Law on Amendments to the Debt Law Act, the Credit Institutions Act and the Payment Institutions and E-Money Institutions Act (Prevention and Suppression of Financial Fraud)

The purpose of the bill is to enhance the detection, identification and prevention of financial fraud by giving payment service providers a clear legal basis for refusing to execute a payment order and credit institutions the right to share the necessary information with other credit institutions, PPA and RIA in case of suspicion of fraud. The current law does not allow for sufficiently quick and effective intervention in case of suspicion of financial fraud, as the right to refuse execution of a payment order is narrowly defined. Also, the current law does not contain clear grounds for sharing necessary and timely information, and thus cooperation between different parties does not function effectively. Payments are generally processed in real-time, which means they reach the payee's account in seconds. Therefore, it is important that payment service providers have a clear legal basis for refusing to execute a payment order, and it is very important to exchange data with different between the parties. The bill is based on the same goal and creates the necessary legal foundations in domestic law that help detect, identify and prevent fraud more effectively. The aim is to enable the implementation of such measures to a certain extent even before the new EU Payment Services Regulation comes into force.

Debt Law Amendment Act

The aim of the bill is to strengthen consumer awareness and guide them to make more sustainable consumption decisions. To this end, the requirements for providing pre-contractual information are supplemented so that consumers can have a better understanding of the characteristics of the products, including their durability and repairability, before making a purchase decision. The changes take over the requirements of the EU directive, which specifies the obligations of businesses and the rights of consumers to promote greener consumption. According to the draft, the obligation to provide the consumer with additional information before concluding the contract extends to the entrepreneur. In the future, the consumer must be informed about the availability of free software updates and the repairability of products. A product's repairability score is a score based on EU requirements that shows how easy it is to repair a product. Currently, the obligation to submit a repairability score applies to smartphones and tablets. In cases where the repairability score is not appropriate, the entrepreneur must provide information about the availability of spare parts and repair and maintenance manuals, as well as possible repair restrictions. The consumer must also be given information about environmentally friendly delivery methods. In addition, it is stipulated that businesses must introduce a harmonized notice and label reminding the consumer of his rights in case of non-conformity of the goods. If the manufacturer offers a sales guarantee related to the durability of the products, it must to present information about this to the consumer through harmonized labeling to ensure better comprehensibility and comparability of the information. Stores and e-shops display a unified notice of consumer rights.

The Law on Amendments to the Law on Property Law and the Law on Implementation of the Law on Property Law

The purpose of the bill is to make housing loan refinancing easier, faster and cheaper and to increase competition on the loan market. For this purpose, the Property Law Act and its implementation law are amended so that when transferring a housing loan from one bank to another, notarization is no longer required, if the borrower and collateral remain the same and the conditions do not become more unfavorable for the client. Necessary agreements can be concluded digitally in the future. The change is related to the government's aim to reduce red tape and borrowing costs, and also stems from a coalition agreement to increase competition in the housing loan market. Easier refinancing motivates banks to offer better conditions to attract customers and gives people more opportunities to choose a cheaper loan. For borrowers, the change primarily means financial and time savings. The notary fee disappears and the need to match the schedules of different parties is reduced. At the same time, the land registry operation and the related state fee remain.

The Law on Debt Law and the Consumer Protection Act Amendment Act

Eelnõuga võetakse Eesti õigusesse üle finantsteenuste kaugturustuse direktiiv, mis asendab varasema samasisulise direktiivi ja kohandab tarbijakaitse nõuded nutiajastu kasutusloogikaga. Direktiiv ajakohastab reeglid vastavalt olukorrale, kus finantsteenuseid sõlmitakse üha enam telefoni, veebivormi või vestlusroboti kaudu. Eesmärk on anda tarbijale piisavalt kaitset kaugmüügi ehk sidevahenditega sõlmitud tehingute korral. Lepingueelne teave peab olema esitatud selgelt ja kasutajale arusaadavalt ka väiksel ekraanil. Ühe olulise muudatusena näeb eelnõu ette õiguse nõuda online asjaajamisel inimsuhtlust. Kui ettevõtja on suhtluse korraldanud juturoboti kaudu, peab tarbijal olema võimalus suunata vestlus päris nõustajale. See on oluline eriti juhul, kui finantsteenuse toode on keeruline või roboti standardsed vastused jäävad liiga üldiseks. Tarbijal peab olema võimalus suhelda enne lepingu sõlmimist inimesega, et veenduda, kas ta on tehingu tingimustest õigesti aru saanud. Olulise uuendusena kehtestatakse veebilepingute puhul taganemisfunktsioon ehk taganemisnupp. See peab andma tarbijale võimaluse loobuda 14-päeva jooksul ostust sama lihtsalt kui internetipoest paari klikiga asja soetamine. Praegu on e-poes ostmine tehtud ülilihtsakssaks, aga taganemine on sageli keeruline ja peidetud blankettide või juhiste taha.

