M. Jérôme Legavre appelle l'attention de M. le garde des sceaux, ministre de la justice, sur les conséquences de l'instauration, au 1er mars 2026, d'une contribution obligatoire de 50 euros pour saisir le tribunal judiciaire (pôle social) ou un conseil de prud'hommes, telle que prévue par l'article 128 de la loi de finances pour 2026 (loi n° 2026-103 du 19 février 2026). Cette mesure, présentée comme un moyen de financer l'aide juridictionnelle, frappe en réalité une catégorie de justiciables que le système laisse sans filet : ceux dont les revenus excèdent légèrement les plafonds de l'aide juridictionnelle tout en demeurant insuffisants pour faire face, sans difficulté réelle, à une dépense procédurale supplémentaire. Parmi ces justiciables se trouvent tout particulièrement les victimes d'accidents du travail, les personnes atteintes de maladies professionnelles et les personnes en situation de handicap ou d'invalidité. Les procédures concernées sont au cœur de leurs droits fondamentaux : contestation d'un taux d'incapacité permanente partielle, reconnaissance d'une maladie professionnelle, recours contre des décisions de l'assurance maladie, actions en réparation. Dans ces contentieux, la représentation par avocat n'est pas toujours obligatoire et le recours est souvent le seul moyen pour ces personnes de faire valoir leurs droits, sans l'appui d'un professionnel du droit. L'expérience du droit de timbre de 35 euros instauré en 2011 et supprimé en 2014 a pourtant documenté une baisse de 13 % des saisines dans les contentieux de faible montant. Cette donnée empirique, reconnue y compris par l'ancienne garde des sceaux, n'a pas été pleinement prise en compte dans l'étude d'impact accompagnant la loi de finances pour 2026. Le Conseil constitutionnel, dans sa décision n° 2026-901 DC du 19 février 2026, a certes déclaré cette contribution conforme à la Constitution, sous réserve de deux interprétations neutralisantes. Il n'a toutefois pas exclu le risque d'un effet dissuasif sur les justiciables aux revenus intermédiaires, ni tranché la question du fléchage effectif du produit de la contribution vers l'aide juridictionnelle plutôt que vers le budget général. C'est pourquoi il lui demande quelles mesures le Gouvernement entend prendre pour garantir que l'instauration de ce timbre fiscal ne conduise pas, comme en 2011-2014, à une diminution significative du recours à la justice par les justiciables aux revenus modestes et intermédiaires, notamment par les victimes d'accidents du travail et les personnes handicapées ; quelles dispositions sont prévues pour assurer un fléchage légalement garanti et contrôlable du produit de la contribution vers l'aide juridictionnelle et non vers le budget général de l'État ; si le Gouvernement envisage d'introduire une modulation de la contribution en fonction des ressources des justiciables, afin de corriger l'inégalité structurelle que constitue un tarif forfaitaire unique indépendant de la capacité contributive ; enfin, dans quel délai et selon quelles modalités le Gouvernement prévoit de dresser un bilan d'impact de cette mesure sur l'accès effectif à la justice, notamment pour les publics vulnérables accompagnés par les associations représentatives que la FNATH incarne depuis 1921.

Mr Jérôme Legavre questions the Minister for Europe and Foreign Affairs about the teachers' strike in Palestine. Since October 13, 2025, teachers have decided to go on strike to obtain satisfaction of their demands: full salary and full working hours. Their salaries were arbitrarily lowered in June 2025, then only paid half. This plunged a many of them in a difficult situation and pushed them to resort to strike action to obtain their financial and professional rights. But, even though the strike is a legal and peaceful means of asserting their rights for employees in this territory, the strikers are victims of brutal pressure, punitive measures and threats to make them give up their demands and return to work without the The root of the problem is not resolved. Thus, the Lawyers for Justice association (located in Ramallah) noted that the West Bank government carried out “a series of serious violations against the teachers participating in the strike, ranging from administrative, economic, security and social pressure, the most notable of which are the following: threats of dismissal, suspension or retirement without legal justification; salary reduction despite irregular payment (...); arbitrary transfer to other schools or directions (...); social and family pressures, particularly against female teachers, including threats of divorce and the creation of conflicts within the family to force them to return to work; summons of certain teachers by the security services; replacement of striking teachers with replacements on temporary contracts until the end of the school year in order to weaken the position of teachers and undermine the strike; psychological and professional harassment in the form of intimidation, direct threats, verbal warnings or informal notifications of deprivation of benefits (...)”. Furthermore, the lawyers point out, “these facts indicate that the administrative framework has become a tool of pressure and collective punishment rather than a mechanism for organizing work. Some of these violations constitute a serious attack on the constitutional right to strike and create a dangerous environment for teachers.” Indeed, article 19 of the fundamental law provides that “freedom of opinion is inviolable and that every individual has the right to express and disseminate his opinion through speech, writing or any other means of expression or art, in compliance with the provisions of the law.” And Law No. 11 of 2017 governing the right to strike of civil servants expressly authorizes the use of strike as a means of protest and demand and in particular its article 1, which constitutes the legal reference applicable in the case of teachers. The situation of the population of the West Bank, as of the entire population Palestinian, is perfectly documented and known by France and the services of the Ministry of Foreign Affairs. These services themselves have until recent years recalled that “the constraints of the occupation” exert particularly painful pressures on the territory: “collection of customs taxes at source by Israel and discretionary reimbursement (blocked on occasion as a retaliatory measure), restriction freedom of movement of people and goods in zone C (60% of the West Bank) controlled by Israel, continued colonization, East Jerusalem de facto integrated into Israel, blockade of Gaza, etc. This is what has led the French State, for decades, to financially support UN services and organizations (UNRWA, UNESCO), or to form international partnerships to help Palestinian refugees, particularly to allow them access to food, healthcare, water and energy and education. And the Government provides financial support to the government of the Palestinian Authority, “in order to support the Palestinian Authority, which is weakened by the ongoing conflict and whose stability is a strong French diplomatic priority”. In the 2026 PLF, the Government has included 8 million euros in budgetary operations, emphasizing that “direct