In September of 2020, presidential memorandums placed a moratorium on all energy leases in those areas for a 10-year period. Suspending Energy Imports from Russia Act This bill prohibits the importation of energy products from Russia. It also permanently authorizes the President to impose visa- and property-blocking sanctions based on violations of human rights, and it revises the President's authority to impose these sanctions. The bill generally prohibits the importation of Russian products that are classified under chapter 27 of the Harmonized Tariff Schedule (which includes mineral fuels, mineral oils and products of their distillation, bituminous substances, and mineral waxes), with an exception for prior contracts or agreements. The President may waive this prohibition for national interest reasons, subject to congressional approval. The bill directs the U.S. Trade Representative to take certain actions, including to consider steps to suspend Russia's participation in the World Trade Organization. Additionally, the bill statutorily authorizes broader coverage of current visa- and property-blocking sanctions for human rights violations to cover persons involved in serious human rights abuses. (Current law imposes these sanctions on persons responsible for gross violations of human rights, a higher standard.) The bill authorizes the President to impose sanctions on any foreign person who (1) is responsible for serious human rights abuse, (2) is a current or former government official who is responsible for or complicit in corruption, (3) is or has been a leader or official of an entity that has engaged in any of these activities, (4) has provided support for any of these activities, or (5) is owned or controlled by a person subject to these sanctions.

Regaining Energy Freedom and Undeniable SEcurity and Preserving U.S. Trade Interests Now Act or the REFUSE PUTIN Act This bill addresses U.S. energy security and independence, the importation and exportation of fossil fuels, and drawdowns from the Strategic Petroleum Reserve. Specifically, the bill directs the President to prohibit the importation of fossil fuels from Russia. While the prohibition is in effect, the President may not ban the export of crude oil. The President must also rescind certain orders, including specified environmental executive orders relating to climate change. Further, agencies must repeal any regulations that have the intent or effect of substantially reducing U.S. energy independence. In addition, the bill grants the Federal Energy Regulatory Commission the exclusive authority to approve or deny applications for facilities, such as liquefied natural gas terminals, to export natural gas from the United States to foreign countries or import natural gas from foreign countries. Additionally, the Department of Energy may not drawdown petroleum in the Strategic Petroleum Reserve until it develops a plan to increase the percentage of federal lands leased for oil and gas production. Finally, the bill also approves the TransCanada Keystone Pipeline in Phillips County, Montana for the import of oil from Canada to the United States.

EUROPE Act

Energy Unleashing in Response to the Offenses of Putin against Europeans Act or the EUROPE Act This bill expedites approvals for natural gas exports to certain countries, imposes sanctions related to Russia, and addresses various energy-related issues. Under this bill, an application to export natural gas to a country with a mutual defense treaty with the United States must be (1) deemed consistent with the public interest, and (2) granted without modification or delay. Further, the Federal Energy Regulatory Commission must expedite the approval for liquefied natural gas terminals intended for exporting natural gas to one or more of such treaty countries. The Department of the Interior must immediately resume oil and gas leasing on public land and offshore waters without further review. The bill also requires the President to, subject to various exceptions and conditions, impose sanctions related to (1) Russia's central bank, and (2) foreign financial institutions that knowingly facilitate transactions with Russia's central bank or other sanctioned Russian financial institutions. The Export-Import Bank (Ex-Im Bank) must make assistance available to finance exports directly regarding clean energy technology, energy infrastructure, and the production of natural resources, with the goal of using at least 25% of its annual authorizations for such assistance. The Ex-Im Bank must set a goal to maximize the amount financed in certain situations, such as when an international strategic competitor is likely competing against a U.S. exporter for an energy-related contract.

Specifically, the President must submit an energy security plan that (1) evaluates U.S. crude oil, petroleum products, and natural gas imports and exports; (2) assesses the energy security risks of such imports; and (3) includes strategies to encourage increased domestic production of crude oil, petroleum products, and natural gas to offset Russian imports. The bill also approves the TransCanada Keystone Pipeline in Phillips County, Montana for the import of oil from Canada to the United States. In addition, the bill grants the Federal Energy Regulatory Commission the authority to approve or deny applications for facilities to export natural gas from the United States to foreign countries or import natural gas from foreign countries. The President and federal agencies must obtain congressional approval before (1) prohibiting or substantially delaying certain new energy mineral leases or permits on federal lands, or (2) withdrawing certain federal lands from mineral and geothermal leasing activities. The Department of the Interior must resume issuing oil and gas leases on federal lands and offshore submerged lands in the Outer Continental Shelf as specified under the bill. Finally, the bill limits the drawdown of petroleum in the Strategic Petroleum Reserve until the Department of Energy develops a plan to increase the percentage of federal lands leased for oil and gas production.

Institutional Grants for New Infrastructure, Technology, and Education for HBCU and MSI Excellence Act or the IGNITE HBCU and MSI Excellence Act This bill establishes a grant program to support long-term improvements of historically Black colleges and universities (HBCUs), graduate programs at HBCUs, and other minority-serving institutions (MSIs). Specifically, the bill requires the Department of Education (ED) to award grants to HBCUs and MSIs to improve campus facilities. A recipient must use grant funds for certain activities, such as constructing or renovating facilities, carrying out major repairs, and strengthening the safety and security of a campus. Any new construction, modernization, or renovation projects must meet building code and energy and water conservation requirements. Further, HBCUs and MSIs must seek to procure contracts from certain small businesses, including those owned and controlled by veterans and service-disabled veterans. The bill prohibits the use of grant funds for specified activities, including for the payment of routine and predictable maintenance costs, minor repairs, and utility bills. No Energy Revenues for Russian Hostilities Act of 2022 This bill prohibits, with some exceptions, the Department of the Treasury from authorizing certain energy-related transactions that would otherwise be blocked by an executive order barring transactions related to specified harmful foreign activities of the Russian government. The bill also revokes a license issued February 28, 2022, by the Office of Foreign Assets Control within Treasury that authorized certain transactions barred by the executive order. The bill allows a waiver from the limitation on an energy transaction if the transaction involves funds owed to a Russian person and the funds are to be used for the sale of agricultural commodities, food, medicine, or medical devices. The bill terminates on the earlier of five years after its enactment, or 30 days after the President reports to Congress that Russia has ceased activities destabilizing the sovereignty and territorial integrity of Ukraine.

American Energy Independence Act of 2022

American Energy Independence Act of 2022 This bill addresses U.S. energy independence, the production and importation of oil and natural gas, and the rescission of specified environmental requirements. Specifically, the bill directs the President to develop a plan for the United States to achieve energy independence by 2024. The Department of Energy (DOE) must also develop a program and issue rules to ensure that the United States achieves such energy independence and becomes a net exporter of energy. The bill also addresses energy pipelines, including by approving the TransCanada Keystone Pipeline in Phillips County, Montana for the import of oil from Canada to the United States. It also provides for energy production, including by requiring regulations to be issued by DOE to reduce requirements on entities harvesting energy through hydraulic fracturing, the Department of Transportation to promote stable and affordable gasoline and diesel prices, and the Department of the Interior to promote the leasing of federal land for oil and natural gas production. In addition, the Environmental Protection Agency (EPA) must identify and repeal certain regulations that substantially reduce energy independence. Further, the bill prohibits the use of any funds to implement the Paris Agreement on climate change. Finally, the bill rescinds (1) Executive Order 14008 about tackling climate change, (2) the 2021 proposed rule issued by the EPA and the U.S. Army Corps of Engineers about the scope of the Clean Water Act, and (3) the 2021 proposed rule issued by the EPA about methane gas emissions.
