The bill updates the Blood Act and transfers the organization of the reference service for immunohematological studies from the Ministry of Social Affairs to the Health Board. This increases the competence of the Health Board in the field of blood and helps ensure the quality of blood tests.
Currently, the Health Board provides reference laboratory services in health protection and does so, for example, in the case of infectious diseases and drinking water research.
The reference laboratory for immunohematological studies provides a service which during the process, for example, donor blood preparations suitable for the patient's treatment are determined. The purpose of the reference laboratory is to ensure the quality of immunohematological research in Estonia.
Immunohematological studies are used to determine the blood group and blood composition, including to assess the compatibility of donor and patient blood before blood transfusions.
In addition, according to the draft, the requirement of a five-year contract for the provision of reference services will be removed from the law. It is necessary to allow flexibility and give the health board discretion over the term of the contract. The terms of the contract must be based on the rules set out in the Public Procurement Act: for example, the contract could be up to 48 months in length, the conclusion of a longer contract must be justified.
According to the procurement contract, the reference service of the reference laboratory for immunohematological studies is currently provided by SA Northern Estonian Regional Hospital until 2027. The transfer of the task from the Ministry of Social Affairs to the Health Board does not affect the validity of this contract. This means that the content and quality of blood services for the patient, PERH and healthcare providers will not change.
The reference service provider is paid a maximum of 143,736 euros annually based on the current management contract. The organization of public procurement and other service-related activities for the organization of the reference service do not require a separate position and do not entail additional costs.

As of January 28, the corresponding EU regulation applies to veterinary drugs, which is binding in its entirety and directly applicable in all member states of the European Union. In order to achieve the goals of the regulation and to better implement it, the Medicines Act must be amended and, in addition, the provisions related to medicines in the Veterinary Act must be specified.
As of January 28, licenses for wholesalers of veterinary medicinal products will be valid throughout the EU. As a result, the bill is planned to provide veterinarians, general and veterinary pharmacies the right to import veterinary medicines from EU veterinary medicine wholesalers into Estonia. So far, veterinarians have been able to buy medicines from an Estonian wholesaler of veterinary medicines.
Also, according to the draft, veterinarians no longer have to apply for a separate permit from the Medicines Board to use a veterinary drug without a marketing authorization. When using medicines with a marketing authorization in veterinary medicine, the veterinarian must follow the mentioned regulation of the stipulated requirements. However, as a first choice, the licensed veterinary medicinal product must continue to be used in accordance with the conditions of the marketing authorization.
The bill clarifies the tasks of the competent authorities in the field of veterinary medicines, the Medicines Board and the Agriculture and Food Board, modernizes the regulation of the Medicines Board's fees, and gives the Medicines Board the right to allow exceptions regarding the packaging requirements of veterinary medicines.

The bill introduces a new complete text of the Public Health Act, which replaces the text of the previously valid Public Health Act.
The bill provides for a comprehensive system of public health measures. The tasks of the ministries, including the Ministry of Social Affairs, in the administration of public health are updated and supplemented. The tasks of local governments in the implementation of public health measures are stipulated more clearly than before. The bill strengthens the special the role of the parties to assess the impact of their actions and decisions on the health of the population.
The bill also updates the health protection requirements, including catering, applicable to pre-school institutions, schools and social service providers. Among other things, the role of the school principal in creating an environment conducive to healthy eating is increased and it is stipulated that his task is to establish requirements and restrictions for the food offered for sale in the educational institution. Draft also amends the Social Welfare Act so that it is clearly understood which social services are subject to the health protection requirements established on the basis of the Public Health Act.
The bill prohibits the provision of tanning and tattooing services to under 18s and updates the requirements for other beauty and personal services.
The explanatory note states that, according to the WHO, the solarium belongs to the first group of carcinogens, which means that its association with cancer has been scientifically proven. There are also several health risks associated with tattooing, which result from the dyes used in the process.
The bill also amends the Advertising Act and the Consumer Protection Act in order to expand the supervisory authority of the Health Board and to give the Board the right and obligation to supervise the trading method of a product or service, including the legality of advertising, for the protection of human health. The draft is still updating maximum fine and penalty rates to be sufficiently effective.

The bill amends the Tobacco Act with the aim of establishing a regulation for tobacco-free snuff, which has not yet been precisely regulated, in order to ensure the safety of the products. The bill also corrects the provisions of the law, which, contrary to the intended purpose, have led to an increase in illegal trade and health risks. It also changes provisions that have reduced the availability of less harmful products compared to more harmful products.

With the amendments to the bill, the Health Insurance Act is supplemented with a new additional temporary incapacity for work insurance case, which is infection with the new dangerous infectious disease COVID-19, in which case the insured person has the right to receive sickness compensation of 100 percent of the person's income from the first day of work release. Among other things, the fixed-term regulation on the payment of sickness benefits, which entered into force on January 1, 2021, will be changed to indefinite, since as of today there are no know when the virus outbreak subsides.
The explanatory letter states that the purpose of the changes made in the draft is to prevent the infection of working-age people and to avoid workplace-based infection centers.

The draft amends the provision of the Act on Psychiatric Assistance, which regulates the provision of psychiatric assistance to minors and persons with limited legal capacity. According to the draft, sane minors will have the right to receive psychiatric treatment with their consent, which until now was not possible without parental consent. The explanatory note states that early and timely medical intervention contributes to effective and efficient treatment, which in turn helps reduce the mental problems of young people.