budgetary aid falls within the framework of the sovereignty of the beneficiary State, namely the payment of salary arrears (...). This envelope will be entirely dedicated to the AP in 2026, as in 2025.” However, the press echoed, at the beginning of October 2025, the laments of the rector of the Jenin governorate and the deputy minister of education of the Palestinian Authority: “We have two months unpaid and when salaries are paid, this does not exceed 50% to 60%. We have already had to postpone the start of the school year by a week, while the Government finds the means to settle part of those for June.” The striking teachers explain exactly the same thing and are mobilizing because they want to live. She also stressed that the PA police and security services, well equipped and "representing a good third of civil servants", are decried by the population because they are seen as auxiliaries of the occupying force, quick "to repress any movement of protest against the AP" and, we see today, repress the legitimate strike mobilization of teachers. It goes without saying that the “fragilities” of the Palestinian Authority highlighted by the Ministry of Foreign Affairs (which the MP understands as the diplomatic name of a rampant corruption) and the abuses carried out by the Israeli government against the Palestinian population in all territories (retention of money from customs taxes, bombings, multiplication of checkpoints, encouragement of colonization) are considerable obstacles to the exercise of their rights for Palestinians and for employees. Again in August 2025, the Government published a press release in which "France strongly condemns the destruction, by the Israeli authorities, of a school under construction in the north of the West Bank, financed by the AFD, in connection with the EU", specifying that "this is the second demolition of a project financed by the AFD in the West Bank, to which is added the destruction of the center of the Al-Bustan Association, in East Jerusalem, supported by the Ministry of Europe and Foreign Affairs and 21 French local authorities”. The Israeli Minister of Finance and minister responsible for the occupied West Bank within the Ministry of Defense, Mr. Smotrich, "suspended all payments to the Palestinian Authority" and claimed "that he was seeking the collapse of the Palestinian Government through 'economic strangulation'" (AFP). In these circumstances, the deputy wishes to know the measures that the Government so that the funds that France sends to the PA are effectively used to pay salaries, and so that threats and repression against strikers cease and a solution consistent with the law and their rights is provided to the financial, professional and personal situation of teachers in the West Bank: respect for the right to strike and full payment of salaries. Mr. Jérôme Legavre draws the attention of the Minister of the Economy, Finance and Industrial, Energy and Digital Sovereignty to the particularly difficult situation faced by residents throughout the country, who find themselves victims of identity theft following the hacking of data stored by various services. A few months ago, France Travail data was targeted and stolen by hackers. He is an institution that brings together the most valuable information about millions of people. A little later, it was the turn of a complementary health insurance company, which holds the data of thousands of people. Finally, very recently, the files of a telephone operator, again concerning tens of thousands of customers, were fraudulently stolen. Of course, the occurrences of such break-ins are much more numerous and they also, too often, concerned various public hospitals or local authorities. In short, it is a scourge that threatens and sometimes actually violates the entire population. This, in a situation where no alternative is now offered to the sending and storage of personal data of customers or users of all these services apart from so-called “dematerialized” forms. However, it is clear that the provisions making it possible to protect the population, or even allow injured people to repair the serious harm suffered, are completely ineffective. If the vast majority of cases of hacking are destined to fuel unbearable commercial relentlessness (itself likely to cause numerous frauds), it appears that the circulation of personal data often gives rise to identity theft. The establishment of the GDPR, the leaflets “steps to take in the event of identity theft” are, in fact, of no use after identity theft. They seem to place the responsibility for the situation, ultimately, on the shoulders of the victim; at the very least, it remains helpless in a legal and practical no-man's land. Thus, victims face fraudulent expenses in the event of theft of their bank details. A very very long nightmare. So, when an unemployed person has patiently and courageously put together a file to create their own company, made the contacts and entered into contracts allowing them to practically start their activity, only to see the fruit of their work captured by crooks following the leak of the France Travail files: what possibilities are before them? All his savings were devoted to this creation: by what will she be compensated? The commercial court registry validated a clearly fraudulent modification of the statutes of the said company, but “cannot go back”: by what means will this person be restored to their rights? Since this question was asked, the MP has been particularly informed of the scam of which another resident of his constituency was the victim: this lady, aged 76, was victim of spoofing (this scam involves pretending to be a trustworthy person - their banking security advisor in this case - in order to extract information and means of payment from the victim); under the pressure of an alleged emergency, she handed her card over to a pseudo bank courier and more than 2,000 euros were fraudulently debited from her account. This lady immediately contacted her bank, made blocked his card and filed a complaint. But the bank refuses to return the funds and takes refuge behind a fallacious argument: its client voluntarily handed over her payment card. This is in fact the principle of the scam in question. The Government, the Bank of France and others are increasing the number of “calls for vigilance” and “advice” to avoid being defrauded. GOOD. But while all residents now have the obligation to send numerous sensitive documents via the Internet, or that human contact counters have almost disappeared in all administrations and institutions, referring each user to “dematerialized” contacts and while we regularly discover that one administration after another has millions of computer files stolen, said users should be held responsible for the crimes of which they are victims? That cannot be. Even though it dramatically concerns millions of people, this question, submitted in December 2024, has to date remained unanswered. He therefore asks again what practical measures the Government intends to take so that such situations are immediately stopped (the victims themselves, and sometimes their bank, have identified and reported them), the irregularities canceled and the damages repaired.

