Mr. Serge Letchimy draws the attention of the Minister of National Education to the job cuts in overseas academies, notably Martinique. In recent years, Martinique has lost many jobs, more than 900 in ten years. This situation poses a whole set of problems. If the demographic decline is one of the main arguments put forward to justify this drop in teaching numbers, the deletion appears unrelated to the drop in the number of students enrolled in Martinique establishments. According to the figures returned to him, there would be 647 fewer students in general and technological high schools and 33 more students in vocational high schools for 45 class cuts. At a rate of 28 students per class, the closures appear unrelated to the effects of the demographic decline. Mr. Serge Letchimy draws the attention of the Minister of National Education to the policies for assigning teachers to overseas academies, notably Martinique. On the one hand, centers of material and moral interests (CIMM) have become a legal priority, in application of Law No. 2017-256 of February 28, 2017 on programming relating to real equality overseas and laying down other provisions in social and economic matters. and the circular adopted on March 1, 2018 by the Minister for Overseas Territories and the Minister for the Civil Service which calls on State services to quickly implement the provisions in question. Reforming the law of January 11, 1984, they make the centers of material and moral interests in one of the communities governed by articles 73 and 74 of the Constitution and in New Caledonia a legal priority of allocation for all state officials. Mr. Serge Letchimy draws the attention of the Minister of Action and Public Accounts to the budgetary situation of the local authority of Martinique (CTM). On March 29, 2016, the CTM Assembly adopted the administrative account for the 2015 financial year with a deficit of -23,637,715.22 euros. Seized accordingly, the regional audit chamber (CRC), by its opinion no. 2016-0147 of September 14, 2016, recalculated the result and put it into effect. clearly a surplus of 535,110.20 euros. This opinion was confirmed by a letter from the first president of the Court of Auditors dated October 24, 2017 addressed to the president of the CTM. Since that date, neither the CTM Assembly nor the executive president of this institution have integrated these CRC corrections into the budget documents of the institution. This situation was noted by the prefect of Martinique by letter dated 17 October 2017 which also did not give rise to a modifying decision. As a result of all this, it appears that all of the budgetary deliberations taken since September 2016 are tainted by a lack of sincerity. This situation is completely incompatible with the missions and position of an institution like the CTM in the economic and social context of Martinique. Their national grievances mainly concern the increase in the number of intensive care beds, the recognition of the specificity and skills linked to exercise in this service, the unfreezing of the index point, the implementation of a salary increase and the creation of a new index bonus. adapted to the workload of caregivers. Mr. Serge Letchimy draws the attention of Mr. Keeper of the Seals, Minister of Justice, to the aftermath of the shooting of February 14, 1974 in Chalvet in Martinique. That day, agricultural workers who had been on strike for several weeks were surrounded by mobile gendarmes who opened fire, leaving one dead and several injured, five of whom were officially recognized at the time. Two days later, the body of another striking worker was was discovered by fishermen. This brought the number of deaths that day to two, in a new illustration of the resilience of violence stemming from the colonial state, beyond the hopes born of departmentalization in 1946. This movement and its repression found their origin in a double dynamic, cyclical and structural. In 1974, Martinique was faced with a serious economic crisis due to the increase in prices imported foodstuffs and the resulting significant contraction in purchasing power as well as the increase in unemployment resulting in particular from the crisis in the sugar industry. In this context, the structural inequalities suffered by overseas populations, themselves stemming from the colonial period, were all the more burdensome for workers, particularly agricultural workers, since the minimum wage in force in France was not applied there even though the cost of living was very high there. One of the victims is still alive. These injuries caused serious after-effects which will prevent him from returning to normal professional activity. No more than his comrades who are now deceased, this person has not received compensation for the tragedy and damage suffered. M. Serge Letchimy attire l'attention de Mme la ministre des sports sur l'inclusion du karaté parmi les sports additionnels lors des JO de 2024. La loi n° 2018-202 du 26 mars 2018 relative à l'organisation des jeux Olympiques et Paralympiques de 2024 comporte plusieurs dispositions visant à assurer la transparence dans l'organisation de ces JO. Dans le cadre de cette organisation, le Comité d'organisation des jeux Olympiques (COJO) a été amené à proposer au Comité international olympique l’ajout de sports additionnels autorisés à participer à cette compétition. Or, les critères sur lesquels repose le choix de ces sports n'a fait l'objet d'aucune publicité ni explication quant à leur caractère objectif. Contrairement aux obligations posées par la loi susmentionnée, le cadre organisationnel des jeux manque ainsi totalement de transparence. Le karaté fait partie des disciplines sportives qui n'ont pas été choisies, sans que la raison n'en soit clairement explicitée. En France, ce sport est pourtant fort de 5 000 clubs présents dans l'Hexagone comme dans les outre-mer. Il compte plus de 250 000 licenciés. Il a rapporté 172 médailles de niveau mondial dont 52 titres et 437 médailles de niveau européen dont 152 titres. Il s'agit donc d'un sport très installé, très pratiqué par la jeunesse en France comme en Europe et dans le monde entier. Il semblait ainsi un candidat naturel pour figurer parmi les sports additionnels présentés par le COJO au CIO. En conséquence, il lui demande de bien vouloir procéder à la communication des critères utilisés par le COJO pour choisir les sports additionnels qui participeront aux jeux Olympiques de Paris de 2024. Il lui demande également de communiquer les grilles d'évaluation qui ont conduit à refuser d'inclure le karaté parmi les sports additionnels retenus.

