Arriving on the French market in spring 2017, after months of announcements of transatlantic flights at unbeatable prices, the Icelandic company Primera Air offered flights from Paris to North America, Spain and Israel until October 2, 2018, the day all its activities cease. Hundreds of passengers thus found themselves stranded in New York, Boston and Toronto in particular, without a repatriation solution and therefore forced to incur numerous costs to return to France on their own. As the company continued to issue tickets until it filed for bankruptcy, Thousands of French passengers now find themselves in credit with the company, without any prospect of being able to recover the funds invested in the purchase of unused tickets. Suicide among Native American populations is a known problem, the phenomenon having been described in a parliamentary report by Aline Archimbaud and Marie-Anne Chapdelaine handed over to the government on November 30, 2015. Annoncés par le Président de la République en juin 2016 pour tenter de sortir le pays de la crise agricole, ces états généraux visent à « relancer la création de valeur et en assurer l'équitable répartition, permettre aux agriculteurs de vivre dignement de leur travail par le paiement de prix justes, accompagner la transformation des modèles de production afin de répondre davantage aux attentes et aux besoins des consommateurs, promouvoir les choix de consommation privilégiant une alimentation saine, sûre et durable ». Mais quelles sont les attentes liées à ces états généraux de l'alimentation et quel est le modèle agricole voulu par le Gouvernement pour la Guyane ? D'ores et déjà, les syndicats des jeunes agriculteurs s'émeuvent de ne pas être associés aux discussions, alors même que la Guyane est la seule région de France qui voit sa surface agricole augmenter chaque année. Pourtant, les sujets de préoccupations sont pléthores avec en tête de file la question des produits agricoles qui entrent en Guyane de manière illégale et font une concurrence déloyale à la production locale. Ou alors son corollaire, la possibilité pour les acteurs locaux de pouvoir travailler avec l'entreprise brésilienne de recherche agricole (EMBRAPA) comme c'est le cas pour les agriculteurs martiniquais. Aussi, au regard des nombreuses questions qui se posent, il lui demande de bien vouloir lui apporter des informations sur la feuille de route agricole de l'État en Guyane et sur ses ambitions quand à ces états généraux, notamment en matière de concertation avec les acteurs locaux guyanais.

Mr. Gabriel Serville draws the attention of the Minister of Ecological and Inclusive Transition to the reduction of the TICPE for advanced biofuels based on flotation grease, composed of at least 30% methyl esters of fatty acids, in order to allow them to benefit from the same advantageous taxation already existing for type B100 biofuels. Since the energy transition law for green growth of 2015, it is now appropriate to prioritize the development of advanced biofuels. Advanced biofuels are biofuels using raw materials that do not compete with food markets. They come in particular from waste, such as flotation grease, and their use allows maximum savings in greenhouse gas emissions. This is all the more true as their production only uses energy renewable and recycled water. Currently, the physicochemical parameters required in France for advanced biofuels derived from flotation grease do not allow their use in captive fleets. Indeed, to be placed on the market, a biofuel must not only meet the criteria set out by the European standard EN14214, but must also meet national parameters, in particular on physicochemical. The percentage of saturated fatty acids and the filterability limit temperature (temperature below which the biofuel freezes) are part of these parameters. Thus, France considers that the biofuel must have a TLF of -10°C in B100. These parameters are only achieved by biofuels from rapeseed, which therefore benefit from tax relief (set out in article 265 of the customs code). This is discriminatory and blocking the production of advanced biofuels for French captive fleets. Indeed, advanced biofuels derived from flotation fats cannot satisfy the French parameters in TLF or percentage of saturated fatty acids (because they contain a share of animal fat), and they are therefore automatically excluded from a reduction in the TICPE for B100 and any other percentage of incorporation even though the latter are more expensive to produce due to their origin. It would therefore be desirable to obtain the possibility of having a tax advantage also for lower incorporation percentages applicable to advanced biofuels. This advantage must also be accompanied by a relaxation of the decrees setting the limit values for the cold properties of biofuels. Indeed, articles 199 undecies B, 217 undecies and 244 quater of the general tax code make the granting of the tax advantage for compliance by the operator with the obligation to submit accounts under the conditions and deadline provided for by articles L. 232-21 to L. 232-23 of the commercial code, namely 30 days after approval of the accounts by its general meeting. This 30-day obligation is almost impossible to respect in the overseas departments due to the operators' incomprehension of the nature of the obligation incumbent on them over time. Not to mention the various delays observed locally in respecting overseas companies with their accounting obligations. For their part, investors are absolutely unable to verify whether the operators have filed their accounts with the commercial court registry within the month following the approval of their accounts before the investment is put into operation. This administrative failure of overseas companies has nothing to do with the fact of being in compliance with their tax and social obligations but on the other hand leads to almost automatic adjustments on this single formal defect for investors and deprives operators of investment. The problem of the sanction for non-compliance with the 30-day deadline for filing accounts (tax adjustment for the investor and non-reimbursement of aid for the operator) is threefold problematic because it is on the one hand potentially ad aeternam since the obligation is not limited in time, whether it concerns the accounts taken into account to determine whether the deposit obligation has been respected, but also to be able to benefit from tax assistance measures in respect of tax exemption for future financial years. On the other hand, the tax administration does not offer any possibility of regularization, which seems to go against the measures adopted in 2018 on the right to make mistakes and the reestablishment of a relationship of trust between the tax administration and users. Finally, the loss of the tax advantage corresponds to a disproportionate sanction with regard to the legal nature of the failure observed while creating a breach of equality between overseas companies and companies metropolitan areas. Thus, by an overly rigid application of the obligation to deposit accounts in the French Overseas Territories by certain DRFIPs, the operator is deprived of the financing of his investment and the investor loses his tax advantage.