Riigikogu decision "Making a proposal to the Government of the Republic to develop a legal framework simplifying the refinancing of home loans"

The bill aims to propose to the government to develop legislative amendments and implementing procedures that would simplify the refinancing of home loans and make it more favorable for borrowers. The rise in interest rates in recent years has significantly increased the cost of home loans for many families. Although loan refinancing could be one solution to reduce the interest burden, its process in Estonia is currently complex, expensive and time-consuming. Borrower protection and increasing competition in the financial market would help to ensure fairer conditions and alleviate the financial difficulties of households.

The purpose of the bill is to change the procedure for relinquishing real estate so that ownership of the real estate is transferred to the local government unit instead of the state. In the future, the ceded property would be transferred to the local government, which knows the local conditions better and is responsible for the development of the living environment. Notaries have an additional obligation to prove these circumstances, which is why the notary fee for the corresponding transaction is also increased. The bill proposes to appoint Kadri Tali as the head of the Estonian delegation of the Parliamentary Assembly of the Council of Europe (ENPA) instead of Liisa Pakosta, who became the Minister of Justice and Digital Affairs. In addition, according to the draft, the current substitute members Reili Rand and Ants Frosch are excluded from the delegation, and Hanah Lahe and Martin Helme are appointed as new substitute members. Aleksei Jevgrafov and Eerik-Niiles Kross will continue as members of the delegation and as substitute members continues Tõnis Lukas. The Foreign Affairs Committee decided on the changes to be made in the draft, taking into account the proposals of the factions. The ENPA delegation represents Estonia and protects the country's interests in the Council of Europe, the purpose of which is to promote democracy and protect human rights and the principles of the rule of law in Europe. Eelnõu mõistab hukka Venemaa tahtliku, süsteemse ja rahvusvahelise õiguse vastase Ukraina laste küüditamine ning nõuab laste vabastamist ja nende turvalise tagasipöördumise tagamist Ukrainasse. Saadikud juhivad eelnõus tähelepanu, et tahtlik ja süsteemne laste küüditamine Ukrainast Venemaale ja Valgevenesse on rahvusvahelise õiguse kohaselt sõjakuritegu ja genotsiid. Nende sõnul on Venemaa ja Valgevene eesmärk hävitada ukraina rahvus ja identiteet, seejuures tappes, haavates, traumeerides ning ümber asustades Ukraina lapsi. Venemaa Föderatsiooni poolt 2014. aastal alustatud agressioonisõja kestel on Ukraina aladelt Venemaale viidud sadu tuhandeid lapsi. Riigikogu nõuab eelnõu kohaselt Venemaalt ja Valgevenelt Ukrainast küüditatud laste vabastamist ja nende Ukrainasse turvalise tagasipöördumise tagamist ning kutsub kõiki riike üles aitama kaasa laste Ukrainasse naasmisele ja tegema selle nimel koostööd. Eelnõu kohaselt avaldab Riigikogu toetust Ukraina presidendi Volodõmõr Zelenskõi väljapakutud 10-punktilisele rahuplaanile, mille osa on Venemaale ja Valgevenesse küüditatute tagasitoomine, ning tunnustab laste tagasitoomisele keskendunud rahvusvahelise koalitsiooni loomist. Samuti tunnustab Riigikogu eelnõus Rahvusvahelise Kriminaalkohtu tegevust karistamatusega võitlemisel, iseäranis mullu märtsis väljastatud vahistamismäärusi Venemaa Föderatsiooni presidendi ja Venemaa laste õiguste voliniku kohta Ukraina laste ebaseadusliku deporteerimise ja ümberasustamise süüdistuses.

Seadusega ratifitseeritakse Eesti ja Austria vaheline investeeringute soodustamise ja kaitse lepingu lõpetamine, vastavale kokkuleppele kirjutasid riigid Viinis alla 13. detsembril 2021. Lepingu lõpetamine on vajalik, et tagada Euroopa Liidu õigusaktidest tulenevalt kõikide Euroopa Liidu liikmesriikide investorite võrdne kohtlemine. Kokkulepe jõustub teise kuu esimesel päeval pärast seda, kui pooled on üksteist riigisiseste jõustumistoimingute lõpetamisest teavitanud. Välisministeerium edastab Austria Vabariigile jõustumisnoodi pärast kokkuleppe ratifitseerimise seaduse jõustumist.
