Military Personnel Toxic Exposure Registry Act

Military Personnel Toxic Exposure Registry Act - Directs the Secretary of Defense (DOD) to establish and administer a system to identify members of the Armed Forces who were potentially exposed to a hazardous disposal site, as well as any negative health effects that may be related to such exposure. Requires the Secretary to: (1) administer the system using existing medical surveillance systems; (2) notify a member and his or her commanding officer of a potential exposure; (3) for each member notified, collect information for purposes of the system; (4) for each member notified, annually provide a complete physical examination and related consultation and counseling; and (5) report annually to the congressional defense committees on the status of system implementation and incidences of illnesses which may have been caused by such exposure. Amends the National Defense Authorization Act for Fiscal Year 2010 to: (1) include solid waste containing plastics within the definition of "covered waste" for purposes of a prohibition against the disposal by the Armed Forces of covered waste in open-air burn pits during contingency operations; and (2) include in a required report concerning the use of such pits those situations in which such pits were used to dispose of waste during military exercises and operations worldwide during the period beginning on September 11, 2001, and ending on the date of enactment of this Act.

Prohibits any court from considering a member's absence due to deployment, or possible deployment, in support of a contingency operation in determining the best interest of the child.

Expresses the sense of the House that: (1) any such action should include the impacts on the U.S. economy incurred by implementation of the U.S. Consumer Assistance to Recycle and Save (CARS) incentives program in regards to Japanese manufactured automobiles that received subsidies; and (2) the Secretary of State should immediately take diplomatic and other measures to ensure that any extension of Japan's Eco-Friendly Vehicle Program is not discriminatory to U.S. manufactured automobile imports to Japan.

Downed Animal and Food Safety Protection Act - States that it is U.S. policy that all nonambulatory cattle in interstate and foreign commerce be immediately and humanely euthanized when such cattle become nonambulatory. Amends the Humane Methods of Slaughter Act of 1958 to direct the Secretary of Agriculture to promulgate regulations providing for the humane treatment, handling, and disposition of nonambulatory cattle by a covered entity, including a requirement that nonambulatory cattle be humanely euthanized. Requires an entity to: (1) humanely euthanize nonambulatory cattle (while not limiting the Secretary's ability to test nonambulatory cattle for disease, such as bovine spongiform encephalopathy); and (2) not move nonambulatory cattle while such cattle is conscious, and ensure that such cattle remains unconscious until death. Prohibits an inspector at an establishment covered by the Federal Meat Inspection Act to pass nonambulatory cattle, carcass, or carcass parts through inspection. Requires an inspector or other employee at such establishment to label such material as "inspected and condemned."

Applies provisions related to breast and cervical cancer programs to programs under this Act.

Buy American Improvement Act of 2009

Buy American Improvement Act of 2009 - Amends the Buy American Act to: (1) extend through FY2013 the requirement for federal agencies to report to specified congressional committees on the amount of agency acquisitions from entities that manufacture products outside the United States; (2) apply such Act to executive, legislative, and judicial branch agencies; and (3) require articles to be treated as made substantially all from articles mined, produced, or manufactured in the United States if the cost of the domestic components exceeds 75% of the total cost of all components. Prohibits federal agencies from determining that: (1) it would not be in the public interest to enter into a contract subject to Buy American requirements after a solicitation of offers notice for such contract is published; (2) the cost of acquiring products manufactured in the United States is unreasonable unless such acquisition would increase the cost of the overall project by more than 25%; or (3) an article is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of satisfactory quality unless the agency has determined that domestic production cannot be initiated without significantly delaying the project and that a substitutable article is not available from a company in the United States. Requires agencies: (1) to give preference in the procurement process to a company that manufactures the solicited product in the United States if such company's bid is substantially the same as a bid made by a non-U.S. manufacturer or such company is the only one that manufactures the product in the United States; (2) to exclude costs related to the startup of a project from a domestic bid; (3) to apply Buy American requirements without regard to whether products to be acquired are for use outside the United States if they are not needed on an urgent basis or if they are acquired on a regular basis; (4) in determining whether to grant a public interest waiver of Buy American requirements, to consider any predicted significant decrease in domestic employment to be against the public interest; and (5) to publish waivers requested and waivers granted on a publicly available website. Directs: (1) the Federal Acquisition Regulatory Council to amend the Federal Acquisition Regulation to ensure that Buy American requirements apply to component projects that have been disaggregated from a larger project for purposes of avoiding applicability of such requirements to the larger project; and (2) the Comptroller General to report to Congress recommendations to be used in determining whether acquiring articles mined, produced, or manufactured in the United States would be inconsistent with the public interest. Requires this Act to be applied in a manner consistent with U.S. obligations under international agreements.

