The Ministry of National Education is very attentive to promoting the success of all students by putting in place the most appropriate conditions to contribute to this. The objective of the school is to develop the potential of all students and to lead them to mastery of the fundamentals: reading, writing, counting, respecting others. The difficulty, inherent in the learning process itself, is taken into account by each teacher in his daily action in class, with the support of the cycle's teaching team. In support and accompaniment of his action, the teacher can call, if necessary, on the specialized staff of the RASED (network of specialized aid for students in difficulty) whose work, specific and complementary, allows a better team response to the learning difficulties and adaptation to the academic demands experienced by certain people. students. Circular No. 2014-107 of August 18, 2014, currently in force, clarified the operation of the RASEDs and the missions of the personnel who work there. Their action is focused on helping students encountering persistent difficulties and preventing these situations. They help school teachers to analyze the situations of students in great difficulty and to construct appropriate responses. They can intervene at any time time of schooling in nursery and elementary school with students who are experiencing difficulties in order to help them overcome them. They are members of the teaching teams of the schools in which they work. Mme Natalia Pouzyreff appelle l'attention de M. le ministre d'État, ministre de l'intérieur, sur la procédure d'accueil des migrants dans les communes, Actuellement l'OFII traite directement et quasi exclusivement avec les bailleurs sociaux chargés de loger les populations migrantes, d'anciens hôtels ont été rachetés à cet effet, pour autant nourriture, vêtements ne sont pas systématiquement fournis. Il lui semble donc utile et nécessaire que les contrats passés entre l'État et les opérateurs type ADOMA, prévoient une procédure de premier accueil qui implique les élus locaux et permette aux associations de pourvoir aux besoins en nourriture, en cours d'alphabétisation et qui définisse les moyens en matière d'équipements (cuisines) et de sécurisation du site et ce dès le premier jour d'arrivée.

Mme Natalia Pouzyreff interroge M. le ministre d'État, ministre de l'intérieur, sur le traitement des demandes d'asile des migrants sous règlement Dublin. La ville d'Achères dans les Yvelines accueillera ces jours-ci une centaine de demandeurs d'asile en provenance d'Afghanistan et du Soudan. Ces réfugiés sont, à ce qu'elle sait, en fin de droits. M. le ministre s'est récemment exprimé à ce sujet évoquant le traitement prioritaire qui serait accordé aux migrants sous règlement Dublin. Elle souhaiterait avoir des précisions concernant les échéances et délais envisagés de résidence de ces personnes dans la commune ceci afin d'adapter au mieux l'action des associations venant en soutien grâce à des cours d'alphabétisation par exemple et en vue d'informer la population locale de cette situation.

Mrs. Natalia Pouzyreff draws the attention of the Minister of Solidarity and Health to the methods of encouraging the continuation of the activities of senior doctors in the fight against medical deserts provided for by the “My health 2022” strategy. Indeed, the combination of employment and retirement, under Law No. 2014-40 of January 20, 2014 guaranteeing the future and justice of the retirement system, should make it possible to extend the exercise of the profession while gradually lightening the workload. This activity was intended to generate additional income to the retirement pension. However, it would seem that the weight of compulsory contributions allocated to the Autonomous Retirement Fund for Doctors of France (CARMF) is disproportionate to the income generated and does not provide any additional benefit. Thus, in 2021, an annual residual activity income of 20,000 euros entails an additional annual contribution to this income of 4,403 euros in sector 1 and 6,540 euros in sector 2, or 22% to 32% of the latter, according to the CARMF 2021 combined retirement-liberal activity guide. In other words, these retirement contributions would appear as a financial penalty which would not encourage the strengthening of a “medical presence in fragile territories”. She wants to know the position of the Government on this subject.

Ms. Natalia Pouzyreff draws the attention of the Minister to the Minister of Territorial Cohesion and Relations with Local Authorities, in charge of the city and housing, to the sale of a parking space within a co-ownership. Indeed, since a 2009 law, co-ownerships can include in their regulations a provision giving a right of priority to residents in the event of the sale of a lot of parking. Until now, this provision had to be voted unanimously (according to the different administrations questioned) in a general meeting, leading in many cases to deadlock situations where a single co-owner could oppose all the others and paralyze the action of the General Meeting. She therefore wishes to question him on the possibility of seeing the legislation evolve so that it is now included in article 20 of the law 2009-323 the possibility of including this provision in the regulations by a vote no longer unanimously by the co-owners but by a majority of the latter (that of two thirds seems the most appropriate) in order to put an end to situations of blockages, potential sources of conflicts and unnecessary tensions within the residences.

