Mr. Benoît Biteau draws the attention of the Minister of Transport to the consequences of the infringement procedure initiated by the European Commission against France concerning the organization of port services. The European Commission has in fact initiated infringement procedure INFR(2025)4021, considering that certain provisions of French law, in particular article 260 of the customs code, which provides for the reservation of national flag for certain port services such as towing and mooring, could constitute a restriction on the freedom to provide services guaranteed by Article 49 of the Treaty on the Functioning of the European Union. A letter of formal notice was sent to France on January 30, 2026, also addressed to Italy and Spain. However, port towing constitutes an essential link in maritime security and the operation of ports. Tugboats provide assistance to ships entering and leaving ports, maneuvering cargo ships in the port area and can intervene in emergency situations, such as fires, rescue operations or maritime pollution. They also constitute a complementary operational capacity for State action at sea. Maintaining ships under the national flag and crews of French sailors also presents important issues in terms of security and sovereignty. Indeed, these resources can be requisitioned by state authorities, in particular the maritime prefect, the regional prefect or the civil security authorities, during major events. Furthermore, French sailors are subject to strict control and qualification procedures, contributing to the safety of port infrastructures, which constitute strategic sites. In this context, several professional and trade union organizations in the maritime sector are proposing to integrate port tugs and their crews into the national strategic fleet provided for by Article L. 1335-4 of the Defense Code. However, the order intended to define the precise list of ships making up this strategic fleet has, to date, not yet been taken. Under these conditions, he asks what positions the Government intends to defend with the European Commission in order to preserve the imperatives of maritime security, national sovereignty and the maintenance of French maritime skills. He also wishes to know if the Government plans to integrate port tugs and their crews into the national strategic fleet provided for by the defense code. and within what time frame the order allowing the composition of this fleet to be specified could be published.

Mr. Benoît Biteau draws the attention of the Minister of Regional Planning and Decentralization to the future of the project manager positions of the “Villages of the Future” program, deployed as part of the France Ruralités plan. This program aims to support rural municipalities in the design and implementation of structuring projects through local engineering support. In several departments, notably in Charente-Maritime, the rise of the system has resulted in a significant increase in the number of labeled municipalities, demonstrating the interest of local elected officials and the relevance of the support offered. However, the operational success of projects relies largely on the action of project managers recruited to ensure the interface between the State, communities and financial partners and to support the municipalities, often poorly equipped in internal engineering, in the assembly and monitoring of complex files. However, funding for these positions is currently limited in time, with a deadline set for December 31, 2026. This prospect raises serious concerns among local elected officials, even as many projects enter their implementation phase. An interruption of support at this stage could weaken the steps taken and compromise the achievement of the objectives assigned to the “Villages of the Future” program. In this context, he asks what the Government's intentions are regarding the sustainability of the positions of "Villages of the Future" project managers beyond 2026 and whether sustainable financing or long-term organization methods for this territorial engineering are being studied in order to guarantee the continuity of support for rural communities.

Mr. Benoît Biteau draws the attention of the Minister of Labor and Solidarity to the effective application of safety measures relating to heavy vehicles equipped with tipping bodies with hydraulic drop sides. This issue had already been followed with commitment by her predecessor, Ms. Frédérique Tuffnell, MP for the constituency, who had worked on several occasions to put in place safety measures after accidents. tragic events of 2016 and 2017. On February 11, 2016, in Rochefort, an accident involving a school bus and a dump truck whose side was left open caused the death of six teenagers. A similar accident that occurred on November 20, 2017 in Saint-Germain-de-Marencennes cost the life of a father. These tragedies have highlighted a serious risk linked to the circulation of vehicles whose drop sides, in a horizontal position, protrude the authorized template. The publication in the Official Journal, on July 14, 2020 (NOR: MTRT2017437V), of a technical opinion from the Ministry of Labor recognizes this risk and provides for the equipment of new and existing vehicles according to specific deadlines. However, this opinion remains non-binding and is based on the sole responsibility of manufacturers and employers, without clear control mechanisms or sanctions in the event of non-compliance. In this context, he would like to know whether the Government currently has a precise inventory of the effective application of this opinion. It also wishes to know the control actions that have been carried out since its publication to verify the presence of the planned safety devices and whether more restrictive regulatory measures are being considered in order to sustainably prevent the recurrence of such tragedies and guarantee the safety of the workers and road users.

