Farm Relief Act of 2008 - Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007 to appropriate funds for: (1) emergency financial assistance to producers on a farm that incurred qualifying natural disaster-caused quantity or quality losses for the 2008 crop; (2) certain processors in Florida for natural disaster-caused crop and other losses in 2008; (3) certain first processors of sugarcane that operate in a county affected by a natural disaster or obtain sugarcane from a county affected by a natural disaster in Louisiana; and (4) certain sugarcane growers in Texas for natural disaster-caused demurrage, storage, and transportation costs in 2008. Provides specified Commodity Credit Corporation funds for grants to state departments of agriculture for assistance to eligible catfish producers to help offset natural disaster-caused feed costs or economic losses in 2008.

Authorizes appropriations to the Secretary of the Army for levee and flood protection repairs, restoration, and improvements, critical coastal restoration projects, the dredging of affected waterways, and the beneficial use of dredged material in Louisiana. Requires the Secretary to provide such funds to the state of Louisiana on the later of: (1) a date that is 90 days after the governor of Louisiana submits a plan describing how the funds will be used; or (2) October 1, 2008.

Ratepayer Recovery Act of 2008 - Amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act to cite conditions under which the President is authorized to make disaster assistance contributions for the repair, restoration, reconstruction, or replacement of private or investor-owned power transmission and distribution facilities damaged or destroyed by a major disaster. Cites conditions for large in-lieu contributions to a private or investor-owned power facility if the owner determines that the public welfare would not best be served by repairing, restoring, reconstructing, or replacing the facility. Restricts the use of such funds to the area affected as a result of the major disaster.

Girl Scouts USA Centennial Commemorative Coin Act - Directs the Secretary of the Treasury to mint and issue up to 350,000 $1 coins in commemoration of the centennial of the Girl Scouts of the United States of America. Requires the coin design to be emblematic of such centennial. Requires such coins to be issued in uncirculated and proof qualities, from only one U.S. Mint facility. Declares the sense of Congress that such facility should be the U.S. Mint at West Point, New York, to the greatest extent possible. Authorizes the Secretary to issue such coins only during calendar 2011. Applies a $10 per coin surcharge to all coin sales. Requires all surcharges received to be paid to the Girl Scouts of the United States of America for efforts involved in marking it centennial, which may include efforts to preserve the birthplace of founder Juliette Gordon Low.

General Services Administration Portfolio Enhancement Act of 2008 - Directs the Administrator of General Services (GSA) to convey to the National Women's History Museum, Inc. (the Museum) the northern part of specified property in the District of Columbia, which the Administrator and the Museum deem appropriate for a museum facility. Grants the Administrator the authority to convey the southern part of such property to the Museum. Requires the Administrator to enter into an agreement with the Museum for the conveyance. Permits separate conveyance of the northern and southern parts. Requires the northern part to be dedicated for use as a site for a national women's history museum for a 99-year period and allows the southern part to be used for any purposes permitted by applicable laws and regulations.

Veterans Health Care Budget Reform Act of 2008 - Requires, beginning with FY2010, a two-fiscal-year budget authority for the following accounts of the Department of Veterans Affairs (VA): (1) Medical Services; (2) Medical Administration; and (3) Medical Facilities. Requires the Comptroller General to conduct a study on the adequacy and accuracy of VA baseline model projections for health care expenditures.

Declares that the federal government has a responsibility to: (1) raise awareness about prostate cancer screening and treatment; (2) increase funding for prostate cancer research; and (3) improve access to, and the quality of, health care services for detecting and treating prostate cancer.

