Insulin Price Reduction Act This bill prohibits health insurance plan issuers and pharmacy benefits managers (PBMs) from receiving rebates or discounts for insulin from manufacturers who certify that its current insulin list price has been reduced to an amount no greater than what the list price was for the same insulin on July 1, 2006. This restriction does not apply to discounts provided to insurance plan holders at retail sale or to flat-rate fees for service paid to PBMs. Further, insurance plans are prohibited from applying a deductible to insulin that has received such price certification. A manufacturer may certify insulin prices by submitting to the Department of Health and Human Services data about the list price of any insulin the manufacturer has produced since January 1, 2000, and by setting the current list price for an insulin product at the 2006 rate. To remain certified, a manufacturer may not increase the list price of insulin by more than the annual increase in the medical care consumer price index. A manufacturer may certify the price of an insulin product for which it did not have a list price in 2006 by reducing the list price of such insulin to the weighted average list price in 2006 of specified insulin categories. This bill also applies to Medicare prescription drug benefits. The bill sets the rebate for insulin under Medicaid based on the average manufacturer price of insulin during the last fiscal quarter of 2019, increasing by the medical care consumer price index thereafter.

Global Child Thrive Act of 2019 This bill reauthorizes for FY2020-FY2025 programs to provide assistance to orphans and other vulnerable children in developing countries. The bill also requires the U.S. Agency for International Development to direct relevant executive branch agencies to incorporate early childhood development into current programs and promote inclusive early childhood development in partner countries. Such actions to promote early childhood development shall build on existing U.S. plans and strategies and aim to (1) prevent unnecessary family-child separation, (2) assist families with children with disabilities, and (3) help countries transition from child care protection systems that rely on residential care (such as orphanages and children's homes) to ones focused on family-based care.

Healthy Start Reauthorization Act of 2019 This bill modifies and reauthorizes through FY2024 the Healthy Start program, which provides grants that support interventions to improve women’s health before, during, and after pregnancy. Further, the bill requires the Health Resources and Services Administration to consider communities with high rates of infant mortality when awarding grants and requires the Government Accountability Office to evaluate the program’s health outcomes.

Seeding Rural Resilience Act This bill directs the Department of Agriculture (USDA) to implement a public service announcement campaign to address the mental health of farmers and ranchers, including television, radio, print, outdoor, and digital public service announcements. Additionally, USDA must establish a voluntary program to train employees of the Farm Service Agency, the Risk Management Agency, and the Natural Resources Conservation Service in the management of stress experienced by farmers and ranchers, including the detection of stress and suicide prevention; and convene a task force of agricultural and rural stakeholders at the federal, state, and local levels to assess the causes of mental stress in farmers and ranchers and identify best practices for responding to such stress.

Whistleblower Programs Improvement Act This bill expands whistleblower protections with regard to commodities and securities law violations. Specifically, the bill extends protections from retaliation to individuals who (1) assist in a Commodity Futures Trading Commission (CFTC) investigation of these violations, (2) make disclosures that are required or protected under any law subject to the CFTC's jurisdiction, or (3) provide information to supervisors or other employees with the authority to investigate potential misconduct. Currently, these protections apply only to individuals who report information directly to the CFTC. The bill also provides for the processing of these whistleblower awards no later than one year after the deadline to file a claim.

SOS: Sustaining Outpatient Services Act This bill allows for payment under the Medicare prospective payment system for hospital outpatient department services of certain items and services that are furnished at off-campus outpatient departments. Specifically, the bill allows for payment of items and services for which payments to physician specialists (under the Medicare physician fee schedule) did not exceed $2 million during the previous year.

Covering our FAS Allies Act This bill permits Medicaid coverage for citizens of the Freely Associated States (the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau) lawfully residing in the United States under the Compacts of Free Association.

Cold War Service Medal Act This bill authorizes the Department of Defense (DOD) to issue a service medal to members of the Armed Forces who served during the Cold War. The medal may be awarded to service members who (1) served on active duty for at least 24 consecutive months during the Cold War, from September 2, 1945, to December 26, 1991; (2) were deployed outside the continental United States for at least 30 days during the Cold War; (3) were members of a reserve component of the Armed Forces and were called or ordered to active duty to participate in exercises or operations directly related to the Cold War ; or (4) performed such other service in the Armed Forces during the Cold War as DOD may prescribe.

