M. Didier Paris attire l'attention de M. le ministre de l'agriculture et de l'alimentation sur les modalités comptables d'affectation des subventions publiques d'investissement reçues par les coopératives d'utilisation de matériel agricole (CUMA). Actuellement, ces subventions intègrent directement les fonds propres en compte de réserve indisponible sans transiter par le compte de résultat. Cette règle propre aux CUMA a l'inconvénient de faire obstacle à la mobilisation comptable de ces fonds pour compenser les charges d'utilisation du matériel, notamment les charges d'amortissement. Dès lors, ces charges sont supportées par les adhérents via la facturation de services rendus. Une modification de l'article L. 523-7 du code rural permettrait utilement de modifier cette règle et réduirait le prix de facturation des services rendus aux adhérents, diminuant ainsi substantiellement leurs coûts de production. Il souhaite connaître la position du Gouvernement sur cette évolution, qui pourrait trouver sa place dans le projet de loi pour l'équilibre des relations commerciales dans le secteur agricole et alimentaire et une alimentation saine et durable et qui améliorerait l'efficience des aides publiques auprès des agriculteurs, ceci sans impact budgétaire pour les financeurs publics.

Mr. Didier Paris draws the attention of the Minister of National Education to the training of high school students in economic and social sciences and to the place that this discipline deserves to hold in the training of young people. More than 50 years ago, economics and social sciences were introduced to high school, allowing the entry of a “third culture”, alongside the humanities and sciences, thus contributing to the enrichment of the intellectual and civic training of high school students. Every day, current events remind us of the need for everyone to have the analytical tools offered by economics, sociology and political science in order to be able to better understand the challenges of the major contemporary democratic questions which are, among other examples, the future of growth, social mobility, employment dynamics, the persistence of inequalities, in particular between women and men, the contrasting effects of globalization or the challenges of European construction. This discipline, very popular with students, has demonstrated its success. The ES series, of which it is the pivotal discipline, has undeniably participated in the democratization of high school by welcoming a third of general baccalaureate holders, who present a particularly varied social recruitment and benefit from diversified opportunities and good success rates in higher education. Economic and social sciences should be a constituent element of the common culture by being offered to every high school student. Absent from middle school and compulsory education in first and final year, it appears necessary to give them sufficient space in second year class. Today, in second general and technological classes, economic and social sciences are not are not part of common lessons but exploration lessons (high school students must choose two lessons including one on economics of 1 hour 30). He would like to know the Government's intentions regarding this discipline which deserves to be integrated into the common core of the general and technological second year class, for a schedule of 3 hours per week.

Mr. Didier Paris draws the attention of the Minister of the Interior to the modalities for exercising foothold easements encumbering private properties from the public river domain. Article L. 2131-2 of the general code of property of public entities provides that owners bordering a watercourse or a state-owned lake, such as Lake Geneva for example, cannot plant trees or enclose themselves by hedge or otherwise than at a distance. distance of 3.25 m. Their properties are encumbered on each bank of this last easement of 3.25 m, known as step easement. Neighboring owners note that the step easement is used very frequently by pedestrians who are accompanied by domestic animals and in particular dogs not kept on a leash. These animals wander onto private properties bordering the public river domain, which causes, for indisputable reasons of hygiene, conflicts between neighboring owners and users of the right of way. Article L. 2131-1 of the general code of property of public persons, cited above, does not stipulate the extension of the easement to domestic animals, it questions the possibility for neighboring owners to oppose the movement of domestic animals on the step easement and on the possibility for the mayors of the municipalities concerned to issue orders prohibiting the use of these easements by pedestrians accompanied by their animals, even on a leash.

M. Didier Paris attire l'attention de M. le garde des sceaux, ministre de la justice, sur les conditions d'entrée en fonction des gardes particuliers. L'article R. 15-33-29 du code de procédure pénale modifié par décret n° 2006-1100 du 30 août 2006 précisait que « la prestation de serment n'est pas requise à la suite du renouvellement d'un agrément, ou d'un nouvel agrément correspondant à une nouvelle commission pour la surveillance de territoires placés dans le ressort du tribunal ayant reçu le serment ». Or l'article 4-I du décret n° 2020-128 du 18 février 2020 portant application de diverses dispositions pénales de la loi n° 2019-222 du 23 mars 2019 de programmation 2018-2022 et de réforme pour la justice a supprimé cet alinéa. Cette disposition alourdit inutilement le formalisme des prestations de serments et ne semble pas se rattacher à une disposition de loi. Bien au contraire, elle est contraire aux objectifs de simplification et d'efficacité de la justice portés par la réforme. Il suffit pour s'en convaincre de se reporter à l'article 47-III de la loi qui a modifié l'article 28 du code de procédure pénale en prévoyant que les fonctionnaires et agents des administrations et services publics auxquels des lois spéciales attribuent certains pouvoirs de police judiciaire n'ont pas à renouveler leur serment en cas de changement d'affectation. C'est pourquoi il lui demande s'il compte modifier l'article 4-I du décret du 18 février 2020 en ce qu'il a supprimé le dernier alinéa de l'article R. 15-33-29 du code de procédure pénale.

