Mr. Luc Lamirault draws the attention of the Secretary of State to the Minister of Territorial Cohesion and Relations with Local Authorities, responsible for rural areas, to the impossibility of making or renewing a national identity card in a France services center. Few town halls process applications for identity cards, so appointments are rare. It could prove useful to allow this renewal to within the France services network in order to facilitate and accelerate the process, particularly when several administrative documents are lost or stolen, each requiring a specific and often time-consuming procedure in different administrations. This request has been made numerous times by people using France services in Eure-et-Loir. The MP supports the France services network and encourages its development by allowing it to be used for all administrative procedures. He asks her opinion on the subject.

Mr. Luc Lamirault draws the attention of the Minister of National Education, Youth and Sports to the proposal made in article 21 bis of the bill reinforcing respect for the principles of the Republic establishing a national identifier for any child subject to compulsory education. In an article published on the website of the Ministry of National Education relating to this bill and the measures affecting education, a paragraph on the INE describes the establishment of a working group with the Ministry of Territorial Cohesion and Relations with Local Authorities and the support of the DINUM “in order to assess the means to extend to all municipalities the implementation of automated data processing for the school census”. According to this same source, the conclusions of this working group should be known during December 2020. The MP would like to know if they have actually been made and what is the content of their proposals. In accordance with article L. 131-6 of the education code, mayors are responsible for ensuring this education for all the children in their municipalities. However, it is recognized that this control is often difficult, particularly due to the lack of accessible information to know the identity of children of educational age. If the Government is unfavorable to a compulsory domiciliary declaration in the event of a change of address, allowing more exact knowledge of the inhabitants of the municipalities, and the data held by the organizations responsible for the payment of family benefits are not always transmitted or sufficient, it questions it about the solutions envisaged to allow takes into account all children of school age.

Mr. Luc Lamirault reminds the Minister Delegate to the Minister of Solidarity and Health, responsible for autonomy, that the increase in the salaries of home helpers is a necessity that it is essential to implement quickly. The release of a budget of 200 million euros during the social security financing bill for the year 2021 is a first step towards making these autonomy professions more attractive. but there remain, according to the deputy, several blockages. Currently, the collective agreement for home help is characterized by initial classification levels with salaries set below the minimum wage. Of course, in accordance with the labor code, home helpers are not paid at a level below the minimum wage, but it is incomprehensible to maintain such a collective agreement in force. Mr. MP has aware that negotiations are underway with in particular amendments 43 and 44 which would allow an increase in the salaries set in the collective agreement of between 33.50 and 300 euros gross per month. He wishes to reiterate the urgency of putting in place these amendments, eagerly awaited on the ground, in order to make these professions more attractive and to reassure the departmental councils. He also alerts him about the remaining charges for the departments in order to achieve the objective of increasing salaries by 15%. He would like to have more visibility on the allocation mechanisms for the departments. There are significant differences in the hourly rates charged and he would like to know whether these differences will be taken into consideration and whether a good management bonus will be applied.

Mr. Luc Lamirault questions the Minister of Ecological Transition on the implementation of article L. 515-46 of the environmental code, which specifies that the operator of a wind turbine, or the parent company in the event of failure, are responsible for providing the financial guarantees necessary for the dismantling of the construction. He would like to know the accounting systems that are put in place to ensure the application of these financial guarantees. The MP recalls that the cost of dismantling a wind turbine is not 50,000 euros, as indicated in the amended decree of August 26, 2011, but can reach 300,000 euros. He therefore wishes a revision of article L. 515-46 in order to take into account the reality of these costs and to ensure the accounting blocking of the sum by the operators. The MP also questions the Minister on the montages financial operators of wind turbines. He takes the example of the Marchéville wind farm, the permit for which was filed by the company JP Énergie environment, a company with capital of more than 2.245 million euros; but the company currently owning it is the one called Parc éolien de Marchéville and having a share capital of 1,000 euros. The MP questions the capacity of a company with capital of 1,000 euros to sufficiently provision in its accounts for the risk and cost of dismantling. In addition, many of these companies do not submit their accounts to the registry offices, making it impossible to ensure their viability. He asks her opinion on this subject.

Indeed, despite the efforts made by the Government to protect this profession against rising energy prices, the profession is struggling to continue to practice. This situation is mainly due to the increase in the price of glass bottles (indirect consequence of the increase in energy). Thus, 67% of breweries are experiencing financial difficulties and 10% are considering closing their business in the coming months. However, this profession includes 6,500 jobs in the brewing sector but also in sectors dependent on it. This worrying context could be resolved by aid amounting to 5 cents per bottle for the current year. He would therefore like to know if the Government plans to financially assist independent brewers, who are a significant part of the local economy.

