John S. McCain National Defense Authorization Act for Fiscal Year 2019 This bill authorizes FY2019 appropriations and sets forth policies regarding the military activities of the Department of Defense (DOD), military construction, and the national security programs of the Department of Energy (DOE). It does not provide budget authority, which is provided in subsequent appropriations legislation. The bill authorizes appropriations to DOD for: Procurement; Research, Development, Test, and Evaluation; Operation and Maintenance; Cooperative Threat Reduction; Working Capital Funds; Chemical Agents and Munitions Destruction; Defense-Wide Drug Interdiction and Counter-Drug Activities; the Defense Inspector General; the Armed Forces Retirement Home; and the Defense Health Program. This bill also authorizes appropriations for Overseas Contingency Operations (OCO), which are exempt from limits on discretionary spending. OCO appropriations authorized in the bill support base budget requirements as well as OCO activities. The bill authorizes the FY2019 personnel strengths for active duty and reserve forces and sets forth policies regarding military personnel; compensation and other personnel benefits; health care; acquisition policy and management; DOD organization and management; civilian personnel matters; matters relating to foreign nations; and strategic programs, cyber, and intelligence matters. Foreign Investment Risk Review Modernization Act of 2018 The bill addresses shifting threats to national security and the Committee on Foreign Investment in the United States. Military Construction Authorization Act for Fiscal Year 2019 The bill authorizes appropriations and sets forth policies regarding military construction for the Army, Navy, Air Force, and defense agencies, the North Atlantic Treaty Organization Security Investment Program, and Guard and Reserve Forces facilities. The bill authorizes appropriations for base realignment and closure (BRAC) activities and prohibits an additional BRAC round. The bill also authorizes appropriations and sets forth policies for DOE national security programs, including the National Nuclear Security Administration.

Natural Gas Parity Act This bill modifies several tax provisions and federal programs related to the sale, purchase, and use of natural gas. The bill modifies tax provisions related to natural gas to extend the alternative fuels tax credit, modify the excise tax on heavy trucks and trailers sold at retail to add a partial exclusion for alternative fuel trucks, add a new tax credit for new natural gas motor vehicles, extend and increase the alternative fuel vehicle refueling property tax credit, and establish a liquefied natural gas equivalent for the purposes of the Inland Waterways Trust Fund financing rate. The bill modifies several federal programs and requirements to specify minimum federal acquisition requirements for natural gas and alternative fuel vehicles; authorize the Department of Energy (DOE) to conduct specified research, development, and demonstration activities regarding natural gas vehicles; authorize DOE to award natural gas vehicle deployment grants under the Clean Cities program; and require specified funds provided for under certain settlement agreements for alleged violations of environmental laws to be used for alternative fuel vehicle deployment grants.

Spending Cuts to Expired and Unnecessary Programs Act This bill rescinds approximately $15 billion in budget authority over 2018-2028 that was proposed to be rescinded by the President under procedures included in the Impoundment Control Act of 1974. (A rescission is legislation enacted by Congress that cancels the availability of previously enacted budget authority before the authority would otherwise expire. Under current law, the President may propose rescissions to Congress, which must be enacted into law to take effect. Congress may rescind all, part, or none of the amounts proposed by the President. If Congress does not pass rescission legislation within 45 days of continuous session of Congress, the President must make the funds available.) The bill rescinds budget authority from specified programs and accounts within: the Department of Agriculture, the Department of Commerce, the Department of Energy, the Department of Health and Human Services, the Department of Housing and Urban Development, the Department of Justice, the Department of Labor, the Department of State, the Millennium Challenge Corporation, the U.S. Agency for International Development. the Department of Transportation, the Department of the Treasury, the Corporation for National and Community Service, and the Railroad Retirement Board.

National Innovation Modernization by Laboratory Empowerment Act or the NIMBLE Act This bill directs the Department of Energy (DOE) to delegate signature authority to the nonmilitary national laboratories for certain agreements. Activity under such an agreement must have a total cost of less than $1 million (including the contributions of the national laboratory and the cost share of the contractor). Agreements must fall within the scope of: a strategic plan for the laboratory that has been approved by DOE, or the most recent congressionally approved budget for DOE activities that are to be carried out by the laboratory.

ARPA-E Act of 2018

ARPA-E Act of 2018 This bill amends the America COMPETES Act to require the Advanced Research Projects Agency-Energy (ARPA-E) in the Department of Energy (DOE) to overcome the long-term and high-risk technological barriers in the development of transformative science and technology solutions to address energy, environmental, economic, and national security challenges. (Currently, ARPA-E must overcome barriers in the development of energy technologies.) The bill expands the goals of ARPA-E to include the development of energy technologies that: provide transformative solutions to improve management of radioactive waste, improve the efficiency and reduce the environmental impact of energy production, and address other challenges within the mission of DOE. The bill expands the responsibility of ARPA-E to accelerate novel early-stage research to include nonenergy research. ARPA-E must: include a strategic vision roadmap in each annual report on energy technology projects or advanced technology projects, and ensure that it does not fund an advanced technology project unless the prospective grantee has demonstrated that it has sufficiently attempted to secure private financing or that such project is not independently commercially viable. Specified categories of proprietary information collected by ARPA-E from award recipients shall be considered privileged and confidential and not subject to disclosure under the Freedom of Information Act.