Mr. Jérôme Legavre alerts the Minister of National Education about the development, under the pretext of citizenship, of measures integrating the armed forces into public schools. They gave rise to multiple abuses and unacceptable violence perpetrated against children and young people. To cite only the most recent: Dijon, April 2025: during a “defense and citizenship rally”, among the workshops offered, was a simulation of “violent demonstration” opposing “protesters” and “police forces” equipped with gendarmerie shields. November 6, 2026, during another “citizen rally” organized in a vocational high school in Fontenay-sous-Bois, students had to “put themselves in the shoes of inmates”, starting by emptying their pockets as if they were entering prison, before having to do push-ups, with a baton on their back for one of them. On occasion in another “role play”, a teenager put on the protective equipment of prison staff while other students attacked him. One of the latter then found himself “pinned to the ground”, “handcuffed face down” and “pinned to the wall” by prison officers, said a teacher, reporting two injured at the end of this role play. That the school is the scene of such events is quite simply intolerable. And these are not accidental drifts or slippages. These devices give the army an “open table” to interfere in educational establishments and exert pressure on young people to recruit them. At the very least, they appear to contradict the principle of equality between all children with regard to the right to education and freedom of conscience, necessary to establish a framework conducive to transmission of knowledge. For decades, a multitude of systems have developed (cadets of the republic, ropes of success, defense classes, high schools and committed classes, etc.) which have in common the targeting of children from working-class and rural neighborhoods, or those experiencing academic difficulties, or even vocational students. The current Minister of National Education himself got excited, emphasizing that "the number of CDSGs has been multiplied by three in five years", starting to dream of sections of excellence "Defense and national security": "such sections, throughout the duration of the high school student would allow long-term monitoring, an anchoring in time of the relationship with defense as well as an enhancement of the commitment via the baccalaureate option "national defense". The deputy is alarmed by the fact that the budgets devoted to public schools are called into question every year, that this year again 4,000 teaching positions should be eliminated, even though public schools are responsible for transmitting to all children the knowledge and means to exercise their independent thinking and critical thinking, in order to enable them to fulfill their rights and duties as citizens in all equality, in their fullness. Conversely, the army budget progresses over the years. Particularly strikingly, it is planned (and claimed) that this budget will double, in amount, between 2017 and 2027. Already, the massive financial flows carried out between the State budget (taxes of the population) and the arms multinationals can be considered indecent, at a time when public schools, hospitals and social housing, are left abandoned when they are not not knowingly destroyed. The MP therefore wishes to question the Minister on the substance of the problems posed by the profusion of school-army systems. The Head of State and ministerial circulars are telling the population about an “army-nation link” that urgently needs to be “strengthened” in the service of “national cohesion”, to spread a “spirit of commitment” to schoolchildren. The Ministry of the Armed Forces praises the system of “defense classes” which today concerns nearly 900 classes, which “contribute to the construction of the educational paths (...) of each student. (...) The objective is to make Defense teaching concrete (...) The defense class promotes the appropriation of republican values ​​and develops the culture of commitment.” The violence recalled above underlines the inanity, in substance as in form, of the “educational” argument. All this, at the very least, raises the question... What "national cohesion" is sought when it is necessary to fight every week in establishments so that absent teachers are replaced, or that the hours of support notified to students with disabilities are respected? To take just this example, in the department of Seine-Saint-Denis, it is the equivalent of a year and a half of lessons which is lost on the education of each young person due to the lack of staff to replace teachers when they are absent. What national cohesion is there when, every year, tens of thousands of young people, even though they hold this first university degree, the baccalaureate, are deprived of their right to access the training of their choice in higher education? What “culture of commitment” really wants to favor a State which bludgeons and takes into custody young people when they mobilize against the destruction of their right to study, or against a reform to destroy pensions in agreement with 90% of the population? What “citizenship” when the vote pronounced by the immense majority in July 2024 against the policy of social injustice of the various governments of Emmanuel Macron, is trampled in the eyes of all ? What “educational path” corresponds to the unspeakable violence committed against children during a “citizen rally” in a vocational high school in Fontenay-sous-Bois? What is the purpose of all this? As various studies point out, we are witnessing an ever-increasing promotion of the “spirit of defense”. The excessive use of the terms “rearmament”, “threat”, “hybrid” by the Head of State in all the domains aims to instill permanent concern regarding an alleged threat, which would be (in essence) poorly identified but present in everyday life. “Defense and consequently the spirit of defense imply the designation of an enemy whose representation is essential to the constitution of a military and even more generally social ethos necessary for the effectiveness of the first and the permanence of the second”. (in The Spirit of daily defense, 2002). The loads of insults poured out against the population of immigrant origin or French people of Muslim faith seem capable of serving this objective. Conversely and in reality, the commitment which mobilizes a large part of the youth is not against an imaginary enemy, but against social inequalities, against attacks on democracy, against the annihilation of the Palestinian people. THE Martial declarations proclaiming the need to “regenerate” a youth that must be “recivilized” are not only farcical. They aim to legitimize and once again strengthen the offensives launched against schools and public services, against freedoms and democratic achievements which hinder excessive exploitation. In a study published in 2022, among the middle school students surveyed participating in a defense class, only 49 % of them did it by choice. This itself constitutes a major problem. But we should listen to them: 96% of them considered that school is a place for learning knowledge and 91% that it is the place where we prepare for our future. These college students are not replacing the army with school. He asks him if he commits to stopping these multiple partnerships of army interference in schools, in order to leave young adults the choice of their life, their profession and their commitments.