Russell National School Lunch Act to increase reimbursement rates for free, reduced price, and paid meals and snacks served under the Child and Adult Care Food Program (CACFP) at nonresidential child care centers and family or group day care homes. Allows such providers to be reimbursed for the service of three meals and a snack. (Currently, reimbursement is provided for two meals and a snack.) Lowers the percentage of children or school children in an area that must be eligible for free or reduced price meals under the school lunch or breakfast programs to make family or group day care homes in the area eligible for higher CACFP reimbursement rates as tier I homes. Increases the maximum monthly administrative payment per home provided to sponsors of family or group day care homes. Directs the Secretary of Agriculture to improve the ability of the CACFP to reach low-income families by streamlining program and paperwork requirements.

Authorizes the Secretary of Veterans Affairs (VA) to approve for such program the pursuit of flight training if: (1) such training is generally accepted as necessary for the attainment of a vocational objective in aviation; (2) the individual possesses a valid private pilot certificate and meets medical requirements necessary for a commercial pilot certificate; and (3) the flight school course meets Federal Aviation Administration (FAA) standards.

Small Business Job Creation and Access to Capital Act of 2009 - Amends the Small Business Act to increase maximum amounts of loans under the following Small Business Administration (SBA) loan programs: (1) the section 7(a) (general small business loans) guaranteed loan program; (2) the section 504 (state and local development company) program; and (3) the Microloan (small-scale loans to start-up, newly-established, and growing small businesses) program. Amends the American Recovery and Reinvestment Act of 2009 to extend through 2010 SBA authority to reduce or eliminate loan fees on section 7(a) and 504 loans. Amends the Small Business Investment Act of 1958 to apply single-business investment limits to SBA-recognized new markets venture capital companies. Directs the SBA Administrator to establish for prospective borrowers an alternative small business size standard that uses maximum tangible net worth and average net income as an alternative to the use of industry standards. Expresses the sense of Congress that the Administrator should establish a website that: (1) lists SBA lenders and provides loan rate information; and (2) allows prospective borrowers to compare rates on SBA-guaranteed loans. Amends provisions of the Small Business Investment Act of 1958 relating to the local development business loan program to allow a small business borrower under such program to refinance a previous business debt: (1) that was incurred no less than two years before application for the SBA loan; (2) that is a commercial loan; (3) that is not guaranteed by a federal agency; (4) the proceeds of which were used to acquire a fixed asset for the benefit of the small business; (5) that is collateralized by fixed assets; and (6) for which the borrower has been current on all payments for at least one year. Allows the Administrator to provide financing under such program for a borrower that meets certain job creation or retention goals. Provides an alternate job retention goal for which a borrower may qualify.

New Deal for a New Economy Act - Directs the Secretary of the Treasury, from unobligated funds under the Emergency Economic Stabilization Act of 2008 (EESA), to make specified sums available for FY2010-FY2012 to the Secretary of Education, the Attorney General, the Secretary of Homeland Security (DHS), and the Secretaries of Commerce, Labor, the Interior, and Agriculture. Requires: (1) the Secretary of Education to allocate, and each eligible local educational agency in the state to receive, funds in proportion to amounts received under the Elementary and Secondary Education Act of 1965; and (2) a state to make and distribute the amount allocated to it within 90 days of receipt. Authorizes the use of funds to hire new employees, rehire employees laid off during the year prior to enactment, continue to employ employees scheduled to be laid off as a result of reduced budgets, and prevent furloughs scheduled as a result of reduced budgets. Directs: (1) the Attorney General to award grants to state, local, or tribal law enforcement agencies through the Community Oriented Policing Services (COPS) program to hire, rehire, continue to employ, and prevent furloughs of police officers; (2) the Secretary of DHS, through the Administrator of the United States Fire Administration, to award grants through the Staffing for Adequate Fire and Emergency Response (SAFER) grant program to hire, rehire, continue to employ, and prevent furloughs of firefighters; (3) the Secretary of Commerce to award grants to states, cities or other political subdivisions or a consortium of such subdivisions, or Indian tribes, to assist in maintaining basic government services; and (4) the Secretaries of the Interior and Agriculture to fund specific public works projects in national parks and through the National Forest Service, respectively. Establishes in the Department of Labor a New Economy Grant Program, to provide grants for the creation of new jobs on specific public works projects. Limits funding under this Act's Departments of Labor, the Interior, and Agriculture programs to individuals who meet specified criteria. Bars displacement of existing employees. Sets forth requirements regarding the use of funds, the maximum employment period, wages, reporting, and expedited administration.