These operators suffered a complete stoppage of their activity from March to May 2020, and were forced to postpone the programming of numerous events and to take charge of the expenses and net additional costs relating to hygiene and safety measures linked to the health crisis. The consequences of covid-19 jeopardize the financial balance of these public service delegations, the financial situation of the delegatees and the employment of their staff. Article R. 3135-5 of the public procurement code states that “the concession contract may be modified when the modification is made necessary by circumstances which a diligent granting authority could not have foreseen. In this case, the provisions of articles R. 3135-3 and R. 3135-4 are applicable.” The conditions for application of this provision are obviously met with regard to the covid-19 epidemic and make it possible to consider a modification of contracts by way of amendment. An extension of the duration of these public service delegations negotiated with public authorities delegators would thus make it possible to smooth out and limit the losses suffered by the delegatees and to protect jobs in the events sector. He asks him if he confirms this analysis for the events sector, considering that the occurrence and consequences of the covid-19 pandemic in France are unforeseeable circumstances within the meaning of article R. 3135-3 of the public procurement code allowing a modification of concessions without new competitive bidding procedure.

Mr. Didier Paris draws the attention of the Minister, to the Minister of State, Minister of Ecological and Inclusive Transition, responsible for transport, to the payment of parking fines, post-parking fee (FPS), which must now be paid by vehicle rental companies in place of their customers. Law No. 2014-58 of January 24, 2014 on the modernization of territorial public action and affirmation of metropolises known as MAPTAM, has organized, since January 1, 2018, the decriminalization and decentralization of paid parking, over which communities have full control from January 1, 2018. From now on, the driver no longer commits an offense punishable by a fine, but becomes liable for a post-parking fee. The request for exemption attached to the ticket having been deleted, the rental companies vehicles now no longer have the possibility of designating the tenant responsible and must first pay the FPS before turning against the tenant. This situation is particularly detrimental to these operators who very rarely manage to be reimbursed. It calls into question their economic model since the amounts of FPS are sometimes much higher than that of the daily profit means from the short-term rental of a vehicle. He would like to know the Government's position regarding the integration of a mechanism which would allow mobility operators to be able to designate the lessee of the vehicle subject to an FPS.

Mr. Didier Paris draws the attention of the Minister of the Economy and Finance to the ongoing evaluation of tax systems in all ministries, in order to identify possible savings measures. Some economic players are rightly concerned about the decisions that could be taken, particularly in terms of calling into question the reduced rate VAT for energy renovation work on buildings. He wishes remember that the reduced rate VAT concerning work in the building sector is an essential support for the purchasing power of households, particularly within the framework of the incentive system for the energy renovation of housing. The plan to combat energy poverty in buildings announced on April 26, 2018 sets the objective of renovating in 10 years 1.5 million thermal sieves inhabited by household owners in low income. This ambitious plan will not succeed if the VAT rate on the work concerned were to increase: low-income households, the first to be affected by this measure, would then give up undertaking energy renovation work on their homes. Furthermore, this measure, if it were to be taken, would have disastrous consequences for construction companies and would inevitably lead to recourse reinforced to illegal and undeclared work with all the consequences that we know: weakening of the social protection system, cost of stopping the market which is nevertheless a priority for renovation, deterioration of the employment market (forecast of short-term dismissal of 30,000 employees in the construction sector), He wishes to know the Government's position on its intentions concerning the maintenance of VAT at a reduced rate for energy renovation work on buildings.