Resource Family Recruitment and Retention Act of 2008 - Amends part E (Foster Care and Adoption Assistance) of title IV of the Social Security Act (SSA) with respect to the requirement that state foster care and adoption assistance plans require development of standards to ensure that children in foster care placements in public or private agencies receive quality services that protect their safety and health. Requires such standards to require each public and private placement agency, subject to renewal of its license or other state approval, to certify annually to the state that it provides foster parents with specified services and information. Numbers among such services and information: (1) notifications of scheduled meetings to allow foster parents the opportunity to participate actively in the case planning and decision-making regarding placement of a child in their home; (2) support services to assist with care of the child; (3) information about the child's medical history, educational history, general behaviors, life experiences, the placement circumstances of the child, and the relationship between the child and his or her parents; (4) timely and complete information about all permanency options available to the child; and (5) assistance with the coordination of services for dealing with family loss and separation when a child leaves the foster home. Amends SSA title IV part B (Child and Family Services) to direct the Secretary of Health and Human Services to award grants to eligible states for innovative programs to empower, provide leadership for, and improve the recruitment, support, training, and retention of foster care, kinship care, and adoptive parents.

Recognizes September 11, 2008, as a day of solemn commemoration of the events of September 11, 2001. Offers condolences to the families, friends, and loved ones of the innocent victims of the September 11, 2001, terrorist attacks. Honors the heroic service, actions, and sacrifices of first responders, law enforcement personnel, state and local officials, volunteers, and others who aided the victims and, in doing so, risked and often gave their own lives. Recognizes the service, actions, and sacrifices of U.S. personnel who have given so much to support our freedom and defend our security. Reaffirms that the people of the United States will never forget the challenges our country endured on and since September 11, 2001, and will work to defeat those who attacked us.

Authorizes the Secretary of Homeland Security or the Attorney General to adjust to permanent resident status certain alien family members of specified Armed Forces members or veterans who are serving or have served honorably on or after October 7, 2001, in the National Guard, the Selected Reserve of the Ready Reserve, or in active-duty status.

Cane River National Heritage Area Reauthorization Act of 2008 - Amends the Cane River Creole National Historical Park and National Heritage Area Act to: (1) revise the boundaries of the Cane River National Heritage Area, Louisiana; (2) revise the duties of the Cane River National Heritage Area Commission; and (3) terminate such Commission on August 5, 2025 (under current law, on the day occurring 10 years after the first official meeting of the Commission).

Prohibits the use of any funds made available under any Act making appropriations for FY2008 or FY2009 to establish a national monument or otherwise convey protected status to any area in the marine environment of the Exclusive Economic Zone of the United States. Authorizes the Secretary of Commerce to submit to Congress a study of the proposed protected area.

Lower Mississippi River National Historic Site Act of 2008 - Directs the Secretary of the Interior, through the Director of the National Park Service (NPS), to complete a special resource study that evaluates the national significance of the Lower Mississippi River area in Louisiana and the suitability and feasibility of designating such area as a unit of the National Park System, which shall be known as the "Lower Mississippi River National Park."

ADA Amendments Act of 2008 - Amends the Americans with Disabilities Act of 1990 (ADA) to redefine the term "disability," including by defining "major life activities" and "being regarded as having such an impairment." Sets forth rules of construction regarding the definition of "disability," including that: (1) such term shall be construed in favor of broad coverage of individuals under the Act; (2) an impairment that substantially limits one major life activity need not limit other major life activities in order to be a disability; (3) an impairment that is episodic or in remission is a disability if it would substantially limit a major life activity when active; and (4) the determination of whether an impairment substantially limits a major life activity shall be made without regard to the ameliorative effects of specified mitigating measures. Prohibits employment discrimination against a qualified individual on the basis of disability. (Current law prohibits employment discrimination against a qualified individual with a disability because of the disability.) Prohibits the use of qualification standards, employment tests, or other selection criteria based on an individual's uncorrected vision unless the standard, test, or other selection criteria, as used by the covered entity, is shown to be related to the position and is consistent with business necessity. Declares that nothing in the Act: (1) alters the standards for determining eligibility for benefits under state worker's compensation laws or under state and federal disability benefit programs; (2) alters the requirement to make reasonable modifications in policies or procedures, unless such modifications would fundamentally alter the nature of the goods, services, facilities, or accommodations involved; or (3) provides the basis for a claim by an individual without a disability that the individual was subject to discrimination because of the individual's lack of disability. Declares that the authority of the Equal Employment Opportunity Commission (EEOC), the Attorney General, and the Secretary of Transportation to issue regulations includes the authority to issue regulations implementing the definitions of this Act. Makes conforming amendments to the Rehabilitation Act of 1973.

