Mr. Jonathan Gery draws the attention of the Minister of Ecological Transition, Biodiversity and International Negotiations on Climate and Nature to the project to set up a deposit for recycling plastic bottles and cans and to the significant concerns it raises among local authorities responsible for the public waste management service. While communities have achieved these significant investments in recent years to modernize their equipment, adapt their sorting centers and support the generalization of the simplification of the sorting process, this system would amount to removing plastic bottles and cans from the current selective collection flow in order to create a specific collection circuit. Communities and their unions are warning in particular of the financial consequences of such reform. This could lead to a significant reduction in support paid by eco-organizations as well as a loss of revenue linked to the recovery and sale of recyclable materials. SYTRAIVAL, a public union which works with 260 municipalities representing more than 375,000 inhabitants, spread over several departments, notably Rhône, Ain and Saône-et-Loire, therefore considers that the implementation of this instruction could result for its territory in a loss of nearly 3.4 million euros per year in support paid by Citeo, an approved eco-organization responsible in particular for the household packaging sector, to which would be added a reduction estimated between 300,000 and 400,000 euros per year in revenue linked to the sale of materials. Nationally, the loss of support and revenue for communities is estimated between 400 and 500 million euros. In the absence of full compensation, these losses would likely be borne by communities and, ultimately, by taxpayers and users of public services. Beyond its cost, local elected officials are questioning the environmental relevance of the system. The recycling deposit does not constitute a reuse deposit: the bottle remains single-use packaging which becomes waste after its consumption. The device therefore does not, in itself, reduce plastic production. It would also complicate a recently simplified sorting process and now known to residents, by forcing them to distinguish plastic bottles and cans from other packaging placed in the sorting bin. Mr. Jonathan Gery draws the attention of the Minister of Action and Public Accounts to the conditions of eligibility for the tax credit in favor of the artistic crafts of artisanal carpentry companies which themselves ensure the design and manufacture of their works. The profession of carpenter is among the artistic professions mentioned by the decree of December 24, 2015 establishing the list of artistic professions. M. Jonathan Gery attire l'attention de Mme la ministre de l'agriculture, de l'agro-alimentaire et de la souveraineté alimentaire sur les difficultés rencontrées par certains porteurs de projets agricoles dans l'application de l'article L. 111-31 du code de l'urbanisme. Dans de nombreux territoires ruraux, des agriculteurs en cours d'installation ou de diversification ou bien des individus s'engageant dans un projet agricole annexe à leur état principal font état de refus de permis de construire concernant des bâtiments agricoles pourtant destinés à l'exercice d'une activité agricole effective, malgré des avis favorables de la municipalité. Ces refus reposent notamment sur l'appréciation portée par certaines commissions ou services instructeurs quant à la nécessité du projet pour l'exploitation ou à sa viabilité économique, alors même que les porteurs de projets produisent des justificatifs attestant de leur qualification agricole, de leur affiliation aux organismes compétents et de la réalité de leur activité. Cette situation suscite des interrogations quant à la marge d'appréciation laissée aux autorités administratives consultées dans le cadre de l'instruction de ces dossiers et à la sécurité juridique offerte aux exploitants agricoles, en particulier lorsqu'il s'agit de nouvelles installations ou de projets innovants contribuant à la souveraineté alimentaire et énergétique du pays, ce qui apparaît fondamental au regard des enjeux de reprise des exploitations auxquels nous sommes confrontés. Par ailleurs, des élus locaux relèvent que le caractère contraignant de certains avis administratifs limite fortement leur capacité à apprécier les besoins de leur territoire et à accompagner le développement d'activités agricoles pourtant soutenues localement. Dans un contexte marqué par le vieillissement de la population agricole et la nécessité de favoriser le renouvellement des générations, elle lui demande si le Gouvernement envisage de faire évoluer le cadre normatif applicable aux constructions nécessaires aux exploitations agricoles, notamment en clarifiant ou assouplissant les critères d'appréciation de leur nécessité et de leur viabilité, ou en réexaminant la portée des avis rendus par les autorités consultées, afin de mieux concilier préservation des espaces naturels et soutien à l'installation agricole.

