According to the draft, Estonia wants to join the Protocol on Acidification, Eutrophication and Tropospheric Ozone Reduction of the 1979 Convention on Long-Range Transboundary Air Pollution, known as the Gothenburg Protocol, and to approve the 2012 amendments to the Protocol. The goal of the Gothenburg Protocol is to reduce the levels of five pollutants - sulfur dioxide, nitrogen oxide, ammonia, anthropogenic volatile organic compounds and especially fine particulate emissions. These pollutants have a harmful effect on human health, natural ecosystems, materials and crops due to acidification, eutrophication or the formation of ground-level ozone as a result of long-range transboundary spread.

With the draft, the EU directive, which deals with national obligations to reduce emissions of five basic air pollutants, will be adopted into Estonian law. The directive establishes national obligations for the reduction of pollutant emissions for the years 2020 and 2030, as well as the requirements of the national program for the reduction of emissions of certain air pollutants. The program sets the goals and measures for reducing air pollutants, which are mandatory for the state. Pollutants that the directive addresses are: sulfur dioxide, nitrogen oxides, extra fine particles, ammonia and non-methane volatile organic compounds. The reduction of these substances in air pollution improves the quality of the outdoor air and leads to a positive effect on ecosystems as well as the living and natural environment. The directive to be adopted calls for strengthening cooperation between countries in reducing pollutant emissions. Among other things, countries must start evaluating the likelihood of how domestic emission sources affect air quality both in the country and in neighboring countries and to describe emission reduction measures. Consistency of the program with other relevant plans and programs must also be ensured. Until now, the content of the program has largely been the content of the countries themselves. The directive is quite flexible from the point of view of fulfilling the limit quantities and allows the state to combine different measures according to the need and possibilities, if there is a risk that the obligations to reduce emissions could not be fulfilled for some reason. For example, as one measure, in a situation where a country is unable to meet its emissions reduction obligations due to an exceptionally cold winter in a certain year, the emissions of that year can be presented as a three-year average to meet the obligations. The three-year average emissions are calculated based on the year in question, the year before that, and the year after that. When implementing flexibility measures, the European Commission must be informed about it. The first national air pollution reduction program must be submitted to the European Commission by April 1, 2019, and must be reviewed at least every four years.

The bill supplements the Nature Conservation Act to implement the Nagoya Protocol on access to genetic resources and the fair distribution of revenues from their use. Derived from the Nagoya Protocol, the purpose of the regulation is to ensure that genetic resources and related traditional knowledge used in the EU are acquired legally from the country of origin. The corresponding regulation of the European Parliament and the Council, which is directly applicable in Estonia, imposes on the member states the obligation to create a monitoring system to control users of genetic resources and related traditional knowledge in the country who fulfill the obligations arising from the regulation. Penalties are established for violation of the requirements arising from the regulation. In the draft, the Ministry of the Environment, the Ministry of Rural Affairs and the Ministry of Education and Science are named as the competent authorities responsible for the implementation of the regulation. The Nagoya Protocol deals with as genetic material material of plant, animal, microbial or other origin. Their use refers to research and development in the field of genetic and/or biochemical composition.

The draft adopts the corresponding EU directive for establishing minimum requirements for joint environmental impact assessment (EIA) for ensuring the protection of the environment and human health. The bill specifies the requirements for the preliminary environmental impact assessment and the content of the report, which makes the preliminary assessments more meaningful and of higher quality. When issuing activity permits, decision-makers must also assess the relevance of the environmental impact assessment report. The explanatory note states that, for example, there may be situations where the application for an activity permit is issued only years after the environmental impact assessment has been recognized as meeting the requirements. However, the corresponding environmental information has changed considerably in the meantime. For this reason, the decision-maker will have to consider each time whether the previously prepared EIA is appropriate or not. In justified cases, the decision-maker has the right to request an additional expert assessment from the developer - thereby ensuring a decision based on up-to-date and adequate material decision making. In addition, it becomes the responsibility of the decision-makers to take into account and include in the conditions of the operating permit the environmental measures prescribed during the EIA. The bill changes the minimum deadline for public display of the environmental impact assessment report. Instead of the current 21 days, there will be 30 days in the future. Although already in the current practice of impact assessment, the website address is generally included in the EIA program and report disclosure notice, where these documents are available electronically. However, this may not always be the case, which is why the law adds a requirement to indicate the corresponding website address in the EIA report disclosure notice. In order to better inform the participants in the proceedings and the public, the decision to recognize the EIA report as meeting the requirements must also include the final conclusions of the report. This helps to better link the report with the granting or non-granting of the license.
