Depuis 2017, la municipalité de Rillieux-la-Pape se bat pour sauver le centre chorégraphique national qui, victime d'un incendie, nécessite de lourds travaux. Suite au revirement de la région Auvergne-Rhône-Alpes, les crédits promis et actés, qui représentaient 50 % du montant des travaux, ont été annulés. M. le député souhaite savoir dans quelle mesure le CCN de Rillieux-la-Pape pourrait s'inscrire dans le programme très attendu par une grande partie de la jeunesse du ministère de doubler d'ici 2026 le nombre de centres chorégraphiques nationaux issus du hip-hop. Il souhaiterait également connaître de quelle manière le ministère de la culture envisage l'extension de l'accès au passe-culture aux zones rurales et aux secteurs difficiles.

Mr. Alexandre Vincendet draws the attention of the Minister of the Economy, Finance and Industrial and Digital Sovereignty to the proliferation of telecommunications pylons deployed by operators. He wishes to raise the problem of installing new pylons to support relay antennas in the territories when similar equipment is often already present nearby. While it is necessarily less costly for an operator to mount an existing pylon than to build a new one, the arrival of the Towercos model has reversed this common sense. Local elected officials and, on the front line, mayors, sometimes find themselves helpless in the face of actors who are reluctant to listen to them. Despite the refusals of certain municipalities and the free appeals requested by mayors, the operators obviously persist in their implementation efforts, even after judgments of inadmissibility of their requests by administrative courts. These projects clearly go against the spirit of the law of November 15, 2021 aimed at reducing the environmental footprint of digital technology in France, which was intended to be an incentive but unfortunately not binding in terms of sharing. Finally, the MP wishes to recall that article D. 98-6-1-II of the postal and electronic communications code insists on the fact that operators must encourage, as far as possible, the sharing of radio sites with other users. He therefore wishes to know what clear and effective, therefore binding, measures the State plans to put in place to guarantee compliance with this article by mobile telephone operators and towercos which - it must be remembered - are no longer regulated since the operators (them, regulated by ARCEP) removed their pylons from their assets.

