Clean Diamonds Act

Clean Diamonds Act - Prohibits the importation of rough diamonds into the United States unless the exporting country is implementing: (1) a system of controls on the export or import of rough diamonds that meets specified requirements, consistent with United Nations General Assembly Resolution 55/56 adopted on December 1, 2000, or consistent with an international agreement which requires such controls and to which the United States is a party; or (2) a system of controls that is functionally equivalent. Prohibits the importation of polished diamonds (including jewelry containing diamonds) into the United States unless the exporting country: (1) is implementing a system of controls on the export and import of rough diamonds, except such system shall not be required for countries that do not import rough diamonds; and (2) requires that its own imports of diamonds originate from countries that have implemented a system of controls on the export and import of rough diamonds. Prohibits the Overseas Private Investment Corporation and the Export-Import Bank of the United States from engaging in certain transactions in connection with a project involving the mining, polishing or other processing, or sale of diamonds in a country that fails to meet the requirements of this Act. Provides a waiver for the requirements of this Act. Urges the President to negotiate an international agreement to eliminate trade in diamonds used to support conflict in the country or regions in which such diamonds are mined.

Hydrogen Future Act of 2001 - Amends the Spark M. Matsunaga Hydrogen Research, Development, and Demonstration Act of 1990 to include among its purposes the development of a hydrogen production methodology that minimizes greenhouse gas production, and the promotion of hydrogen as a major energy source. Instructs the Secretary of Energy to: (1) report annually to Congress on programs and activities authorized under the Act; (2) give particular attention to developing an understanding and resolution of critical technical issues preventing the introduction of hydrogen into foreign markets, particularly where an energy infrastructure is not well developed; (3) require a cost-share commitment from non-Federal sources of at least 25 percent (currently 50 percent) of the cost of a hydrogen research project (with Secretarial discretion to reduce or eliminate such cost-share commitment, including the cost-share commitment for critical technology demonstrations). Directs the Secretary to conduct a hydrogen technology transfer program designed to accelerate wider application in foreign countries to increase the global market for hydrogen technologies and to foster global economic development without harmful environmental effects. Modifies guidelines for the Hydrogen Technical Advisory Panel to require: (1) between nine and 15 members; and (2) staggered three-year terms. Amends the Hydrogen Future Act of 1996, with respect to the integration of fuel cells with hydrogen production systems, to: (1) revise the general requirement for proposed projects to specify that they shall prove the feasibility of integrating fuel cells into Federal, State, and local government facilities for stationary and transportation applications; and (2) direct the Secretary to establish an interagency task force to develop an implementation plan that focuses upon development and demonstration of integrated systems and components for specified hydrogen-based production and uses.

Patient Abuse Prevention Act - Amends titles XVIII (Medicare) and XIX (Medicaid) of the Social Security Act (SSA) to establish programs to prevent abuse of recipients of home health or of long-term care services in skilled nursing facilities (SNFs) or other long-term care facilities under the Medicare and Medicaid programs, including background checks on workers and a hiring ban on abusive workers. Prescribes criminal and civil penalties for violation of this Act. Requires State Medicare and Medicaid registries to collect information about nursing facility employees other than nurse aides. Amends SSA title XI to include abusive long-term care facility employees in the national health care fraud and abuse data collection program database. Includes SNFs, certain other nursing facilities, home health agencies, hospices, intermediate care facilities for the mentally retarded, and providers of home health or long-term care services as long-term care facilities. Directs the Secretary of Health and Human Services to establish a demonstration program to provide grants to develop information on best practices in patient abuse prevention training for managers and staff of hospital and health care facilities.

Rural Health Care Improvement Act of 2001 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to provide for: (1) payment adjustment for low-volume hospitals; (2) revision in the Medicare disproportionate share hospital (DSH) payment adjustment for rural hospitals equalizing DSH payment amounts; (3) a single, standardized amount under the Medicare inpatient hospital prospective payment system (PPS); (4) treatment of certain physician pathology services; and (5) one-time opportunity of critical access hospitals to return to the Medicare inpatient hospital PPS. Amends the Public Health Service Act (PHSA) to establish: (1) a capital infrastructure revolving loan program under which the Secretary of Health and Human Services may make described loans to any rural entity for projects for capital improvements from the loan and loan guarantee fund under PHSA; (2) a high technology acquisition grant and loan program under which the Secretary may award grants and make loans to any eligible entity for any costs incurred by the entity in acquiring eligible equipment and services for improving the quality of health care in rural areas; and (3) a program of grants to eligible entities under which the Secretary shall award such grants to public or nonprofit private entities to establish telehealth resource centers for the health care needs of individuals in rural areas. Amends SSA title XVIII concerning: (1) rural health clinics and Medicare reimbursement; and (2) exclusion of certain rural health clinic services and federally qualified health center services from the Medicare PPS for skilled nursing facilities.