Mr. Serge Letchimy draws the attention of the Minister of Action and Public Accounts to the persistent difficulties regarding the obligation to submit accounts to the registry of the commercial court, imposed on overseas operators leasing equipment eligible for tax assistance referred to in articles 199 undecies B and 127 undecies of the general tax code. Indeed, the deadline conditions imposed by the legislation (30 days from the date of approval of the accounts at the general meeting) seem difficult to maintain due to the workload of accountants during reporting periods or even delays from commercial court registries. These delays result in an increase in the number of adjustment notifications to investors. They also result in the refusal of reimbursement of the tax credit to operators or the loss of retrocession of the tax advantage which they could have benefited from. This situation seems particularly penalizing in a difficult economic context and in practice renders tax support schemes for overseas economies ineffective due to the frequent refusal of the operators concerned to benefit from these support schemes. Mr. Serge Letchimy questions the Minister of Action and Public Accounts on the reform of enhanced leave granted to civil servants from overseas, planned for 2020. The principle of territorial continuity is a fundamental element of the social, political and institutional contract between the French Republic and its overseas territories. Among the measures which give substance to this principle, enhanced leave occupies a completely essential. However, for several years, overseas elected officials have noted an increasingly limited allocation of enhanced leave, arousing the anger of the 35,000 civil servants likely to benefit from it and who see the link with their native land diminishing over time. This situation is linked to the fact that the administrations concerned tend to refuse, more and more frequently, domiciliation, in an overseas region, of the “centers of material and moral interests” of the requesting agents. The DGAFP circular of January 3, 2007 relating to the conditions for granting enhanced leave to agents of the three public functions, recalled by the interministerial circular of March 1, 2017, nevertheless insisted on the fact that the criteria generally used for their definition were not “exhaustive nor necessarily cumulative in nature”. However, the courts have recently encouraged this restrictive reading, ultimately preventing those concerned from having the fact recognized in law that they are indeed “originating” from these territories and that they are, therefore, legitimately justified in claiming the benefit of the measures precisely designed to allow them to maintain this link, despite the distance and the significant cost that this distance requires to be crossed. There is several months, the President of the Republic has made known his intention to reform the system of enhanced leave, arousing the concern of citizens who fear an additional attack against an already heavily weakened system. Whatever its modalities, this reform cannot succeed without the Government committing to recognizing the reality of the links which unite overseas people with their territory of origin. This broad interpretation of “centers of material and moral interests” is also essential for the implementation of the measures which were unanimously adopted within the framework of Law No. 2017-256 of February 28, 2017 on programming relating to real equality overseas and laying down other provisions in social and economic matters, with a view to accelerating the procedures for transferring civil servants from overseas to post in other territories or in France. He therefore asks him to explain what the concrete modalities of the envisaged reform of enhanced leave will be, and the way in which the centers of material and moral interests will henceforth be recognized for those from overseas departments, regions and communities.