Ms. Natalia Pouzyreff draws the attention of the Secretary of State, to the Prime Minister, responsible for people with disabilities, to the mission letter dated March 28, 2019. Four ministries, including the one that the Secretary of State is leading, mandate the General Inspectorate of Finance and the Inspectorate of Social Affairs to carry out a mission relating to establishments and work assistance services (ESAT) of which there are 1,400 and which support 120,000 disabled people through work. L'objectif de la réforme du stationnement, mise en place depuis le 1er janvier 2018, après plusieurs années de travaux, est de donner davantage de compétences aux collectivités locales pour mettre en place un véritable service public du stationnement incluant la définition de la stratégie en matière de tarification et une meilleure incitation au paiement. Pour cela, le système est passé d'une logique de sanction pénale nationale, identique sur the whole of territoire, à une logique de redevance d'occupation domaniale, décidée et maîtrisée par les collectivités locales. Les communes peuvent désormais décider de soumettre à paiement (redevance) tout ou partie du stationnement sur leur voirie publique ainsi que le montant du forfait de post-stationnement (FPS) qui est dû en cas de non-paiement immédiat ou de paiement partiel de la redevance de stationnement correspondante. Le montant de ce FPS, dont le redevable est le titulaire du certificat d'immatriculation (CI), varie donc d'une commune à l'autre, à la différence de l'amende pénale qui vient sanctionner l'infraction de non-paiement. Si le redevable souhaite contester le forfait de post-stationnement, il doit d'abord déposer un recours administratif préalable obligatoire (RAPO) dans le mois suivant la notification du FPS. En cas de rejet, le redevable a un mois pour saisir la commission du contentieux du stationnement payant (CCPS). La réforme, en se fondant sur un principe de redevance d'occupation domaniale, conduit à identifier un « redevable d'une créance publique » et non plus un « responsable pénal ». Dès lors, le système est construit, à l'instar du système fiscal, autour d'un redevable légal unique, le titulaire du CI, facilement identifiable par la collectivité et ayant un lien objectif raisonnable avec le fait générateur du prélèvement réclamé. La question soulevée par le paiement du FPS par le locataire de courte durée d'un véhicule relève dès lors d'un sujet de droit civil contractuel entre le propriétaire du véhicule, seul redevable vis-à-vis de l'administration, et la personne à qui il confie son véhicule et contractuellement responsable de son bon usage. Dans le cadre de cette réforme, les problématiques des professionnels de la location de courte durée ont fait l'objet d'une attention particulière. Sans remettre en cause la construction juridique du dispositif par l'introduction d'un système de désignation ouvert au loueur, des dispositions spécifiques ont été introduites pour faciliter la mise en œuvre de la récupération du FPS auprès du locataire et l'exercice par ce dernier d'un recours. Il est ainsi prévu par les textes réglementaires: la télétransmission des avis de paiement, à l'instar de ce qui existait auparavant pour l'avis de contravention, entre l'agence nationale de traitement automatisé des infractions (ANTAI - qui notifie pour le compte des collectivités l'avis de paiement du FPS) et les professionnels, de façon à leur permettre de répercuter rapidement sur leur client l'avis des sommes à régler et leur droit au RAPO; la possibilité pour leur client d'exercer ledit RAPO pour le compte du loueur redevable légal, cela par le biais d'un mandat accordé par le loueur à produire devant le service instructeur. L'adaptation des conditions générales de vente est donc un élément clé de la bonne mise en œuvre de la réforme et de telles clauses ne peuvent être considérées comme des clauses abusives. À cet égard, il est possible de s'inspirer de la rédaction des contrats utilisés en Italie ou en Belgique qui s'appuient depuis de nombreuses années sur un système similaire. Le ministère chargé des transports, en lien avec les ministères concernés, s'attachera à accompagner les professionnels, notamment pour la rédaction de clauses types à insérer dans les conditions générales de vente du contrat de location.

Faced with the scourge of the misuse of nitrous oxide, particularly among young people, the law aimed at providing immediate responses to phenomena disturbing public order, security and the tranquility of our fellow citizens ("RIPOST") of August 18, 206 provides for a general ban on the possession, transport and transfer of this substance. From February 2027, individuals will no longer be able to obtain nitrous oxide. Moreover, the law creates an offense of inhalation punishable by one year of imprisonment and a fine of €3,750 and an offense of driving after clearly consuming psychoactive substances punishable by three years of imprisonment and a fine of €9,000. In order to facilitate proof of the misuse of nitrous oxide, particularly when driving a vehicle, the road safety delegation is helping to finance a study aimed at validating scientifically the detection of nitrous oxide in exhaled air using a detection device close to a breathalyzer.