M. Jérôme Legavre interroge M. le ministre de l'intérieur au sujet des graves violences racistes reprochées à plusieurs membres de la compagnie de sécurisation et d'intervention de Seine-Saint-Denis (CSI 93), déjà mise en cause à de nombreuses reprises et présentée par la Ligue des droits de l'Homme comme une unité « structurellement à la dérive ». Selon plusieurs révélations de presse et des plaintes déposées devant le parquet de Bobigny, deux personnes, dont un mineur de 15 ans, auraient été victimes le 12 septembre 2025 de violences particulièrement graves commises par des agents de la CSI 93 : coups répétés « avec des gants coqués », coups de matraque au visage dans un fourgon, utilisation d'une bombe lacrymogène métallique comme arme contondante et humiliations délibérées, notamment des injonctions à « imiter des bruits d'animaux » après chaque coup porté. L'avocat de la famille du jeune garçon a déposé une plainte pour « actes de torture et de barbarie », en soulignant la volonté d'humiliation et la durée des sévices. Une plainte distincte a été déposée pour des faits similaires par un autre jeune homme de 24 ans, lui aussi victime présumée de violences et d'un choc volontaire avec une moto de police. La CSI 93 est pourtant une unité déjà lourdement entachée : plusieurs de ses membres ont été condamnés en juin 2023 pour faux procès-verbaux et violences volontaires, d'autres en 2025 pour violences et faux en écriture publique. Promise à la dissolution par l'ancien préfet de police de Paris Didier Lallement, elle a finalement été réorganisée et placée sous l'autorité de la CSI de Paris, sans que sa dérive structurelle ne semble avoir été corrigée. La LDH demande désormais son démantèlement pur et simple. Par ailleurs, selon un rapport publié par l'ONG Flagrant déni, les violences commises par des personnes dépositaires de l'autorité publique auraient augmenté de près de 60 % entre 2016 et 2024, alors même que les effectifs de l'IGPN diminuent. L'inspection générale n'aurait à ce jour pas été saisie de ces nouveaux faits, selon la famille du mineur, ce qui interroge sur les mécanismes effectifs de contrôle. Au-delà des faits individuels, ces affaires indéniablement racistes révèlent un problème structurel au sein de la CSI 93. Depuis plusieurs années, les enquêtes, condamnations et signalements se succèdent sans que les réorganisations décidées aient permis d'enrayer des pratiques manifestement ancrées. Si des sanctions individuelles sont évidemment indispensables, elles ne sauraient suffire à traiter un dysfonctionnement systémique, qui pose la question du maintien même de cette unité et de l'incapacité manifeste de ses cadres à prévenir les dérives structurellement racistes et violentes. La dissolution de cette compagnie doit dès lors être à l'ordre du jour. Face à ces éléments d'une particulière gravité, il lui demande quelles mesures immédiates ont été prises pour suspendre les agents mis en cause, préserver les preuves et garantir l'indépendance de l'enquête ; si l'IGPN a été saisie ou si elle le sera sans délai ; comment le Gouvernement justifie le maintien en activité d'une unité dont la dangerosité structurelle est documentée depuis plusieurs années ; s'il entend enfin procéder à la dissolution de la CSI 93, comme cela avait été initialement annoncé et quelles garanties il compte apporter pour assurer la protection des mineurs, le contrôle démocratique des forces de sécurité intérieure et la lutte contre les violences et les dérives racistes au sein de la police.

Mr. Jérôme Legavre draws the attention of the Minister of the Interior to the difficulties raised by the prefect of the Hérault department against the exercise, in particular by the Libre Pensée 34 association and the BDS association, of the freedom and right of demonstration recognized for all citizens in the country. These two associations, with many other associations and many citizens, anxious to express their emotion, their anger and their aspiration for an end to the crimes perpetrated against the Palestinian and Lebanese people, have regularly convened or supported by participating in demonstrations on Saturdays, totally peaceful and respectful of public order in the commune of Montpellier. Le ministère de la culture est particulièrement mobilisé pour soutenir toute la diversité des esthétiques en musiques actuelles, dont le metal fait partie intégrante. À travers notamment son opérateur, le Centre national de la musique (CNM), créé en 2020, le ministère accompagne the whole of la filière musicale. Conformément à ses missions inscrites dans la loi n° 2019-1100 du 30 octobre 2019, le CNM intervient de deux manières auprès des professionnels de la musique: par un soutien financier (aides sélectives, aides transversales, crédits d'impôts) et par un soutien non financier (information, conseils, formation). En effet, outre les différentes ressources qui permettent de documenter le secteur de la musique (baromètres, études), le CNM soutient les acteurs de la filière musicale à travers ses programmes d'aides financières. Ces aides couvrent aussi bien le champ du spectacle vivant, que le secteur phonographique ou des éditions musicales. Elles permettent par exemple de soutenir le montage d'une tournée à l'international ou la réalisation d'un phonogramme. Les structures affiliées qui portent des projets metal répondant aux critères d'éligibilité détaillés au sein du Règlement général des aides, accessible sur le site du CNM, peuvent donc prétendre aux subventions de l'établissement. En 2024, après quatre années d'existence dont deux années exceptionnelles liées à la crise du Covid, le CNM a entrepris un travail de réforme dans le but d'ajuster ses programmes d'aide et de mieux prendre en compte les nouveaux enjeux actuels (transitions, modèles économiques). Un schéma d'intervention rénové sera présenté en fin d'année au conseil d'administration du CNM pour une mise en œuvre début 2025. Le ministère de la culture accompagne également les