Start Healthy, Stay Healthy Act of 2001 - Amends title XIX (Medicaid) of the Social Security Act (SSA) to provide for an enhanced Federal Medicaid medical assistance percentage for States that elect to continuously enroll infants during the first year of life without regard to the child's membership in the woman's household or the mother's eligibility status. Amends SSA title XXI (State Children's Health Insurance Program) (SCHIP) to permit a State child health plan, implemented under either SCHIP or Medicaid, to provide for coverage of pregnancy-related assistance for targeted low-income pregnant women under specified conditions. Provides for SCHIP and Medicaid coordination with SSA title V (Maternal and Child Health Services). Increases the SCHIP income eligibility level with respect to a low-income child. Amends: (1) SSA title XIX to provide for an enhanced Federal Medicaid medical assistance percentage for increased expenditures for medical assistance for children; (2) SSA title XXI to increase SCHIP appropriations; and (3) SSA titles XIX and XXI to permit a State to elect to provide Medicaid and SCHIP coverage of children age 20 or 21.

Bridges to the Cuban People Act of 2001 - Exempts from the embargo on trade with Cuba (including prohibitions under the Cuban Democracy Act of 1992 against the unloading at a U.S. port of vessels that previously entered a Cuban port to engage in trade) the export of any agricultural commodity, farm machinery or equipment, medicine, or medical device, or any travel incident to the delivery of such items. Prohibits the President from prohibiting or regulating travel to or from or within Cuba by U.S. nationals or lawful resident aliens, including specified transactions ordinarily incident to such travel, financial or otherwise. Authorizes the President to provide scholarships for Cuban nationals who seek to undertake graduate study in public health, public policy, economics, law, or other field of social science. Authorizes the President to waive certain sanctions against, and restrictions on assistance to, Cuba, including the exclusion from the United States of certain aliens who have confiscated property in Cuba of U.S. nationals or who traffics in such property, if he determines that it will promote the peaceful transition to democracy in Cuba or will further U.S. national economic interests. Prohibits the Secretary of the Treasury from limiting the amount of remittances to Cuba that any U.S. person may make. Exempts from prohibitions or restrictions on trade with Cuba the import of certain drugs, biological products, and medical devices into the United States. Prohibits the use of funds to enforce unilateral sanctions on the export of goods and services intended for the exclusive use of children in Cuba.

Dental Health Improvement Act - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services (HHS) to award grants to States to help them develop and implement innovative programs to address the dental workforce needs of designated dental health professional shortage areas in a manner appropriate to the State's individual needs. Defines "designated dental health professional shortage area" to mean an area, population group, or facility that is designated by the Secretary as a dental health professional shortage area or designated by a State as having a dental health manpower shortage. Sets forth certain grant requirements. Directs the Secretary to develop and implement a plan for increasing the participation of dentists and dental hygienists in the National Health Service Corps' scholarship and loan repayment programs. Revises scholarship and loan repayment program requirements to allow periods of obligated service (period of time that a recipient must serve in a health professional shortage area in order to receive a scholarship or loan) to be served and fulfilled on a part-time basis if certain conditions are met. Sets forth requirements with respect to the dental health professional shortage area designation process.

