La faculté donnée aux chefs de service d'accorder des autorisations d'absence pour participer à des fêtes ou à des cérémonies religieuses qui ne sont pas inscrites au calendrier des fêtes chômées, fixé par la législation et l'usage, vise à concilier les nécessités du service avec l'exercice de la liberté religieuse des agents publics. Cette pratique administrative est conforme au principe de laïcité qui, s'il repose sur la stricte séparation des religions et de l'État, garantit aussi la liberté de conscience individuelle et le droit de chacun à pratiquer sa religion (article 1er de la loi du 9 décembre 1905 concernant la séparation des églises et de l'État). Aussi, la circulaire FP n° 901 du 23 septembre 1967 relative aux autorisations d'absence dont peuvent bénéficier les agents de l'État à l'occasion des fêtes religieuses propres à leur confession, complétée par celle du 10 février 2012, énonce cette compétence du chef de service et établit une liste indicative et non limitative des fêtes religieuses pouvant susciter des demandes de la part des agents. Cette liste ne prive nullement le chef de service de sa pleine capacité d'appréciation de la compatibilité entre la demande d'autorisation spéciale d'absence pour fête religieuse d'un agent et les exigences tirées des nécessités de service, sous le contrôle du juge. Elle ne le prive pas non plus de sa compétence pour accorder une autorisation spéciale d'absence pour une fête religieuse qui n'y serait pas mentionnée explicitement. Cette interprétation est conforme à la jurisprudence constante du juge administratif. Le Conseil d'État a jugé que l'institution de fêtes légales ne fait pas obstacle, par elle-même, à ce que des autorisations d'absence soient accordées à des agents publics pour participer à d'autres fêtes religieuses correspondant à leur confession, sous réserve des nécessités du fonctionnement normal du service. Il a également rappelé que la liste publiée par l'administration présente un caractère indicatif et ne peut être regardée comme limitant les confessions ou les fêtes susceptibles de donner lieu à autorisation.

Le 1er mai est en France un jour férié et obligatoirement chômé pour tous les salariés. Ce n'est que par exception qu'il est possible d'employer un salarié au cours de cette journée. En l'état actuel du droit, cette exception concerne les établissements et les services qui, en raison de la nature de leur activité, ne peuvent interrompre le travail. Ces règles sont d'ordre public mais elles ne portent que sur les salariés. Ainsi, les personnes qui ne sont pas salariées peuvent naturellement exercer leur activité le 1er mai. En revanche, lorsqu'il souhaite employer des salariés le jour du 1er mai, il appartient à l'employeur d'établir que, dans sa situation particulière, la nature de son activité ne lui permet pas d'interrompre le travail le jour du 1er mai, ainsi qu'il résulte de la jurisprudence constante de la Cour de cassation (Cass. crim., 8 février 2000, n° 99-82118). Par ailleurs, le juge rappelle également qu'il n'existe pas de dérogation de principe au chômage du 1er mai en faveur des établissements bénéficiant d'une dérogation de droit au repos dominical en application de article R. 3132-5 du code du travail (Cass. crim., 14 mars 2006, n° 05-83436). Ainsi, il convient d'analyser au cas par cas chaque situation de fait afin de déterminer si, en raison de la nature de l'activité (au regard de circonstances ou de besoins particuliers avérés, des impératifs de sécurité ou de l'intérêt général), l'interruption du fonctionnement de l'entreprise le 1er mai est ou non possible. Compte tenu de ce qui précède et dans la mesure où article 7.6 de la convention collective nationale des fleuristes, de la vente et des services des animaux familiers n'impose pas le chômage le 1er mai, il apparaît que les activités de nourrissage, de surveillance et de soins aux animaux ainsi que la « mission de salubrité publique » exercées par les professionnels du secteur des animaux familiers sont des éléments susceptibles de pouvoir être invoqués à bon droit par les employeurs de structures assurant la prise en charge d'animaux vivants pour justifier de l'impossibilité d'interrompre le travail le 1er mai et donc d'employer des salariés ce jour-là. Cependant, dans la mesure où article L. 3133-6 du code du travail ne prévoit pas que certaines activités entrent « de plein droit » dans son champ d'application, il appartiendra toujours au juge d'apprécier souverainement chaque situation en cas de litige.

Ms. Anne-Sophie Ronceret draws the attention of the Minister of Action and Public Accounts to the tax consequences of the abolition of the status of individual entrepreneur with limited liability (EIRL) for former holders of this status who have opted for corporate tax. Before the reform which entered into force in 2022, entrepreneurs operating under EIRL status and subject to corporate tax benefited from a tax framework identified for the sale of their activity, allowing them to reinvest the proceeds of this sale in a new structure, in particular of the SAS or SARL type, under tax conditions considered to be more understandable by those concerned. Since the abolition of the EIRL status and the switch to the new status of individual entrepreneur, while retaining for some the option of corporate tax, uncertainties remain as to to the tax regime applicable to the transfer of their activity. In particular, it appears that questions remain regarding the treatment of the capital gain on sale for former EIRLs having retained their option for corporate tax. This uncertainty gives rise to fears, in certain situations, that a capital gain constituted within the framework of an activity already subject to corporate tax could, upon sale, be also subject to income tax under the single flat-rate levy, thus creating a risk of economic double taxation. Such a situation would be likely to penalize entrepreneurs who have structured their activity on the basis of existing law at the time of their tax choice and to slow down their transfer or reinvestment projects in new activities. While several parliamentarians have already alerted the Government on this difficulty, she asks what is the Government's position on the tax regime applicable to transfers of activity of former EIRLs having opted for corporate tax and whether clarifications are envisaged, by doctrinal or legislative means, in order to secure the situation of the entrepreneurs concerned.

