (2) assembling a large study population of individuals with Down syndrome, and (3) conducting clinical trials that include those with Down syndrome.

Hannah Cvancara Service Act This bill prohibits the Department of Defense or military departments from excluding a person with an amputated limb from assignment to a medical personnel position if such an individual meets physical fitness and other required standards for the position.

Veterans Expedited TSA Screening Safe Travel Act or the VETS Safe Travel Act This bill makes certain veterans eligible for the Transportation Security Administration (TSA) PreCheck Program at no cost if they meet the program's background check and security requirements. Veterans who are eligible for this fee waiver are those who are in the patient enrollment system of the Department of Veterans Affairs (VA) and require the use of a wheelchair, prosthetic limb, or other assistive device to aid with mobility due to (1) loss, or loss of use, of a limb; (2) full or partial paralyzation; or (3) permanent blindness. The VA and the TSA must develop and implement a process under which eligible veterans may receive the PreCheck Program benefit. Further, the VA and the TSA must develop and implement a process to provide disabled veterans with effective outreach about TSA programs that are designed to improve the screening process for passengers with disabilities.

This joint resolution nullifies the final rule issued by the Federal Highway Administration (FHWA) titled National Performance Management Measures; Assessing Performance of the National Highway System, Greenhouse Gas Emissions Measure and published on December 7, 2023. Under current law, each state must set targets for and report on the progress of performance metrics related to the U.S. surface transportation system. The rule establishes a specific measure for assessing greenhouse gas (GHG) emissions associated with transportation (GHG measure). The rule also requires state departments of transportation and metropolitan planning organizations to establish declining carbon dioxide (CO2) targets for the GHG measure and report to the FHWA on their progress towards achieving these targets.

Israel Security Supplemental Appropriations Act, 2024 This bill provides FY2024 supplemental appropriations to the Department of Defense (DOD) and the Department of State for activities to respond to the attacks in Israel. The bill designates the funding as emergency spending, which is exempt from discretionary spending limits. Specifically, the bill provides appropriations to DOD for Military Personnel; Operation and Maintenance; Procurement; Research, Development, Test and Evaluation; Defense Working Capital Funds; and the Defense Health Program. The funding is provided for purposes such as supporting current U.S. military operations in the region; replacing defense articles that were provided to Israel; reimbursing DOD for defense services and training provided to Israel; and procuring Israel's Iron Dome, David's Sling, and Iron Beam defense systems to counter short-range rocket threats. The bill also provides appropriations to the State Department for Diplomatic Programs, Emergencies in the Diplomatic and Consular Service, and the Foreign Military Financing Program. The funding is provided to the State Department for purposes such as (1) increasing security at U.S. embassies impacted by the attacks on Israel, and (2) conducting emergency evacuations of U.S. government personnel and citizens in the region. Finally, the bill includes provisions that expand the authorities of the President to transfer defense articles and services from DOD to Israel.

Roberto Clemente Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue coins in recognition of the life of Roberto Clemente, baseball player and human rights activist. All sales of coins issued under this bill must include a surcharge to be paid to the Roberto Clemente Foundation.

Immigration Visa Efficiency and Security Act of 2023 This bill addresses issues concerning family- and employment-based visas. The bill increases the annual per-country cap on family-based immigrant visas from 7% of the total number of such visas available to 15% and eliminates the per-country cap for employment-based immigrant visas. The bill establishes transition rules for employment-based visas such as (1) reserving a percentage of EB-2 (workers with advanced degrees or exceptional ability) and EB-3 (skilled and other workers) visas for individuals not from the two countries with the largest number of recipients of such visas, and (2) allotting a number of visas for professional nurses and physical therapists. The bill imposes additional requirements for H-1B visas, such as prohibiting (1) an employer from advertising that a position is limited to H-1B applicants or that H-1B applicants are preferred, and (2) certain employers from having more than half of their employees as nonimmigrant visa workers. The Department of Labor shall create a publicly available website where an employer seeking an H-1B visa must post information about the open position. The bill also expands Labor's authority to investigate H-1B applications for fraud or misrepresentations. The bill also prohibits H-1B or H-3 (trainee or special education exchange) visas for nationals of a foreign adversary country for employment in any matter vital to U.S. national interests. The bill also allows certain nonimmigrant visa holders to obtain lawful permanent resident status if the individual (1) has an approved immigrant visa petition, and (2) has waited at least two years for a visa.

Expanding Public Lands Outdoor Recreation Experiences Act or EXPLORE Act This bill sets forth policies for the Department of the Interior and the Department of Agriculture related to recreation on certain public lands. Issues addressed include itemized budget information for outdoor recreation across departments; long-distance bike trails; recreational climbing activities; target shooting ranges; overnight campsites in Arkansas; filming and still photography; motorized and nonmotorized access; invasive species; gateway communities; real-time information for the public on visitor levels; broadband and cellular service; public-private partnerships; access for persons with disabilities to trails and recreation opportunities; recreational and job opportunities for military members and veterans; youth access to recreational lands; issuance of special recreation permits; a digital version of the National Parks and Federal Recreational Lands Pass; extension of seasonal recreation opportunities; and volunteers on public recreational lands.