musiques actuelles dont le metal par le biais du réseau des SMAC (scènes de musiques actuelles). Les 92 structures labellisées, réparties sur the whole of territoire, s'attachent à promouvoir la diversité des expressions artistiques. Ainsi, en 2022, pas moins de 400 projets identifiés « hard/metal » ont été diffusés dans the whole of réseau, et les groupes ou artistes de « rock/punk » totalisaient près de 1 800 représentations. Certaines SMAC sont par ailleurs particulièrement impliquées dans le suivi et la promotion de l'esthétique metal: Le Camji (Niort - 79), l'Empreinte (Savigny-le-Temple - 91), le File 7 (Magny-le-Honge - 77), le Geulard Plus (Nilvange - 57). Enfin, la mise œuvre de la politique publique pour la musique à l'échelle des territoires se matérialise aussi par l'action des directions régionales des affaires culturelles. Avec le dispositif des aides déconcentrées au spectacle vivant, les ensembles musicaux dans le champ des musiques de patrimoine et dans le champ des musiques actuelles peuvent bénéficier d'aides au projet ou de conventionnements pluriannuels (jusqu'à 4 ans). Plusieurs compagnies qui conçoivent des spectacles dans les esthétiques metal ou rock sont soutenues dans ce cadre, comme « Excursus » portée par le bassiste Laurent David avec son projet de création black metal opératique intitulé « La Suspendida ». Depuis 2021, afin de mieux prendre en compte les modèles de structuration des musiques actuelles, ce dispositif est également ouvert aux productions déléguées. La valorisation et la promotion du metal par le ministère est au cœur de cette année 2024. En effet, la Philharmonie de Paris, établissement public du ministère de la culture, propose une exposition intitulée: « Metal: Diabolus in musica ». Du 5 avril au 29 septembre 2024, l'exposition met en lumière les codes, l'iconographie et l'histoire du genre. Cette mise en avant s'accompagne d'un travail d'échanges et de réflexions sur la culture et les représentations du metal. De plus, un colloque intitulé « Metal et metalheads: des mythes et des rites », accueilli par la Philharmonie de Paris, a permis de faire dialoguer plusieurs acteurs sur les spécificités de la culture associée au metal. Plus généralement, le ministère de la culture est mobilisé sur les enjeux liés à la découvrabilité des contenus musicaux sur les plateformes de diffusion en ligne au niveau européen. Jérôme Legavre interroge Mme la ministre de l'éducation nationale et de la jeunesse sur la mise en application par la rectrice de l'académie de Créteil de l'avis n° 20227622 rendu le 26 janvier 2023 par le président de la Commission d'accès aux documents administratifs (CADA) rédigé comme suit : « Mme D. a saisi la commission d'accès aux documents administratifs, par courrier enregistré à son secrétariat le 8 décembre 2022, à la suite du refus opposé par le recteur de l'académie de Créteil à sa demande de communication des données chiffrées sur les demandes d'autorisation d'instruction en famille de l'académie, en indiquant pour les 3 départements, les éléments suivants : 1) le nombre de demandes/refus/rapo/refus après rapo/contentieux au tribunal pour les 4 motifs (maladie, pratique intensive d'un sport ou d'un art, itinérance, situation propre) ; 2) le nombre de demandes/refus/rapo/refus après rapo/contentieux au tribunal d'autorisation de plein droit. En l'absence de réponse du recteur de l'académie de Créteil à la date de sa séance, la commission rappelle que le livre III du code des relations entre le public et l'administration ne fait pas obligation aux autorités administratives de répondre aux demandes de renseignements qui leur sont adressées, ni d'élaborer un document nouveau en vue de procurer les renseignements ou l'information souhaités (CE, 30 janvier 1995, ministre d'État, ministre de l'éducation nationale, n° 128797 ; CE, 22 mai 1995, Association de défense des animaux victimes d'ignominie ou de désaffection, n° 152393). En revanche, la commission considère de manière constante que sont des documents administratifs existants au sens de l'article L. 300-2 du code des relations entre le public et l'administration, ceux qui sont susceptibles d'être obtenus par un traitement automatisé d'usage courant. Il résulte en effet de la décision du Conseil d'État du 13 novembre 2020, n° 432832, publié aux tables, que constituent des documents administratifs au sens de ces dispositions les documents qui peuvent être établis par extraction des bases de données dont l'administration dispose, si cela ne fait pas peser sur elle une charge de travail déraisonnable, laquelle doit être interprétée de façon objective. La commission précise, à ce titre, que les informations demandées doivent pouvoir être obtenues par un traitement automatisé de données, sans retraitements successifs, en particulier par des interventions manuelles. Elle estime également que, lorsque les informations sollicitées doivent, pour être extraites d'un fichier informatique, faire l'objet de requêtes informatiques complexes ou d'une succession de requêtes particulières qui diffèrent de l'usage courant pour lequel le fichier informatique dans lequel elles sont contenues a été créé, l'ensemble des informations sollicitées ne peut alors être regardé comme constituant un document administratif existant (avis n° 20222817, 20222850 et 20222936 du 23 juin 2022). Une demande portant sur la communication d'un tel ensemble d'informations doit dès lors être regardée comme tendant à la constitution d'un nouveau document (Conseil n° 20133264 du 10 octobre 2013) et, par suite, être déclarée irrecevable. Mr. Jérôme Legavre questions the Minister of Health and Prevention about the fitting of non-precious metal dental prostheses of the chrome-cobalt type, the nomenclature of which is HBLD038. He also questions him about overpayments claimed from health professionals by the primary health insurance fund for having prescribed dental prostheses in a material other than non-precious metal. He finally asks her about an