M. Bernard Reynès interroge Mme la garde des sceaux, ministre de la justice, sur la réforme de la justice. En 2013, une nouvelle cité judiciaire a vu le jour à Tarascon regroupant le tribunal de grande instance, deux tribunaux d'instance, celui d'Arles et de Tarascon, deux tribunaux de commerce, Arles et Tarascon, le tribunal pour enfants et le service des juges d'application des peines. Au vu du bilan d'activités présenté le 23 janvier 2018 lors de l'audience solennelle de rentrée du TGI de Tarascon, l'année 2017 a démontré la qualité et l'efficacité de la justice rendue à Tarascon. La réforme de la carte judiciaire tendrait à créer un tribunal pilote départemental à Marseille ou Aix en Provence, pour ne laisser subsister en lieu et place du TGI de Tarascon un tribunal vidé de ses compétences, autrement dit un tribunal de « seconde zone ». Les citoyens vont devoir effectuer 200 km aller-retour pour se rendre auprès de leur juridiction de première instance. Où est l'égalité pour tous d'accès à la justice ? Peut-on parler encore de justice de proximité ? Une fois encore c'est la ruralité que l'on bafoue ! Il lui demande que les dispositions de la réforme de la justice et particulièrement celle concernant la réforme de la carte judiciaire aillent dans le sens d'une justice de qualité pour les citoyens et surtout pour ceux des zones rurales et pas seulement pour ceux qui résident dans les grands centres urbains.

In this context, a large number of construction and public works companies must face to a significant increase in prices and significant supply difficulties. It would be totally unfair for these same companies to suffer alone the additional costs induced by this situation when they have awarded contracts that they are not able to update and at the very moment when most of them are required to repay the State guaranteed loan that they obtained. Faced with this situation, he would like to know the measures that the Government intends to take to support this oh-so-important part of our economy.

Mr. Bernard Reynès draws the attention of the Minister of the Economy, Finance and Recovery to the situation of lessors of tourist residences. Mr. Bernard Reynès questions the Minister of the Economy, Finance and Recovery on Decree No. 2020-1620 of December 19, 2020 relating to the solidarity fund for companies particularly affected by the crisis, which provides for the month of December 2020, for all companies regardless of their size, subject to a ban on welcoming the public, a right of option between aid of up to 10,000 euros or compensation of 20% of 2019 turnover up to a limit of 200,000 euros per month. However, the latest figures published by the interministerial security observatory are not reassuring in the sense that since 2010, the number of cyclists killed has increased by 22%. The risk for a cyclist of being the victim of an accident is three times higher than for a motorist and the most serious injuries affect the head. In 2019, 187 cyclists lost their lives, more than 1,600 others were hospitalized. Mr. Bernard Reynès draws the attention of the Minister for Europe and Foreign Affairs to the serious concerns raised by charitable associations, such as the Bouches-du-Rhône Food Bank, about food aid at European level. In fact, these associations benefit in particular from the European Fund for Aid to the Most Deprived (FEAD) which allows them to have 100 to 120 tonnes of basic products, i.e. almost 30% of the products they distribute. This essential contribution provides stability and regularity of food distributed to people in need. The covid-19 crisis and its economic and social consequences have particularly hit populations. Many families found themselves with a drop in income or lost their jobs and the number of registrations really exploded in six months. This help has not always not been paid and the foodstuffs are starting to run out. Considering that this fund allows associations to act against poverty and precariousness, he asks them to intervene with their European counterparts so that the 2020 amount is paid quickly and that the current FEAD budget is maintained within the framework of future European discussions.

Bernard Reynès alerte M. le ministre de l'agriculture et de l'alimentation sur les graves manquements des entreprises de travail temporaire étrangères employant des travailleurs saisonniers agricoles, ressortissants d'un État membre de l'Union européenne au titre du détachement ou ressortissants de pays tiers résidant à titre principal dans un pays de l'espace européen, face à leurs obligations de garantir la santé et la sécurité de ces travailleurs, face aux risques sanitaires qu'ils font courir aux populations locales et enfin face aux conditions d'accueil indécentes des saisonniers. Les producteurs français ont besoin de cette main-d’œuvre qualifiée pour permettre des récoltes efficaces et ces travailleurs étrangers sont indispensables au fonctionnement de certaines exploitations fruitières et maraîchères, ainsi qu'à l'approvisionnement qualitatif et quantitatif de la population. Le Gouvernement indique être totalement engagé pour renforcer la force de travail sur les exploitations agricoles et adapter les dispositifs aux besoins, tout en assurant la protection et la sécurité de chacun, priorité première du Gouvernement. Par instruction du Premier ministre du 20 mai 2020, ces saisonniers peuvent désormais entrer sur le territoire. Aujourd'hui des travailleurs détachés dans les exploitations des Bouches-du-Rhône, du Vaucluse et du Gard par des sociétés de service espagnoles viennent d'être testés positifs au covid-19. Lors de la première phase de tests, des responsables locaux de l'entreprise auraient demandé aux travailleurs de refuser les analyses en prétendant que s'il y avait des cas positifs, l'État français les empêcherait tous de travailler et une partie des personnes concernées a refusé d'être testée. Comment s'assurer que les quatorzaines sont respectées et les travailleurs testés positifs réellement isolés ? Comment s'assurer que l'on n'assistera pas à une reprise de la pandémie alors que ces travailleurs étrangers sont confrontés à la promiscuité dans des logements surpeuplés, mal équipés et aux conditions d'hygiène inexistantes ? Aussi, M. le député souhaite connaître la position de M. le ministre sur cette question. Il lui demande si des mesures vont être prises pour contrôler les entreprises de travail temporaire étrangères employant des travailleurs saisonniers agricoles, pour les contraindre à garantir les droits de ces travailleurs en matière de conditions de travail et de logement, et les dispositions prises pour enrayer toute propagation du virus.

