La France et l'Espagne sont liées par une convention fiscale en vue d'éviter les doubles impositions et de prévenir l'évasion et la fraude fiscales en matière d'impôts sur le revenu et sur la fortune, signée le 10 octobre 1995. Cet accord prévoit que les revenus perçus au titre d'un emploi salarié soient imposés exclusivement dans l'État de résidence, à moins que l'activité ne soit exercée dans l'autre État. Si l'emploi y est exercé, les rémunérations reçues à ce titre sont imposables dans cet autre État. Un régime d'imposition dérogatoire propre aux travailleurs frontaliers est prévu au protocole à cette convention afin de tenir compte de la spécificité de cette zone transfrontalière et de la dynamique de ce bassin d'emploi. Bien que les travailleurs exercent une activité dans l'autre État, ils sont imposés exclusivement dans leur État de résidence s'ils vivent dans une zone située à 20 kilomètres de part et d'autre de la frontière dans l'une des communes incluses dans la zone frontalière. La liste établissant les communes qui délimitent cette zone est prévue par un accord signé le 25 janvier 1961, modifié. La France et l'Espagne se sont également entendues, par la voie d'un échange de lettres du 19 février 1998, pour que le bénéfice de ce régime d'imposition spécifique soit subordonné à la production d'une attestation de travailleur frontalier. L'administration fiscale française reste vigilante à la bonne mise en œuvre de cet accord bilatéral. En cas de difficultés d'application de ce régime d'imposition, elle invite tout contribuable se trouvant dans une telle situation à contacter les services fiscaux concernés. Les travailleurs frontaliers peuvent saisir l'administration fiscale compétente par le biais de la procédure amiable prévue à article 26 de la convention fiscale franco-espagnole du 10 octobre 1995 en vue d'une résolution. A ce jour, la Direction générale des finances publiques du ministère de l'Économie, des Finances et de la Souveraineté industrielle et numérique ne relève pas de difficulté particulière d'ordre général relativement à l'application du régime frontalier, tant s'agissant de la délimitation de la zone frontalière que de l'attestation.

The resolution of the UN General Assembly of September 19, 2024 ordered States “to prohibit any export of weapons or related material to Israel and to prevent any economic or commercial relations with Israel that would be likely to strengthen its illicit presence in the Occupied Palestinian Territory.” From June 2 to 4, 2025, the President of the Republic will co-chair, with the Crown Prince of Saudi Arabia, the international conference, set up by the UN, “responsible for examining the application of UN resolutions relating to the question of Palestine and the two-State solution, with a view to establishing a comprehensive, just and lasting peace in the Middle East”. France's compliance with Articles 6 and 11 of the United Nations Arms Trade Treaty is essential, otherwise it will discredit its action within the conference. Il associe à sa question ses collègues députés des Pyrénées-Atlantiques, M. Iñaki Echaniz et Mme Colette Capdevielle. La loi de finances pour 2024 a souhaité impulser une réforme incitative des redevances des agences de l'eau. Une redevance sur la consommation d'eau potable a ainsi été créée et s'applique à tous les consommateurs au prorata de leur consommation quel que soit l'usage. Une exonération de cette redevance pour les élevages est prévue par la loi dès lors qu'un dispositif de comptage spécifique existe. Or il n'a pas été pensé de dispositif similaire pour les maraîchers et arboriculteurs. Pourtant, ces professionnels, en application des dispositions législatives nationales et européennes du « paquet hygiène », sont tenus de nettoyer les légumes à l'eau potable. Ces exploitations sont donc directement dépendantes des réseaux d'eau potable pour leur activité. Ces filières de production ont un intérêt majeur et stratégique pour notre territoire, en déficit de production de fruits et légumes. La dépendance aux importations est liée à une diminution structurelle de la production locale, plutôt qu'à une hausse de la consommation. Il est donc fondamental de soutenir ces productions, grandes laissées pour compte de la PAC et subissant des modèles économiques fragiles. En conséquence, M. le député demande à M. le ministre de prévoir une exonération similaire à celle des élevages. Il lui demande également quelles mesures pourraient être mises en place pour structurer et accompagner le développement de ces filières essentielles à l'autonomie et la souveraineté alimentaire des territoires.

