Question 37261 — people with disabilities

France · National Assembly

Mr. Mustapha Laabid draws the attention of the Minister of National Education, Youth and Sports to the precarious situation of those accompanying children with disabilities (AESH). Despite the progress made thanks to the 2019 reform aimed at improving the working conditions of these caregivers essential to the inclusion of children with disabilities in schools, almost generalized part-time work prevents AESH from make a decent living from their work with an average monthly remuneration of 760 euros for 24 hours of weekly work. In addition, the generalization of localized inclusive support centers (PIAL) has had perverse effects, notably the reduction in the number of hours of effective monitoring for students and an increase in travel between establishments for AESH, thus making it almost impossible to acquire another job. to achieve decent remuneration. He would therefore like to know his position regarding this situation and possible courses of action to remedy it.

Question 37156 — foreign trade

France · National Assembly

Mr. Mustapha Laabid alerts the Minister Delegate to the Minister for Europe and Foreign Affairs, responsible for foreign trade and attractiveness, about the policy pursued by China towards the Uyghur minority. On January 12 and 13, 2021, the United States, the United Kingdom and Canada announced plans to ban the importation of goods containing cotton fiber or tomatoes, including canned goods and sauces, grown under the form of forced labor by the Uyghur minority in the Xianjiang region (revealed by the study by German anthropologist Adrian Zenz, published in December 2020). On December 23, 2021, the Ministry of Europe and Foreign Affairs mentioned France's intention not to sign the agreement between the European Union and China on investments as long as the latter does not commit to ratifying the Organization's convention. international labor law prohibiting forced labor. However, on December 30, 2020, France finally signed this agreement, contenting itself with a promise from China to make “continuous and sustained efforts towards ratification [of this convention]”. By virtue of the deep attachment to the values of human rights that France carries throughout the world, it must go further in its condemnation of the situation of the Uighurs and can help deter China more effectively, for example by joining the United States, Canada and the United Kingdom in their refusal to import Chinese products emanating from this forced labor. He asks her her intentions on this subject.

Indeed, these non-profit associations ensuring in particular the renovation of built heritage must face significant expenses linked to the intervention of professionals. The interview and the restoration of heritage is one of the Government's major projects, as announced by the Minister in November 2017. Consequently, he asks him if this solution is possible and if reflection is underway at the ministry on this subject.

Question 10632 — administration

France · National Assembly

Question 35902 — maternity health insurance

France · National Assembly · 1 February 2021

Mr. Mustapha Laabid draws the attention of the Minister of Solidarity and Health to the reimbursement by health insurance of medications based on anti-CGRP monoclonal antibodies whose antimigraine action has been recognized. Aimovig (erenumab) from the Novartis laboratory has had marketing authorization since 2019. Emgality (galcanezumab) from the Lilly laboratory and Ajovy (fremanezumab) obtained marketing authorization in June 2020. Reimbursement of these drugs is supported in many European countries. This is particularly the case in Spain, Belgium, Germany, Italy and Slovakia... However, their cost is around between 400 and 600 euros per month. Migraine is classified by the World Health Organization among the twenty diseases with the greatest societal impact and even rises to ninth place if only the female population is considered. In France, according to the French federation of neurology, nearly 20 million working days are lost due to migraine and the health costs caused annually by the latter represent nearly 3 billion euros. Consequently, he asks it to please specify what measures the Government plans to take with a view to providing for the reimbursement of medicines based on anti-CGRP monoclonal antibodies.

Question 15045 — public procurement

France · National Assembly · 11 November 2018

Mr. Mustapha Laabid draws the attention of the Minister of the Economy and Finance to the remote organization of public service delegation commissions. Ordinance no. 2015-899 of July 23, 2015 (art. 101) amended article L. 1414-2 of the general code of local authorities which now provides that “the deliberations of the tender commission may be organized remotely under the conditions of order no. 2014-1329 of November 6, 2014.” This provision results in the establishment of videoconference calls for tenders in communities with a large geographical area, in particular regional councils, and provides a real solution to the meeting of the quorum necessary for the holding of this body. However, the text does not envisage this possibility for the Public Service Delegation Commission and this then even though these two bodies have strong similarities (identical composition, field of competence linked to public procurement). Furthermore, Ordinance No. 2014-1329 relating to remote deliberations of collegial administrative bodies, which applies to local authorities, with the exception of its deliberative bodies, seems to allow CDSPs to benefit from the flexibilities of remote organization. Also, he questions him about the possibility of organizing public service delegation commissions by videoconference, or even audioconference.

Question 15044 — public procurement

France · National Assembly · 11 November 2018

Mr. Mustapha Laabid draws the attention of the Minister of the Economy and Finance to the organization of the competitive procedure with negotiation. Above the European thresholds, the procedures allowing negotiation with economic operators are the competitive procedure with negotiation (article 71 of decree no. 2016-360), the negotiated procedure with prior competitive bidding (article 74 of the aforementioned decree) and competitive dialogue (article 75 of the aforementioned decree). The 2016 reform of public procurement regulations allowed expanded use of these negotiated procedures, which corresponded to a strong expectation of public purchasing professionals for whom negotiation is a lever for purchasing performance and good management of public funds. The negotiated purchase is, in fact, a purchase tailored as closely as possible to the need and paid at the right price. The procedure competitive with negotiation, the terms of which are specified in Article 72 and Article 73 of Decree No. 2016-360 relating to public procurement, provides for a two-stage mechanism: a first phase dedicated to the call for applications, then a second phase dedicated to offers and negotiation. In a competitive procedure with negotiation, the minimum time for receipt of applications is 30 days, reduced to 15 days for contracting entities working through the negotiated procedure with prior competitive bidding. This first phase has a significant impact on the procedure time, with the risk of slowing down the use of this type of procedure or shortening the time dedicated to negotiations, which nevertheless constitutes the main interest of this procedure. This procedural cumbersomeness is all the less understandable in view of the impetus for simplification inspired by the latest reform of public procurement and even though the Government displays the desire to support innovation through public procurement. He therefore asks that the organization of this procedure be studied according to a so-called open procedure, allowing the simultaneous reception of applications and offers.

Question 7240 — businesses

France · National Assembly · 3 October 2018

Mr. Mustapha Laabid questions the Minister of Action and Public Accounts on the application of the patronage regime to food distribution companies. Food distribution companies which donate products for the benefit of works or organizations of general interest, carrying out an eligible activity within the meaning of article 238 bis of the general tax code, benefit from a tax reduction within the framework of what is called the patronage regime. New economic players have emerged in recent years with the aim of optimizing the fight against food waste and improving local solidarity in favor of the most deprived people. These services aim, in particular, to train staff of companies in the food distribution sector in the collection of unsold products, likely to be used by associations helping people in difficulty; to make storage equipment available to these companies; to monitor the quality of donations; sometimes to organize the transport of goods donated to associations, etc. He is asked to specify whether the transport service invoiced by the service provider, facilitator of donations, can be included in the tax reduction base from which companies benefit. food distribution sector. Furthermore, it is asked to specify whether the invoice from the same service provider generally covering the management of the collection of donations intended for associations can be included in the basis of this same tax reduction, as long as it presents a sufficiently direct link with the donation of food products eligible for the patronage regime. Practices are currently disparate. He is necessary to clarify the situation with regard to all players in the sector. He would therefore like to know his intentions on these questions.
