Home Energy Generation Act

Home Energy Generation Act - Amends the Federal Power Act to mandate that: (1) each retail electric supplier make available an electric energy meter capable of net metering to certain retail customers that have installed an energy generation unit intended for net metering; and (2) rates, charges, and contract terms for electric energy sales to customer-generators be the same as those that would be applicable if the customer-generator did not own or operate a qualified generation unit and use a net metering system. Prescribes the manner in which such retail electric suppliers shall calculate the net energy measurement and billing for a customer using a net metering system. Subjects qualified generation units and net metering systems to specified safety, performance, and reliability standards. Authorizes the Federal Energy Regulatory Commission (FERC) to: (1) adopt additional control and testing requirements for customer-generators necessary to protect public safety and system reliability; and (2) prohibit additional charges by electric suppliers and local distribution systems for equipment or services for safety or performance additional to those necessary to meet such standards. Sets a deadline for FERC to promulgate: (1) model standards for the physical connection between local distribution systems and qualified generation units and other specified electric generation units; and (2) regulations ensuring simplified contracts will be used for the interconnection of electric energy by electric energy transmission or distribution systems and generating facilities with a power production capacity of 250 kilowatts or less.

Access to Cancer Clinical Trials Act of 2001 - Amends the Public Health Service Act, the Employee Retirement Income Security Act of 1974 (ERISA), and the Internal Revenue Code to provide coverage for qualified individuals participating in approved cancer clinical trials if a group health plan or an issuer offering health insurance coverage in connection with a group health plan or in the individual market otherwise provides coverage to such an individual. Directs the Secretaries of Health and Human Services (HHS), of Labor, and of the Treasury to: (1) analyze cancer clinical research and its cost implications for managed care; and (2) report to Congress an assessment of any incremental cost to group health plans resulting from this Act and any recommendations regarding action on other diseases. Requires the Secretaries of Labor, of the Treasury, and of HHS to ensure coordinated administration of this Act.

Innocence Protection Act of 2001 - Amends the Federal judicial code to authorize a person convicted of a Federal crime to apply to the appropriate Federal court for DNA testing to support a claim that the person did not commit: (1) the Federal crime of which the person was convicted; or (2) any other offense that a sentencing authority may have relied upon when it sentenced the person with respect to such crime. Sets forth: (1) guidelines for the court to use in ordering DNA testing; (2) post-testing procedures; (3) provisions regarding preservation of evidence; (4) criminal penalties for destroying or altering DNA evidence; and (5) provisions regarding post-conviction DNA testing in State criminal justice systems. Prohibits a State from denying an application for DNA testing made by a prisoner in State custody who is under sentence of death if specified conditions apply. Provides grants to prosecutors for DNA testing programs. Establishes the National Commission on Capital Representation. Withholds funds from States not complying with standards for capital representation. Provides for capital defense incentive grants and resource grants. Increases compensation in Federal cases, and sets forth provisions regarding compensation in State cases, where an individual is unjustly sentenced to death. Adds a certification requirement in Federal death penalty prosecutions. Expresses the sense of Congress regarding the execution of juvenile offenders and the mentally retarded.

Clean Diamonds Act - Prohibits the import of diamonds into the United States unless the exporting country is implementing a system of controls on the export or import of rough diamonds that meets specified requirements, consistent with United Nations General Assembly Resolution 55/56 adopted on December 1, 2000, or a future international agreement which implements such controls and to which the United States is a signatory. Sets forth both civil and criminal penalties for violations of the requirements of this Act. Prohibits the Overseas Private Investment Corporation and the Export-Import Bank from engaging in certain transactions in connection with projects or exports to countries violating the requirements of this Act. Expresses the sense of Congress that the President should take steps to negotiate an international agreement to eliminate the trade in diamonds used to support conflict in the country or regions in which such diamonds are mined. Provides a waiver for the requirements of this Act.

Requires the Secretary of the Treasury to deposit into the CRAF certain Outer Continental Shelf revenues, undisbursed impact assistance and coastal conservation amounts, and interest earned on CRAF investments. Allocates CRAF funds among coastal States for impact assistance and coastal conservation, the Land and Water Conservation Fund, and Federal aid to a certain wildlife restoration fund. Provides for CRAF funding of the Urban Park and Recreation Recovery Act of 1978, the National Historic Preservation Act, the National Maritime Heritage Act of 1994, Endangered and Threatened Species Recovery Agreements, and a specified program for payments in lieu of taxes and refuge revenue sharing. Expresses the intent of Congress that amounts made available under this Act are to supplement, and not to detract from, annual appropriations for the National Park Service. Prohibits the expenditure of funds under this Act if such an expenditure diminishes benefit obligations of the Federal Old-Age and Survivors Insurance Trust Fund, the Federal Disability Insurance Trust Fund, the Hospital Insurance Trust Fund, or the Supplementary Medical Insurance Trust Fund.