Ms. Anne-Sophie Ronceret draws the attention of the Minister of Health, Families, Autonomy and People with Disabilities to the difficulties encountered, in certain territories, in securing coverage by health insurance for hearing aid medical devices when they are prescribed following a teleconsultation with an ENT doctor. Indeed, professionals in the sector report situations observed particularly in Charente where, due to particularly long delays in accessing an ENT appointment, patients with hearing problems have resorted to an ENT teleconsultation in order to avoid a disruption in their journey. In these cases, the teleconsultation would have been covered by health insurance. On the other hand, the coverage of medical devices prescribed on this occasion would sometimes be subject to a posteriori questioning by the National Health Insurance Fund (CNAM), with request for restitution of the sums paid, on the grounds that the prescription would have been established within the framework of a teleconsultation. These situations seem to reveal a need for clarification and harmonization, in order to guarantee a clear and secure application of the rules of care, both for patients and for professionals, in a context where telemedicine contributes to facilitate access to care in areas under tension. Also, the MP would like to know if the Government intends to specify the framework applicable to prescriptions for hearing aid medical devices delivered following an ENT teleconsultation, in order to secure their care, to harmonize the practices of the funds throughout the territory and to define, where applicable, the traceability requirements which must appear on the order.

Ms. Anne-Sophie Ronceret draws the attention of the Minister of Health, Families, Autonomy and Disabled People to the uncertainties surrounding the reimbursement of osteopathic procedures by complementary organizations, within the framework of so-called “responsible” contracts. Les déchets de pneumatiques, bien que classés comme non dangereux, constituent une menace pour l'environnement et la santé publique en cas d'incendies (émissions de gaz toxiques) ou de dépôts sauvages. La lutte contre la gestion illégale des déchets de pneumatiques est un sujet d'attention pour la gendarmerie nationale. Dans sa zone de compétence, elle constate une hausse des infractions depuis 2022: +22 % en 2023, +45 % en 2024 (529 faits). En 2025, 560 faits ont été recensés, soit une évolution de +5,9 %. L'analyse fait ressortir que 63,4 % des faits sont liés à un abandon sauvage (les pneumatiques sont généralement abandonnés avec d'autres déchets), 11,7 % concernent un brûlage à l'air libre de déchets pneumatiques et 18,3 % concernent des installations classées pour la protection de l'environnement (ICPE), notamment les garages automobiles. Les infractions liées au transport illégal de déchets pneumatiques représentent 6,6 %. En matière de lutte, la gendarmerie développe son action à trois niveaux: un commandement national par le CESAN (commandement pour l'environnement et la santé), une unité judiciaire spécialisée, disposant de dix détachements dans les zones et l'outre-mer au travers de l'OCLAESP et enfin, un maillage territorial de the whole of ses unités de recherches et territoriales. Ainsi, ce sont près de 4 200 gendarmes qui sont formés au traitement des infractions environnementales, présents dans les unités de la gendarmerie départementale et notamment dans chaque brigade territoriale. La lutte contre les déchets, dont les pneumatiques usagés, s'exerce au travers de l'action quotidienne des unités territoriales de la gendarmerie mais également lors des « opérations territoires propres » (OTP), qui sont conduites depuis 2020 par les commandements zonaux de la gendarmerie avec l'appui des partenaires institutionnels. La gendarmerie nationale agit ainsi concrètement par l'organisation déconcentrée d'opérations inter-services ciblant localement des situations potentielles d'atteintes à l'environnement et à la santé publique. Lors de ces opérations, les dépôts sauvages de pneumatiques sont également ciblés. En outre, les déchets pneumatiques sont également recherchés dans le cadre de l'opération AUGIAS qui vise à lutter contre le trafic transfrontalier de déchets au sein de l'Union européenne, et notamment à la frontière franco-espagnole. Des opérations de contrôle sont régulièrement effectuées dans ce cadre. Par ailleurs, pour accroître la connaissance de cette délinquance et la qualité de la réponse procédurale, chaque enquêteur de la gendarmerie dispose, via l'application pour smartphone « Enviro'Gend » ou via Intranet, d'une documentation spécifique sur le dépôt de déchets pneumatiques, notamment sur sa matérialisation et les infractions à relever. En parallèle, le CESAN diffuse régulièrement des infographies destinées aux unités territoriales de la gendarmerie qui traitent de la gestion irrégulière de déchets et des infractions susceptibles d'être relevées. Enfin, depuis 2022, 59,9 % des infractions constatées en lien avec cette thématique ont donné lieu à l'identification de mis en cause, traduisant une action résolue de l'État sur ce sujet. Parmi celles-ci, on note principalement que 23,4 % des auteurs d'infractions ont été convoqués en justice ou déférés et que 17,2 % des auteurs ont fait l'objet d'un classement sans suite, en grande majorité, en raison de la remise en état des sites pollués. 58,5 % des affaires avec mis en cause identifié sont encore en cours d'investigations ou en attente de décision pénale.