Mr. Alexandre Vincendet draws the attention of the Minister of Labor, Health and Solidarity to the conditions giving civil servants the right to be granted long-term leave (CLD). Under the terms of article 57-4 of law no. 84-53 of January 26, 1984 establishing statutory provisions relating to the territorial civil service, territorial agents are entitled to obtain long-term leave “in the event of tuberculosis, mental illness, cancerous condition, poliomyelitis or serious and acquired immune deficiency”. This legislative provision was then extended to all civil servants, by regulation (article 29 of decree no. 86-442 of March 14, 1986). Pursuant to these provisions, public employees suffering from one of these five illnesses and who are placed on long-term leave may claim remuneration at full salary for a period of three years and half pay for a period of two years. Unfortunately, some agents may suffer from equally seriously debilitating illnesses such as Parkinson's disease, Charcot disease or multiple sclerosis. These illnesses require extensive treatment and prolonged care and their progressive nature generally does not allow a resumption of professional activity. The fact that these serious pathologies are not registered on the list allowing the granting of long-term leave, only entitles these people to long-term sick leave which maintains full salary for one year, then the salary is reduced by half for the following two years. In addition, long-term sick leave blocks the position occupied by the agent for three years, because it does not allow him to be released for the benefit of another agent, whereas the impossibility of activity of the sick agent is very often permanent. Finally, it seems surprising to him that tuberculosis or poliomyelitis, which are pathologies which have almost disappeared thanks to vaccination, are still present on this list, while Parkinson's disease which is a serious and disabling neurodegenerative disease or Charcot's disease are not there. In their 2021 information report, MPs Woerth and Park stated that the parallel market was between 15% and 25% of the total volume of cigarettes consumed in France. According to Public Health France, in 2021, 20.8% of smokers would have made their last purchase outside the network tobacconists. Finally, a KPMG report estimates that almost 40% of cigarette consumption in France comes from the parallel market. France alone represents 47% of the illegal volumes of cigarettes in the entire European Union. Indeed, the law is little or not applied to cross-border purchases, where individuals buy beyond what is permitted. As such, the MP wishes to know the results of the fines of 135 euros and the number of fines since the decree issued in March 2020. Mr. Alexandre Vincendet draws the attention of the Minister of Labor, Health and Solidarity to the turn of the working groups in progress with the General Directorate of Care Supply (DGOS) in charge of establishing the training of future dental assistants (known as level 2) as defined by the law of May 19, 2023 on improving access to care through trust in health professionals ("Rist 2"). This career enhancement has been supported by the dental profession for several years so that dental assistants (known as level 1) can have a perspective of development, to free up medical time for dental surgeons and to improve patient care. This new training will be fully financed by employers via the conventional training contribution managed by the skills operator (OPCO) of the sector. Currently, a dental assistant (known as level 1) who has obtained a level 4 qualification (bac level according to the nomenclature of diplomas) with 357 hours of theoretical training and 1,535 hours of practical training in the dental office cannot carry out any task in the mouth. He also cannot take x-rays. Obtaining new skills is essential to the ability to carry out delegated tasks and activities, some of which will be carried out in the mouth from the clinical examination requiring knowledge in oral medicine, to the performance of technical procedures such as scaling or the use on the patient of products and instruments with a toxic or traumatic risk. Training and learning must therefore be coherent and adapted. Their duration cannot be less than the time of initial level 4 training and therefore be logically level 5 (bac+2 according to the nomenclature of diplomas). However, during the working groups led by the DGOS with professionals in the sector, it was announced that this training would only be at level 4. Which implies a reduction in tasks, in particular the delegated procedures carried out in the mouth no longer free up medical time for the practitioner. Article L. 243-7 of the Social Security Code empowers recovery inspectors to verify the basis, rate and calculation of contributions intended to finance supplementary pension plans and insurance contributions. unemployment and contributions provided for by article L. 143-11-6 of the labor code on behalf of the managing institutions mentioned in article L. 351-21 of the same code. This same article specified that agreements concluded between the Central Agency for Social Security Organizations (ACOSS) and, on the one hand, the national compulsory supplementary pension organizations (AGIRC-ARRCO) and, on the other hand, Pôle emploi, set in particular (...) the remuneration for the service rendered by the organizations responsible for collecting contributions to the general system. Due to the expansion of the missions of recovery inspectors, characterizing the service thus rendered to the aforementioned organizations and following negotiations initiated within the framework of social dialogue, between the Union of National Social Security Funds (UCANSS) and the representative trade union organizations, an agreement was reached concluded on February 27, 2009. As such, a professional career path system (progress from level 6 to level 7 of the classification of jobs in the protocol of November 30, 2004) is formalized: it is based on recognition of mastery of the function (assessment of experience, results and skills implemented) and is the subject of allocated national funding (article 32 of the agreement of February 27, 2009). Since 2020, the missions of inspectors have been extended to other contributions based on salaries or specific categories of employment (OETH - obligation to employ disabled workers -, apprenticeship tax, vocational training), each contribution to be verified having specific rules for calculations, settlements or processing. Mr. Alexandre Vincendet draws the attention of the Minister of the Economy, Finance and Industrial and Digital Sovereignty to the removal of the tax advantage on non-road diesel (GNR) included in the law on January 1, 2024. This removal has been postponed four times in the last five years, demonstrating its unbearable nature for public works companies. To date, despite the Government's announcements, this removal still constitutes a pure measure of tax efficiency in the absence of an ecological alternative in terms of energy. In fact, only a few electric vehicles have appeared on the market. Hydrogen is not yet a mature technology and as for the use of biofuels, its cost is prohibitive. A fortiori, no support measure for the public works sector was voted during the latest budget discussions. The abolition of the GNR thus remains a measure that is difficult to sustain for companies in an inflationary context, reinforced by the recent implementation of extended producer responsibility (REP PMCB). In view of the above, a further postponement of the elimination of the tax advantage on the GNR seems essential during the next finance bill. This new postponement must be accompanied by a real ecological transition plan, as the Government is committed to implementing in other economic sectors. Public works companies are particularly awaiting the implementation of the following measures: as part of the multi-annual energy program, to indicate "black and white" access to low-carbon liquid fuels as a priority for non-road uses such as works public authorities with a clear commitment from public authorities to ensure production capacities. Le 1er janvier 2023, la zone à faibles émissions mobilité (ZFE) du Grand Lyon est entrée en vigueur pour les voitures des particuliers, après une période pédagogique de 4 mois. La cause affichée est indiscutable ; cependant, combattre les particules fines ne peut se faire au détriment des plus modestes, des travailleurs qui se lèvent tôt, les grands oubliés de cette écologie punitive. Car les classes populaires ne polluent pas volontairement : elles ne peuvent faire autrement. Ce dispositif vise à sanctionner les plus modestes qui ne peuvent s'acheter une voiture neuve au risque de les reléguer dans les banlieues, leur interdisant ainsi l'entrée dans les grandes villes. Face à la mobilisation d'une grande partie de la population et des élus locaux, la Métropole de Lyon a annoncé ralentir la cadence du déploiement de la ZFE par rapport au calendrier initial. Aussi, M. le député demande à M. le ministre ce qu'il compte faire pour mettre fin à la colère qui gronde face à la politique écologiste punitive de l'exécutif métropolitain lyonnais qui creuse les inégalités sociales entre les Lyonnais et les habitants des quartiers populaires. Il l'alerte sur un détournement du dispositif ZFE comme un outil de ségrégation et d'assignation à résidence et souhaite connaître sa position sur le sujet.