application immediate 100% coverage of new zirconia prostheses. Experts from the Risk Assessment Committee (RAC) proposed the classification of cobalt as CMR: carcinogen category 1B (suspected hazard), mutagen 2 (suspected hazard) and toxic for reproduction 1B (suspected hazard), based on investigations and evaluations. The investigations were carried out by the European Chemicals Agency (ECHA) and the assessments were been carried out by the CER. The latter showed “germ cell mutagenicity” of the metal cobalt on the gastrointestinal tract at repeated doses of cobalt/cobalt chloride ingestion. Thus, in September 2017, the CER requested the revision of the classification of metallic cobalt in the European Union REACH regulation (registration, evaluation and authorization of chemicals, i.e. “registration, evaluation and authorization of chemical substances). Therefore, the metal cobalt has been reclassified as a CMR 1B substance. Cobalt has been classified as CMR CE under the CLP regulation since October 1, 2021: carcinogen category 1B: may cause cancer. Mutagenic category 2: likely to induce genetic abnormalities. Reprotoxic category 1B: may harm fertility. From May 27, 2025, MDR Regulation (EU) 2017/745 will apply to all medical devices and therefore cobalt. Dental prostheses made of non-precious metal such as chrome-cobalt would therefore seem to pose a problem. There would be a risk for patients covered by complementary health insurance, the most deprived patients and for health professionals who work with cobalt. Indeed, since the new convention of 2020, the CPAM requires dental surgeons to install crowns and metal bridges made of non-precious alloys (cobalt-chromium) on the posterior teeth for patients benefiting from complementary solidarity health insurance or dependent on the rest at zero cost. They are no longer authorized to carry out a replacement therapeutic procedure by paying the same price, which calls into question their power to prescribe. This was the case before 2018 with the old convention which allowed one crown to be reimbursed metal-ceramic or ceramic at the cost of a metal crown. The supplement was the responsibility of the healthcare professional or the patient. The provision of care has therefore decreased by removing this alternative even though the cost is the same. This creates discrimination between patients who have the financial means to access high-quality care and others on whom a metal alloy is imposed. Article 6 of the Declaration of human and citizen rights states that “the law must be the same for everyone”. Therefore, all individuals in the same situation must be treated equally. For these reasons, health professionals, considering the potential carcinogenic risk of cobalt, have continued to substitute metal-ceramic or ceramic dental prostheses for metal, regardless of the patient's diet. The CPAM is now asking them for undue when these are preventive medical acts, based on equality in law and without additional cost. In order to remedy the inconsistency of this situation, it would first be appropriate to cancel the overpayments so as not to sanction these health professionals. L'année scolaire 2022-2023 marque le retour à la normalité après trois années de crise sanitaire ayant induit d'importants aménagements. Ces aménagements ont porté à la fois sur les enseignements mis en place par les établissements, les enseignants redoublant d'efforts et de créativité pour mettre en place les cours à distance, qu'ils sont désormais en mesure de mettre en place dans des délais restreints, mais également sur le calendrier des examens. Ainsi, à la session 2022 du baccalauréat, les épreuves terminales des enseignements de spécialité se sont déroulées au mois de mai, alors que la réforme du lycée et du baccalauréat général et technologique prévoyait leur organisation au second trimestre. La présente année scolaire va permettre un déroulement apaisé des épreuves et par suite une transition sereine vers l'enseignement supérieur pour les élèves. Ce rétablissement du calendrier des examens a remis en lumière la préoccupation de certains enseignants de faire coïncider la certification avec la fin de l'étude des programmes nationaux d'enseignement permettant aux élèves d'acquérir les connaissances et compétences nécessaires pour leur poursuite d'études supérieures. Le resserrement des programmes d'examen des épreuves terminales des enseignements de spécialité, paru au Bulletin officiel de l'éducation nationale n° 36 du 30 septembre 2022, prévoit un allégement des parties des programmes nationaux pouvant être évaluées lors des épreuves de spécialités de mars, allégement pour partie déjà prévu par des textes antérieurs. Ce resserrement ne modifie ni le contenu ni les ambitions des programmes nationaux, qui ont vocation à être traités sur la totalité des deux années du cycle terminal. Après les épreuves terminales des enseignements de spécialité, le troisième trimestre est un moment de capitalisation et de consolidation des acquis par les élèves. Il offre aux enseignants, libérés des enjeux inhérents à la préparation des épreuves terminales du mois de mars, l'opportunité de privilégier des modalités d'apprentissage et une démarche pédagogique offrant une plus large place à l'autonomie et aux coopérations tenant compte des attentes de l'enseignement supérieur. Ce moment de l'année est propice aux échanges liés au projet d'études de l'élève et aux croisements entre disciplines ou spécialités, notamment dans le cadre de la fin des programmes des enseignements de spécialité et de la préparation des épreuves du Grand oral et de philosophie qui ont lieu en juin. Dans la voie générale, comme dans les séries de la voie technologique, cette approche, qui peut être menée en collaboration avec des enseignants des universités et des écoles supérieures de l'académie ou des sections d'enseignement supérieur présentes dans les lycées, est de nature à faciliter la transition des élèves vers leur statut d'étudiant.