Mr. Jonathan Gery draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the concerns of non-contracted doctors regarding the consequences of article 76 of the social security financing law for 2026, which provides, from January 1, 2027, for the dereimbursement by the National Health Insurance Fund (CNAM) of health products, acts and services established by doctors practicing in sector 3. This provision conditions treatment not on the nature of the prescribed procedure or its medical indication, but solely on the conventional status of the prescriber. Thus, two patients with the same pathology and receiving the same prescription will not benefit from the same reimbursement depending on whether or not their doctor has signed an agreement with the CNAM. This difference in treatment is not based on no objective criteria linked to the quality or safety of care: all doctors, whether or not they are approved, are subject to the same ethical obligations and the same freedom of prescription guaranteed by article L. 162-2 of the social security code and articles R. 4127-8 and R. 4127-53 of the public health code. In this it disregards the principle of equality before the law and public offices enshrined by the articles 6 and 13 of the Declaration of the Rights of Man and of the Citizen, as well as the requirement for health protection resulting from the Preamble of 1946. The measure also penalizes patients throughout the national territory. In normally well-equipped areas, many doctors practicing in sector 1 and 2 no longer accept new patients or offer waiting times that are incompatible with current care needs. The doctor of sector 3 then fulfills a function of access to care that ARS zoning does not record: more than 54% of non-contracted doctors thus receive their patients in less than 48 hours, whereas waiting times in sector 1 or 2 commonly reach three weeks. Depriving these patients of reimbursement for their prescriptions would amount to sanctioning them for using the only practitioner actually available, independently of the administrative classification of their territory. This reality is even more acute in areas officially recognized as under-dense by the ARS. According to data from the Ameli file and the work of the sector 3 doctors' union, 56.7% of the 1,126 non-contracted doctors practice in areas classified by the ARS as under-dense and 88% of them carry out an activity exclusively oriented towards care. In these territories, dereimbursement would constitute a double penalty: absence of local alternative and full coverage payable by the patient, including for medications or examinations covered by common reimbursement law. In total, more than a million patients would be deprived of reimbursement for their prescriptions. The resulting foregoing of care and referrals to already saturated emergency services would be counterproductive both in health and budgetary terms. He asks how the Government intends to guarantee equal care for all insured persons and continuity of access to care throughout the country from January 1, 2027, the date on which the measure will come into force.

This tragedy is a serious reminder of the particular vulnerability of minors entrusted to the protection of the State and the collective responsibility incumbent on public authorities to guarantee their protection, support and reconstruction. Social children's homes welcome minors who are often marked by particularly difficult life paths, made up of family breakdowns, violence, neglect or deep trauma. In this context, psychological support constitutes a fundamental element of their care, essential to their balance, their security and their future. However, many professionals warn of the insufficiency of the human and financial resources allocated to these structures, particularly in terms of effective access to regular, individualized and lasting psychological monitoring. The shortage of specialized professionals, particularly in child psychiatry, as well as delays in accessing this care, sometimes compromise the quality and continuity of the necessary support. Furthermore, the The question of human resources and the presence of supervisory staff constitutes a major concern today. Establishments are facing increasing recruitment difficulties, high turnover and persistent pressure on staff, in a context where the missions entrusted are particularly demanding, both on a professional and human level. Since the reform of complementary social protection for state agents, the generalization of membership in collective mutual insurance is planned from May 2026 for national education personnel. M. Jonathan Gery appelle l'attention de Mme la ministre de l'agriculture, de l'agro-alimentaire et de la souveraineté alimentaire sur les conséquences du réexamen par l'ANSES des autorisations de mise sur le marché (AMM) des spécialités à base de cuivre destinées à la viticulture. Durant l'été 2025, l'ANSES a procédé au réexamen de 34 spécialités commerciales à base de cuivre utilisées pour la protection du vignoble. Ce processus a conduit au retrait de dix-sept d'entre elles, à la perte de l'usage vigne pour huit autres, à l'absence d'usage vigne pour trois nouvelles AMM et à la limitation à un usage amateur pour quatre spécialités supplémentaires. À l'issue de ces décisions, seuls deux produits restent autorisés (Heliocuivre et Champ Flo Ampli), assortis de restrictions très importantes concernant les zones non traitées, les doses maximales ou encore les distances de sécurité pour les riverains