Timber Revitalization and Economic Enhancement Act II of 2008 - Amends the Internal Revenue Code to make permanent: (1) the reduction in the rate of tax on the net timber gain of corporations; and (2) rules for the treatment of timber real estate investment trust (REIT) gains, mineral royalty income, and prohibited transactions.

First Responders Support Act of 2008 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to: (1) increase death and disability benefits for public safety officers; and (2) expand educational benefits for dependents of public safety officers killed or disabled in the line of duty. Amends the Internal Revenue Code to allow a tax credit for up to $7,500 of the medical expenses paid or incurred by a public safety officer or a family member for injuries sustained while such officer was performing an official duty. Authorizes the Director of the Bureau of Justice Assistance to award grants for mental health services or counseling to public safety officers seriously injured in the line of duty and the family members of such officers who are killed or seriously injured in the line of duty.

Expresses continued support and sympathy for the hundreds of thousands of civilians of Sudan, Chad, and the Central African Republic who have been affected by the ongoing violence and regional instability. Urges: (1) the United Nations, the African Union, and other international leaders to use the unique opportunity presented by the Olympics to promote peace, dialogue, and reconciliation in areas of conflict; (2) the government of China to press the Sudanese government to commit to a cessation of hostilities, allow the full deployment of UNAMID peacekeeping forces, and engage in good faith in efforts to rejuvenate peace talks; (3) the government of Sudan and other armed actors in the region to cease hostilities; (3) the President and the international community to ensure that mediation efforts are supported and backed by credible leverage through targeted pressure and an enforced arms embargo; and (4) the United Nations and the African Union to use the opportunity presented by a cessation of hostilities to fully deploy and equip UNAMID as well as strengthen the UN Mission in Sudan to better monitor the Abyei region. Welcomes the efforts of the new joint African Union-United Nations mediator, Mr. Djibril Bassole, to revive a comprehensive peace process, demobilize militias, and promote voluntary return of internally displaced persons and refugees. Encourages the UN Secretary-General and other international leaders to publicly promote the principles reflected in the Olympic Truce among all the warring parties in Sudan, Chad, the Central African Republic, and other conflict areas around the world.

National Infantry Museum and Soldier Center Commemorative Coin Act of 2008 - Directs the Secretary of the Treasury to mint and issue $1 coins emblematic of the courage, pride, sacrifice, sense of duty, and history of the U.S. Infantry, in commemoration of the legacy of the U.S. Army Infantry and the establishment of the National Infantry Museum and Soldier Center. Expresses the sense of Congress that the coins should be struck at the U.S. Mint at West Point, New York, to the greatest extent possible. Restricts coin issuance to calendar year 2012. Requires a $10 surcharge per coin, and payment of all surcharges received to the National Infantry Foundation to establish an endowment to support the maintenance of the National Infantry Museum and Soldier Center.

