Mr. Pierre-Alain Raphan questions the Minister for Europe and Foreign Affairs on the situation of French people detained abroad. The news regularly reminds everyone that French people are detained abroad in delicate situations. The reasons for their arrest or the conditions in which they are sometimes detained are worrying and the MP wants France to do everything in its power to ensure the victims and their family respect for fundamental rights. The MP would like to know the status of the current situation of this phenomenon. He asks him if he can tell him: the number of French people detained abroad, the list of countries in which they are detained, the reasons for which they are detained, the share of French people detained abroad for unknown reasons, the share of French people in arbitrary detention, the share of French people detained by states, the share of French people detained by non-state groups, their status (expatriates, students, journalists, tourists, professionals, etc.), the share of dual nationals, the age groups of French people detained, the actions taken by French diplomacy to ensure that their rights and dignity are respected and the actions taken by French diplomacy to release them when justified.

Mr. Pierre-Alain Raphan questions the Prime Minister on the implementation in public policies of the law aimed at taking into account new wealth indicators in the definition of public policies entered in the Official Journal under number 2015-411 adopted on April 13, 2015. Indeed, "The Government submits annually to Parliament, on the first Tuesday in October, a report presenting the evolution, over past years, of new wealth indicators, such as indicators of inequality, quality of life and sustainable development, as well as a qualitative or quantitative assessment of the impact of the main reforms undertaken the previous year and the current year and those envisaged for the following year, in particular within the framework of the finance laws, with regard to these indicators and the evolution of the gross domestic product. This report can the subject of a debate before Parliament. Firstly, would it be possible to have access to the reports for 2019 and 2020? Secondly, it would be necessary to know how these indicators have been integrated into recent reforms. Furthermore, what would be the methods and tools most suited to each ministry to enable them to manage public policies accordingly? Finally, the exceptional situation crossed by societies mobilizes citizens on the organization of public policies and the role of Parliament. This is why, in order to give political action sustainable development objectives, it seems, on the one hand, appropriate to know the outcomes of this law and, on the other hand, to question the measurement tools that are clear and useful to as many people as possible to guarantee reciprocal understanding. Mr. Pierre-Alain Raphan questions the Minister of the Interior on the subject of sexual and gender-based violence. The phenomenon of sexual and gender-based violence which affects a significant number of users of VTC services and which has been revealed for several weeks, is raising concerns. In this context, the MP met on December 11, 2019 several women who told him about the crimes they suffered from VTC drivers or people having usurped the identity of certain drivers. Today, the question clearly arises of the responsibility of the platforms in the measures to be taken as quickly as possible so that such crimes no longer occur. In this context, the MP wishes to know precisely the extent of the phenomenon. Les services du ministère de l'Europe et des affaires étrangères (MEAE), tant à Paris qu'à Téhéran et Libreville, suivent avec la plus grande attention les situations respectives de Mme Fariba Adelkhah, de M. Benjamin Brière et de MM. Brice et Grégory Laccruche Alihanga. Au titre de la protection consulaire prévue par la convention de Vienne du 24 avril 1963 - dont les autorités iraniennes refusent toujours l'entier bénéfice à Mme Adelkhah en raison de sa nationalité iranienne - la France a, à plusieurs reprises, demandé et obtenu des autorités iraniennes et gabonaises que les conditions de détention de ces compatriotes soient améliorées et que l'attention nécessaire soit portée à leur santé. Ces préoccupations ainsi que l'importance que la France attache au respect du droit à la défense sont régulièrement rappelées. Mme Fariba Adelkhah a été incarcérée une première fois le 5 juin 2019 et bénéficiait, depuis le 3 octobre 2020, d'une mesure d'assignation à résidence, sous le contrôle d'un bracelet électronique. À l'annonce de sa réincarcération, décidée sans aucune explication ni information préalable, la France a exigé sa libération immédiate dans une déclaration, le 12 janvier dernier. M. Benjamin Brière, condamné le 24 janvier 2022 par la justice iranienne à 8 ans de prison, a décidé de faire appel de cette décision. Il a bénéficié récemment de visites consulaires et mis un terme à la grève de la faim qu'il avait entamée le 25 décembre dernier. Les services du MEAE sont en lien permanent avec sa famille et son avocate. M. Brice Laccruche-Alihanga a été condamné le 29 octobre 2021 à 5 ans de prison ferme et n'a pas fait appel de cette décision. Il est poursuivi, avec son frère et plusieurs autres compatriotes, dans une affaire pour laquelle ils n'ont pas encore été jugés. Ils bénéficient de visites et d'appels consulaires réguliers depuis le début de leur détention, y compris lorsque les mesures prises par les autorités gabonaises en réponse à la crise sanitaire ne leur permettaient plus d'être en contact avec l'extérieur.