Didier Paris attire l'attention de M. le ministre de l'agriculture et de l'alimentation sur l'arrêté du 27 décembre 2019 relatif aux mesures de protection des personnes lors de l'utilisation de produits phytosanitaires qui prescrit le respect d'une distance de sécurité de 10 mètres à partir des limites de propriété des riverains pour l'usage de la majorité des produits aujourd'hui utilisés pour lutter contre les maladies cryptogamiques de la vigne (et de l'arboriculture). Le respect de la nouvelle réglementation va générer une véritable impasse technique pour lutter contre le mildiou, l'une des principales maladies cryptogamiques de la vigne très présente en zone septentrionale, dans la zone de sécurité des 10 mètres. L'absence de traitement contre cette maladie récurrente entraînera une perte totale de récolte. Cela aura pour conséquence de rendre la culture impossible et provoquera progressivement l'arrachage de plusieurs centaines d'hectares de vignes qui se transformeront en friches avant d'être urbanisés et de repousser à nouveau les limites de l'espace viticole (1 000 ha sont concernés en Bourgogne). Cette situation mettra en difficulté l'ensemble des viticulteurs quelque que soit leur mode de production. Afin de sortir les viticulteurs de cette impasse, il propose que soit autorisée l'utilisation du cuivre, produit homologué en AB, jusqu'à la limite de propriété des riverains, pour une période transitoire de 4 ans, soit jusqu'au 31 décembre 2023, au même titre que pour les produits de biocontrôle. Ce délai vise à permettre à la recherche de trouver des alternatives au cuivre en produits de bio-contrôle. Il lui demande s'il acceptera, compte tenu de cette impasse technique aux conséquences potentiellement catastrophiques, d'autoriser par dérogation l'usage du cuivre sans distance de sécurité pour une période transitoire de 4 ans pour les cultures hautes (vigne, arboriculture).

Mr. Didier Paris draws the attention of the Minister of the Economy and Finance to the effectiveness of the fight against telephone canvassing initiated within the framework of the law relating to consumption of March 17, 2014, notably through the Bloctel system. Since the activation of the list opposing telephone canvassing, it seems that the Bloctel system has failed to protect consumers from abusive practices of the telephone canvassing. While this system resulting from Law No. 2014-344 is supposed to combat and regulate telephone canvassing, nine out of ten French people are today fed up with being harassed by the telephone platforms of various companies. He asks him to please clarify the Government's intentions to put an end to these practices and to indicate the additional measures that could be taken to allow the consumers to no longer be bothered.

Le nombre et la qualité des projets soumis dans le cadre des territoires à énergie positive pour la croissance verte (TEPCV) témoignent de la dynamique des territoires et de leur engagement au service de la transition énergétique et écologique de notre pays. Par note du 26 septembre 2017, le ministre d'État, ministre de la transition écologique et solidaire, a adressé des directives aux préfets afin de gérer les crédits de l'enveloppe spéciale transition énergétique (ESTE) avec rigueur et discernement et de réaliser un point d'avancement de the whole ofs projets inscrits dans les conventions conclues par l'État avec les collectivités. Cet état des lieux était indispensable pour évaluer le besoin de financement réel des projets. L'État honorera ses engagements juridiques et soutiendra les collectivités dans la réalisation des projets retenus dans le cadre des TEPCV, au service de la transition énergétique et écologique des territoires. À cet effet, le Premier ministre a décidé l'ouverture de 75 M€ de crédits nouveaux en faveur du budget du ministère de la transition écologique et solidaire. La loi de finances rectificative inclura cet abondement, qui portera à 475 M€ l'enveloppe spéciale de transition énergétique et permettra de continuer à financer en 2018 les actions déjà engagées dans les territoires. Par ailleurs la note ministérielle du 20 novembre dernier a permis de préciser certains points d'interprétation délicats que l'application de la note du 26 septembre avait révélés. Est ainsi établi désormais un cadre clarifié qui permettra aux collectivités et aux préfets de gérer la mise en œuvre des conventions dans la sérénité. Pour les années à venir, il est toutefois nécessaire de clôturer au plus vite l'ESTE qui constitue un dispositif de financement sui generis non pérenne, porté par la Caisse des dépôts et consignations. C'est pourquoi les conventions sont considérées comme cristallisées et ne feront pas l'objet d'avenants pour modification du programme d'actions. Seules de petites modifications au sein d'une même action pourront être prises en compte, dans l'esprit habituel de gestion des subventions d'État. À l'occasion des débats parlementaires on le government bill de finances pour 2018, le Gouvernement s'est engagé à conduire une réflexion sur un nouveau dispositif de financement du projet de transition écologique qui devra mieux intégrer les objectifs de résultats et limiter les effets d'aubaine. Cette réflexion sera conduite dans le cadre de la Conférence nationale des territoires.
