M. Alexandre Allegret-Pilot interroge M. le ministre délégué auprès du ministre de l'économie, des finances et de l'industrie, chargé de l'industrie, sur la gestion des matières et déchets radioactifs. Les pouvoirs publics ont décidé une relance de l'utilisation de l'énergie nucléaire en France, incluant la construction de nouveaux réacteurs de puissance et le soutien à des projets de petits réacteurs modulaires. Le Conseil de politique nucléaire de février 2024 a confirmé la politique de retraitement des combustibles nucléaires usés en vue du recyclage des matières fissiles valorisables (pour supprimer à terme la dépendance de la France à l'uranium importé) avec l'objectif de parvenir à terme à la fermeture complète du cycle du combustible nucléaire. Dans son rapport n° 18 de juin 2024, la Commission nationale d'évaluation des études et recherches sur la gestion des matières et déchets radioactifs (CNE) souligne que les réacteurs à neutrons rapides (RNR) de puissance élevée sont la seule filière permettant la fermeture complète du cycle. La CNE a réalisé une revue des stratégies de gestion des déchets radioactifs de haute et moyenne activité, dont notamment les combustibles usés, dans le monde. Il en ressort que le stockage géologique est la solution de référence, même si l'avancement de la mise en œuvre de cette stratégie est très différent d'un pays à l'autre. La Commission doit remettre un avis fin 2025 sur le dossier d'autorisation de création Cigéo, un projet de centre de stockage géologique (la Finlande et la Suède sont les seuls pays ayant à ce jour autorisé la création d'une installation de stockage géologique ; la construction de l'installation finlandaise est très avancée). Face à ce constat, il lui demande quelles mesures le Gouvernement envisage de prendre pour permettre le déploiement d'un parc de RNR de puissance élevée (offrant des garanties contre les risques de crise structurelle d'approvisionnement en uranium) et l'avancement concret dans la mise en œuvre d'un centre de stockage géologique en France.

M. Bastien Lachaud appelle l'attention de M. le Premier ministre sur la situation des stocks de comprimés d'iode dédiés à la protection de la population nationale en cas d'incident nucléaire majeur lié au conflit en Ukraine. Dans le contexte de la guerre en Ukraine, la centrale nucléaire de Zaporijjia, la plus grande d'Europe, s'est retrouvée à plusieurs reprises théâtre de combats et son alimentation en électricité régulièrement perturbée. En août 2024, l'Agence internationale de l'énergie atomique s'était inquiétée de la détérioration de la situation sécuritaire de la centrale. Si un incident nucléaire devait survenir, la population française risquerait d'être exposée au panache radioactif qui s'en dégagerait, avec des conséquences sanitaires catastrophiques. Le secrétariat général de la défense et de la sécurité nationale, service relevant du Premier ministre, a pour mission d'organiser la réponse des pouvoirs publics en cas d'incident nucléaire grave, notamment si celui-ci survient hors des frontières. Aussi, il lui demande de bien vouloir informer la représentation nationale sur le volume de stocks d'iode disponible et les dispositions mises en œuvre par le secrétariat général de la défense et de la sécurité nationale pour préparer une distribution de grande ampleur.

M. Jean-Philippe Tanguy interroge M. le ministre de l'économie, des finances et de l'industrie sur l'allongement du calendrier du chantier des deux réacteurs Hinkley Point C en Angleterre. Initialement prévue pour 2025, EDF repousse sa mise en service en 2027 puis en 2029, sans exclure l'hypothèse d'une ouverture en 2030 voire 2031. En effet, les travaux de montage électromécanique (câbles et tuyaux) devaient durer vingt-huit mois; finalement cette étape en prendra cinquante-deux. La multiplication par deux de la durée des travaux a des effets dévastateurs sur les finances, la crédibilité d'EDF et plus largement de la France. Selon l'électricien, les coûts atteindraient entre 7 à 9,3 milliards de livres supplémentaires, par rapport aux coûts estimés en 2015. À cela s'ajoute la sortie du groupe chinois China Genetal Nuclear Power Group (CGN), entraînant une hausse de contribution significative, à hauteur de 6 milliards de livres, pour le groupe français EDF, seul à supporter ces surcoûts. Une fois encore, il semble qu'aucune leçon n'ait été tirée des fiascos finlandais et de Flamanville. Personne n'est jamais responsable de rien ! Ce retard de plusieurs années pénalise à court, moyen et long terme la capacité de la France à exporter son savoir-faire par la signature de plusieurs contrats : des pays d'Europe de l'Est, l'Inde, ou encore les Pays-Bas semblent réticents à acheter des EPR d'EDF. Par exemple, en vue d'une vente, le gouvernement tchèque a retenu deux candidats à son appel d'offres : EDF et le sud-coréen KHNP. Ces commandes sont nécessaires pour remplir le plan de charge du nouveau nucléaire français, qui prévoit la construction de 1,5 à 2 EPR par an. Afin d'atteindre les objectifs qu'il s'est fixé, la filière du nucléaire devra être capable de produire en série. Il ne serait pas surprenant que le gouvernement tchèque choisisse le groupe sud-coréen, capable de construire des réacteurs nucléaires en l'espace de 7 ans contrairement au groupe français. L'accumulation des retards du projet Hinkley Point C impacte la crédibilité d'EDF, courant le risque de ne pas signer cet important contrat. Il lui demande comment le Gouvernement peut expliquer une telle dérive et les mesures qu'il entend mettre en œuvre pour l'éviter à l'avenir.