National Commission on Online Platforms and Homeland Security Act This bill establishes the National Commission on Online Platforms and Homeland Security to address content on online and social media platforms that implicates national security concerns. Specifically, the commission shall identify, examine, and report on the ways online platforms have been used in furtherance or support of targeted violence or covert foreign state influence campaigns and how addressing such uses impacts users' free speech, privacy, civil rights, and civil liberties. Consistent with these purposes, the commission must analyze (1) online platforms' responses to such usage; (2) the impacts of algorithms and automated decision-making systems on the rights and privacy of users; and (3) the extent to which online platforms have transparent, consistent, and equitable policies and procedures to address violations of platform rules. The commission must then develop recommendations for how online platforms could address improper use through methods that are transparent and accountable while continuing to promote free speech and innovation on the internet and preserving individual privacy and civil rights. Additionally, the Department of Homeland Security must (1) research whether any connection exists between the use of online platforms and targeted violence; and (2) develop voluntary approaches that could be adopted by online platforms to address any correlations found while still preserving the individual privacy, civil rights, and civil liberties of users.

Investing in Tomorrow's Workforce Act of 2019 This bill (1) directs the Government Accountability Office to study the barriers to providing, and opportunities for improving, training for workers in industries that have, or are likely to have, high rates of job loss due to automation; (2) directs the Department of Labor to award grants to eligible partnerships to support demonstration and pilot projects relating to the training needs of workers who are, or are likely to become, dislocated workers as a result of automation; (3) expands training programs for such workers, including activities that prepare the individuals for occupations in the technology sector; (4) authorizes the award of national dislocated worker grants to provide employment and training assistance to workers affected by advances in automation technology; and (5) expands funding for national dislocated worker grants.

Timely ReAuthorization of Necessary Stem-cell Programs Lends Access to Needed Therapies Act of 2019 or the TRANSPLANT Act of 2019 This bill modifies and reauthorizes through FY2025 the C.W. Bill Young Cell Transplantation Program, which provides support to patients who need a potentially life-saving bone marrow transplant or umbilical cord blood transplant. The bill also requires the Department of Health and Human Services to conduct a periodic review of the science of using adult stem cells and birthing tissues in therapeutic treatments.

Safe at Home Act This bill requires each executive agency and federal court to accept, for any purpose for which an individual is required to provide an address to the agency or court, an address designated to that individual pursuant to an address confidentiality program (e.g., a program to protect stalking or domestic violence victims).

National World War II Memorial Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue up to 50,000 $5 coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the National World War II Memorial in the District of Columbia. The design of the coins shall be emblematic of the memorial and the service and sacrifice of American soldiers and civilians during World War II. All surcharges received from the sale of such coins shall be paid to the Friends of the National World War II Memorial to support the National Park Service in maintaining and repairing the memorial, and for educational and commemorative programs.

Stopping Harmful Interference in Elections for a Lasting Democracy Act or the SHIELD Act This bill establishes a duty to report election interference from foreign entities, applies existing campaign advertising requirements to online advertisements, and generally limits political spending and election interference by foreign entities. Specifically, a political committee must report certain foreign contacts involving an offer of unlawful election assistance to the Federal Bureau of Investigation and the Federal Election Commission. The bill establishes criminal penalties for violations of these requirements. Existing requirements for political advertisements and electioneering communications apply to internet and digital advertisements, including requirements related to disclosures and contributions. Additionally, large online platforms must maintain a public database of certain political advertisements. The bill places limitations on political spending by foreign entities. Specifically, foreign entities may not (1) contribute to campaigns related to ballot initiatives and referenda, or (2) make disbursements for certain internet activity referring to a candidate or a political issue. A candidate is prohibited from offering to share nonpublic campaign information with certain foreign entities. The bill also prohibits (1) the dissemination of false statements regarding federal elections or public endorsement, or (2) the intentional hindering of voting or registering to vote. The bill establishes criminal penalties and a private right of action with respect to these prohibitions.