Ms. Natalia Pouzyreff questions the Minister Delegate to the Minister of Solidarity and Families, responsible for disabled people, about Decree No. 2011-974 of August 16, 2011, relating to the allocation of the allowance to disabled adults to disabled people (AAH) suffering a substantial and lasting restriction for access to employment and to certain modalities of allocation of this allowance, which defines the restriction substantial and sustainable for access to employment (RSDAE). Article 2 stipulates that the following is compatible with the recognition of a RSDAE: “Professional activity in an ordinary work environment for a working period of less than half-time, as long as this limitation of working time results exclusively from the effects of the applicant's disability”. As a result, a disabled person with a disability rate between 50 and 79% working over a weekly period greater than or equal to half-time is considered to have no substantial and lasting restriction on access to employment and does not give rise to the right to AAH. The accumulation of AAH and income from professional activity is not possible in this case. This is a major obstacle to the development of the professional integration of disabled people and to the desire to increase the share of labor income in resources of AAH beneficiaries. The President of the Republic announced, during the National Disability Conference on April 26, 2023, that “the resumption of professional activity in the ordinary environment will be facilitated by a reform of the conditions for accumulating the disabled adult allowance and income derived from a professional activity carried out, beyond half-time”. Ms. Natalia Pouzyreff questions the Minister Delegate to the Minister for Ecological Transition and Territorial Cohesion, responsible for cities and housing, on the issues arising from the lack of accumulation of unpaid rent insurance and solidarity deposits. Article 55 of Law No. 2009-323 of March 25, 2009 on mobilization for housing and the fight against exclusion, provides that the security cannot be requested by a lessor who has previously taken out insurance guaranteeing the tenant's rental obligations. Except for the case of students and apprentices. This provision was intended to avoid the multiplication of constraints for tenants and to facilitate their access to housing. In reality, however, this measure proves to be counterproductive and becomes an obstacle to obtaining housing for some fellow citizens. In Indeed, the law allows insurers to reserve the right to refuse files when they consider that the applicant does not provide sufficient financial guarantees. However, regarding unpaid rent insurance, the policy generally applied by insurers is the refusal of all files from individuals finding themselves in an unstable professional situation: permanent contract during a trial period, fixed-term contract with less than 8 months remaining or still independent with less than 2 years of continuous activity. The refusal is understandable economically speaking, however this excludes, in fact, a large part of the workers and housing seekers. A situation which fuels recruitment difficulties and favors the development of scams and fraud, with applicants generally finding themselves in an emergency situation. The deputy questions the minister on what he is possible to put in place to overcome this problem. Ms. Natalia Pouzyreff draws the attention of the Minister of the Interior regarding the illegal occupation of public or private land by Travelers. The law of July 5, 2000 No. 2000-614, which establishes the principle of welcoming Travelers and promotes the balance between freedom of movement, decency of installation conditions and the concern of elected officials to avoid illicit installations, does not seem dissuasive enough and causes complex eviction procedures. Despite an effort by municipalities in recent years to comply with the requirements of welcoming Travelers, illegal settlement still causes too much harm to communities and fellow citizens. Indeed, the parking of Travelers on municipal land degrades and often leads to the cancellation of sporting activities or events planned on the occupied site and undermines the tranquility of the neighborhood. Eviction procedures are long and costly; communities alone bear the costs linked to dismantling, cleaning, rehabilitation, but also the administrative procedures that eviction involves without receiving compensation. To respond to the mayors' questions on the subject, procedures should be simplified and accelerated. Moreover, the President of the Republic Emmanuel Macron announced on September 14, 2021 during the closure of Beauvau security the establishment of a fixed fine in the face of this scourge of illegal occupation of land by travelers from the month of October 2021. This financial penalty could prove useful to municipalities. Mme Natalia Pouzyreff attire l'attention de Mme la secrétaire d'État auprès du ministre de l'économie et des finances, sur l'avenir du secteur automobile. Un projet de directive européenne vise à atteindre 35 % de véhicules neufs à émissions nulles ou faibles en 2030. La France souscrit aux objectifs ambitieux de réduction des émissions de CO2 et apportera certainement son soutien à cette directive. L'industrie automobile constitue une filière économique et industrielle de premier ordre pour le pays qui concerne près de 200 000 emplois. La transition envisagée ne manquera pas d'affecter l'ensemble de cet écosystème. À titre d'exemple, 40 % des 40 000 emplois de la filière que comptent les Yvelines pourraient être concernés. Il convient d'anticiper cette transformation notamment en mettant en place des programmes de reconversion des salariés vers les métiers liés aux transports propres. Dans ce contexte, elle souhaite savoir quelles solutions d'accompagnement sont envisagées pour répondre à ce défi majeur, tant économique, qu'industriel et sociétal.

In fact, most of the Tibetan migrants settled in this camp will be recognized as refugees and will be able to integrate into French society. The French Office for Immigration and Integration (OFII), which has the authority to make admission decisions in places of accommodation located throughout the territory, does not appear to offer accommodation to these applicants. asylum.