M. Benoît Biteau appelle l'attention de Mme la ministre de l'agriculture, de l'agro-alimentaire et de la souveraineté alimentaire sur le financement de la formation des cadres et futurs cadres des organisations syndicales et professionnelles agricoles. La formation de ces cadres constitue un enjeu majeur pour la démocratie agricole. Elle est financée par les crédits du programme 143 « Enseignement technique agricole », action 5 « Moyens communs à l'enseignement technique agricole public et privé », sous-action 8 « Formation et information des syndicats agricoles ». À un mois de la fin de l'année civile 2025, la FADEAR (Fédération des associations pour le développement de l'emploi agricole et rural) n'a toujours pas reçu de convention de la part du ministère, alors que le budget alloué à la formation versé à la FADEAR s'élevait à 241 991 euros les trois dernières années. Cette situation menace la continuité des formations et la pérennité des emplois salariés. Par ailleurs, la répartition des crédits de cette ligne budgétaire reste opaque, ce qui soulève des questions sur la transparence et l'équité dans l'attribution de ces financements publics. M. le député souhaite connaître le montant total et la répartition de cette ligne budgétaire pour l'année 2025, les organisations bénéficiaires des crédits ainsi que les bases de calcul des attributions. Il lui demande également quelles mesures le ministère entend mettre en œuvre pour garantir la transparence et la traçabilité de ces financements, assurant ainsi la continuité des formations et la stabilité des emplois associés.

M. Benoît Biteau appelle l'attention de Mme la ministre de l'agriculture, de l'agro-alimentaire et de la souveraineté alimentaire sur la question cruciale du financement de France services agriculture (FSA), tant pour la phase test prévue en 2026 que pour sa mise en œuvre complète en 2027. La loi d'orientation agricole fixe un objectif clair : doubler le nombre d'accompagnements à l'installation et à la transmission. Cet objectif intervient dans un contexte sans précédent où la moitié des agriculteurs et agricultrices partiront à la retraite d'ici dix ans, rendant indispensable une politique ambitieuse de renouvellement des générations. La transmission représente également un moment décisif pour engager la transition agroécologique : maintien ou passage en agriculture biologique, agriculture paysanne, systèmes herbagers, polyculture-élevage, diversification, autonomie et résilience des fermes. Or la réussite de cette double ambition - installation et transmission - suppose un accompagnement humain de qualité, assuré par une diversité d'acteurs compétents, ainsi qu'une coordination territoriale effective. Le nouveau dispositif, France services agriculture, s'articulera autour d'un point d'accueil départemental unique (PADU) piloté par les chambres d'agriculture et un réseau de structures d'accompagnement agréées au niveau 2. La participation de ces structures aux travaux de préfiguration (élaboration des outils, concertation, gouvernance) est essentielle pour respecter le pluralisme et assurer une gouvernance démocratique, conformément aux objectifs de la loi d'orientation agricole. Celle-ci nécessite un financement suffisant et adapté. Les acteurs de terrain estiment les besoins à 4 millions d'euros pour la seule expérimentation. Lors de son audition par la commission des affaires économiques du Sénat, sur le projet de loi de finances 2026, le mercredi 19 novembre 2025, Mme la ministre a indiqué que le financement de la phase de préfiguration serait couvert par les crédits de l'AITA (accompagnement à l'installation - transmission en agriculture), le financement de FSA étant renvoyé au PLF 2027. Elle a précisé que les directions régionales de l'alimentation, de l'agriculture et de la forêt (DRAAF) seraient dotées d'un budget ad hoc pour financer les projets d'expérimentation par voie de subvention. Dans ce contexte, M. le député souhaite interroger Mme la ministre sur les points suivants : Le Gouvernement prévoit-il d'abonder les crédits dédiés à la phase test FSA en 2026, afin de permettre la participation effective de l'ensemble des structures compétentes de niveau 2 et d'assurer un véritable pluralisme ? Si le Gouvernement n'envisage pas d'abonder l'AITA, mais de redéployer ses crédits, Mme la ministre peut-elle préciser quelles actions d'accompagnement à l'installation et à la transmission verront leurs financements diminuer ? Le PLF 2027 comportera-t-il une ligne budgétaire dédiée et suffisante pour financer durablement l'ensemble du dispositif FSA, en cohérence avec l'objectif fixé dans la loi de doubler les accompagnements installation'transmission ? Quels moyens humains et financiers sont prévus pour garantir que la transmission des fermes soit un levier de transition agroécologique et que l'accompagnement soit assuré par une diversité d'acteurs disposant d'un savoir-faire éprouvé ? Enfin, il lui demande quelles garanties le Gouvernement entend apporter pour éviter que, faute de financements publics suffisants, l'accompagnement ne soit capté par des acteurs privés lucratifs, en contradiction avec l'esprit de la loi et au détriment de la neutralité et du pluralisme.