Improving Provider Directories Act This bill requires private health insurance plans, including self-funded employer health plans, to display in online provider directories a method for notifying the plan about inaccurate provider information. Upon such notification, plans must correct and update the provider information in each directory within 30 days and submit an annual report to the state insurance commissioners in each state where the plan is available that contains the all corrective actions taken during the previous year. Plans that do not comply with this requirement are subject to a tax penalty.

Public Servants Protection and Fairness Act This bill establishes an alternative formula to calculate Old-Age, Survivors, and Disability Insurance benefits for those who receive pensions for certain non-covered employment. (The existing formula is known as the windfall elimination provision.) The alternative formula adjusts an individual's total lifetime earnings based on the proportion of covered earnings (i.e., earnings subject to Social Security payroll taxes). It applies to individuals who (1) first become eligible for benefits after 2021, (2) have earnings from non-covered service performed after 1977 and (3) have less than 30 years of coverage (i.e., years in which a beneficiary is considered to have contributed a substantial amount into the Social Security trust funds). Beneficiaries receive the higher benefit amount as calculated under the alternative method or the existing formula. In addition, the bill provides rebates for certain beneficiaries currently impacted by the existing formula. The Social Security Administration must include non-covered earnings in Social Security account statements, and the Government Accountability Office must study the availability of certain information related to retirement plans maintained by state and local governments.

This joint resolution nullifies a rule issued by the Department of Education (ED) on September 23, 2019. The rule revised the process for a student loan borrower to obtain a discharge from a student loan if an institution of higher education misrepresented a material fact. Among other requirements, the 2019 rule requires each borrower to apply to ED for a defense to repayment. However, under the previous 2016 rule, an application could be submitted on behalf of an entire group (e.g., veterans).

Pediatricians Accelerate Childhood Therapies Act of 2019 or the PACT Act of 2019 This bill provides statutory authority for the Trans-National Institutes of Health (NIH) Pediatric Research Consortium to coordinate pediatric research across national health research institutions. The consortium, chaired by the director of the Eunice Kennedy Shriver National Institute of Child Health and Human Development, must develop priorities for the NIH to award research grants to early career pediatric researchers, including physician-scientists and researchers from underrepresented populations.

Protecting America's Food and Agriculture Act of 2019 This bill authorizes U.S. Customs and Border Protection (CBP), every fiscal year, to hire, train, and assign 240 new agricultural specialists until the total number of specialists equals and sustains the requirements identified each year in the Agriculture Resource Allocation Model. The CBP may also hire, train, and assign support staff to assist the specialists and specified levels of agricultural canine teams. In calculating the number of specialists needed at each port of entry through the Agriculture Resource Allocation Model, the Office of Field Operations of the CBP must (1) rely on data collected regarding the inspections and other activities conducted at each such port of entry; and (2) consider volume from seasonal surges, other projected changes in commercial and passenger volumes, the most current commercial forecasts, and other relevant information.

National POW/MIA Memorial and Museum Act of 2019 This bill designates the memorial and museum that is being constructed on an approximately 26-acre area on the POW-MIA Memorial Parkway in Jacksonville, Florida, as the "National POW/MIA Memorial and Museum." The director of the memorial and museum shall submit a report to Congress that includes a budget for the memorial and museum.

Eric Garner Excessive Use of Force Prevention Act of 2019 This bill modifies the criminal civil rights statute that prohibits the deprivation of rights under color of law. Currently, the second prong of the prohibition bars the application of different punishments, pains, or penalties based on an individual's alien status, color, or race. This bill specifies that the application of any pressure to a person's throat or windpipe which may prevent or hinder breathing or reduce intake of air (e.g., a chokehold) constitutes a punishment, pain, or penalty.