SBIR/STTR Reauthorization Act of 2008 - Amends the Small Business Act with respect to: (1) authorization of the Small Business Innovation Research (SBIR) program and the Small Business Technology Transfer (STTR) program; (2) a Small Business Administration (SBA) Office of Technology; (3) set-asides and award levels; (4) allowance of awards for subsequent phases at another agency and under either program; (5) phase II invitation requirements; (6) allow majority-venture investment in SBIR firms; (7) special acquisition preferences for SBIR and STTR phase III awards; (8) collaboration requirements between SBIR/STTR participants and federal laboratories and research and development centers; (9) the Federal and State Technology Partnership (FAST) and Rural Outreach programs; (10) a workforce development pilot program; (11) technical assistance expenditures for SBIR and STTR awardees; (12) extension of the commercialization pilot program of the Department of Defense (DOD); (13) creation by agencies other than DOD of innovation development transition pilot programs; (14) submission of applications for the support of nanotechnology-related projects; (15) an advisory board to assess SBIR program management and effectiveness; (16) SBIR and STTR oversight and evaluation, including data collection procedures and public and government database information requirements; (17) federal compliance with SBIR and STTR funding allocation requirements; (18) continued National Academy of Sciences evaluation of the SBIR program; (19) report information concerning SBIR and STTR phase III awards; and (20) a Government Accountability Office (GAO) study concerning intellectual property protections under SBIR and STTR programs.

Rural Small Business Enhancement Act of 2008 - Amends the Small Business Act to reduce state matching funds requirements for participation in the Federal and State Technology Partnership (FAST) and Small Business Innovation Research (SBIR) programs of the Small Business Administration (SBA). Revises the SBA's Rural Outreach program (a program to increase states' participation in the SBIR and Small Business Technology Transfer [STTR] programs) to: (1) make eligible for program awards states whose total value of SBIR and STTR contracts awarded during FY2004 was less than $10 million and will match federal funding on a 50% basis; (2) reauthorize the program for FY2009-FY2020; and (3) require award funds to be used to increase state participation in the SBIR and STTR programs. Requires a report from the SBA Administrator to the congressional small business committees on the number of government-owned computers in possession of, and recently disposed by, the SBA. Directs the Administrator to establish a pilot program to annually provide up to 1,000 excess government-owned computers to small businesses at no cost or a reduced cost. Requires the Administrator to hire at least five additional full-time employees for the SBA's Office of Technology. Directs the Administrator to carry out a rural lending outreach program to provide up to an 85% guaranty of loans of not more than $250,000.

Honors and commemorates the selfless acts of heroism displayed by the late Private First Class Jacob Joseph Chestnut and Detective John Michael Gibson of the U.S. Capitol Police on July 24, 1998. Expresses: (1) the condolences of the Senate to the wives, children, and other family members of Private First Class Chestnut and Detective Gibson on the 10-year anniversary of their passing; (2) gratitude and appreciation for the professional manner in which the U.S. Capitol Police carry out their diverse missions; and (3) appreciation for the dedication U.S. Capitol Police officers have for protecting the Capitol Complex. Commends the U.S. Capitol Police for their continued courage and professionalism in protecting the Capitol Complex and its employees and visitors.

Prohibits the Administrator of the Environmental Protection Agency (EPA), or a state with an approved National Pollutant Discharge Elimination System (NPDES) permit program under the Federal Water Pollution Control Act, from requiring an NPDES permit for a covered vessel for the next two years for any discharge: (1) of effluent from properly functioning marine engines; (2) of laundry, shower, and galley sink wastes; or (3) that is incidental to the normal operation of a covered vessel. Defines "covered vessel" to mean a vessel that is less than 79 feet in length or a fishing vessel. Requires the Administrator to evaluate the impacts of such discharges, excluding discharges: (1) from a vessel of the Armed Forces; (2) of sewage from a vessel, other than the discharge of graywater from a vessel operating on the Great Lakes; and (3) of ballast water. Provides that such prohibition does not apply with respect to: (1) rubbish, trash, garbage, or other such materials discharged overboard; (2) other discharges when the vessel is operating in a capacity other than as a means of transportation; (3) ballast water discharges; or (4) any discharge that contributes to a violation of a water quality standard or poses an unacceptable risk to human health or the environment.