Mr. Benoît Biteau questions the Minister of National Education about the elimination, on September 1, 2025, of the support fund for the development of extracurricular activities (FDSAP), created by Law No. 2013-595 of July 8, 2013. This fund supported municipalities organizing the school week over 4.5 days and made it possible to finance extracurricular artistic, cultural and sporting activities, often free for families. This decision particularly impacts rural municipalities, whose already constrained budgets do not allow them to absorb the disappearance of this funding without calling into question the quality and diversity of the activities offered to children. In many villages, the FDSAP represented an essential lever to guarantee access for all children to educational and cultural activities, helping to reduce territorial inequalities and social. The elimination of the fund comes at a time when the citizens' convention on the child's time, currently in progress, emphasizes that "the child's time is not defined for the child, his health, his development and his learning". This decision therefore seems to contradict the preliminary recommendations of this consultation, even though studies, notably from the National Academy of Medicine, recommend the organization of the school week in 4.5 days to optimize the well-being and learning of children. Mr. Benoît Biteau alerts the Minister of Ecological Transition, Biodiversity and International Negotiations on Climate and Nature to the critical state of the European eel in watercourses, an emblematic species of rivers whose current population represents less than 5% of its historical level, in decline under the effect of multiple pressures such as the fragmentation of watercourses, pollution, related mortality hydraulic infrastructure, predation and fishing at different stages of its life cycle. For more than fifteen years, the Charente-Maritime Federation for Fishing and the Protection of the Aquatic Environment has been working to monitor and restore eel populations and campaigning for a general moratorium on fishing, considering this measure as the only one capable of allowing the natural reconstitution of the species. The projects orders and decrees currently being considered limit this moratorium to recreational fishing, while allowing professional fishing for glass eels and yellow eels to continue. This approach creates inequality between fishermen and maintains pressure on the most vulnerable stages of the species, a strategy which appears inconsistent with conservation objectives. Furthermore, the State's decision is based on data outdated. The often cited figure of 700 tonnes of annual catches by recreational fishing dates from 2007, while recent estimates show catches of between 70 and 90 tonnes. Basing public policy on such old data weakens its relevance and effectiveness. He would like to know the measures that the Government intends to implement to develop a strategy for preserving the eel. based on up-to-date scientific data. He also wants to know if a global moratorium, including all forms of fishing, will be established in order to allow the sustainable recovery of populations. He questions him about the measures planned to ensure fair support for fishermen and to develop ambitious actions to restore habitats and eel populations. Mr. Benoît Biteau draws the attention of the Minister of Small and Medium Enterprises, Commerce, Crafts, Tourism and Purchasing Power to the difficulties encountered by elected representatives of the Chambers of Trades and Crafts (CMA) in the exercise of their missions of supporting craft businesses. Indeed, in the name of compliance with the General Data Protection Regulation (GDPR), they are currently refused access to the lists of nationals in their rooms. This situation prevents elected consular officials, legitimate representatives of artisans, from fully exercising their role of proximity and support, particularly to businesses in difficulty. In a context of continued reduction in public funding, CMA employees are forced to concentrate their efforts on structures with sufficient resources, to the detriment of the most fragile companies, yet those that require the most support. However, supervised, secure and proportionate access to nationals' data would allow consular officials to more effectively detect situations of fragility, strengthen their mission of general interest and actively support the economic vitality of territories. It would not be a question of deviating from the principles of the GDPR, but of establishing a clear legal framework recognizing the institutional role of elected consular officials and giving them the means to act in the collective interest of the craft industry. He therefore asks whether the Government plans to put in place legislative or regulatory provisions allowing elected representatives of chambers of trade and crafts - and more broadly of consular chambers - to access, in secure conditions and in accordance with the law European, with the information necessary for the exercise of their missions of support and representation of craft businesses.