Mr. Jérôme Legavre questions the Prime Minister on the situation and future of public structures responsible in particular for helping the integration of RSA recipients (local missions, municipal social action centers). Prime Minister Jean Castex announced in September 2021 the “renationalization of RSA financing” in the department of Seine-Saint-Denis. Since then, 34 other departments have joined this process. It is about of a 5-year experiment: the sums “released” by the departments on the payment of the RSA, are planned to “strengthen the support policies for RSA recipients”, particularly with a triple objective: doubling the number of RSA referents, better supporting recipients, removing all “peripheral obstacles” to the path to employment (administrative procedures, housing, childcare, transport). He is logical to think that public money which, at department level, is no longer used to pay social benefits, will be usefully released, for example, to recruit more public agents to meet needs, examine files in greater depth, etc. But there is no trace of development of public services in the department/State agreement: nor recruitment of agents in the CCAS, the PIE; nor recruitment of public daycare staff; neither development of public collective transport or construction of public HLM housing. There is therefore nothing that is actively geared towards the development of public structures capable of responding to the most pressing needs of the population, the most vulnerable within it. The department of Seine-Saint-Denis, according to the conditions of the agreement signed with the State, affirms that the money released must “be used to do more and to do differently”. Thus, in the name of the new “Local Integration Agencies”, the 34 existing structures, reporting to communities and the public service, should give way to a mass of “partners”, “actors”: associations, social and solidarity economy and businesses. The list of “finalists” of the call for expressions of interest launched by the department (a call for tender) was revealed in October 2022. These are 11 “consortia local actors in employment and integration” (!) made up mainly of associations and companies. Which will receive public subsidies for their operation, or even a 10% bonus (depending on the exit rate of beneficiaries of the system), in place of the work hitherto carried out by public agents. Mr. Jérôme Legavre questions the Minister Delegate to the Minister for Ecological Transition and Territorial Cohesion, responsible for cities and housing, on the measures that the Government is considering to respond to the dramatic situation of the lack of emergency accommodation places in the country. Distress situations are increasing. The latest report on “The state of poor housing in France” highlights that 4.1 million people suffer from poor housing or lack of personal accommodation. 1,068,000 people are deprived of personal housing and the figures studied by the Abbé Pierre Foundation show a deterioration of the situation. For its part, SIAO 93 (Integrated Reception and Orientation Service) is sounding the alarm in its barometer for the 3rd quarter of 2022: requests for shelter are increasing sharply, particularly for couples with children” (+16% between August and September 2022); interruptions in care are also increasing, in particular due to the exit from the system of hotel rooms, preferentially allocated to tourism reservations and anticipation of the Olympic Games. Concretely in Seine-Saint-Denis, Interlogement93 (SIAO operator responsible for the 115 telephone platform) explains that “the current means made available no longer make it possible to respond to the demands of women, children and men who find themselves on the streets daily in Seine-Saint-Denis. There is an average of 386 unfilled shelter requests per day in the department for this month of November, compared to 280 people last year.” 1,500 to 2,000 people try to call 115 every day for an emergency accommodation solution. Across the country, in mid-September 2022, 6,300 people who had called 115 had no solution, including more than 2,000 children. In 2021, the Minister of Housing decided to put an end to the “thermometer management” of the accommodation park (opening of places in November and closing in the spring) and since then, the listeners of 115 have noted an ever greater increase in the number of people left without answers. Finally, associations and private hoteliers cannot replace the responsibilities of the State. Nous faisons actuellement face à la plus grave crise énergétique depuis les chocs pétroliers de 1970 en raison de la guerre en Ukraine qui retire une source d'approvisionnement en gaz et en pétrole aux pays européens, de la faible disponibilité du parc nucléaire sur lequel repose largement notre production d'électricité, de la sécheresse historique de l'été dernier, qui a réduit à un niveau historiquement bas les stocks hydroélectriques. Cette crise de l'énergie a des conséquences directes sur nos approvisionnements énergétiques et sur les coûts de l'énergie. Dans ce contexte, le Gouvernement est pleinement engagé pour sécuriser l'approvisionnement en énergie, baisser les prix de l'énergie et protéger le pouvoir d'achat des Français. Le Gouvernement est ainsi attaché à accompagner les collectivités locales et a pris des mesures fortes dès le début d'année 2022: Les petites collectivités, de moins de 10 employés, moins de 2 millions d'euros de recettes et ayant une puissance de contrat souscrite inférieure à 36 kVa sont éligibles aux tarifs réglementés de vente d'électricité (TRVe). A ce titre, plus de 20 000 collectivités sont couvertes par le bouclier tarifaire sur l'électricité, mis en place dès le 1er février 2022. Ce bouclier tarifaire sera reconduit en 2023, avec, au 1er février 2023, une hausse des TRVe limitée à +15 % TTC en moyenne sur la base de laquelle est calculé le bouclier tarifaire. Le bouclier tarifaire bénéficiera