Duchenne Muscular Dystrophy Childhood Assistance, Research and Education Amendments of 2001, or the DMD CARE Act - Amends the Public Health Service Act to require the Director of the National Institutes of Health to: (1) expand and intensify programs of the National Institute of Neurological Disorders and Stroke, National Institute of Arthritis and Musculoskeletal and Skin Diseases, and the National Institute of Child Health and Human Development (the National Institutes) with respect to research and related activities concerning Duchenne muscular dystrophy (DMD); (2) award grants or contracts to public or nonprofit entities for at least three DMD research centers of excellence; and (3) provide for donation, collection, and preservation of tissues and genetic materials for such research. Directs the Secretary of Health and Human Services to establish a Muscular Dystrophy Coordinating Committee to coordinate all Federal DMD health programs and activities. Authorizes the Secretary, through the Centers for Disease Control and Prevention (CDC), to award grants and cooperative agreements for the collection, analysis, and reporting of DMD data. Requires the establishment through the CDC of at least three regional centers of excellence in DMD epidemiology. Directs the Secretary to establish a DMD education and information program.

Unsolicited Commercial Electronic Mail Act of 2001 - Amends the Federal criminal code to provide criminal penalties for intentionally initiating the transmission of any unsolicited commercial electronic mail message (message) to a protected computer in the United States with the knowledge that any domain name or other initiator identifying information contained in or accompanying such message is false or inaccurate. Prohibits any person from sending such a message unless the message contains a valid e-mail address, conspicuously displayed, to which a recipient may send notice of a desire not to receive further messages. Prohibits a person from sending other unsolicited commercial e-mail messages after a reasonable period of time following such notice. Requires any such message to include information that: (1) identifies the message as unsolicited commercial e-mail; and (2) contains notice of the opportunity for the recipient to request to not receive further messages. Makes it unlawful for a person to initiate the transmission of such a message in violation of a policy regarding unsolicited commercial e-mail messages that complies with specified requirements. Directs the Federal Trade Commission (FTC) to notify violators under this Act, to prohibit further initiation of such messages, and to require the initiator to delete the names and e-mail addresses of the recipients and providers from all mailing lists. Requires the names and e-mail addresses of any children of the recipient to be included in such notification.

Requires revolving funds to be used only for providing assistance for activities which have as a principal benefit the improvement or protection of water quality of navigable waters. Provides for an extended repayment period and additional subsidization with respect to loans made to financially distressed communities from revolving funds. Reauthorizes appropriations for FY 2002 through 2006 for the revolving fund program.

Preparedness Against Domestic Terrorism Act of 2001 - Amends the Robert T. Stafford Disaster Relief and Emergency Assistance Act (the Act) to include snow droughts, acts of terrorism or other catastrophic events within its definition of "major disaster" for purposes of authorized disaster relief. Requires the President (current law authorizes the Director of the Federal Emergency Management Agency (FEMA Director)) to be responsible for carrying out Federal emergency preparedness plans and programs. Includes as a covered hazard a domestic terrorist attack involving a weapon of mass destruction. Requires the President to ensure that Federal response plans and programs are adequate to respond to the consequences of terrorism directed against a target in the United States. Includes the development of equipment, clothing, and facilities within authorized preparedness measures. Repeals provisions of the Act which: (1) allow State preparedness funds to be used to prepare for hazards and for providing emergency assistance in response to hazards; and (2) require the FEMA Director to establish emergency preparedness security regulations. Establishes the President's Council on Domestic Preparedness. Requires the Council to: (1) publish a Domestic Terrorism Preparedness Plan and an annual implementation strategy; (2) designate an entity to assess the risk of terrorist attacks against transportation, energy, and other infrastructure facilities; and (3) establish voluntary minimum guidelines for preparedness programs. Authorizes the Council to attend meetings of the National Security Council pertaining to domestic terrorist attack preparedness matters, subject to the direction of the President.

Electronic Commerce Enhancement Act of 2001 - Requires the Director of the National Institute of Standards and Technology (NIST) to establish an Advisory Panel to report on the challenges facing small and medium-sized manufacturers and other such businesses in integrating and utilizing electronic commerce technologies and business practices. Requires the Panel's final report to the Director and specified congressional committees to include: (1) a three-year planning document for NIST's Manufacturing Extension Partnership (MEP) program in the field of electronic commerce; and (2) recommendations for NIST to address interoperability issues in electronic commerce. Requires the MEP program to: (1) establish a pilot program to assist such manufacturers and businesses in integrating and utilizing electronic commerce technologies and business practices through a competitive grants program; and (2) consult with the Panel and utilize the Panel's reports. Requires the Director to: (1) identify critical enterprise integration standards and implementation activities for major manufacturing industries; (2) report to Congress on such matters and anticipated related NIST activities for that fiscal year; and (3) submit to Congress a plan for enterprise integration for each major manufacturing industry. Requires annual plan updates for an industry until enterprise integration has been achieved.