et les personnes présentes. Le cuivre constitue pourtant le seul fongicide minéral autorisé en agriculture biologique, efficace contre le mildiou et certaines maladies bactériennes. Il demeure également un outil indispensable pour de nombreuses exploitations en viticulture conventionnelle. L'absence d'alternatives opérationnelles place ainsi une large part de la filière viticole dans une situation particulièrement préoccupante. Ces décisions nationales créent en outre une distorsion de concurrence au niveau européen : alors que le règlement d'exécution (UE) n° 2025/1489 proroge l'approbation du cuivre jusqu'au 31 décembre 2029, certains États membres, comme l'Italie, ont décidé de reporter leurs évaluations à cette échéance, contrairement à la France. De plus, le classement des deux produits encore autorisés dans la catégorie « SPE 1 » empêche désormais le lissage des doses prévu par la réglementation européenne (28 kg/ha sur 7 ans), imposant un plafond strict de 4 kg/ha/an, incompatible avec les années de forte pression sanitaire comme 2024. Ces décisions interviennent dans un contexte de fragilité économique pour la filière, alors même qu'un grand nombre de viticulteurs ont engagé des démarches agro-environnementales ambitieuses : plus de 650 exploitations certifiées HVE et plus de 300 en agriculture biologique ou en conversion dans le Beaujolais, tandis qu'environ 75 % des exploitations des Coteaux du Lyonnais sont engagées dans ces démarches. Il lui demande quelles sont les intentions du Gouvernement quant à la possibilité de suspendre les réhomologations nationales des produits à base de cuivre jusqu'à la révision communautaire prévue en 2029, à l'harmonisation des méthodes d'évaluation entre les principaux États membres producteurs, ainsi qu'à la poursuite et au renforcement des travaux de recherche sur les alternatives au cuivre, afin qu'aucune décision précipitée ne fragilise davantage la filière avant la conclusion de ces études.

Mr. Jonathan Gery draws the attention of the Minister of Labor, Health, Solidarity, Families, Autonomy and Disabled People to the worrying consequences of the price reductions planned for medical imaging as part of the latest social security financing law. Since October 1, 2025, many liberal radiology groups, particularly in the Rhône, have joined the national movement of permanent care strike, initiated by the National Federation of Radiologists (FNMR). This movement follows the establishment of a saving of 300 million euros on imaging, implemented mainly through sudden reductions in technical packages, which nevertheless finance the majority of the operating costs of the structures (equipment, maintenance, salaries, energy, etc.). Health professionals denounce unilateral decision which seriously jeopardizes the economic balance of radiology practices, particularly local ones, and which ultimately risks reducing access to care for patients. They point out that radiology plays a fundamental role in care pathways, whether it involves screening, diagnosis or therapeutic alternatives to surgery thanks to interventional radiology. La situation des personnes retraitées locataires de longue durée dans le parc social soulève, de manière légitime, des interrogations relatives à la sécurisation de leur parcours résidentiel et à l'adaptation des règles du housing social aux évolutions des usages familiaux et intergénérationnels. S'agissant de l'accession à la propriété, le législateur a reconnu, à diverses reprises, la pertinence de permettre l'accession à la propriété de ménages résidant dans le parc social, notamment au travers de dispositifs spécifiques. Ainsi, la loi n° 83-657 du 20 juillet 1983 relating to la vente de logements appartenant aux bailleurs sociaux a ouvert, dans un cadre encadré et sécurisé, la possibilité pour les organismes HLM de vendre, sous conditions, des logements à leurs occupants. Ce dispositif a été réaffirmé et renforcé par la suite, notamment par la loi n° 2009-323 du 25 mars 2009 dite « loi MOLLE » et par la loi n° 2018-1021 du 23 novembre 2018 portant évolution du housing, de l'aménagement et du numérique (ELAN), qui ont facilité les procédures de vente et assuré de meilleures garanties pour les locataires intéressés. Toutefois, la vente de logements sociaux aux locataires du parc social doit être conciliée avec le nécessaire maintien ou développement de logements à loyers abordables pour les ménages à faibles ressources, ce qui ne permet pas toujours au bailleur concerné de proposer des logements en accession à ses locataires en place. Concernant la question de la sous-occupation, les commissions d'attribution des logements et d'examen d'occupation des logements ont l'obligation d'examiner, tous les 3 ans en zone tendue, la situation de leurs locataires en situation notamment de sous occupation pour leur proposer un housing adapté à leurs situations. La commission peut également conseiller l'accession sociale à la propriété. Cette obligation doit permettre d'ajuster au mieux l'offre à la taille des ménages et ainsi de favoriser la rotation au sein du parc social alors que ce dernier n'est que de 7,4% au 1er janvier 2024. Toutefois, elle ne s'applique pas aux personnes de plus de 65 ans, les retraités ne sont donc pas concernés pour la plupart. La mise en œuvre du volet relating to l'examen d'occupation des logements des commissions d'attribution doit permettre d'améliorer la mobilité au sein du parc social et de permettre un parcours résidentiel pour les ménages y compris les ménages de longue durée.