Lower Drug Costs Now Act of 2019 This bill establishes several programs and requirements relating to the prices of prescription drugs. In particular, the bill requires the Department of Health and Human Services (HHS) to negotiate prices for certain drugs (current law prohibits HHS from doing so). Specifically, HHS must negotiate maximum prices for (1) insulin products; and (2) at least 25 single source, brand-name drugs that do not have generic competition and that are among the 125 drugs that account for the greatest national spending or the 125 drugs that account for the greatest spending under the Medicare prescription drug benefit and Medicare Advantage (MA). The negotiated prices must be offered under Medicare and MA, and may also be offered under private health insurance unless the insurer opts out. The negotiated maximum price may not exceed (1) 120% of the average price in Australia, Canada, France, Germany, Japan, and the United Kingdom; or (2) if such information is not available, 85% of the U.S. average manufacturer price. Drug manufacturers that fail to comply with the bill's negotiation requirements are subject to civil and tax penalties. The bill also makes a series of additional changes to Medicare prescription drug coverage and pricing. Among other things, the bill (1) requires drug manufacturers to issue rebates to the Centers for Medicare & Medicaid Services for covered drugs that cost $100 or more and for which the average manufacturer price increases faster than inflation; and (2) reduces the annual out-of-pocket spending threshold, and eliminates beneficiary cost-sharing above this threshold, under the Medicare prescription drug benefit.

Advancing Access to Precision Medicine Act This bill allows state Medicaid programs to cover DNA sequencing clinical services for certain individuals. Specifically, states may cover such services for individuals under the age of 21 (or a lower age, if the state chooses) and for former foster youth under the age of 26 who (1) have been referred or admitted to a pediatric intensive care unit and seen by a medical specialist for a chronic or undiagnosed disease, and (2) are suspected by a medical specialist to have a pediatric-onset genetic disease. The Centers for Medicare & Medicaid Services may award grants to assist states in developing plans to cover such services. Additionally, the National Academy of Medicine must study the effects of genetic and genomic testing and ways to expand health insurance coverage of such services, including under Medicare and Medicaid.

Preparedness and Risk Management for Extreme Weather Patterns Assuring Resilience and Effectiveness Act of 2019 or the PREPARE Act of 2019 This bill directs the President to establish the Interagency Council on Extreme Weather Resilience, Preparedness, and Risk Identification and Management, which shall establish government-wide goals and provide recommendations for addressing extreme weather resilience, preparedness, and risk identification and management. Each federal agency shall submit biannually to the Office of Management and Budget and to the council a comprehensive plan that integrates consideration of extreme weather into its operations and overall mission objectives.

Protect America’s Wildlife and Fish In Need of Conservation Act of 2019 or the PAW and FIN Conservation Act of 2019 This bill nullifies the 2019 rules relating to the listing of endangered or threatened species and the designation of critical habitats. Among other things, the restored rules automatically give threatened species the same protections as endangered species; revise requirements governing when an agency must consult with the U.S. Fish and Wildlife Service or the National Marine Fisheries Service about endangered species, threatened species, or their habitats; prohibit economic assessments from being considered in listing decisions; and revise the criteria used for designating critical habitats for the species.

Financial Aid Communication and Transparency Act of 2019 or the FACT Act of 2019 This bill requires the Department of Education (ED) to publish certain requirements for financial aid offers. ED must conduct consumer testing to serve as the basis for determining such requirements for financial aid offers, and a financial aid offer must contain information such as cost of attendance and sources of available financial aid. An offer must also contain a standardized quick reference box to enable comparison of information on college costs and financial aid.

Sex Trafficking Demand Reduction Act This bill expands requirements for fighting human trafficking that apply to foreign countries receiving U.S. foreign assistance. (The President is authorized to reduce assistance to, or take other actions against, countries that fail to meet such requirements and are not making significant efforts to do so.) The Department of State, when evaluating whether a country has met such requirements, shall assess whether the country has made serious efforts to prohibit the purchase of commercial sex acts if the central government has authority to do so, whereas currently the State Department must assess whether a country has made serious efforts to reduce such activities. The State Department shall also assess whether a country has made serious efforts to educate buyers of commercial sex acts on how traffickers exploit prostituted persons.

Puppies Assisting Wounded Servicemembers for Veterans Therapy Act or the PAWS for Veterans Therapy Act This bill requires the Department of Veterans Affairs to implement a pilot program to assess the effectiveness of addressing post-deployment mental health and post-traumatic stress disorder through a method where veterans train service dogs for veterans with disabilities.