Disadvantaged Business Disaster Eligibility Act of 2008 - Permits any small business that was participating in a Small Business Administration (SBA) business development program located in a Louisiana parish or Mississippi or Alabama county designated by the SBA Administrator as a disaster area by reason of Hurricane Katrina or Rita to continue participation and eligibility in such program for an additional 24 months.

Disapproves the rule submitted by the Secretary of Health and Human Services relating to requirements set forth in the State Health Official Letter 07-001, dated August 17, 2007, issued by the Director of the Center for Medicaid and State Operations in the Centers for Medicare & Medicaid Services and the State Health Official Letter 08-003, dated May 7, 2008, from such Center, requiring states that expand the income eligibility level for children under the State Children's Health Insurance Program (SCHIP) above 250% of the federal poverty level to adopt the five crowd-out strategies described in the August 17, 2007, letter and to provide certain assurances described in such letter.

Supporting America's Volunteer Emergency Services Act of 2008 - Directs the Secretary of Housing and Urban Development to determine the average annual price per gallon for gasoline and diesel fuel for each of the five Petroleum Administration for Defense Districts for 2007. Requires: (1) the average annual price per gallon to be based solely on data reported by the Energy Information Administration; and (2) that price to serve as the baseline fuel cost for each District. Requires the Secretary to reimburse a qualified volunteer fire department for 75% of the difference between: (1) the actual expenditures of the department for gasoline and diesel fuel for a year; and (2) the amount that such expenditures would have been using the baseline fuel costs. Directs each qualified volunteer fire department seeking reimbursement to submit to the Secretary at the end of each year: (1) all of its receipts and bills of sales documenting the amounts of gasoline and diesel fuel purchased during that year; and (2) a sum total of the aggregate number of gallons and the costs of gasoline and diesel fuel purchased.

Small Business Energy Emergency Relief Act of 2008 - Amends the Small Business Act to authorize the Small Business Administration to make disaster loans to assist small businesses that have suffered or are likely to suffer substantial economic injury as the result of a significant increase in the price of heating fuel occurring on or after October 1, 2007. Prohibits such loan from being made if the total amount outstanding and committed to the borrower would exceed $1.5 million, unless the borrower is a major source of employment in its surrounding area. Amends the Consolidated Farm and Rural Development Act to authorize the Secretary of Agriculture to make loans to farm operations that qualify as a small business and that have or are likely to suffer substantial economic injury on or after October 1, 2007, as the result of a significant increase in energy costs in connection with an energy emergency declared by the President or the Secretary.

Attorney-Client Privilege Protection Act of 2008 - Amends the federal criminal code to prohibit any U.S. agent or attorney, in any federal investigation or criminal or civil enforcement matter, including any form of administrative proceeding or adjudication, from: (1) demanding or requesting that an organization, or a current or former employee or agent of such organization, waive the protections of the attorney-client privilege or attorney work product doctrine; (2) offering to reward or actually rewarding an organization, or current or former employee or agent, for waiving such protections; or (3) threatening adverse treatment or penalizing an organization, or current or former employee or agent, for declining to waive those protections. Prohibits a U.S. agent or attorney in any federal investigation or criminal or civil enforcement matter, including any form of administrative proceeding or adjudication, from considering specified conduct in: (1) making a civil or criminal charging or enforcement decision relating to an organization, or one of its current or former employees or agents; or (2) determining whether an organization, or a current or former employee or agent, is cooperating with the government. Numbers among the actions a U.S. agent or attorney may not use as a charging decision condition or a cooperation-determining factor: (1) any valid assertion of the protection of the attorney-client privilege or attorney work product doctrine; (2) the provision of counsel to, or contribution to the legal defense fees or expenses of, a current or former employee or agent of an organization; (3) entry into, or existence of, a valid joint-defense, information-sharing, or common-interest agreement between an organization and a current or former employee or agent, or among its current or former employees; (4) the sharing of relevant information in anticipation of or in response to an investigation or enforcement matter between an organization and a current or former employee or agent, or among its current or former employees, unless shuch sharing is itself an offense; or (5) the failure to terminate the employment or affiliation of or otherwise sanction any employee or agent of the organization because of the employee's or agent's decision to exercise personal constitutional rights or other legal protections in response to a government request. Prohibits a U.S. agent or attorney from demanding or requesting that an organization or an affiliated person not take any such action.