Mr. Bernard Reynès draws the attention of the Minister of National Education and Youth to the question of teaching the languages of France and in particular Provençal. According to article 75-1 of the Constitution of the Fifth French Republic, “Regional languages belong to the heritage of France”. Regional languages are therefore heritage languages and it is for this reason that they deserve a special status, distinct from that of foreign languages. He alerts the Minister to the fundamental incompatibility between the article of the Constitution previously cited and the high school reform set out in Decree No. 2018-614 of July 16, 2018. Several provisions of this decree are denounced by teachers of Provençal as well as by regionalist associations which highlight the absence of the mention "Provençal" in the title of the option and its reduction to a single language, Occitan. Furthermore, we cannot claim to contribute to the maintenance of regional languages while reducing their bonus to the baccalaureate, this for all languages of France combined. However, this is indeed the purpose of this decree and what it wishes to alert the Minister to. Finally, the number of hours allocated to regional languages (also called “hourly allocation”) must not, as is currently the case, vary depending on the establishment. Regional languages deserve a fixed time allocation which would put them on an equal footing with the provision of foreign language teaching. Bernard Reynès alerte M. le ministre de l'agriculture et de l'alimentation sur les difficultés que rencontrent les « petits » exploitants agricoles cultivant en plein champ dans plusieurs domaines (arboriculture, maraîchage, luzerne, foin) à obtenir du foncier afin de poursuivre le développement de leur activité agricole car ils subissent depuis plusieurs années une hausse des prix soutenue tant à la location qu'à l'acquisition, de surfaces foncières à exploiter. Cette situation engage leur pérennité car leurs charges fixes augmentent chaque année, et notamment dans le cadre des baux ruraux souscrits des propriétaires qui sont réévalués d'année en année aux prix du marché. Les prix pour la location d'un hectare sur certaines communes de sa circonscription sont passés de 150 euros par hectare à 400 euros par hectare actuellement en location et cela monte encore. sont également en cause dans leurs difficultés, les problèmes d'eau survenus lors de l'irrigation de leurs cultures. Les producteurs qui n'ont que de petites parcelles à arroser à l'eau claire, ne parviennent pas à compenser la quantité d'eau absorbée pour l'irrigation de ces grandes exploitations céréalières ou légumières qui nécessitent beaucoup plus de volume en eau, afin de maintenir une production intensive et un fort taux de rendement à l'hectare de plein champ cultivé. Cette situation ambigüe et conflictuelle entre deux formes d'agriculture nous dirige d'ailleurs à l'opposé de ce qui est aujourd'hui dans l'air du temps à savoir : le produit local, le consommé local, les circuits courts et l'agriculture raisonné avec en ligne de mire les projets alimentaires territoriaux qui fleurissent pour reterritorialiser l'alimentation. C'est pourquoi il lui demande quelles mesures concrètes pourraient être mises en œuvre afin de contenir l'augmentation des prix du foncier qui frappe ces petits exploitants agricoles et les accompagner dans le développement de la surface à cultiver afin de ne pas stagner, voire disparaître.