German is the leading language in Europe in terms of number of speakers and the language of our largest economic partner. The situation of German teaching in France has never been so dramatic. The number of students learning it continues to decrease (currently around 15% of students choose German in LV2 compared to more than 75% for Spanish), the The number of candidates for teaching competitions is also decreasing, German being the discipline in which the proportion of unfilled positions at CAPES is the highest. Alexandre Vincendet attire l'attention de M. le ministre de la transition écologique et de la cohésion des territoires sur le nécessaire encadrement des relations contractuelles entre les constructeurs automobiles et les concessionnaires. Depuis mai 2021, plusieurs constructeurs automobiles ont annoncé la résiliation de leurs contrats avec les concessionnaires. Les négociations contractuelles, entamées depuis, témoignent des risques qui pèsent aujourd'hui sur les concessionnaires, ainsi que sur l'ensemble de la chaîne de valeur automobile (recyclage, location, ...). Cette situation, alors même que les constructeurs enregistrent des profits inédits, est la cause directe du déséquilibre entre les constructeurs et le reste de la filière. Un tel déséquilibre est quant à lui permis par un encadrement largement insuffisant des relations contractuelles qui unissent constructeurs et distributeurs. Plusieurs pays européens ont remédié à cette situation - Belgique, Espagne, Grèce, Autriche, Luxembourg et, plus récemment, Italie - en prévoyant l'obligation pour les constructeurs ou importateurs automobiles d'indemniser les investissements non amortis engagés par leurs distributeurs ou un droit à l'indemnité compensatrice au profit de ceux-ci en fin de contrat. Sans l'adoption rapide d'une législation adéquate, c'est toute l'activité de distribution automobile qui se trouverait en péril. Face à un vide législatif national, le changement de modèle proposé par les constructeurs automobiles aurait d'importantes conséquences, compte tenu du rôle clef des concessionnaires en faveur du maillage territorial, du nombre d'emplois qu'ils représentent et de leur potentiel en faveur du verdissement des mobilités. En l'état, nous allons au-devant de la disparition de nombreuses entreprises, notamment situées en zone peu dense. M. le député souhaiterait savoir quand et comment le Gouvernement compte remédier à cette situation très préoccupante.

