The Climate-Resistant Economy Act

The bill provides direction for the gradual reduction of Estonia's dependence on imported fossil fuels. The bill strengthens the resilience of the economy and society to climate change. For this purpose, a clear framework will be created that directs the development of the economy towards the introduction of clean energy, resource efficiency and climate neutrality. The bill supports the competitiveness of companies by encouraging innovation and the development of low-emission technologies. It is important greater valorization of local resources and application of circular economy principles that help reduce costs and dependence on external inputs. Also, the direction of sustainable development improves companies' access to financing and strengthens their position in international markets. In summary, the bill contributes to the long-term stability of the economy, strategic independence and the growth of people's well-being. In the development of the law, it has been sought balance between different constitutional values, insofar as no fundamental right, interest or purpose has automatic priority over others. This means that other interests and goals, including national defense ones, must also be considered when implementing the principles of the Climate-Resistant Economy Act. The bill defines climate-related concepts and sets climate goals and principles that support the reduction of greenhouse gas emissions and the impact of climate change adaptation.

Atmospheric Air Protection Act Amendment Act

The bill calls for an end to national enforcement of the EU's emissions trading system. The explanatory letter states that the European Union's green revolution, which has been an economically disastrous and questionable ideological and self-destructive policy from the point of view of environmental protection, has reached a dead end. This policy has caused a sharp rise in production costs and energy prices, business closures, job losses and mass industrial exodus. The result is a sharp decline in the competitiveness of Estonia and the whole of Europe, which threatens the sustainability of our economy, investments and people's living standards.

Act to amend the Atmospheric Air Protection Act, the Waste Act and the Criminal Record Act

The law is being amended to bring Estonian law into line with the new EU regulations regarding substances that deplete the ozone layer and fluorinated greenhouse gases. Among other things, the references are updated, the procedure for issuing invitations and permits is clarified, and the scope of regulation is extended to new groups of substances, including HFOs and natural refrigerants. An important part of the changes is aimed at reducing the use of F-gases and improving environmental protection. F gases are man-made gases that cause the greenhouse effect - SF6, for example, is a 23,000 times stronger greenhouse gas than CO2. Since F-gases are found in common refrigeration and air conditioning equipment and electrical switches in substations, the law imposes stricter requirements for their handling, control and reporting. The aim is to promote the transition to natural refrigerants and green technology in the refrigeration industry. Owners of HFO-containing equipment (currently 14) must to start registering devices and doing leakage checks (100-300 euros). The professional certificates of operators of cold, air-conditioning and heat pumps will become time-limited. The handling permit obligation also extends to natural refrigerants, which affects at least 20 companies. At the same time, the administrative burden will be reduced in several areas. For example, the obligation to register larger capacity heat pumps installed in residential buildings (50-100 units) will disappear, it will be simplified reporting of F-gases and threshold amounts are established that reduce the obligation to submit data for about 10 companies. The changes are planned to enter into force in general, and the European Commission must be notified of the new penalty provisions before January 1, 2026.

The Act on Amending the Waste Act and Amending Other Acts Related to It

The draft is intended to amend the Waste Act (JäätS), the General Part of the Environmental Code Act (KeÜS), the District Heating Act (KKÜS), the Environmental Charges Act (KeTS), the Local Government Organization Act (KOKS) and the Packaging Act (PakS). The purpose of the changes is to promote environmentally sound economic growth. To benefit the recycling industry, waste landfilling and incineration will be reduced, waste sorting will be increased and waste will be improved competitive conditions in waste transport. The sub-goal is to create role clarity in the field. For this purpose, the activities of recycling organizations will be enhanced and the restrictions of the local government on the organization of waste management will be reduced. The changes create the prerequisites for the timely achievement of the recycling target levels established in the European Union. The main goal of the changes made in the draft is the greater use of secondary raw materials contained in household waste. The bill will increase the responsibility and possibilities of local government units in organizing waste management, improve the recycling of packaging and packaging waste through their more extensive collection, establish payment systems that motivate recycling, and increase the transparency and timeliness of waste data. The changes are necessary to channel household waste into a circular economy. This requires structural changes (the so-called waste reform), which would ensure the adequate collection and recycling of household waste by type and the achievement of the target figures for the recycling of household waste and packaging waste. The gradual increase in the amount of separately collected and recycled waste enables the development of the recycling industry in Estonia, as ensuring high-quality waste flows and stable generation (ie stable separate collection) is an important prerequisite for making investments and developing the recycling industry.