Mr. Serge Letchimy draws the attention of the Minister for Europe and Foreign Affairs to the deterioration of the political situation in the Republic of Haiti. On the night of February 6 to 7, 2021, the Haitian authorities announced the arrests of 23 people, including several senior officials and magistrates of the country, accused of having organized an attempted coup d'état and assassination against the President of the Republic, Mr. Jovenel Moïse. Ces Arrests took place in a deleterious political climate while numerous demonstrations are organized in the country by the population and opposition parties, denouncing the President's continued illegitimate power. Elected for the first time on October 25, 2015 during a vote canceled for fraud, Jovenel Moïse was re-elected and was sworn in on February 7, 2017 for a 5-year mandate. Significant differences of opinion on the end of his mandate exist between the ruling party and the oppositions, who accuse him of strengthening his authority in defiance of the country's Constitution and democratic requirements. Worsened by these political unrest, the economic and social situation in Haiti is catastrophic. The economy is at its lowest point and is contributing to the exacerbation of an unprecedented climate of violence. While the international community has seized this question, France remains hesitant despite the long and painful shared history that unites these two countries. M. Serge Letchimy attire l'attention de M. le ministre de l'agriculture et de l'alimentation sur l'importation de produits agricoles ne respectant pas les normes de production imposées aux producteurs européens. L'article 44 de la loi n° 2018-938 du 30 octobre 2018 sur l'équilibre des relations commerciales dans le secteur agricole et alimentaire et une alimentation saine, durable et accessible à tous acte en effet qu'il est « interdit de proposer à la vente ou de distribuer à titre gratuit en vue de la consommation humaine ou animale des denrées alimentaires ou produits agricoles pour lesquels il a été fait usage de produits (...) non autorisés par la réglementation européenne ou ne respectant pas les exigences d'identification et de traçabilité imposées par cette même réglementation ». Cette disposition a de fait pour objet de mettre un terme à la concurrence déloyale associée, pour les producteurs agricoles de l'Union européenne, aux importations de produits ne respectant pas, de fait, les normes très contraignantes imposées par la réglementation européenne en vue de garantir aux consommateurs européens un niveau élevé de sécurité alimentaire. Or, malgré le dernier alinéa de l'article en question mentionnant que « l'autorité administrative prend toutes mesures de nature à faire respecter l'interdiction prévue », l'application de cette disposition légale, plusieurs mois après son adoption, semble toujours se faire attendre, menaçant aussi bien la pérennité de nombreuses exploitations agricoles que la sécurité alimentaire des consommateurs. Des organisations agricoles ont pourtant proposé à cet effet la création d'un comité réunissant la direction générale de la concurrence, de la consommation et de la répression des fraudes (DGCCRF), de la direction générale de l'alimentation (DGAL), de Agence nationale de sécurité sanitaire de l'alimentation, de l'environnement et du travail (ANSES) et des organisations professionnelles agricoles représentatives, chargé de réaliser un inventaire précis de tous les produits, médicaments vétérinaires et méthodes de traçabilité autorisés dans les pays tiers et interdits sur le territoire de l'Union européenne. Il lui demande donc quelles dispositions il compte prendre pour faire rapidement appliquer l'article 44 susvisé.