Strengthening Management of Advanced Recycling Technologies Act of 2008 or the SMART Act of 2008 - Requires the Secretary of Energy to offer to enter into cooperative agreements with specified persons, municipalities, or electric utilities to: (1) develop licensing documentation and technical criteria for new recycling plants; (2) conduct specified design and engineering work on recycling technology designs; and (3) share the cost of obtaining construction and operating licenses for specified used fuel recycling facilities. Requires assistance for such agreements to be awarded only to private entities that propose to develop recycling facilities that meet specified prerequisites. Requires the Secretary to offer to enter into long-term contracts with specified persons, municipalities, or electric utilities to recycle commercial used nuclear fuel. Requires the Secretary to: (1) offer to enter into temporary agreements to store high-level radioactive waste produced by specified facilities; (2) make payments to specified local governments that have submitted notices that they are willing to have a privately owned and operated temporary used fuel storage facility located within their jurisdiction; (3) offer to enter into temporary used fuel storage facility economic impact agreements with local governments upon the docketing of license applications for such facilities by the Nuclear Regulatory Commission (NRC); and (4) offer to enter into a long-term contract for the storage of used fuel from civilian nuclear power plants with a private entity that owns or operates an independent used fuel storage facility licensed by the NRC within the jurisdiction of local governments that receive assistance. Authorizes the Secretary to settle specified claims against the Secretary for failure to dispose of high-level radioactive waste or used nuclear fuel by January 31, 1998. Requires the Secretary to: (1) provide priority for the acceptance of used nuclear fuel from a facility that has been decommissioned and shut down permanently; and (2) provide for the transportation of used fuel. Amends the Nuclear Waste Policy Act of 1982 to set a fee for electricity generated by a civilian nuclear power reactor and sold by a specified date. Changes the name of the Nuclear Waste Fund to the Nuclear Waste Revolving Fund and authorizes the Secretary to make expenditures from it for the management of used nuclear fuel. Declares that for purposes of NRC license determinations under the Atomic Energy Act of 1954 and this Act, the Secretary's obligation to develop a repository in accordance with the Nuclear Waste Policy Act of 1982 provides sufficient and independent grounds for any further NRC findings of reasonable assurances that used nuclear fuel and high-level radioactive waste would be disposed of safely and in a timely manner.

Mosquito Abatement for Safety and Health Reauthorization Act of 2008 - Amends the Public Health Service Act to include among the reasons preferences shall be given in awarding mosquito control program grants that a political subdivision or consortium of political subdivisions demonstrates to the Secretary of Health and Human Services that its control program is consistent with existing state mosquito plans or policies. Reauthorizes appropriations for FY2009-FY2013 for mosquito control programs to prevent and control mosquito-borne diseases.