Mr. Luc Lamirault draws the attention of the Minister of Labor, Health and Solidarity to the conditions for maintaining the activity of private health establishments. This request follows requests from several private organizations located in the constituency of the MP. The financing of health establishments, both public and private, is guaranteed to be based on the same criteria. Although a general increase in budgets has was carried out between 2023 and 2024 and that certain aid was provided to private establishments through various envelopes, the findings made on site are quite different. Indeed, due to the health crisis and inflation, private establishments are facing an increase in their activity, which is not offset by sufficient resources. This threatens the population's access to care, thus reducing their chances to receive special care. In addition, Eure-et-Loir is a department particularly affected by medical desertification, making the lack of support for private establishments all the more worrying, which constitute an essential source of access to medical care. He would like to know the reasons for this marked gap between the financing of public and private establishments.

Mr. Luc Lamirault questions the Minister of the Economy, Finance and Industrial and Digital Sovereignty on the marketing, on French territory, of hydraulic jacks coming mainly from China and wrongly claiming CE marking. Indeed, alerted by the company Truck Tech SAS, located in his constituency, which markets manually operated hydraulic jacks under the RASSANT brand, Mr. MP wishes insist on the importance of respecting European safety standards. Indeed, to comply with the standards of the “machinery” directive no. 2006/42/EC, this equipment must be equipped with “dead man” safety. However, jacks from China do not have them. The General Directorate of Labor (DGT) affirmed to the company Truck Tech SAS that “the absence of a device aimed at stopping the movement of the machine when the operator lets go control such as the “dead man” function for manually operated hydraulic trolley jacks is a non-compliance with EESS 3.3.1 of the machinery directive 2006/42/EC”. These illegally CE marked hydraulic jacks should therefore be banned from sale. Following this opinion, the Directorate General for Competition, Consumer Affairs and Fraud Control (DGCCCRF) aligned itself with the DGT's decision and requested the joint laboratory service in order to study the taking into account of this interpretation for the next jack checks. He therefore wishes to know what the Government plans to put in place in order to better control products coming from China and in particular to ensure compliance with European safety standards before being put into circulation on European markets.

Indeed, Opale is the new accounting software package being deployed exponentially until 2025 in EPLEs. Presented as a modern tool, highly operable, improving accounting processing, the observation on the ground is quite different: technical failure of the software package with inoperative services, overwhelmed and insufficient technical assistance, cumbersome configuration and extended processing times, particularly regarding invoice payment deadlines. Faced with this situation, the staff appears very worried and disillusioned. He would like to know if similar difficulties have been reported to his services and if actions have been put in place to remedy these failures.

Mr. Luc Lamirault draws the attention of the Minister of Health and Prevention to the situation of permanent and contractual public law agents in the hospital public service of independent public social and medico-social establishments. If the latest Ségur de la santé protocol allowed a revaluation of 183 euros net for a set of professionals by an expansion of the complementary index treatment (CIT), a part of the agents working in independent establishments and attached to the hospital civil service status remains forgotten: administrative, technical and logistical staff. This situation leads to a negligible difference in treatment for the proper functioning of certain structures and the quality of care for users. In fact, autonomous establishments do not have the means to fight against the departure of their employees attracted to structures eligible for additional index treatment. In addition, it should be noted that the staff of autonomous establishments have also been subject to compliance with the vaccination obligation. By deciding to accept it, they have contributed and continue to contribute to enabling the continuation of care. He therefore asks what measures the Government intends to take to harmonize the remuneration of professionals by allocating the CTI to hospital civil service agents unfairly excluded from the system.

Mr. Luc Lamirault draws the attention of the Minister Delegate to the Minister of the Economy, Finance and Industrial and Digital Sovereignty, responsible for small and medium-sized businesses, trade, crafts and tourism, to the future of stained glass artists, master glassmakers and craftsmen since the announcement of a modification of the REACH regulation, one of the objectives of which is to include lead in the list of substances subject to authorization. If professionals in the sector unquestionably emphasize the harmfulness of this centuries-old product, in practice they are already subject to a very strong precautionary principle, exposure to lead being subject to strict regulations and reinforced medical monitoring which protect both workers and their families. The objective of ensuring a level of protection of the population and the environment in the face of to harmful substances is entirely legitimate but risk management must not be characterized by a weakening of the trust capital of craftsmen, who have largely integrated all the protocols into their workshops in order to prevent risks, the used lead being also sorted and collected. Furthermore, its use in the heritage sector does not require any risk of exposure for consumers, since once integrated into the building, it is no longer intended to be handled outside of maintenance and restoration operations carried out only by professionals. Despite research in the sector and in the absence of substitution of this material, he asks what measures the Government intends to put in place so that the precautionary principle is not subject to excessive application which would undermine French know-how and the professionals' control of the risk generated by the use of lead.