Indeed, to date, animal osteopathy is not recognized in France. Alexandre Vincendet attire l'attention de M. le ministre de la santé et de la prévention sur la nécessité d'obtenir la reconnaissance par la communauté médicale et les autorités de tutelle de la compétence de l'IADE dans une pratique isolée extra-hospitalière et de proposer au SAMU et à l'organisme de tutelle la mise en place d'une réponse graduée, armée de la présence des IADE. En effet, la situation des infirmiers anesthésistes diplômés d'État (IADE), profession de santé, est peu connue du grand public et pourtant essentielle dans le fonctionnement du système de santé du pays pour pratiquer l'anesthésie et la réanimation en toutes circonstances. Depuis plus d'un demi-siècle, la profession d'IADE est la seule profession paramédicale pour laquelle cinq années d'études à temps plein sont nécessaires et exigées dans le but de conduire à l'obtention du diplôme d'État. Depuis 2014, une reconnaissance de grade master 2 lui est attribuée. La formation de haute qualité des IADE les rend opérationnels dès la fin de leur cursus d'expérience et de formation. Cette formation compte des unités d'enseignement (UE) spécifiques aux soins critiques et au pré-hospitalier. Un stage de 4 semaines est obligatoire au sein d'un SMUR. Malgré cela, la présence des infirmiers anesthésistes diplômés d'État (IADE) y est sans cesse remise en cause. Cependant, depuis plusieurs années, de nombreux centres expérimentent une réponse paramédicale pour la gestion des urgences extra-hospitalières. Dans certains cas, le but est de combler une désertification médicale, dans d'autres, c'est une offre de soins supplémentaire. Certains centres expérimentent une réponse graduée à un appel médical d'urgence où des paramédicaux sont placés sous la responsabilité du régulateur. La démarche intellectuelle, l'analyse de la situation, la capacité à évaluer le risque, sont des compétences acquises lors de la formation IADE et consolidées par la pratique en milieu anesthésique, permettant aux IADE de réagir à bon escient et de demander un avis médical si la situation l'exige. La qualité des soins apportés à la population française dépend de la reconnaissance de la profession IADE et le maintien de sa qualité de formation. En parallèle de cette demande de reconnaissance, il l'appelle à maintenir la qualité de la formation et ses quatre domaines de compétences ; il lui demande ses intentions à ce sujet.

M. Alexandre Vincendet appelle l'attention de M. le ministre de la santé et de la prévention sur la procédure de référencement de certains médicaments prévue à l'article 30 du PLFSS. En effet, les conséquences économiques de la mise en place d'une politique d'appel d'offres seraient dévastatrices pour le réseau officinal : des pharmacies seraient contraintes de licencier une partie de leur personnel, voire de baisser le rideau ; aggravant ainsi les problématiques d'accès au soin dans des zones déjà fragilisées par la désertification médicale. Ensuite, une telle mesure risquerait d'aggraver encore les ruptures de stock et les pénuries, dans un contexte de crise sanitaire et politique déjà fort difficile. Et ce alors même que les pharmacies ont pour consigne de ne pas changer les traitements chez les personnes de plus de 75 ans (stabilité de la délivrance), dans le cadre de leur convention paritaire avec l'assurance maladie. De nombreux pharmaciens de tous départements de France sollicitent les parlementaires sur ce sujet. Aussi, il lui demande s'il compte revenir sur cette disposition.

Alexandre Vincendet attire l'attention de M. le ministre de la santé et de la prévention sur la nécessité de rétablir la franchise de 30 euros que devaient acquitter les étrangers en situation irrégulière pour bénéficier de l'aide médicale d'État, dite AME. En effet, le nombre de bénéficiaires de l'AME a doublé en 15 ans, passant de 189 000 en 2005 à 369 000 bénéficiaires en 2020. Depuis sa création, l'AME connaît une croissance moyenne de 8,3 % par an. Or, un peu plus d'un an après sa création par le gouvernement Fillon, la franchise de 30 euros a été supprimée. Avec 6 millions d'euros d'économies alors escomptés à l'époque, cette franchise imposait aux étrangers en situation irrégulière de participer sur un petit montant à leurs soins. Face à l'augmentation du nombre de bénéficiaires de l'AME mais aussi au nombre croissant de fraudes à l'AME, il lui demande s'il envisage de rétablir la franchise de 30 euros à l'AME.