Restoring America's Commitment to Consumers Act of 2009 - Amends the Truth in Lending Act to prohibit the annual percentage rate (APR) applicable to an extension of credit on a credit card account under an open end consumer credit plan from exceeding 16%. Includes in an APR any compensation fee (including a membership fee or an annual fee) for: (1) opening or maintaining the account; (2) granting an extension of credit; or (3) making available a line of credit. Authorizes the Board of Governors of the Federal Reserve System to make adjustments to the maximum APR limitation; but creates the presumption that any increase by the Board to the maximum limitation is not in the public interest unless severe economic conditions justify the increase. Prohibits construction of this Act as an endorsement by Congress of a 16% APR. Declares the intention of Congress that: (1) such maximum APR limitation should merely serve as a ceiling on consumer credit cards and few, if any, consumer credit card accounts would ever bear the maximum rate; and (2) consumer credit card issuers should strive to maintain APRs most advantageous to borrowers. Treats as an unfair or deceptive act or practice a credit card account which, as of December 11, 2009, bears an APR that is less than 16%, and subsequently increases it between December 11, 2009, and 60 days after enactment of this Act. Imposes a $15 cap upon certain credit card account fees, including fees (such as late fees, overdraft fees, or over-the-limit transaction fees) for borrower default or breach of any condition upon which credit was extended.

Let Wall Street Pay for the Restoration of Main Street Act of 2009 - Amends the Internal Revenue Code to impose an excise tax on certain securities transactions, including transactions in stocks, futures, swaps, credit default swaps, and options. Exempts transactions for securities held in tax-exempt retirement accounts, health savings accounts, educational accounts, and regulated investment companies. Allows the purchaser of securities a credit against the excise tax for the lesser of the tax incurred or $250 ($500 for married couples filing joint tax returns). Requires withholding of excise tax amounts by the transferor of securities subject to the tax. Requires one-half of the tax revenues raised by this Act to be held in a separate Job Creation Reserve account to offset additional costs from the Surface Transportation Authorization Act of 2009 and subsequent legislation to fund job creation. Expresses the sense of Congress that one-half of the tax revenues raised by this Act shall be used to reduce the federal deficit.

Green Infrastructure for Clean Water Act of 2009 - Requires the Administrator of the Environmental Protection Agency (EPA) to make competitive grants to eligible higher education institutions and research institutions to establish and maintain between three and five centers of excellence for green infrastructure. Defines "green infrastructure" as a stormwater management technique that preserves, restores, enhances, or mimics natural hydrology. Establishes the duties of each center, including: (1) researching green infrastructure; (2) developing manuals and setting industry standards on best management practices relating to state, local, and commercial green infrastructure; (3) providing information about its research and manuals to the national electronic clearinghouse center; (4) providing technical assistance and training on green infrastructure; and (5) evaluating regulatory and policy issues about green infrastructure. Requires one of the centers to be designated as the national electronic clearinghouse center, which shall, in addition to its other duties, operate a website and a public database on green infrastructure. Requires the Administrator to make competitive grants to eligible entities that manage stormwater, water resources, or waste water resources to: (1) plan and design and install green infrastructure projects; (2) develop standards and revisions to local zoning, building, or other local codes necessary to accommodate such projects; (3) develop fee structures to provide financial support for green infrastructure; (4) develop training and educational materials about green infrastructure; (5) develop and implement a green infrastructure portfolio standard program; (6) monitor and evaluate the environmental, economic, or social benefits of green infrastructure; and (7) implement a best practices standard for a green infrastructure program. Requires the Administrator to give priority to applications from: (1) a community that has combined storm and sanitary sewers in its collection system or is low-income or disadvantaged; or (2) an eligible entity that will use 10% of the grant for a low-income or disadvantaged community. Requires the Administrator to: (1) establish within EPA's Office of Water a green infrastructure program to coordinate and promote the use of green infrastructure and to integrate green infrastructure into the permitting programs; (2) direct each EPA regional office to develop a program to promote and integrate the use of green infrastructure within the region; (3) create a green infrastructure compliance assistance center; and (4) establish measurable goals, to be known as the green infrastructure portfolio standard, to increase the percentage of annual water managed by eligible entities that uses green infrastructure.