Mr. Benoît Biteau draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the situation of victims of meningiomas caused by taking synthetic progestins such as Androcur (cyproterone acetate), Lutéran or Lutényl, prescribed in particular as part of hormonal treatments. From 2018, these medicines were the subject of supervision measures by the National Agency of medicines and health products (ANSM), after the identification of high risks of benign brain tumors (meningiomas). However, the first scientific alerts on these serious adverse effects date back to the early 2000s. Today, several hundred patients, supported by the AMAVEA association (Association meningiomas due to cyproterone acetate, assistance to victims and consideration of other molecules) and represented by a law firm, initiated legal proceedings against the pharmaceutical laboratories and against the State. The mobilized firm indicates that it is defending more than 750 cases, including 70 ongoing procedures, and has around forty definitive expert reports establishing a causal link between taking these treatments and the development of meningiomas causing serious after-effects. Facing the slowness and complexity of these legal procedures, the associations and lawyers representing the victims are requesting the creation of an amicable compensation system, based on the model of those established for Médiator (Benfluorex) and Dépakine (sodium valproate). Such a mechanism would allow more rapid recognition of the harm suffered, guarantee equal treatment between victims and avoid the trauma of long and costly procedures. He therefore asks the Government's intentions regarding the establishment of an amicable compensation system for victims of meningiomas linked to the taking of Androcur and other synthetic progestins and also wishes to know if the Government plans to integrate such a measure into the social security financing bill.

Mr. Benoît Biteau draws the attention of the Minister of the Economy, Finance and Industrial and Digital Sovereignty to the critical situation of the National Agency for Adult Vocational Training (AFPA), a public establishment created in 1949, which plays an essential role in the qualification of people furthest from employment, thanks to a dense territorial network and more than 900 training courses accessible throughout the life. While the AFPA trains nearly 93,000 people each year, including 50,000 job seekers, a confidential note from Bercy and recently revealed by the press indicates that the institution is directly threatened. The experts mandated by the Government are recommending radical decisions, including the elimination of the annual subsidy of 210 million euros, the reduction of the scope of its missions and the transfer of part of its real estate assets. The AFPA could therefore be sacrificed in the name of strictly accounting logic, even though a report from a consulting firm demonstrates that its training is more effective than other existing systems and that it produces economic benefits greater than their cost, thus confirming its social and economic profitability. Benoît Biteau alerte Mme la ministre de l'agriculture et de la souveraineté alimentaire sur la réduction budgétaire affectant le dispositif DiNA (dispositif national d'accompagnement des projets et des initiatives des Cuma). Ce dispositif, bien au-delà de son rôle initial de soutien au partage de matériel agricole, accompagne le développement de projets collectifs portés par les Cuma (coopératives d'utilisation de matériel agricole). Il contribue notamment à l'emploi en milieu rural, au renouvellement des générations agricoles, à la réduction de l'usage des pesticides, à l'atténuation du changement climatique, ainsi qu'à la souveraineté alimentaire et énergétique. Le DiNA a récemment fait l'objet d'une évaluation par le CGAAER, d'une concertation approfondie entre le réseau Cuma et la DGPE en 2022-2023, puis d'une refonte en 2024, en cohérence avec les orientations des politiques publiques. Il constitue un levier unique pour l'accompagnement stratégique des collectifs agricoles, mobilisé chaque année par plus de 600 Cuma, soit plus de 14 000 agricultrices et agriculteurs à l'échelle nationale. Dans ce contexte, la baisse de son financement suscite une vive inquiétude au sein du réseau Cuma, d'autant plus que le dispositif, récemment actualisé en concertation avec les services du ministère, s'avère particulièrement efficace pour un coût relativement modeste comparé à d'autres aides. Alors que l'accompagnement des agriculteurs est un enjeu crucial, il souhaite connaître ses intentions quant à l'avenir et à la pérennité du DiNA, seule ligne budgétaire spécifiquement dédiée aux Cuma.