Barriers to Suicide Act of 2019 This bill requires the Department of Transportation (DOT) to establish a program to facilitate the installation of evidence-based suicide deterrents on bridges, including suicide prevention nets and barriers. DOT may award competitive grants to states and local governments to carry out the program. The Government Accountability Office must conduct a study to identify the types of structures, other than bridges, that attract a high number of individuals attempting suicide-by-jumping and the types of nets or barriers that are effective at reducing such suicides.

Surface Mining Control and Reclamation Act Amendments of 2019 This bill reauthorizes the Abandoned Mine Reclamation Fund fees and expands the payments from the fund for abandoned coal mine cleanups. Specifically, the bill authorizes the Department of the Interior to reimburse states and tribal governments from the fund for the emergency restoration, reclamation, abatement, control, or prevention of adverse effects of coal mining practices; extends the authority for Interior to collect reclamation fees through FY2036; and increases the minimum amount of funds from $3 million to $5 million that Interior must award to states and Indian tribes who have an approved abandoned mine reclamation program.

Rural Maternal and Obstetric Modernization of Services Act or the Rural MOMS Act This bill expands initiatives to address maternal health in rural areas. The bill provides funding for the Health Resources and Services Administration (HRSA) to establish rural obstetric networks for improving outcomes in birth and maternal morbidity. Specifically, these networks must (1) connect individuals with care providers, (2) identify successful maternal-care models, (3) facilitate collaboration among rural providers, (4) provide training and guidance, (5) collaborate with academic institutions that have regional expertise, and (6) measure and address inequities in birth outcomes among rural residents. HRSA also must award five-year demonstration program grants to (1) train physicians, medical residents, and other practitioners to provide maternal and obstetric services in rural communities; and (2) support academic programs that develop or provide training to improve maternal care in rural areas. Further, the bill adds maternal-health services as part of the telehealth network and telehealth resource-centers grant programs. The bill also makes a series of changes to the research and reporting requirements of the Department of Health and Human Services and the Government Accountability Office with respect to data on maternal-health outcomes.

Clean Industrial Technology Act of 2019 or the CIT Act of 2019 This bill provides incentives for the nonpower industrial sector to reduce nonwater greenhouse gas emissions to the atmosphere. Specifically, the bill requires the Department of Energy (DOE) to establish an industrial emissions reduction technology research, development, demonstration, and commercial application program. Under the program, DOE must award grants and fund demonstration projects to develop and evaluate technologies designed to increase (1) the industrial competitiveness of the United States, and (2) the emission reductions of nonpower industrial sectors. DOE may also enter into contracts and cooperative agreements for these purposes. In addition, DOE must establish an Industrial Technology Innovation Advisory Committee to provide advice to DOE and the Office of Science and Technology Policy about the program. Finally, DOE must establish a technical assistance program to promote the commercial application of emission reduction technologies in nonpower industrial sectors.

Broadband Deployment Accuracy and Technological Availability Act or the Broadband DATA Act This bill requires the Federal Communications Commission (FCC) to change the way broadband data is collected, verified, and reported. Specifically, the FCC must collect and disseminate granular broadband service availability data (broadband maps) from wired, fixed-wireless, satellite, and mobile broadband providers. To do this, the FCC is required to establish the Broadband Serviceable Location Fabric (a dataset of geocoded information for all broadband service locations, atop which broadband maps are overlaid) as the vehicle for reporting broadband service availability data. Additionally, the FCC must put forth specified requirements for service availability data collected from broadband providers, and it must create a challenge process to enable the submission of independent data challenging the accuracy of FCC broadband maps.

Rare disease Advancement, surveillance Research, and Education Act of 2019 or the RARE Act of 2019 The bill reauthorizes through FY2024 the National Institutes of Health Rare Disease Regional Centers of Excellence and expands activities to facilitate research and increase awareness of rare diseases and conditions. (Rare diseases and conditions are those with a prevalence of fewer than 200,000 individuals in the United States.) The Centers for Disease Control and Prevention (CDC) may expand infrastructure and activities to track the epidemiology of up to four rare diseases and conditions and incorporate this information into a National Rare Disease or Condition Surveillance System. The Agency for Healthcare Research and Quality must expand its activities to increase health care providers' awareness of rare diseases and conditions. The National Academies of Sciences, Engineering, and Medicine, or another appropriate entity, must update the 2010 report Rare Diseases and Orphan Products: Accelerating Research and Development.