Mr. Bernard Reynès draws the attention of the Minister of the Economy and Finance to the commitment made by the Government to the national representation to stabilize, after the tax reduction for room costs of 150 million euros included in the finance law for 2018, the tax resources allocated to the chambers of commerce and industry (CCI) until the end of the mandate. Thus, on October 21, 2017 in public session at the Assembly nationally, the Minister of Action and Public Accounts had indicated that the contribution of the CCIs to the public effort was “only once for the entire five-year period”. On November 14, 2017, in the Senate Economic Affairs Committee, the Minister of the Economy and Finance made the same commitment to the chambers: “we undertake to guarantee the stability of their resources in 2019-2022”. Moreover, several responses from the Ministry of the Economy and Finance to written parliamentary questions assured that “the Government has made a commitment, within the framework of the 2018-2020 three-year trajectory, that no further reduction will be made in 2019 and 2020, in order to give the network multi-year visibility on its resources”. However, on May 28, 2018, during the meeting of the executive committee of the national industry council, the Prime Minister announced a further reduction of 100 million euros in the tax allocated to CCIs in 2019. M. Bernard Reynès attire l'attention de Mme la ministre déléguée auprès du ministre de l'éducation nationale, de la jeunesse et des sports, chargée des sports sur la dénonciation, par la Fédération française de la montagne et de l'escalade (FFME), des conventions de gestion des sites d'escalade naturels et le transfert de la responsabilité aux propriétaires privés et aux collectivités. La FFME établit depuis de nombreuses années des conventions d'autorisation d'usage avec les propriétaires privés et publics de site d'escalade naturels. Ces contrats, qui transfèrent la responsabilité du propriétaire vers la fédération, ont pour objet l'ouverture gratuite au public des sites concernés. La FFME favorise ainsi le développement de la discipline et le tourisme qui en découle sur 2 500 sites conventionnés dans toute la France. Suite à un accident intervenu en 2010 dans les Pyrénées-Orientales, la cour d'appel de Toulouse a reconnu, le 21 janvier 2019, la responsabilité de la FFME concernant les falaises conventionnées pour les dommages causés aux pratiquants lorsqu'ils proviennent du site lui-même. La FFME n'étant pas en mesure d'assumer à l'avenir des sommes aussi importantes, elle est favorable à une protection accrue des propriétaires et gestionnaires. La fédération défend en effet l'extension de l'exonération légale de responsabilité civile bénéficiant aux propriétaires riverains de cours d'eau privés à l'ensemble des propriétaires et des gestionnaires d'espaces, sites et itinéraires relatifs aux sports de nature pour les dommages causés ou subis à l'occasion de la pratique des sports de nature. Cette exonération légale porterait uniquement sur la responsabilité sans faute fondée sur l'article 1242 al. 1er, anciennement art. 1384 al. 1er, du code civil. Le milieu de l'escalade craint une interdiction de la pratique sur ces sites de la part des propriétaires privés et publics, au vu des risques financiers conséquents encourus. Il l'interroge sur la possibilité, pour le ministère, de modifier le code des sports afin d'éviter que les propriétaires désengagent leur responsabilité et limitent la pratique de l'escalade en France.

Mr. Bernard Reynès alerts the Minister of State, Minister of Ecological and Inclusive Transition, to the risk of rapid disappearance of 260 jobs at the company SIRAP France, a company specializing in the manufacture of plastic packaging following the initiatives launched as part of the circular economy roadmap and the commitments made by the Government consisting of declaring as problematic and useless products to expanded polystyrene base that this company manufactures. Sirap France is a leading company on the food packaging market in France, active since 1994 with three production plants (Noves, Remoulins, Tarascon), a turnover of 60 million euros and 260 employees. It is part of a group, Sirap, created in 1960 which is today one of the most recognized producers of packaging for fresh products in Europe (with 13 factories, in Italy, France, Spain, Germany, Great Britain, Poland and Hungary), with a turnover of 275 million euros. Expanded polystyrene is the lightest packaging solution available on the market, consisting of 95% air and 5% polymer. In the food packaging sector, this also translates into a reduction in the cost of the product for the benefit of the end consumer. Like the also demonstrate applications in high performance sectors such as military, nautical, aeronautical or wind power applications, the expansion guarantees, in addition to lightness, high mechanical and insulation performance. Expanded polystyrene makes it possible to obtain unrivaled results in the field of preserving the quality of food and combating food waste. All residues of production (20% to 35% of the semi-finished product) are regularly recycled in the same production process, thus demonstrating that this operation is technically feasible. Improvement efforts are currently focused on improving the availability of post-consumer recycled polystyrene for food applications, which is still insufficient. Mr. Bernard Reynès questions the Minister of Territorial Cohesion on articles 20 and 28 of the bill on the evolution of housing, development and digital technology, known as the ELAN law, which raise fears for the survival of local construction craftsmen and SMEs. For the Government, this involves exempting HLM offices from the obligation to respect the provisions of the law on public project management allowing allotment, therefore the freedom for any company, regardless of its size, to apply directly for work corresponding to its skills. By allowing HLM organizations to globalize, without reason, a market divisible into lots, it discriminates against operators who do not have the capacity to provide a global offer. This form of globalized contract leaves the way open to large construction groups and de facto excludes craftsmen and SMEs by depriving them direct access to their local markets which represent more than 50% of their activity. Likewise, under the pretext of speeding up the construction procedures for social housing, the possibility is offered to social housing organizations to use the design-construction procedure until 2021, a procedure which is perpetuated without objective reason.