Mr. Benoît Biteau draws the attention of the Minister for Europe and Foreign Affairs to the worrying situation linked to the mining activities of a French group in Senegal and its subsidiary in the Lompoul region. For several years, the extraction activities of zircon and other minerals by this mining company have raised serious concerns among local populations. In fact, several thousand peasants were forced to cede their land to make way for mining, without receiving fair compensation. In addition, the environmental impact of these operations is devastating: destruction of a unique ecosystem, depletion of water resources and alteration of agricultural land vital for vegetable production in Niayes, an essential region for Senegalese agriculture. Beyond ecological concerns, this project has led to forced relocations of populations, precarious living conditions for displaced people, as well as considerable economic losses for farmers and local tourism businesses. Despite the numerous denunciations and local mobilizations, the Senegalese authorities seem to support this activity despite the fact that the compensation received by the affected populations is judged insufficient. As a member of the France - Senegal friendship group, the MP would like to know the position of the French Government on the impact of the activities of the subsidiary of this group in Senegal. More concretely, he would like to know what commitments the Government has made to ensure that French companies operating internationally respect strict standards in terms of human rights and respect for the environment.

Mr. Benoît Biteau alerts the Minister of Agriculture and Food Sovereignty to the absurdity and danger of the “Terre de Chavaignac” cattle factory project. This project, led by T'Rhéa, a subsidiary of the Carnivor group, provides for the creation of a gigantic fattening center from an existing farm of around 700 cattle. “Terre de Chavaignac” faces significant opposition from the local population and environmental associations, expressed during two public surveys totaling more than 99% unfavorable contributions, as well as an opposition vote from the municipal councils of the municipalities concerned. Initially planned to accommodate 3,100 cattle, the scale of the project was reduced to 2,120 cattle following the unfavorable opinion of the investigating commissioner on June 12, 2024, the file being considered insufficient regarding the issues of water management and the risks of water pollution on the site. Despite this warning, the size of the site (buildings, food storage capacity, manure, water reserve) has not been modified and the risks to the environment persist. In addition, the plan presented by the project leader to evacuate the enormous quantity of manure produced by the site provides for the spreading of this manure on areas owned by several owners who have not been kept informed of this project and some of whom are opposed to it, therefore invalidating the expected spreading plan. A difficulty in evacuating the manure is all the more worrying as the site is close to several ponds, some of which are the subject of fish farming, which would therefore be exposed to a significant risk of pollution if the project were to be carried out. “Terre de Chavaignac” also includes several gray areas on essential elements, in particular on the precise quantification of its carbon footprint, as noted by the regional mission of environmental authority Nouvelle-Aquitaine. Thus, the establishment of this cattle factory whose meat will be sold abroad, instead of extensive and truly peasant livestock in Limousin, is the symbol of an industrial agricultural model that is harmful to the environment, but also to employment. and the income of peasants, as well as for animal welfare, thus preferring export logic to food sovereignty. He therefore wishes to know the measures it will take to avoid the installation of such cattle factories and further support extensive livestock farming, preserving meadows hosting a rich biodiversity and making it possible to tackle climate change head-on by sequestering very carbon efficiently.