Subjects persons who violate such prohibitions to specified penalties. Waives such prohibition for wildlife law enforcement purposes where a valid permit has been issued. Requires the Secretary of the Interior to continue discussions concerning trade in bear viscera with the appropriate representatives of Parties to the Convention on International Trade in Endangered Species of Wild Fauna and Flora and with other representatives of countries that are not party to the Convention which are determined to be the leading importers, exporters, or consumers of such products, in order to establish coordinated efforts with such countries to protect bears. Declares that nothing in this Act shall be construed to affect State regulation of bear population or to affect the lawful hunting of bears under State law.

Establishes in NSF a working group to review and coordinate regular and supplemental curricula in kindergarten through the 12th grade for science, mathematics, engineering, and technology. Requires the NSF Director to: (1) make grants to State or local educational agencies (SEAs or LEAs) or private elementary or middle schools to hire master teachers to provide support for teachers of mathematics, science, engineering, or technology programs, and in-classroom assistance and oversight of hands-on inquiry materials, equipment, and supplies; (2) subject to appropriations, make demonstration project grants to eligible LEAs; (3) with the Secretary of Education, compile and disseminate information on standard prerequisites for middle school and high school students who seek to enter a course of study at an institution of higher education in science, mathematics, engineering, or technology education to teach in an elementary or secondary school, and State licensing requirements for such teachers; (4) make an agreement for National Academy of Sciences compilation and evaluation of studies on the effectiveness of technology in the classroom on learning and student performance; (5) establish a program under which grants may be made for instruction of teachers for grades kindergarten through the 12th grade in the use of technology in the classroom; (6) convene a National Science Education Forum; and (7) make available through the Internet a complete field-test version of any curricular program developed with NSF funds. Authorizes the Director to award grants to: (1) secondary school and college students working with university faculty, software developers, and experts in educational technology, or to such faculty, developers, and experts working with such students, to develop high-quality educational software and Internet web sites, with priority given to mathematics, science, engineering, and technology software and sites; (2) States for assisting middle school teacher training in technology, to help reach the goal of making all middle school graduates technology-literate; and (3) SEAs or LEAs or private elementary, middle, or secondary schools, under any NSF education and human resources grant program, for distance learning integration into the education process in kindergarten through the 12th grade. Directs the President, acting through the NSF, to provide scholarships to teachers at public and private schools in kindergarten through the 12th grade to participate in Federal, State, or private research programs. Requires the Director to establish an Internet web site for use by students and teachers participating in such program.

Includes information on model science, mathematics, engineering, and technology teacher mentoring programs among the information which the Eisenhower National Clearinghouse for Mathematics and Science Education (Clearinghouse) is required to disseminate. Includes such mentoring programs under teacher professional development program requirements for State plans, accountability reports, and local activities. Revises ESEA provisions for the allocation and use of funds for the Clearinghouse. Requires such funds to be used to: (1) solicit and gather qualitative and evaluative materials and programs, review their evaluation, rank their effectiveness, and distribute results of reviews, as well as excerpts of materials and links to Internet sites and information on-line communities of users to teachers; and (2) establish an Internet site offering a search mechanism to assist site visitors in identifying information on science, mathematics, engineering, and technology education instructional materials and programs, including electronic links to information on classroom demonstrations and experiments, teachers who have used materials or participated in programs, vendors, curricula, and textbooks. Directs the Clearinghouse to give particular attention to the effective use of materials and technology in science, mathematics, engineering, and technology education. Directs the National Academy of Sciences to study and report on the Clearinghouse. Authorizes the Secretary of Education to make grants for summer professional development institutes for teachers. Includes providing technology training software and instructional materials to teachers among local uses of ESEA school technology resource grants. Requires a portion of each ESEA 21st Century Community Learning Centers program grant to be used to provide after-school day care services that focus on science activities. Amends the Higher Education Act of 1965 (HEA) to treat technology training, tutoring teachers in the uses of classroom technology, as community service by college students under the work-study program. Increases funding for such program and reserves the amount of such increase to compensate students employed in technology training or tutoring teachers in the uses of classroom technology. Directs the Secretary of Commerce to study and report to Congress on specified aspects of a comprehensive approach to providing technologically competent teachers for U.S. schools.
