Summary

Kohtute seaduse muutmise ettepaneku kohaselt muudetakse kohtute seadust ulatuses, mis on vajalik Riigikaitsekohtu, kui Põhiseaduse §-s 148 nimetatud erikohtu, moodustamiseks ja selle tegevuseks põhimõttelise õigusliku aluse loomiseks. Eelnõuga määratletakse Riigikaitsekohtu pädevuse sarnaselt teise tegutseva erikohtu liigiga -halduskohtuga - üldise pädevusvaldkonnana ja jätab täpsema pädevuse regulatsiooni edaspidi väljatöötatavate kohtumenetluse seaduste reguleerimisalasse. Eelnõus on siiski selgelt väljendatud põhimõte, et Riigikaitsekohus ei ole rahuajal reeglina kohtumõistmisfunktsiooni täitmise osas pidevalt toimiv kohus ja saab ainult seadustes täpselt sätestatud juhtudel ja korras täita õigusemõistmisfunktsiooni rahu ajal.