Teacher Health and Wellness Act This bill directs the National Institutes of Health to carry out a five-year study on reducing teacher stress and increasing teacher retention and well-being by implementing and analyzing the results of any of several types of programs, including (1) teacher stress management programs, (2) mentoring and induction programs during the school year and teacher pre-service, and (3) organizational interventions such as principal training programs.

Excellence in Maternal Health Act of 2019 This bill requires the Department of Health and Human Services (HHS) to establish specified grant programs to support positive maternal health care outcomes for pregnant and postpartum women and their infants. Specifically, grants must be used to (1) develop best practices to reduce preventable maternal mortality; (2) train health care professionals about reducing and preventing discrimination when providing maternal health services; (3) support the collaboration of professionals across health settings with respect to maternal health; and may be used to (4) establish evidence-informed, integrated health care services to pregnant and postpartum women and their infants. HHS also must contract with an independent research organization to study and make recommendations about best practices for reducing and preventing discrimination in the provision of maternal health services. HHS also must meet certain reporting requirements for specified maternal and child health care grant programs.

Strengthening Financial Aid for Students Act (Strengthening FAFSA) This bill increases the income protection allowance levels used to calculate a working student's expected family contribution and need for financial assistance. An income protection allowance is an amount for basic living expenses that is protected from being considered income available for postsecondary educational expenses. The bill also raises from 12 to 14 the total number of semesters during which a student may receive a federal Pell Grant.

Animal Welfare Enforcement Improvement Act This bill revises the licensing process of the Department of Agriculture (USDA) for animal dealers and exhibitors to expand USDA's oversight and enforcement of animal welfare requirements. The bill also authorizes citizen suits to enforce the Animal Welfare Act. Dealers and exhibitors must apply to USDA for licenses or renewal licenses each year. Before issuing or renewing licenses, USDA must conduct unannounced facility inspections. USDA must deny an application for a new license if the applicant fails to meet animal welfare standards during a second inspection, a renewal license if the applicant violates such standards in more than one inspection in the previous two years, or a new or renewal license if the dealer or exhibitor has violated laws relating to animals or if the issuance of the license would facilitate the circumvention of state or local laws that prohibit the private ownership of certain animals. Further, USDA must suspend the licenses of dealers or exhibitors whose violations present a risk to animal welfare. USDA must revoke the licenses if the violations persist or if the licensees commit multiple violations. Dealers and exhibitors with suspended or revoked licenses may not be (1) granted another license, (2) granted another license through another person or entity, or (3) employed by another licensee to work with animals during the period of the suspension or revocation.

National Suicide Hotline Designation Act of 2019 This bill requires the Federal Communications Commission to designate 9–8–8 as the universal telephone number for a national suicide prevention and mental-health crisis hotline.

Student Loan Disclosure Transparency Act of 2019 This bill requires a lender disbursing a loan that is insured or guaranteed by the federal government to make certain disclosures. Specifically, prior to disbursement, the lender making such loan must disclose the (1) principal amount, interest rate, and number of required monthly payments to be made on the loan; (2) estimated balance owed by the borrower; and (3) estimated aggregate amount the borrower will pay. Prior to repayment, the lender must disclose the projected total of interest charges that the borrower will pay on the loan, as well as projections of the borrower's monthly repayment amount. Lastly, the lender must disclose certain specified information monthly, including the (1) original principal amount of each of the borrower's loans, separately and in the aggregate; (2) current balance on each loan and on all loans in the aggregate; (3) interest rate on each loan and the total amount the borrower has paid in interest; and (4) a description of each fee the borrower has been charged for the preceding installment period. The Department of Education must obtain feedback from individuals and report on the usefulness and effectiveness of such disclosures.