M. Romain Daubié attire l'attention de Mme la ministre de la transition écologique, de l'énergie, du climat et de la prévention des risques, au sujet de la circulaire du 17 février 2010 relative à la maîtrise des activités au voisinage des installations nucléaires de base (INB) susceptibles de présenter des dangers à l'extérieur du site, dite circulaire « Borloo ». En droit, la loi 2006-686 du 13 juin 2006 relative à la transparence et à la sécurité en matière nucléaire, dite « loi TSN », fixe le cadre juridique nécessaire à la maîtrise des activités autour des installations nucléaires de base. La maîtrise de l'urbanisation et des activités dans l'environnement des installations nucléaires de base doit notamment être réalisée par des servitudes d'utilité publique, conformément à l'article 31 de loi susmentionnée. La circulaire en date du 17 février 2010, dite circulaire « Borloo », a complété la loi du 13 juin 2006 en précisant les modalités de maîtrise des activités autour des installations nucléaires. Concrètement, sur la base des informations techniques communiquées par la division territoriale de l'autorité de sûreté nucléaire à propos des zones de dangers, les préfets doivent informer les communes ou les établissements publics de coopération intercommunale ayant compétence en matière d'urbanisme concernés. La circulaire indique de privilégier un développement des activités à l'extérieur de cette zone. À l'intérieur de cette zone, le texte permet de refuser les projets qui s'avéreraient incompatibles avec les objectifs de sécurité des populations concernées, ou de prescrire des conditions les rendant acceptables en application de l'article R. 111-2 du code de l'urbanisme. Reste que si cette circulaire n'était mise en place que de façon transitoire à l'origine, à ce jour, elle perdure et engendre des difficultés pour les projets d'urbanisme des communes ayant des centrales ou des établissements nucléaires implantés sur leur territoire. Ces communes, regroupées au sein de l'ARCICEN (Association des représentants des communes d'implantation de centrales et établissements nucléaires), font l'objet de nombreux recours administratifs vis-à-vis des projets d'urbanisme qu'elles souhaitent mettre en place, alors même que ceux-ci sont nécessaires pour la création de logements, d'écoles, de gendarmeries ou encore de maisons de santé, face à la hausse d'habitants aux abords des centrales. Dans l'attente du rapport sur la circulaire dite « Borloo » qui était attendu pour le mois de juin 2024 et compte tenu de la mise en application de la loi n° 2023-491 du 22 juin 2023 relative à l'accélération des procédures liées à la construction de nouvelles installations nucléaires à proximité de sites nucléaires existants et au fonctionnement des installations existantes, il semble également nécessaire de prendre des mesures s'agissant de la circulaire dite « Borloo » afin que les communes d'implantation et d'établissements nucléaires puissent mener à bien les projets d'urbanisme utiles à la collectivité publique. Il l'appelle à prendre les mesures nécessaires vis-à-vis des difficultés engendrées par cette circulaire pour les communes d'implantation et d'établissements nucléaires.

Energy and Water Development and Related Agencies Appropriations Act, 2025 This bill provides FY2025 appropriations for U.S. Army Corps of Engineers civil works projects, the Department of the Interior's Bureau of Reclamation, the Department of Energy (DOE), and several independent agencies. The bill provides appropriations for U.S. Army Corps of Engineers civil works projects, including for Investigations; Planning, Engineering, and Design; Construction; Mississippi River and Tributaries; Operation and Maintenance; the Regulatory Program; the Formerly Utilized Sites Remedial Action Program; Flood Control and Coastal Emergencies; Expenses; the Office of the Assistant Secretary of the Army for Civil Works; and the Water Infrastructure Finance and Innovation Program. The bill provides appropriations to the Department of the Interior for the Central Utah Project and the Bureau of Reclamation. The bill provides appropriations to DOE for energy programs, including Energy Efficiency and Renewable Energy; Manufacturing and Energy Supply Chains; Cybersecurity, Energy Security, and Emergency Response; Electricity; Grid Deployment; Nuclear Energy; Fossil Energy and Carbon Management; Energy Projects; Naval Petroleum and Oil Shale Reserves; the Strategic Petroleum Reserve; the Northeast Home Heating Oil Reserve; the Energy Information Administration; Non-Defense Environmental Cleanup; the Uranium Enrichment Decontamination and Decommissioning Fund; Science; Nuclear Waste Disposal; Technology Coordination and Commercialization; Clean Energy Demonstrations; the Advanced Research Projects Agency—Energy; the Title 17 Innovative Technology Loan Guarantee Program; the Advanced Technology Vehicles Manufacturing Loan Program; the Tribal Energy Loan Guarantee Program; Indian Energy Policy and Programs; Departmental Administration; and the Office of the Inspector General. The bill also provides appropriations to DOE for Atomic Energy Defense Activities of the National Nuclear Security Administration, Environmental and Other Defense Activities, and the Power Marketing Administrations. The bill provides appropriations to several independent agencies, including the Federal Energy Regulatory Commission and the Nuclear Regulatory Commission. The bill also sets forth requirements and restrictions for using funds provided by this and other appropriations acts.