Medicare Wellness Act of 2001 - Establishes within the Department of Health and Human Services a Working Group on Disease Self-Management and Health Promotion (Working Group) to establish policies and criteria for the Secretary of Health and Human Services to make grants to approved applicants to study specified approaches to further health promotion and disease prevention among Medicare beneficiaries under title XVIII of the Social Security Act (SSA). Directs the Secretary to conduct demonstration projects to promote disease self-management for conditions identified by the Working Group for target individuals. Amends SSA title XVIII to outline Medicare coverage of various specified preventive services, including: (1) therapy and counseling for cessation of tobacco use, and counseling for post-menopausal women; (2) screening for diminished visual acuity, and screening for hypertension; and (3) medical nutrition therapy services for Medicare beneficiaries with cardiovascular diseases, diabetes, or a renal disease. Permits waiver of coinsurance and deductibles for certain preventive services, such as: (1) diabetes outpatient self-management training services; (2) colorectal and prostate cancer screening tests; and (3) bone mass measurement. Directs the Secretary to: (1) integrate supplemental preventive health services with existing program integrity measures; and (2) conduct specified activities, including annual notices to Medicare beneficiaries, to promote use of preventive health benefits, items, and services. Directs the Director of the Centers for Disease Control and Prevention to conduct a national falls prevention and awareness campaign among Medicare beneficiaries. Prescribes requirements for clinical depression screening demonstration projects. Amends SSA title XVIII to direct the Secretary to establish a health education and risk appraisal program. Provides for fast-track consideration of prevention benefit legislation in Congress.

Public Safety Employer-Employee Cooperation Act of 2001 - Provides collective bargaining rights for public safety officers employed by States or local governments. Directs the Federal Labor Relations Authority (FLRA) to determine whether State law provides specified rights and responsibilities for public safety officers, including: (1) granting public safety employees the right to form and join a labor organization which excludes management and supervisory employees, and which is, or seeks to be, recognized as the exclusive bargaining agent for such employees; and (2) requiring public safety employers to recognize and agree to bargain with the employees' labor organization. Requires the FLRA to issue regulations establishing collective bargaining procedures for public safety employers and employees in States that do not substantially provide for such rights and responsibilities. Directs the FLRA, in such cases, to: (1) determine the appropriateness of units for labor organization representation; (2) supervise or conduct elections to determine whether a labor organization has been selected as an exclusive representative by a majority of the employees in an appropriate unit; (3) resolve issues relating to the duty to bargain in good faith; (4) conduct hearings and resolve complaints of unfair labor practices; and (5) resolve exceptions to arbitrator's awards. Grants a public safety employer, employee, or labor organization the right to seek enforcement of such FLRA regulations and authority through appropriate State courts. Prohibits public safety employers, employees, and labor organizations from engaging in lockouts or strikes, or sickouts, work slowdowns, or other actions designed to compel agreement to a proposed contract which will measurably disrupt the delivery of emergency services.

Helping Our Professionals Educationally (HOPE) Act of 2001 - Authorizes the Secretary of each military department to permit a member who is entitled to basic educational assistance under the Veterans Educational Assistance Program (VEAP), has served at least six years, has a critical military skill or is in a military specialty designated as critical, and agrees to serve at least four more years to transfer such assistance to one or more dependents. Allows up to 18 months of entitlement to be transferred. Prohibits a spouse from using such assistance until the transferor has completed six years of service. Prohibits a child from using such assistance until the transferor has completed ten years of service and the child has completed secondary school requirements or is 18 years of age. Authorizes a VEAP-entitled individual to elect to receive an accelerated lump-sum payment of basic educational assistance, under specified conditions. Makes Montgomery GI Bill benefits available for training which leads to licensing or certification in technological occupations. Makes members who continue in the Selected Reserve beyond the ten-year period required for entitlement to educational assistance eligible for such assistance for five years after separation from such service (unless such separation is under other than honorable conditions).

Providing Reliable Officers, Technology, Education, Community Prosecutors, and Training In Our Neighborhoods Act of 2001 or PROTECTION Act - Modifies provisions of the Omnibus Crime Control and Safe Streets Act of 1968 regarding public safety and community policing ("cops on the beat" program, COPS) to authorize the Attorney General to use funding under COPS grants to: (1) increase prosecutor presence and to enhance law enforcement access to new technologies; (2) pay overtime to existing career law enforcement officers to the extent that such overtime is devoted to community policing efforts; and (3) promote higher education among in-service State and local law enforcement officers by reimbursing them for the costs associated with seeking a college or graduate school education. Includes among permitted additional grant projects: (1) specialized integrity and ethics training; and (2) innovative proactive crime control and prevention programs involving school officials and religiously-affiliated organizations. Authorizes the Attorney General to use up to five percent of appropriated funds for technical assistance and training to States, local governments, Indian tribal governments, and other public and private entities. Repeals provisions of the Act regarding termination of grants for hiring officers. Allows grants to be used to assist: (1) police departments in employing specified professional, scientific, and technological advancements; and (2) State, local, or tribal prosecutors' offices in implementation of community-based prosecution programs that build on local community policing efforts. Reserves specified funds for units of local government with a population of less than 50,000. Authorizes the Attorney General to use no more than 50 percent of grant renewal funds to award grants targeted specifically for retention of police officers.