aux collectivités éligibles aux TRVe qu'elles aient effectivement un contrat aux TRVe, ou pas. Par ailleurs, conformément aux annonces du Président de la République début janvier, les fournisseurs garantiront aux très petites entreprises (TPE), et plus largement à toutes les entités assimilables à une TPE, quel que soit leur statut et quelle que soit leur puissance souscrite, un prix moyen d'électricité de 280 €/ MWh HT en 2023, soit 28 c€/kWh. Les collectivités locales assimilées à des TPE en bénéficieront donc. Si les collectivités locales ne peuvent bénéficier du bouclier tarifaire sur le gaz, réservé aux résidentiels, je me permets de préciser que la fin des tarifs réglementés de vente du gaz (TRVg), qui doit intervenir au 30 juin 2023, n'entraine en aucun cas la fin du bouclier tarifaire sur le gaz ou plus généralement des mesures de protection des consommateurs face à la crise énergétique actuelle. En effet, la loi de finances pour 2023 prévoit que celui-ci sera prolongé et, au second semestre 2023, calculé sur la base d'un indice de prix fixé par voie réglementaire. Pour 2023, le Gouvernement a annoncé en octobre dernier la mise en œuvre d'un dispositif d'amortisseur électricité. Doté en loi de finances pour 2023 de 3 milliards d'euros, ce dispositif sera temporaire et effectif dès le début d'année 2023. Il permettra de limiter la hausse des prix de l'énergie pour les consommateurs non éligibles au bouclier tarifaire et de catégorie PME. Il est par ailleurs ouvert à toutes les collectivités territoriales non éligibles au bouclier tarifaire sur l'électricité qui pourront demander l'application de l'amortisseur électricité. Ce mécanisme s'appliquera à tous les contrats en cours dès lors que le contrat repose sur un prix de l'énergie supérieur à 180 €/MWh. Concrètement l'Etat va prendre en charge, sur 50 % des volumes d'électricité consommés, l'écart entre le prix de l'énergie du contrat et 180 €/MWh (soit 0,18 €/kWh). Le montant d'aide au titre de l'amortisseur électricité peut être estimé sur le simulateur by the government (https://www.impots.gouv.fr/simulateur-amortisseur-electricite). Enfin, les collectivités locales bénéficieront de la prolongation et de l'amplification du filet de sécurité pour l'année 2023, désormais ouvert également aux départements et régions fragilisés par la crise. Ce filet s'ajoute à « l'amortisseur électricité » susmentionné et couvrira aussi les surcoûts liés au prix du gaz comme de l'électricité. Pour bénéficier du bouclier tarifaire, de l'amortisseur électricité ou de la mesure de plafonnement à 280 €/MWh HT (soit 28 c€/kWh) en moyenne sur l'année 2023, il n'y a qu'une chose à faire: remplir l'attestation d'éligibilité auprès des fournisseurs. Cette attestation est la même pour les trois dispositifs. Elle permettra au fournisseur de les mettre en œuvre directement dans la facture d'électricité. Dès lors qu'une collectivité locale n'a pas déjà un contrat aux TRVe, elle doit remplir cette attestation via les modalités mises en œuvre par son fournisseur, sachant que toutes les entités concernées ont été contactées par leur fournisseur. Les modalités de remplissage de l'attestation unique sont disponibles sur le site https://www.ecologie.gouv.fr/amortisseur-electricite-entreprises-et-collectivites-des-2023. the whole of ces mesures permettra, pour les contrats signés aux prix les plus élevés, de réduire très fortement la facture d'électricité. Je vous invite, dans ce contexte, à inviter vos interlocuteurs à faire pleinement jouer le jeu de la concurrence pour rechercher l'offre la plus pertinente en termes de prix et d'indexation. Le Gouvernement vise également à apporter des solutions structurelles à la hausse des prix de l'énergie élevés. D'une part, au plan européen, le Gouvernement porte une réforme en profondeur de l'organisation des marchés électriques afin que, sans remettre en cause la pleine intégration du marché français au marché européen, les Français payent un prix de l'électricité proche du coût complet moyen de notre mix électrique. Le Gouvernement se bat également à court terme pour baisser les prix du gaz et découpler les prix de l'électricité des prix du gaz. D'autre part, le Gouvernement soutient fortement les collectivités dans leurs efforts de sobriété et d'efficacité énergétique: Au travers des dotations d'investissement, l'Etat accompagne les collectivités dans leurs projets de rénovation énergétique des bâtiments afin de faire baisser structurellement les coûts de l'énergie grâce à l'efficacité énergétique. Ainsi, en 2023, les dotations d'investissement aux collectivités territoriales (DSIL, DETR, DPV, DSID) sont maintenues à un niveau historiquement élevé, avec notamment plus de 2 Md€ ouverts en loi de finances pour 2023. D'autre part, le « fonds vert » permettra de mobiliser au total 2 milliards d'euros de crédits pour financer des projets portés dans les territoires. Par ailleurs, le dispositif des certificats d'économies d'énergie (CEE) prévoit des bonifications via le « Coup de pouce chauffage des bâtiments tertiaires » pour le remplacement des équipements de chauffage ou de production d'eau chaude sanitaire utilisant des énergies fossiles par des dispositifs plus efficaces énergétiquement et utilisant des énergies renouvelables. Celui-ci est en place depuis 2020 et jusqu'à fin 2025. Enfin, parce l'accompagnement des territoires dans leur démarche de sobriété et d'efficacité énergétiques est essentiel, j'ai également ré abondé à hauteur de 220 millions d'euros le programme CEE ACTEE (Action des Collectivités Territoriales pour l'Efficacité Energétique), financé par les CEE. Celui-ci apporte un financement pour de l'ingénierie, de la maîtrise d'œuvre, ainsi que l'achat d'équipements de suivi de travaux de rénovation énergétique. Il met en outre à disposition un centre de ressources facilitant le parcours des collectivités (guide, cahier des charges, simulateurs, …) et touche tous les domaines de compétences des territoires.