M. Alexandre Vincendet attire l'attention de M. le ministre de l'intérieur et des outre-mer sur les fraudes et mauvais contrôles à l'aide médicale de l'État, dite AME. L'aide médicale de l'État (AME) s'inscrit en effet dans le cadre de la lutte contre les exclusions. Cette protection santé s'adresse aux ressortissants étrangers en situation irrégulière et précaire. Cependant, le dernier rapport de la Cour des comptes sur la certification des comptes du régime général montre que la fréquence des erreurs et leurs incidences financières sur les remboursements des frais de santé évoluent à la hausse sur la période 2021-2022. Les dispositifs de maîtrise des risques de portée financière restent insuffisamment efficaces selon le même rapport. Ainsi, des incertitudes affectent le montant des charges facturées par l'assurance maladie à l'État au titre de l'aide médicale de l'État (AME), destinée aux ressortissants étrangers résidant de manière stable mais irrégulière sur le territoire national, pour un montant de 0,9 milliard d'euros en 2021. De plus, le manque de traçabilité des bénéficiaires de l'AME favorise une fraude aux médicaments. Face à cette situation et afin d'assurer une meilleure traçabilité des bénéficiaires de l'AME, M. le député demande au ministère de l'intérieur la création d'un fichier central des bénéficiaires de l'aide médicale de l'État. Il lui demande sa position sur ce sujet.

Alexandre Vincendet attire l'attention de M. le ministre de l'intérieur et des outre-mer sur le droit aux propriétaires de véhicules prochainement interdits à la circulation dans le cadre de l'extension de la zone à faibles émissions (ZFE) de la Métropole de Lyon d'en être personnellement informés par courrier. En effet, le lundi 26 septembre 2022 a été voté en conseil de la Métropole de Lyon un nouveau périmètre de la ZFE qui impactera des milliers d'automobilistes sur les communes de Villeurbanne, Bron, Vénissieux, Pierre-Bénite, Saint-Genis-Laval, Oullin, La Mulatière, Sainte-Foy-lès-Lyon, Sathonay-Camp, Fontaines-sur-Saône et Rillieux-la-Pape. Ainsi, les véhicules crit'Air 5 et hors-catégories seront exclus de la ZFE classique au 1er janvier 2023 et de la ZFE étendue au 1er janvier 2024, les véhicules crit'Air 4 seront exclus de la ZFE classique au 1er janvier 2024 et de la ZFE étendue au 1er janvier 2025, les véhicules crit'Air 3 seront exclus de la ZFE classique au 1er janvier 2025 et de la ZFE étendue au 1er janvier 2026 et les véhicules crit'Air 2 seront exclus de la ZFE classique au 1er janvier 2026. Le président de la Métropole de Lyon se refuse d'informer les propriétaires des véhicules concernés par les prochaines interdictions de circulation au motif que l'utilisation des données d'identification des propriétaires par l'immatriculation des véhicules serait contraire au RGPD, ces informations étant traitées par le passé par la préfecture de Lyon et désormais centralisées par l'Agence nationale des titres sécurisés (ANTS). Il lui demande donc si, dans le cadre de l'extension de cette ZFE, l'ANTS peut transmettre la liste des immatriculations concernées par les interdictions de circulation à venir à la Métropole de Lyon afin que celle-ci puisse informer par courrier nominal les propriétaires des véhicules concernés.

Si l'HIA Desgenette est avant tout un établissement militaire dont les missions prioritaires concernent le soutien aux forces armées, il est aussi dans le cadre de son activité amené à prendre en charge les civils qui font le choix d'y être traités. Face à la baisse drastique du nombre de médecins dans cet établissement hospitalier, il souhaite savoir si le ministère des armées compte en renforcer les effectifs.