What are the current stocks of DNC vaccines available and what is the strategy planned by the State to allow rapid and sufficient vaccination of livestock in risk areas, particularly in the event of extension to new departments? What human, material and financial resources does the State intend to mobilize in the short and medium term to anticipate and respond to the multiplication of health crises in the agricultural sector, at a time when climate change and the intensification of trade are favoring the emergence of new epidemic outbreaks? Mr. Jonathan Gery draws the attention of the Minister Delegate to the Minister of Labor, Health, Solidarity and Families, responsible for autonomy and disability, to the alarming situation of establishments and services for the elderly, faced with a continuous deterioration of their financial situation and their human resources, as revealed by the latest HR and finance barometer of the National Federation of associations of directors of establishments and services for the elderly (FNADEPA). According to this survey, carried out among 1,600 FNADEPA members, 70.5% of establishments and home services suffer from a shortage of staff, a situation which has worsened compared to 2024 (58%) and which particularly affects home autonomy services (85%). This chronic shortage leads one in two structures to resort to regularly on a temporary basis, which weakens the quality of support for elderly people. Le ministère chargé de l'éducation nationale a engagé depuis plusieurs années un chantier d'ampleur en vue d'améliorer les règles statutaires de reprise des services lors de la nomination dans un corps enseignant, afin de diversifier les profils recrutés et d'offrir des secondes carrières attractives. En 2022, les modifications réglementaires ont porté sur l'amélioration de la reprise des services de droit privé pour les lauréats des troisièmes concours. Cette mesure a été étendue au 1er septembre 2023 aux lauréats issus des autres voies de concours (externe et interne). Ainsi, les lauréats des concours peuvent bénéficier lors de leur classement de la prise en compte de leurs expériences professionnelles effectuées dans le secteur privé à hauteur des deux tiers de leur durée en application de article 7 du décret n° 51-1423 du 5 décembre 1951 portant règlement d'administration publique pour la fixation des règles suivant lesquelles doit être déterminée l'ancienneté du personnel nommé dans l'un des corps de fonctionnaires de l'enseignement relevant du ministère chargé de l'éducation nationale. Cette mesure concerne le classement à l'entrée dans un corps enseignant ou assimilé et non le déroulement de carrière qui s'ensuit. Le principe de non-rétroactivité des actes administratifs interdit en effet de faire bénéficier les fonctionnaires déjà nommés et titularisés dans leur corps de dispositions réglementaires postérieures qui seraient applicables en matière de classement. Par ailleurs, selon une jurisprudence constante, un décret instituant des règles de reprise d'ancienneté et ne comportant pas de dispositions permettant d'en faire bénéficier les agents déjà en fonction ne constitue pas une discrimination contraire au principe d'égalité de traitement des fonctionnaires d'un même corps (par exemple CE n° 260508 du 10 décembre 2004, syndicat national des infirmiers conseillers de santé).