Mr. Benoît Biteau attracts the attention of the Minister of State, Keeper of the Seals, Minister of Justice? on the proper application of the law concerning the publication of information of public interest on the subject of green algae in Brittany. In this perspective, the associations, Sauvegarde du Trégor Goëlo Penthièvre and Defense of victims of green tides, request that the Brest Public Prosecutor make public the autopsy reports on the suspicious death of several wild boars in autumn 2024 on the beaches of the Bay of Saint-Brieuc. And for good reason, the autopsies of these animals are entrusted to the Brest public prosecutor and covered by the secrecy of the investigation. Even though, as provided for in Article 11 of the Code of Criminal Procedure: "to put an end to a disturbance of public order or when any other imperative of public interest justifies it, the prosecutor of the Republic may, [...] make public objective elements taken from the procedure. History seems to be repeating itself, even though the Saint-Brieuc prosecutor has just notified emergency doctor Pierre Philippe of the “disappearance” of the autopsy of Jacques Thérin, who died among green algae in Saint-Michel-en-Grève in 1989. His stubborn requests, by mail, for more than 15 years have not made it possible to lift the secrecy on this document. However, it would have been of prime importance, at the time, for us to officially know the causes of this death, most likely linked to the putrefaction of green algae which produces this violent toxic gas, hydrogen sulphide. The authorities, in particular the health services, could then have taken all the necessary precautions and, among other things, equipped the collectors of the stranded algae with gas masks and detectors. And Thierry MorFOisse would perhaps not have died in 2009 while transporting decomposing algae without his employer having informed him of the danger linked to this activity. Given the seriousness of the situation, it is urgent to fully inform users of areas affected by green algae of the risks they run by using them. In addition, for the good information of the administrative judge and the smooth running of current procedures, this essential information on the cause of death of these animals in connection with the state of the places where they died, cannot be withheld from the knowledge of administrative judges. The MP therefore asks the Minister to ensure compliance with the law of criminal procedure, so that justice can make public the results of autopsies concerning suspicious deaths; but also to investigate the disappearance of the Auffray file and the lack of a satisfactory response to the requests of a doctor working to bring to light the truth. He wants to know her intentions on this matter.

Mr. Benoît Biteau alerts the Minister of Ecological Transition, Biodiversity, Forests, Sea and Fisheries to the suspicious death of several wild boars in autumn 2024 on the beaches of Saint-Brieuc Bay. According to the Côtes d'Armor prefecture, studies in the search for hydrogen sulphide were carried out as part of an autopsy on the corpse of the last four animals found in October 2024. However, the autopsies of these animals were entrusted to the Brest public prosecutor and are, to this day, covered by the secrecy of the investigation. However, as requested by the associations, Sauvegarde du Trégor Goëlo Penthièvre and Defense of victims of green tides, it appears essential to make public the results of the autopsies carried out on the animals, to take, if necessary, the necessary health measures. The ecological damage has by elsewhere been recognized by the Rennes court, in a judgment of July 18, 2023: the judges concluded that the destruction of habitats and the massive collapse of biodiversity, due to the presence of hydrogen sulfide resulting from the decomposition of massively stranded algae. Under such conditions, attested by a judicial decision, it is impossible to envisage that a passing mammal would not be fatally poisoned. And it is enough to go to the scene of the death of these wild boars as the associations regularly do, taking all safety measures, to understand the highly probable link between the in situ detection of the toxic gas that is hydrogen sulphide, resulting from the decomposition of stranded green algae, and its fatal inhalation by these passing animals.