Alexandre Vincendet attire l'attention de M. le ministre de l'intérieur et des outre-mer sur l'inaction de la ville et de la métropole de Lyon pour assurer la sécurité des Lyonnais à travers un dispositif de vidéosurveillance. En effet, selon un rapport du ministère de l'intérieur de mars 2022, la ville de Lyon a été classée troisième ville la plus dangereuse de France derrière Paris et Marseille. La preuve en est, mercredi 20 juillet 2022, trois policiers ont été attaqués et lynchés par la foule place Gabriel-Péri dans le quartier de la Guillotière. Le lendemain jeudi 21 juillet 2022, un 4e policier a été agressé lors d'une interpellation en milieu d'après-midi vers 16h dans le 2e arrondissement de Lyon. Le samedi 23 juillet 2022, les forces de l'ordre ont, à deux reprises, été confrontées à des foules hostiles dans le même secteur afin d'entraver les arrestations. Si le préfet du Rhône a demandé le déploiement de plus de forces de police dans le quartier de la Guillotière pour permettre l'interpellation des suspects, le ministère de l'intérieur a annoncé des opérations de police à venir face à l'immigration illégale et a précisé que 700 opérations de police avaient déjà eu lieu depuis janvier 2022 dans le quartier de la Guillotière. Le refus répété de la ville et de la métropole de Lyon d'installer un dispositif de vidéosurveillance est aujourd'hui une source d'insécurité pour de nombreux Lyonnais alors que plusieurs grandes villes ont déjà opté en faveur de la vidéosurveillance. Il lui demande les moyens techniques et humain que l'État compte déployer à Lyon afin de compenser le désengagement de la ville et de la métropole en matière de sécurité.

Alexandre Vincendet appelle l'attention de M. le ministre délégué auprès du ministre de la transition écologique et de la cohésion des territoires, chargé de la ville et du housing, sur la difficulté pour de nombreux ménages d'accéder à la propriété en zone urbaine et métropolitaine. En effet, de nombreux ménages pour qui le housing représente un tiers de leur budget se retrouvent confrontés à un triple facteur qui les dissuade d'investir dans la pierre: tout d'abord, une augmentation du prix de l'immobilier, ensuite une augmentation des taux d'intérêts bancaires et enfin une augmentation des prix de construction. Certains dispositifs d'accession à la propriété ont été supprimés comme l'APL à l'accession en 2018 alors que l'APL locatif coûte trois fois plus cher à l'État pour un ménage qui ne peut rentrer dans le parcours résidentiel /accession à la propriété. Il lui demande quels sont les leviers envisagés par le Gouvernement pour insuffler un coup de boost à l'accession à la priorité dans les zones métropolitaines et les QPV et si la piste d'un retour de l'APL accession ou d'une défiscalisation tout ou partie de la hausse des taux d'intérêts pour les primoaccédants est envisagée par le Gouvernement.

Alexandre Vincendet appelle l'attention de M. le ministre délégué auprès du ministre de l'économie, des finances et de la souveraineté industrielle et numérique, chargé des comptes publics sur la situation de certains ménages pour lesquels l'un des conjoints, dans l'obligation de louer un second logement pour raison professionnelle, se retrouve soumis à la taxe d'habitation. En effet, actuellement, un tel logement loué par nécessité professionnelle est considéré comme résidence secondaire et n'entre donc pas dans le champ d'application de l'extinction de la taxe d'habitation pour les résidences principales. Il demande si le Gouvernement envisage d'étendre l'exonération de la taxe d'habitation au conjoint dans l'obligation de louer un second logement, loin de sa résidence principale, mais situé à proximité du lieu d'exercice de son activité professionnelle. Cette mesure à traduction fiscale serait en effet une mesure à portée sociale, visant notamment à améliorer la mobilité géographique, sans pour autant obliger le conjoint le moins rémunéré (souvent hélas statistiquement une femme) à abandonner son travail pour suivre la mobilité géographique du conjoint le mieux rémunéré.