Department of Energy Science and Innovation Act of 2018 This bill authorizes various scientific research activities, programs, and initiatives in the Department of Energy (DOE). The bill states that the mission of DOE's Office of Science shall be the delivery of scientific discoveries, capabilities, and major scientific tools to transform the understanding of nature and to advance energy, economic, and national security. The bill provides statutory authority for the Office of Science's basic energy sciences program, construction and operation of user facilities, Advanced Scientific Computing Research program, and Science Laboratories Infrastructure Program. DOE shall provide for specified upgrades to or construction of basic energy sciences research infrastructure. DOE shall carry out a Solar Fuels Research Initiative and a Electricity Storage Research Initiative. The Office of Science shall: carry out specified research programs; ensure the access of U.S. researchers to the most advanced accelerator facilities and research capabilities in the world, including the Large Hadron Collider; and assess the potential of fusion energy projects supported by the Advanced Research Projects Agency-Energy.

Farm to Food Bank Act of 2018 This bill amends the Food, Conservation, and Energy Act of 2008 to require the Department of Agriculture (USDA) to establish a program to allocate funding to states to support the establishment and administration of farm to food bank programs. A "farm to food bank program" is a program under which agricultural producers donate food products to a food bank, an association of food banks, or a food assistance network for free distribution to individuals in need. The bill also amends the Federal Crop Insurance Act to require the Federal Crop Insurance Corporation to establish a procedure under which an insured crop that is donated by a producer does not qualify as a produced crop under a crop insurance claim. USDA must coordinate with the Environmental Protection Agency to conduct a study to evaluate and determine methods of measuring food waste, standards for the volume of food waste, and causal factors for food waste.

The bill makes private entities eligible for grants and modifies the purposes for which the grants may be used. Energy Reliability Act of 2018 This bill amends the Internal Revenue Code to allow a tax credit through 2022 for a portion of the expenses for the operation or maintenance of a coal-powered electric generation unit, excluding expenses for coal. The credit applies to taxpayers who own or lease an electric generation unit that: (1) uses coal to produce at least 75% of the electricity produced by the unit, and (2) has constructed and installed emissions controls pursuant to specified Environmental Protection Agency (EPA) regulations or any other applicable federal emissions control requirements that are equal to or more stringent than the EPA regulations. Taxpayers may transfer the credit to an eligible project partner. An "eligible project partner" is a person who: is responsible for operating, maintaining, or repairing the unit; participates in the provision, including transportation, of coal or other materials and supplies to the unit; provides financing for the construction, expansion, repair, or operation of the unit; or leases the unit. If a unit claims a credit under this bill, the Federal Energy Regulatory Commission (FERC) must require the applicable reliability coordinator to conduct an assessment analyzing the reliability and resilience attributes offered by the unit to the regional grid in which it is located. FERC must submit to Congress: (1) the results of the assessments, and (2) a recommendation as to whether the credit should be extended after 2022.

Promoting Hydropower Development and Jobs Act This bill amends the Federal Power Act to authorize the Federal Energy Regulatory Commission (FERC) to establish an expedited process for issuing and amending licenses and preliminary permits for qualifying hydropower facilities that will be associated with existing nonpowered dams. In establishing the expedited process, FERC shall convene an interagency task force with federal and state agencies and Indian tribes to coordinate the regulatory process associated with the authorizations required to construct and operate a qualifying facility. FERC must assess the safety of existing nonfederal dams and other nonfederal structures related to a qualifying facility before licensing the facility. FERC must coordinate with the Department of the Army, the Department of the Interior, and the Department of Agriculture to jointly develop a list of existing nonpowered federal dams that have the greatest potential for nonfederal hydropower development. Licensees of a qualifying facility are not required to pay an annual charge for administrative expenses until construction commences.

Energy Infrastructure Demand Response Act of 2018 This bill requires the Department of Energy to establish a natural gas demand response pilot program that uses the latest demand response technology from the energy sector for natural gas to (1) reduce the cost of energy for consumers, (2) reduce market price volatility, (3) increase reliability of the energy system, and (4) achieve reductions in air emissions and other benefits.

Consortia-Led Energy and Advanced Manufacturing Networks Act This bill requires the Department of Commerce to carry out a grant program for establishing consortia to enhance U.S. economic, environmental, and energy security by promoting domestic research and commercial application of clean technologies and advanced manufacturing processes. Clean technology means technologies, production processes, or methodologies that: produce energy from renewable energy sources; transmit, distribute, or store energy more efficiently; enhance energy efficiency for buildings and industry; enable the development of a Smart Grid (an evolving electric power network that utilizes new information technology systems, including those that enable customers to reduce or shift their power use during peak demand periods); produce an advanced or sustainable material with energy or energy efficiency applications; improve energy efficiency for transportation; or enhance water security through improved water management, conservation, distribution, or end use applications.