Harmful Algal Blooms and Hypoxia Amendments Act of 2008 - Amends the Harmful Algal Bloom and Hypoxia Research and Control Act of 1998 to: (1) require the Secretary of Commerce, acting through the National Oceanic and Atmospheric Administration (NOAA), to establish criteria for determining which states should serve on the Inter-Agency Task Force on Harmful Algal Blooms and Hypoxia and to implement a nominations process to select representatives for such Task Force; and (2) require the Task Force's scientific assessments of hypoxia and harmful algal blooms (hypoxia) once (currently, every five years). Requires: (1) the President, acting through the Task Force, to establish a national program to integrate efforts to address hypoxia research, monitoring, prediction, control, mitigation, prevention, and outreach; (2) the Task Force to be the oversight body for the development and implementation of the National Harmful Algal Bloom and Hypoxia Program; and (3) NOAA to be the lead federal agency for implementing and administering such Program. Sets forth the Program's responsibilities and duties, including: (1) promoting a national strategy to help communities understand, detect, predict, control, and mitigate freshwater and marine hypoxia events; (2) maintaining and enhancing the Ecology and Oceanography of Harmful Algal Blooms Program, the Monitoring and Event Response for Harmful Algal Blooms Program, the Northern Gulf of Mexico Ecosystems and Hypoxia Assessment Program, and the Coastal Hypoxia Research Program; and (3) establishing a Mitigation and Control of Harmful Algal Bloom Program. Requires the national hypoxia program to: (1) oversee the development and implementation of Regional Research and Action Plans and identify regions and sub-regions to be addressed by each Plan; and (2) convene regional panels of experts. Requires each panel to develop a Plan that identifies appropriate elements for the region, including: (1) priorities for ecological and socioeconomic research on issues related to, and impacts of, hypoxia; and (2) state and local government actions that may be implemented to monitor, minimize, reduce, and address hypoxia. Requires the Task Force to report to specified congressional committees not less than every five years on hypoxia. Requires: (1) the Secretary, acting through NOAA, to establish a collaborative pilot program with the Environmental Protection Agency (EPA) and other federal agencies to examine hypoxia occurring in freshwater systems; and (2) such program to be located in the Mississippi River Basin watershed.

Capture Arrest and Transport Charged Fugitives Act of 2008 - Amends the Presidential Threat Protection Act of 2000 to authorize appropriations through FY2015 for establishing new Regional Fugitive Task Forces and for hiring criminal investigators and providing training for such Task Forces. Requires the Attorney General to: (1) provide transportation services to state and local governments for the extradition of fugitives through the U.S. Marshal Service Justice Prisoner and Alien Transportation Service; (2) make grants to states for the extradition of fugitives to other states for prosecution; and (3) make grants to states for establishing or upgrading information and identification technologies for serious misdemeanor and felony warrants. Makes state compliance with felony and serious misdemeanor warrant reporting requirements a condition for receiving grants under this Act. Requires states to make electronically available to the National Crime Information Center (NCIC) all serious misdemeanor and felony warrants issued by such states and their local jurisdictions.

Outpatient Mental Health Modernization Act of 2008 - Establishes a moratorium between January 1, 2009, and January 1, 2010, on changes in the Medicare outpatient department (OPD) fee schedule amount established for partial hospital (episode and visit) services. Amends title XVIII (Medicare) of the Social Security Act to: (1) establish an accreditation program for community mental health centers providing partial hospitalization services; (2) require a specified reduction in the OPD fee schedule increase factor for any such center that fails to submit required data on its partial hospitalization services; and (3) establish a minimum number of four units of items and services as a requirement for coverage of such services. Directs the Secretary of Health and Human Services to require fiscal intermediaries under the Medicare program to file the cost reports of providers of partial hospitalization services into the Healthcare Provider Cost Reporting Information System (HCRIS) maintained by the Centers for Medicare & Medicaid Services.

Directs the Secretary of Health and Human Services, for a cost reporting period beginning on or after July 1, 2005, to provide for payments of direct graduate education costs under title XVIII (Medicare) of the Social Security Act in accordance with an alternative payment methodology for eligible hospitals in or adjacent to a major disaster area which have established a program to educate residents displaced from a graduate medical education (GME) program impacted by such disaster.

Recognizes the historical significance to the nation, and supports the continued celebration, of Juneteenth Independence Day (June 19, 1865, the day Union soldiers arrived in Galveston, Texas, with news that the Civil War had ended and that the enslaved African Americans were free). Declares the sense of Congress that: (1) history should be regarded as a means for understanding the past and solving the challenges of the future; and (2) the celebration of the end of slavery is an important and enriching part of the history and heritage of the United States.