Child Welfare Provider Inclusion Act of 2023 This bill generally prohibits the federal government, states, tribal nations, or localities from discriminating or taking adverse action against a child welfare provider that declines to provide services due to the provider's sincerely held religious beliefs or moral convictions. However, government entities may still take adverse action against a provider that declines to provide adoption or foster care services based on race, color, or national origin. The Department of Health and Human Services must withhold a portion of federal funding for family services and child welfare activities from a government entity that discriminates against a child welfare provider in violation of this bill. Child welfare providers may also sue the government entity for such discrimination. A prevailing provider may recover reasonable attorney's fees and costs. Furthermore, government entities that accept certain federal funding for family services and child welfare activities must waive sovereign immunity as a defense to lawsuits brought under this bill. (In many cases, sovereign immunity shields states, territories, tribal nations, and some localities against private suits.)

This joint resolution nullifies the final rule issued by the National Labor Relations Board titled Standard for Determining Joint Employer Status and published on October 27, 2023. The rule establishes a new joint employer standard for determining whether two employers simultaneously employ a particular employee or employees. Under the rule, an entity may be considered a joint employer of another employer's employees if the two share or codetermine the employees' essential terms and conditions of employment. The rule is currently scheduled to take effect on February 26, 2024.

Finally, the bill rescinds specified unobligated funds that were provided for activities of the Internal Revenue Service.

No Funds for Iranian Terrorism Act This bill requires the President to impose property-blocking sanctions on foreign financial institutions and international financial institutions that process, participate in, or facilitate a transaction involving certain Iranian funds (namely, the approximately $6 billion of Iranian funds that the Biden administration permitted to be transferred from restricted accounts in South Korea to restricted accounts in Qatar to facilitate the release of five U.S. citizens detained in Iran).

Transportation Security Screening Modernization Act This bill directs the Transportation Security Administration (TSA) to streamline the process for individuals applying for or renewing enrollment in multiple security threat assessment (STA) programs, in particular the Transportation Worker Identification Credential (TWIC) and the Hazardous Materials Endorsement (HME) programs. Among other things, the TSA must permit an individual to enroll at a TSA-authorized enrollment center once and use the application, as well as information generated by TSA’s vetting, to enroll in any other programs; permit an individual to enroll in more than one STA program at the same time for a single fee that is less than the combined fee for applying to the same programs separately; provide for a streamlined and expeditious renewal process; and provide states the expiration dates for each individual’s STA to ensure commercial driver's licenses include an individual's current HME status. Additionally, the TSA must publish on its website information relating to the streamlining of the enrollment system. If the TSA determines it is necessary to implement these changes through rulemaking, the bill provides for an expedited rulemaking process.

Pay Our Troops Act This bill provides continuing appropriations for military pay for any period during which interim or full-year appropriations for FY2024 are not in effect (i.e., a government shutdown). Specifically, the bill provides FY2024 continuing appropriations for the pay and allowances of (1) members of the Armed Forces, including reserve components, who perform active service during the period; and (2) civilian employees and contractors of the Department of Defense (and the Department of Homeland Security in the case of the Coast Guard when the Coast Guard is not operating as a service in the Department of the Navy) who are providing support to such members of the Armed Forces. If a government shutdown occurs, the bill provides the continuing appropriations until the earlier of (1) the enactment into law of specified appropriations legislation, or (2) January 1, 2025.

CBDC Anti-Surveillance State Act This bill prohibits a Federal Reserve bank from offering products or services directly to an individual, maintaining an account on behalf of an individual, or issuing a central bank digital currency (i.e., a digital dollar) directly or indirectly to an individual. Further, The Board of Governors of the Federal Reserve System and the Federal Open Market Committee are prohibited from using a central bank digital currency to implement monetary policy.

Lower Costs, More Transparency Act This bill requires health care providers and insurers to disclose certain information about health care costs. It also establishes requirements for certain payment methodologies under Medicare and Medicaid and extends several public health programs. For example, the bill provides statutory authority for regulations that require hospitals to annually publish their prices and related information, including the discounted cash price and negotiated charges. The bill also specifically extends these requirements to clinical laboratories, imaging service providers, and ambulatory surgical centers that participate in Medicare. Additionally, pharmacy benefit managers (PBMs) must semiannually report to health plan sponsors on the number and types of claims for covered drugs, including whether the drugs were brand-name or generic drugs and associated costs. Contracts with PBMs for employer-sponsored health plans must also allow health plan fiduciaries to audit certain claims and cost information without undue restrictions. In addition, the bill requires pass-through pricing models, and prohibits spread-pricing, for payment arrangements with PBMs under Medicaid. It also requires Medicare payments for certain drug administration services at off-campus hospital outpatient departments to be the same as that for other provider settings (i.e., physician offices). The bill provides funds for the Department of Health and Human Services, the Department of Treasury, and the Department of Labor to implement and enforce the bill's requirements. Finally, the bill extends several public health programs, including the Teaching Health Center Graduate Medical Education Program (through FY2030) and the National Health Service Corps (through December 31, 2025).

Main Street Tax Certainty Act This bill makes permanent the tax deduction for qualified business income. (Under current law, the deduction expires after December 31, 2025.) Qualified business income is defined as the net amount of qualified items of income, gain, deduction and loss with respect to any trade or business, excluding capital gains or losses, dividends, interest income, or income earned outside the U.S.