Ms. Anne-Sophie Ronceret draws the attention of the Minister of Small and Medium Enterprises, Commerce, Crafts, Tourism and Purchasing Power to the proposed modification of the guidelines of the General Directorate for Competition, Consumption and Fraud Repression (DGCCRF) relating to the logistics penalties provided for in Article L. 441-17 of the Commercial Code. Since the adoption of the laws “Egalim 2” and “ Descrozaille” and the publication in 2023 of the DGCCRF guidelines, abusive logistics penalties have clearly declined and the situation has generally stabilized for manufacturers and distributors. Professional organizations in the sector emphasize that these guidelines have contributed to better regulating practices by reminding that penalties are not intended to constitute an automatic resource. but compensation for real damage that the distributor must be able to demonstrate. The draft revision of the guidelines currently subject to consultation is, however, perceived by many economic players as a significant reversal of doctrine. It would tend to assimilate penalties to a quasi-automatic right of the distributor, including on the basis of expired agreements, which raises questions with regard to the principles of law bonds. It would also weaken the scope of the one-year limitation period provided for by law by modifying the assessment of the starting point and would call into question the requirement to demonstrate harm on a case-by-case basis, which is at the heart of the legislator's will. In a context of already very tense commercial negotiations marked by the multiplication of purchasing centers and strong pressure on the margins of retail companies, agri-food, these developments raise serious concerns about the risk of a resurgence of bad practices in terms of logistical penalties and destabilization of commercial relations. Mrs. Anne-Sophie Ronceret draws the attention of the Minister of Health, Families, Autonomy and Persons with Disabilities to the situation of patients suffering from serious adverse effects following the use of synthetic progestins, in particular cyproterone acetate (Androcur), Lutényl or Lutéran. Indeed, prescribed for several decades for various indications, these drugs have been the subject of alerts from the Agency National Safety of Medicines and Health Products (ANSM) from 2018 due to an increased risk of meningiomas, non-cancerous brain tumors that can cause serious after-effects. However, many patients indicate that information relating to this risk was partially known well before this date. To date, several hundred files have been compiled and dozens of procedures legal or amicable proceedings are underway, some of which have already led to the recognition of a causal link between the consumption of these medications and the occurrence of meningiomas. Consequently, in order to avoid long and trying litigation processes and to guarantee fair compensation, the study of an amicable compensation system is mentioned by various stakeholders. Such a mechanism would allow, where appropriate, expertise on parts, harmonization of practices and shorter instruction times. In addition, compliance will involve several steps: identifying whether they fall under EPR, identifying the packaging concerned, putting in place the necessary internal tools, training their teams and anticipate the financial impacts, even though the budgets for 2026 have already been decided and the period of commercial negotiations will begin. Furthermore, the process of approving eco-organizations and individual systems will itself take several months after the publication of the texts. Many companies, beyond just wholesale, fear finding themselves in a situation of involuntary non-compliance as soon as on January 1, 2026. In this context, she asks what measures the Government intends to put in place to ensure a gradual and secure entry into force of the EPR sector for professional packaging and whether the hypothesis of a moratorium, mentioned by several professional organizations, could be studied to guarantee the success of this system.

Mme Anne-Sophie Ronceret attire l'attention de M. le ministre d'État, ministre de l'intérieur, sur les difficultés rencontrées par les anciens propriétaires de véhicules lorsque les nouveaux acquéreurs tardent à effectuer le changement de carte grise. Cette situation peut entraîner des conséquences financières et administratives lourdes, puisqu'ils continuent de recevoir des amendes de post-stationnement et peuvent subir des saisies injustifiées sur leurs comptes bancaires. Mme la députée souligne notamment le cas d'une habitante de Montfort-l'Amaury, dans sa circonscription, qui reçoit des amendes pour un véhicule vendu en octobre 2022, l'acquéreur n'ayant effectué le changement de carte grise que deux ans plus tard. Malgré un dépôt de plainte et un recours déposé auprès du tribunal du stationnement payant de Limoges en février 2025, cette personne n'a reçu aucun accusé de réception ni réponse à ce jour. Elle souhaite donc connaître les mesures que le Gouvernement envisage pour sécuriser le processus de changement de carte grise, prévenir ces situations pénalisantes pour les citoyens et garantir un traitement efficace et rapide des recours engagés par les anciens propriétaires injustement mis en cause.