Mr. Pierre-Alain Raphan questions the Secretary of State to the Ministers of the Economy, Finance and Recovery, and Territorial Cohesion and Relations with Local Authorities, responsible for digital transition and electronic communications, on the competitive situation in the sector of new technologies applied to financial activities. On April 29, 2021, the Competition Authority issued an opinion on the evaluation of the competitive situation in the sector of new technologies applied to financial activities and, more particularly, to payment activities. The president of the authority mentions the “risk of strengthening the market power” of digital giants such as the American GAFA (Google, Apple, Facebook, Amazon) or, ultimately, the Chinese BATX (Baidu, Alibaba, Tencent, Xiaomi). This development seems particularly significant because platform-type players have considerable advantages to assert: they control ecosystems relying on large communities of users, have access to vast sets of data and have the technical capacity to put them to use. In addition, by relying, for payment processing, on traditional banking players and bank card groups, the large Platforms have the capacity to reap significant profits, without being subject to the regulatory constraints that weigh on banking players. The competition authority's opinion highlights the following risks: the competitive relationship between bank services and the services of new entrants; barriers to entry and expansion; the competitive advantages of the different players in the sector; a risk of strengthening the market power of BigTech and locking in consumers. In October 2020, after sixteen months of investigations and a report of more than 400 pages, the antitrust subcommittee of the American House of Representatives precisely described the monopoly of one of the GAFA on the applications market. According to American parliamentarians, this company notably prevents the emergence of any competition thanks to dual control of its operating system and its store. In doing so, the mechanics of the rule laid down by the manufacturer on in-app purchases, and in particular the famous 30% commission levied on the price of applications and also on subscription services, constituted from its conception a distortion of competition. This company also requires everyone to use its IAP (in app payment) payment system and has made “ sherlocking” (practice which consists of copying innovative applications for its own benefit by integrating them as a new free service) an assumed practice of its economic development to the detriment of the competition. He asks him to enlighten him on the Government's strategy and proposals in the face of this phenomenon impacting the sovereignty of France and the emergence of territorial actors in these sectors. He wishes know what measures are being taken by the Government to regulate this monopolistic behavior.

Mr. Pierre-Alain Raphan draws the attention of the Minister of National Education to the situation of school life assistants and those accompanying students with disabilities. The inclusion of students with disabilities is conditioned by the quality of the support they receive on a daily basis. However, it seems that the working conditions, training and remuneration do not in any way encourage staff to engage sustainably on this path. This turnover brings its share of harmful consequences to the beneficiary children who above all need stable and lasting mentors. This precariousness is all the more present in public agricultural education where for equal work, remuneration is around 25% lower than for staff who work under contract with national education. He therefore asks him what measures the Government plans to implement to guarantee quality support for students with disabilities and eliminate inequalities in the treatment of AESH in public agricultural education and those in national education.

Only foreign nationals referred to in Article L. 120-4 of the National Service Code may sign a civic service or voluntary association contract with an approved legal entity. However, Algerian nationals are governed by special legal regimes not covered by the code of entry and stay of foreigners and the right to asylum and, as such, cannot engage in the civic service system. Considering the strong ties between the two countries, he therefore asks what measures the Government could take to correct this unequal treatment.
