Mr. Luc Geismar draws the attention of the Minister of Ecological Transition to the legal weaknesses that weigh on the classification of hamlets as agricultural zones in local town planning plans. Indeed, national town planning policies have strengthened provisions for the preservation of agricultural and natural spaces. The actions of public authorities must therefore promote “urban renewal, controlled urban development, the restructuring of urbanized spaces, the revitalization of urban and rural centers” while ensuring “economical use of natural spaces and the preservation of spaces allocated to agricultural and forestry activities” (article L. 101-2 of the town planning code). From this perspective, the construction possibilities in hamlets and other areas of diffuse urbanization, including in hollow teeth, have been strongly restricted since the Grenelle and ALUR laws. The law specifies in particular that the PLU regulations can only exceptionally delimit in natural, agricultural or forest areas sectors of limited size and reception capacity in which constructions can be authorized. In order to respond to these national issues, certain structures have the practice of asking that the urban area, outside urban areas, or strictly reserved for large villages, structured and served by collective networks. In other cases, hamlets intended to be built can be considered as STECAL (classification in Ah or Nh generally) after advice from the departmental commission for the preservation of natural, agricultural and forest areas. Thus, “sectors of the municipality, equipped or not, to be protected due to the agronomic, biological or economic potential of agricultural land can be classified as agricultural zones” (article R. 151-22 of the town planning code). En effet, les effectifs de gendarmerie du département de la Loire-Atlantique n'ont que très peu augmenté entre 2010 et 2020, puisque seulement 37 gendarmes supplémentaires ont été affectés sur ce territoire durant cette période. Or, dans le même temps, la population de Loire-Atlantique a cru de 1,2 % par an, cette dynamique semblant se poursuivre. Selon l'Insee, la population pourrait ainsi atteindre entre 1,55 et 2,01 millions habitants à l'horizon 2030, contre 1,426 million en 2019. Cette maigre augmentation des effectifs de gendarmerie est source d'insécurité dans le département puisque, sur les 207 communes qui le composent, seules 9 sont en zone police nationale et les 198 autres se situent sur des zones gendarmerie. La conséquence de cette situation est une délinquance en augmentation et la Loire-Atlantique est aujourd'hui le troisième département le plus touché par la délinquance, dans ses zones gendarmerie. C'est pourquoi il souhaite l'alerter sur la nécessité de renforcer les effectifs de gendarmerie de Loire-Atlantique afin de rattraper le retard accumulé ces dix dernières années, et l'interroger sur la prise en compte de cette augmentation de la délinquance dans les zones gendarmerie de Loire-Atlantique par le ministère de l'intérieur.

Indeed, in application of Directive No. 2023/959 amending Directive 2033/87/EC, the EU Emissions Trading System (ETS) will be extended from January 1, 2024 to CO2 emissions from all large ships entering EU ports, regardless of their flag. This system aims to encourage energy efficiency, low carbon solutions and the reduction of the price difference between alternative fuels and traditional maritime fuels. To ensure a gradual transition, shipping companies must only return quotas for part of their emissions during an initial implementation period. Thus, from 2025, 40% of their emissions declared in 2024 will be affected. This additional resource is distributed by auction between Member States by a predefined distribution key, mainly based on historical ETS emissions. The receipt of the proceeds from the auctioning of carbon quotas in this system confers on the State significant budgetary space to finance the ecological transition. This is why from 2024, the ETS directive binds Member States to direct 100% of auction revenues towards climate spending. Although since 2013, finance laws provide that France's auction revenues are allocated to the National Housing Agency (ANAH) within the limit of a ceiling, the rest will be directly paid into the general state budget. For 2023, its total gross product is estimated at 2.4 billion euros, of which 700 million euros would be allocated to ANAH. This resource is inevitably set to increase significantly in the years to come, linked to the expansion of the carbon market to maritime transport. However, article L. 3511-3 of the code of public health prohibits propaganda or advertising, direct or indirect, in favor of tobacco, tobacco products or ingredients defined in the second paragraph of Article L. 3511-1. Or ce critère n'a toujours pas évolué et ne permet pas de rendre éligibles des véhicules polluants dont la première immatriculation est postérieure au 1er janvier 2011 au profit de véhicules moins polluants. Dans un contexte où les gestes en faveur de la transition écologique sont particulièrement encouragés, il en résulte donc que dans la pratique, l'accès à ce dispositif est pourtant limité. Aussi, dans un souci de cohérence, il souhaiterait savoir ce que prévoit le Gouvernement pour faire évoluer la date d'éligibilité des véhicules polluants pour un plus large accès à la prime.

Des efforts ont déjà été concédés pour renforcer les effectifs de police à Nantes : 70 policiers nationaux y sont installés depuis dix-huit mois dans le cadre d'un contrat de sécurité intégrée signé au printemps 2021, des CRS et des agents de la CRS 8 ont également été envoyés en renfort le 4 octobre 2022, et la création d'un CRA en Loire-Atlantique a été annoncé. Dans ce contexte, il souhaite savoir si la localisation envisagée pour ce centre reprendrait la même configuration que celui de Rennes, à savoir à proximité de l'aéroport. This fraud is particularly significant on online marketplaces, where controls by the National Tax Investigation Department (DNEF) have highlighted that “98% of companies operating on the controlled marketplaces were not registered and did not pay VAT”. This situation is not acceptable. For this reason, the Initiatives taken in recent years, both at national and European level, are to be welcomed. Thus, the obligation for platforms to declare the income of their sellers, contained in the anti-fraud law passed by Parliament in October 2018, constitutes a major step forward. Likewise, Directive 2017/2455 on e-commerce, which is due to come into force in 2021, should also represent definite progress in fight against fraud on online marketplaces.