In many households of artisans or traders, spouses actively participated in the operation of the business, in an undeclared framework, due to lack of means to contribute for two. This well-known economic reality affected an entire generation of women whose work, although real and essential, remained invisible to the eyes of the administration. When some of these women were able to obtain employee or affiliated status on a personal basis, life events, such as illness or disability, came abruptly interrupt their career, without the possibility of reconstitution of sufficient rights. These life trajectories today lead to extremely modest retirement pensions, sometimes lower than those of a person who has never worked, without even giving rise to the solidarity allowance for the elderly (ASPA), due to restrictive criteria. It is also problematic that administrative services sometimes wrongly consider that the sale of a business compensates for the lack of sufficient retirement. However, in many cases, this fund could never be sold, or completely lost its value, leaving households without exit capital or savings. He wants to know if the Government plans to recognize the invisible but very real work accomplished by the spouses of artisans who remained without status for many years. He him also asks whether it intends to revaluate pensions resulting from incomplete or discontinuous careers, in particular those of former self-employed people and their spouses. Mr. Jonathan Gery draws the attention of the Minister of Labor, Health, Solidarity and Families to the consequences of caregiver leave on the remuneration of public officials and in particular on the payment of the duties, constraints and expertise allowance (IFSE). This leave, provided for by articles L. 634-1 to L. 634-4 of the general civil service code, allows public officials to temporarily suspend their professional activity in order to support a loved one losing their autonomy. Although this system meets a requirement for humanity and solidarity, its financial impact for public officials remains worrying. Indeed, unlike other leaves considered as actual service, caregiver leave does not guarantee the maintenance of IFSE, which can be suspended. However, several other types of leave allow this to be maintained. compensation: maternity, paternity or adoption leave, family solidarity leave or, since September 2024, long-term illness leave and serious illness leave. In a context of aging of the population and a stated desire to encourage elderly, disabled or losing autonomy people to remain at home, it would be desirable for caregiver leave to benefit from the same provisions, particularly in terms of financial recognition. The fact that this leave is not paid constitutes a barrier to its use by public agents and in particular by the poorest, even though family solidarity is today widely encouraged by the public authorities. Maintaining the IFSE for public employees on caregiver leave would represent a measure of social justice and recognition of the commitment of caregivers, while securing their professional situation. He therefore asks whether the Government plans to guarantee the maintenance of IFSE for the entire duration of caregiver leave, like other leaves assimilated to periods of effective service, in order to support public employees in their essential role as family caregivers.

Jonathan Gery attire l'attention de M. le ministre auprès de la ministre du travail, de la santé, de la solidarité et des familles, chargé de la santé et de l'accès aux soins, sur les conséquences des nouvelles conditions tarifaires envisagées par l'Union nationale des caisses d'assurance maladie (UNCAM) concernant les transports sanitaires assurés par les taxis conventionnés. La profession alerte sur la fragilisation de son équilibre économique et, par conséquent, sur le risque réel de rupture dans l'accès aux soins pour les patients, notamment dans la circonscription de M. le député et plus particulièrement en zones rurales. Alors que les véhicules sanitaires légers (VSL) désertent progressivement certains territoires, les taxis conventionnés demeurent souvent les seuls à assurer un maillage territorial fin et une présence humaine indispensable au transport des patients, notamment âgés, vers les structures de soins. La baisse envisagée des tarifs conventionnels en dessous de ceux des VSL pourrait entraîner la disparition d'un nombre important d'entreprises de taxis, ce qui compromettrait la continuité des soins et l'égal accès aux soins, pourtant garanti par l'article L. 110-1 du code de la santé publique. Cette situation serait d'autant plus problématique que le vieillissement de la population, le développement de l'hospitalisation à domicile ainsi que la réorganisation des plateaux techniques hospitaliers ont accru les besoins en transports sanitaires assis. Il lui demande donc quelles mesures le Gouvernement entend prendre pour garantir la viabilité économique du transport sanitaire individuel par taxi, assurer une juste rémunération de ces professionnels et préserver l'accès aux soins des patients, notamment en zone rurale.

Mr. Jonathan Gery draws the attention of the Minister to the Minister of Labor, Health, Solidarity and Families, responsible for health and access to care, on the management of medical examinations linked to the diagnosis of endometriosis, as well as treatments. Endometriosis affects approximately 10% of women. The average duration of its diagnosis is 7 to 10 years, during which the woman suffering from this chronic disease in will suffer and will be obliged to undergo a multitude of examinations and medical appointments in the hope of obtaining a diagnosis which can, for some, constitute significant expenses. It should be remembered that the price of a consultation is currently 30 euros with a general practitioner and 60 euros with a specialist. It should also be remembered that 5% of the French population, or almost 3 million French people, do not have mutual and must therefore cover part of these expenses. Educating doctors about the symptoms and means of diagnosis and setting up free screening campaigns could help reduce diagnosis time and therefore allow all these women to be reimbursed after their examinations and to obtain treatment. Additionally, reimbursement for the pill when taken in response to endometriosis would be more than desirable, because most pills are expensive and not reimbursed by social security. Investments in the research sector would also be an avenue to explore, as there is, to date, no effective treatment for the disease itself. He therefore asks what measures will be proposed to improve reimbursement for examinations, medical appointments as well as treatments linked to endometriosis.