Establishing a Network of Health-Advancing National Centers of Excellence for Depression Act of 2009 or the ENHANCED Act of 2009 - Amends the Public Health Service Act to direct the Secretary of Health and Human Services (HHS), acting through the Administrator of the Health Resources and Services Administration, to award grants on a competitive basis to institutions of higher education or public or private nonprofit research institutions to establish national centers of excellence for depression to engage in activities related to the treatment of depressive disorders. Lists priority criteria for grant recipients, including location in a geographic area with disproportionate numbers of underserved and at-risk populations in medically underserved areas and health professional shortage areas. Directs the Secretary to allocate appropriated funds so that up to 30 centers may be established by September 30, 2016. Authorizes the the Secretary to select centers to specialize in: (1) subspecialties such as prepartum and postpartum depression, traumatic stress disorder, suicidal tendency, bipolar disorder, and depression; and (2) providing mental health services to communities with problems of access. Sets forth required activities of such centers, including to: (1) integrate basic, clinical, or health services interdisciplinary research and practice in the development of evidence-based interventions; (2) provide training and technical assistance to mental health professionals, facilitate the communication of research findings and depressive disorder-related information to the public, and provide education about depressive disorders; (3) collaborate to develop and implement treatment standards, clinical guidelines, and protocols to improve the accuracy and timeliness of diagnosis of depressive disorders and treatment standards that emphasize early intervention and treatment for, prevention of, and recovery from depressive disorders; (4) incorporate principles of chronic care coordination and integration of services that address physical, mental, and social conditions in the treatment of depressive disorders; and (5) demonstrate effective use of a public-private partnership to foster collaborations among centers and community-based organizations and social and human services providers. Requires the Secretary to designate one grant recipient as a coordinating center, which shall establish and maintain a national, publicly available database to improve prevention programs, evidence-based interventions, and disease management programs for depressive disorders. Directs the Secretary, through the Administrator, to: (1) establish performance standards; and (2) issue a report card for each center to the coordinating center and periodically to Congress. Urges that the knowledge and research developed by the centers be disseminated broadly within the medical community and the federal government.

Patient Health and Real Medication Access Cost Savings Act of 2009 or the PHARMACY Bill - Declares that a consumer shall have the right to choose to purchase prescription drugs from any domestic pharmacy that meets all applicable federal and state license and permit requirements. Directs the Secretary of Health and Human Services (HHS) to issue regulations that: (1) prohibit a pharmacy benefit manager (PBM) from providing incentives to, encouraging, or requiring pharmacy benefit plan enrollees to use certain pharmacies or from excluding an eligible pharmacy from a plan's pharmacy network; (2) require a PBM to ensure that pharmacy benefit plan enrollees pay a specified copayment for brand name drugs; (3) require a PBM to reimburse a pharmacy in the network of a pharmacy benefit plan that is federally funded, at specified rates, for brand-name drugs, generic drugs, and additional professional services; (4) require a PBM to be reimbursed by a pharmacy benefit plan sponsor for adjudicating and processing claims; (5) limit the amount that a PBM charges a pharmacy benefit plan sponsor for a drug that is dispensed to enrollees to the amount the PBM paid the pharmacy for such drug; (6) require a manufacturer of prescription drugs to pay all rebates directly to the pharmacy benefit plan sponsor and not to a PBM; and (7) require a pharmacy benefit plan sponsor to provide a list of the wholesale acquisition costs of the top 500 most frequently prescribed drugs to physicians in a plan any insurance-related charge of which is underwritten by a federal, state, or local government. Amends title XVIII (Medicare) of the Social Security Act to include pharmacist services as "medical and other health services" under Medicare. Directs the Secretary, by January 1, 2011, to establish a pharmaceutical access program to provide affordable prescription drugs to individuals who receive drug benefits under federal programs (except Medicaid). Requires: (1) a pharmacy that dispenses prescription drugs in the United States to remit to the Secretary 50 cents for each brand name prescription and $1.00 for generic drug prescription dispensed; and (2) the sponsor of a pharmacy benefit plan that is not federally funded to increase the professional dispensing fee paid to pharmacies by the same amounts. Requires the use of funds generated from such fees to provide affordable access to prescription drugs to low-income individuals who have enrolled in the program.

Allots implementation grants to states on the basis of each state's share of disadvantaged students. Requires the Secretary to: (1) perform a five-year national evaluation of the implementation and effect of the literacy initiatives supported by this Act; and (2) provide technical assistance and information on literacy instruction to educational entities. Authorizes the Secretary to withhold this Act's funding from states and subgrantees, and states to withhold funding from subgrantees, whose initiatives are not making significant progress in improving student literacy.