La population étudiante internationale est aujourd'hui en hausse, les mobilités académiques sont de plus en plus courantes dans les parcours de formation et ce mouvement s'intensifiera dans les prochaines années. Il y a actuellement 5,5 millions d'étudiants en mobilité à travers le monde et ils devraient être 9 millions en 2025 (Unesco, 2018). Le plan « Bienvenue en France », présenté par le Premier ministre le 19 novembre 2018 et porté par le ministère de l'enseignement supérieur, de la recherche et de l'innovation (MESRI), vise ainsi à renforcer l'attractivité de notre pays avec un objectif clairement affiché: accueillir au moins 500 000 étudiants internationaux à l'horizon 2027. De par son histoire, sa culture et son rayonnement, la France a toujours été un grand pays d'accueil pour les étudiants du monde entier. Il s'agit ainsi de la 4e puissance mondiale pour l'accueil d'étudiants internationaux et de la première du monde non-anglophone. Ce statut n'est pas acquis et pourrait être significativement remis en cause faute de modernisation de notre politique d'accueil. En effet, de nouveaux acteurs universitaires internationaux, en Chine, en Turquie, en Inde ou au Moyen-Orient s'engagent ouvertement pour attirer des étudiants du monde entier en déployant des stratégies très volontaristes. Afin de remplir l'objectif annoncé par le Premier ministre, le plan « Bienvenue en France » décline trois priorités d'action. Il s'agit, tout d'abord, d'améliorer les conditions d'accueil et de séjour des étudiants internationaux afin de hisser nos établissements d'enseignement supérieur au niveau des meilleurs standards internationaux en la matière. Cela consiste en une simplification des procédures de délivrance de visas, en la création de guichets uniques dans les universités pour que les étudiants internationaux aient un interlocuteur identifié, et en proposant davantage de formations en anglais et plus de cours de français intensif pour les étudiants non francophones. Dès 2019, le fonds "Bienvenue en France" doté de 10 millions d'euros, soutiendra ces actions concrètes et un label sera mis en place par Campus France pour permettre aux futurs étudiants d'identifier les établissements les plus investis dans leur accueil. Cette initiative sera financée au moyen de frais d'inscription différenciés afin de permettre aux étudiants internationaux qui en ont les moyens de pouvoir contribuer, à leur tour, au financement de l'université. Cela s'accompagnera d'une série de mesures aimed at consolider notre politique de solidarité internationale à destination des étudiants internationaux qui en ont le plus besoin. Ainsi, le nombre de bourses et d'exonérations de droits d'inscription délivrées au niveau de l'État, soit par le ministère de l'Europe et des affaires étrangères, soit par le ministère de l'enseignement supérieur, de la recherche et de l'innovation, sera multiplié par trois. Les universités pourront à leur tour définir leur politique de solidarité internationale en délivrant des bourses et des exonérations supplémentaires. Les étudiants internationaux qui bénéficieront de ces bourses auront une priorité pour l'accès au contingent dédié de logements étudiants gérés par les CROUS. Des dispositifs complémentaires pourront également être mis en œuvre par les collectivités territoriales qui le souhaiteront. Pour les étudiants internationaux qui n'obtiendront pas de bourses ou d'exonérations nationales ou universitaires, l'État continuera de prendre à sa charge les deux tiers du coût des formations en signe d'ouverture et de solidarité. Que ce soit dans le cadre d'un accord international, de bourses nationales ou de bourses d'établissements, aucun étudiant international aujourd'hui inscrit en France dans une formation ne sera concerné par l'application des droits différenciés. Des mesures d'exonération seront également appliquées aux étudiants suisses, québécois ou venants en France dans le cadre d'un partenariat entre universités qui prévoit déjà une exonération, notamment les étudiants qui sont accueillis dans le cadre de programmes d'échange comme Erasmus+. Le ministère en charge de l'enseignement supérieur et de la recherche veillera également à ce que les frais de scolarité des doctorants internationaux puissent être compris dans les financements de leurs thèses afin de conforter le rayonnement international des établissements universitaires français. Le ministère de l'enseignement supérieur, de la recherche et de l'innovation réaffirme la relation privilégiée de la France avec plusieurs États du Maghreb et d'Afrique, ainsi que la formidable richesse culturelle que représente la Francophonie. Les bourses accordées par le ministère de l'Europe et des affaires étrangères concerneront prioritairement les étudiants ressortissants de ces États partenaires. Il en va de même pour celles qui seront décidées par les universités. Le troisième volet du plan « Bienvenue en France » vise à soutenir la projection internationale des établissements français. Plus d'étudiants internationaux doivent pouvoir choisir la France et l'enseignement supérieur français sans nécessairement quitter leur pays. Un fonds d'amorçage de 5 millions d'euros permettra ainsi de soutenir les projets qui voient le jour, dans le prolongement du campus franco-sénégalais annoncé par le Président de la République en février 2018 ou du campus Franco-tunisien. L'AFD (agence française de développement) sera ensuite chargée de soutenir l'implantation des établissements français à l'étranger. La stratégie « Bienvenue en France » vise donc à développer l'attractivité française tout en donnant l'opportunité aux étudiants internationaux qui le souhaitent de choisir la France et son enseignement supérieur.

Mr. Serge Letchimy draws the attention of the Minister of National Education to the conditions for the appointment of national education officials overseas. Each year, winners of the national education competitions originating and residing in one of the overseas regions or communities are appointed to positions domiciled in French academies, such as Créteil or Versailles.