Amends the IRC to establish a limited tax credit for qualified tribal school modernization bonds.

Tibetan Policy Act of 2001 - Sets forth congressional declarations, including that it: (1) reaffirms that Tibet is an occupied country under the established principles of international law; (2) commends the Republic of India and the kingdom of Nepal for providing asylum and humanitarian care to the Dalai Lama and Tibetans in exile; (3) expresses concern over incidents of ill treatment of transitory Tibetans in border areas; and (4) urges continued cooperation with the Office of the United Nations High Commissioner for Refugees in Kathmandu. Expresses the sense of Congress that the President and the Secretary of State (as well as U.S. and European parliamentarians in the United States-European Interparliamentary Group) should initiate steps to encourage the Government of the People's Republic of China to enter into negotiations with the Dalai Lama or his representatives leading to an agreement on Tibet. Establishes within the Department of State a United States Special Coordinator for Tibetan Issues who shall promote substantive dialogue between the Government of China and the Dalai Lama or his representatives. Directs the U.S. executive director of each international financial institution to encourage and use the U.S. vote to support projects in Tibet consistent with specified principles. Directs the Export-Import Bank of the United States, the Overseas Private Investment Corporation, and the Trade and Development Agency similarly to support projects in Tibet consistent with such principles. Amends the Federal Food, Drug, and Cosmetic Act to: (1) eliminate the user fee waiver for pediatric supplements to a human drug application; (2) provide priority status for pediatric supplements; (3) include neonates within the definition of pediatric studies; (4) provide for dissemination of pediatric supplement information; and (5) set forth requirements for the additional six-month exclusivity period for new or already-marketed pediatric drugs. Directs the Secretary to establish an Office of Pediatric Therapeutics within the Office of the Commissioner of Food and Drugs, which shall coordinate all FDA pediatric activities.

Provides for the Office of Information and Regulatory Affairs to retain information collection review functions. Establishes a Chief Information Officers Council as the principal interagency forum for improving agency practices related to the development, use, operation, and performance of Government information resources. Establishes in the Treasury an E-Government Fund to be used to fund interagency information technology projects and other innovative uses of information technology. Requires each executive agency to: (1) comply with standards established by the CIO and support the CIO's efforts to develop and maintain an integrated Internet-based system of delivering Government information and services to the public; (2) ensure compatibility of its methods for use and acceptance of electronic signatures; (3) publish an online agency directory; (4) establish a website and post all information required to be published on regulatory proceedings and electronic dockets for rulemakings; and (5) conduct a privacy impact assessment before developing or procuring an information system or initiating a new collection of personally identifiable information that will be processed electronically. Requires establishment of: (1) an online Federal telephone directory; (2) an online National Library; and (3) individual Federal court websites. Requires the CIO to: (1) study the feasibility of integrating Federal information systems across agencies; (2) convene an interagency task force to develop recommendations on standards for the collection and dissemination of essential information about federally funded research and development databases that address public availability and agency coordination and collaboration; (3) establish guidelines for privacy notices on agency websites; and (4) promulgate standards and criteria for agency websites. Requires the Secretary of the Interior to facilitate the development of common protocols for geographic information systems. Provides for the use of the share-in-savings contracting approach for information technology projects. Requires studies on: (1) using information technology to enhance crisis response and consequence management of natural and manmade disasters; (2) best practices of federally funded community technology centers; and (3) disparities in Internet access across various demographic distributions. Provides for establishment of: (1) a Federal Information Technology Training Center; and (2) an Advisory Board on Government Information which shall recommend standards for establishing permanent public access to government information disseminated on the Internet, developing inventories of government information, and cataloguing and indexing government information. Requires the CIO and each agency to develop and post on the Internet a public domain directory of Government websites.

Requires the Secretary of the Treasury to focus electronic filing efforts on benefitting the taxpayer by: (1) reducing the time between receipt of an electronically filed return and remitting a refund; (2) reducing the cost of filing a return electronically; (3) improving services provided by the Internal Revenue Service to low and moderate income taxpayers; and (4) providing tax-related computer software at no or nominal cost to low and moderate income taxpayers. Provides for a pilot program for the creation of four mobile tax return filing offices with electronic filing capabilities.
