Après l’alinéa 21, insérer l’alinéa suivant : « Par dérogation, une collectivité régie par l’article 73 de la Constitution peut, dans le cadre de la compétence prévue par l’article L. 611‑31 concernant les titres miniers en mer, renouveler une concession après 2040 et délivrer un permis exclusif de recherches ou une autorisation de prospection préalable sous réserve du respect des conditions prévues au présent code.