M. Peio Dufau interroge M. le ministre de l'économie, des finances et de l'industrie sur les moyens de lutte contre la fraude à la résidence principale. Élu de la sixième circonscription des Pyrénées-Atlantiques, M. le député fait face à de nombreux témoignages de maires qui font état d'un phénomène massif de fraude à la résidence principale. Cette fraude est pratiquée par des propriétaires souhaitant échapper aux contributions obligatoires liées au statut de leur résidence, telles que la taxe sur les plus-values immobilières, la taxe d'habitation et la surtaxe sur la THRS permise dans les communes en zone tendue. Les remontées de terrain suggèrent que ce phénomène est insuffisamment contrôlé. Au-delà de l'alerte qu'il souhaite transmettre à M. le ministre, il aimerait mieux comprendre les moyens d'ores et déjà déployés pour faire face à cette fraude. Aussi il lui demande de lui transmettre les éléments suivants sur l'action de la DGFiP : le nombre d'opérations de contrôle fiscal en matière de taxe d'habitation sur les résidences secondaires et ses majorations, régies par les articles 1407, 1407 bis et 1407 ter du code général des impôts, ainsi qu'en matière de taxe sur la plus-value régie par l'article 150 U du code général des impôts (contrôles sur place et sur pièces) ; le nombre de cas de transmissions par l'autorité fiscale à l'autorité judiciaire aux fins de poursuites pénales en application du code de procédure pénale et du livre des procédures fiscales ; le nombre d'agents alloués pour la mise en œuvre du contrôle fiscal en la matière, au niveau national et départemental ; les moyens techniques déployés (outils informatiques, croisement des données de différents services, intelligence artificielle) ; le plan d'action spécifique de lutte contre la fraude à la résidence principale et stratégie de coopération avec les collectivités locales. À l'heure où les collectivités locales voient leurs dotations diminuer, le manque à gagner dû à la fraude peut être considérable. Pour référence, la majoration de la THRS rapporte 1,8 million d'euros par an à une commune comme Biarritz et la THRS représente une part significative des recettes de certaines communes (14,6 % des recettes à Menton, 15,8 % à Biarritz) selon l'OFGPL. De plus, les déclarations frauduleuses viennent gonfler artificiellement le nombre de résidences principales de certaines communes qui, voyant leur proportion de logements sociaux diminuer mécaniquement, sont exposées à des pénalités dans le cadre de la loi SRU. Ainsi, il est urgent d'identifier les potentielles failles dans la politique de contrôle pour proposer des solutions, dans un double objectif de justice fiscale et d'augmentation des recettes pour les collectivités.

M. Peio Dufau attire l'attention de M. le garde des sceaux, ministre de la justice, sur la situation de M. Guillaume Vama et de M. Joël Tjibaou. Ils sont détenus depuis le 19 juin 2024 pour leur participation supposée aux émeutes survenues en réaction au dégel du corps électoral en Kanaky - Nouvelle-Calédonie par le Parlement. Ils auraient dû être libérés et placés sous contrôle judiciaire le 17 octobre 2024 suite à la décision d'une juge d'instruction du tribunal judiciaire de Nouméa. Pourtant, le procureur de la République a immédiatement fait appel de cette décision. Alors que de sérieux doutes planent sur les conditions de transfert de ces prisonniers politiques kanaks vers l'Hexagone et les motivations de leur détention à plus de 17 000 km de la Nouvelle-Calédonie, cette décision incompréhensible laisse soupçonner que l'apaisement n'est pas encore à l'ordre du jour des discussions politiques qui s'ouvrent. Il lui demande de bien vouloir lui indiquer pourquoi des instructions n'ont pas été données au procureur de ne pas s'opposer aux décisions des juges d'instruction, dès lors que celles-ci peuvent contribuer à l'apaisement en Kanaky - Nouvelle-Calédonie. Il demande au Gouvernement de préciser s'il souhaite l'apaisement dans la situation en Nouvelle-Calédonie et plus largement de confirmer son intention de trouver une résolution au conflit, basée sur le dialogue et sur le respect du droit international.