The Act on Amendments to the General Part of the Environmental Code Act and Other Acts

Eelnõu eesmärk on vähendada nii ettevõtjate kui ka eraisikute halduskoormust eelkõige jäätmekäitluse, sinimajanduse, maavarade kaevandamise ning tööstusheite valdkondades. Keskkonnakaitselubade teenustega seotud haldusprotsess muutub lihtsamaks, kuid keskkonnakaitse tase jääb samaks. Eelnõu hõlmab näiteks muudatusi, kus keskkonnaluba väheolulistele tegevustele enam väljastama ei pea ning mõnel juhul ei tule väheolulisi tegevusi enam ka registreerida. Näiteks puudutab see teede ja sildade ehitajaid, kes ei pea taotlema enam veekeskkonnariskiga tegevuse registreeringut tee või raudtee silla või truubi ehitamiseks. Muudatus aitab kiiremini ellu viia olulisi arendusi Kaitseväe polügoonil või Rail Baltica rajamisel. Samuti ei pea enam näiteks koolid, lasteaiad ja teised juriidilised isikud taotlema jäätmekäitleja registreeringut, kui nad soovivad oma biojäätmeid kohapeal komposteerida ja nende kogus jääb alla ühe tonni aastas. Eelnõu kohaselt määratakse selgemalt keskkonnakaitse osapoolte kohustused, vähendatakse kohustuste täitmise sagedusi ja muudetakse selgemaks järelevalveprotsesse. Keskkonnanõuded nagu loa kohustus ja loa taotlemise protsess seotakse õiglasemalt tegevuse võimaliku keskkonnamõjuga.

The Act on Amending the Waste Act and the Packaging Act

The main purpose of the bill is to bring national law into line with European Union law and to establish measures to prevent and reduce the generation of waste and the negative environmental impact of waste generation and handling. In the current waste law, it is not clearly stated that in order to reduce the generation of food waste, when donating and redistributing food in other ways, priority must be given to food remaining food for people and not becoming feed, and that it not processed into non-food products. The bill supplements and specifies the regulation of extended producer responsibility. The bill expands and clarifies the concept of a tire manufacturer, as a result of which an unlimited amount of used tires can be handed over to a collection point for used tires, and which reduces the need to take used tires to a place not intended for this purpose, e.g. under the forest. The bill specifies motor vehicle manufacturer, agricultural plastic manufacturer and motor vehicle part manufacturer terms, which allows for the sake of legal clarity and following problems that have arisen in practice to reduce inquiries about the term producer and disputes between producers and state authorities related to the term. The purpose of the bill is to ensure the fulfillment of the target figures for waste collection and recycling of problem products by organizing and establishing more specific requirements than before for the purchase of problem products and parts separated from these products. In addition, the bill extends the statute of limitations for misdemeanors in violation of the obligation to take back, collect, reuse and dispose of waste generated from problem products, in order to enable the reduction of the proportion of statutes of limitations for misdemeanors and to ensure that the required target numbers are met. The bill creates legal clarity regarding the guarantee required when applying for environmental protection permits for waste storage and handling of hazardous waste, and thereby reduces disputes and the burden on applicants and state authorities. The bill gives the minister responsible for the field the right to establish the waste sampling procedure by regulation and thereby create better opportunities for reliable classification of waste. The introduction of changes to the purchase and acceptance of problem products does not change the principle in the Waste Act. The part of the text "dangerous substances" will be removed from the requirement of the restriction on the purchase of problematic products. The indicated indication is misleading, as problem products (electrical and electronic equipment, batteries and accumulators, scrap vehicles) that are sold already containing hazardous parts. According to the principle of extended producer responsibility, the producer is responsible for fulfilling the waste management obligations of problem products directed to the market.

Water Act Amendment Act
